Americus Patrioticus , Even if they are found guilty it’s still no reason for someone’s property to be removed from them. Unless of course if the property was stolen property or bought with ill gotten gains.
@@MissMarinaCapri , Some punishments for crime call for the forfeiture of things used to perpetrate the crime. If a criminal uses a house or a car to sell illegal contraband or to commit murder, there is no reason why the criminal cannot be forced to forfeit the property as punishment for the crime. The same goes for weapons and tools used to commit crime. What is not tolerable is for law enforcement to be allowed to seize property on suspicion and then keep the property if the suspect is found to be not guilty or is never charged with any crime. Having a lot of cash in a suitcase is not evidence of crime all by itself. The police do not have the right to seize cash without further proof of criminal behavior. On an all too often basis, ordinary, law abiding citizens have lost cash and property to seizure when no crime has been committed. The innocent law abiding citizen is then forced to prove that they are innocent in a guilty until proven innocent civil forfeiture scheme. The legal costs are often more than the property or cash is worth, so the citizen is either forced to spend more than they recover or give up the property to the police, who then use it for themselves. This is why it is called policing for profit. One particularly egregious example of civil forfeiture is the seizure of property which has either been stolen or is used by a criminal without the owner's knowledge or permission. The US Constitution never allows for any form of seizure to be conducted unless a proper warrant based upon probable cause is issued, or a police officer witnesses the property being used to commit a crime, or the property is contraband. Seizure may only be used to gather evidence, to take contraband, or to punish. If the property is legally owned and is not contraband, the police have no right to keep the property if the defendant is found to be not guilty. Also, there is no exception in the USA to the presumption of innocence. If property is seized as evidence or because the police feel the property has been used to commit a crime, the police must be willing and able to prove their case beyond a reasonable doubt. Civil forfeiture is a complete violation of our constitution. One cannot dance around our rights by renaming "seizure" as "civil forfeiture" and then forcing the citizen whose property was seized to prove that the property has not been used to commit crime. Since the police make the accusation of guilt, the police must prove the guilt beyond a reasonable doubt. Also, only a person can be guilty. An inanimate object can never be guilty.

So I'm curious on how many they actually allow you to win or remedy instead of corruptly going against victims or stalling it out until their death so forth and so on. Another words is it worth pursuing if this happens to you or is it a lost cause in most cases?
That unfortunately wont help as money orders are still considered to not only be assets but cash equivalents. So the law really makes no distinction between regular cash and other cash like tokens with a face value such as money orders, cheques, travellers cheques, casino chips, etc. If it can easily be converted to cash at face value somewhere it is generally regarded as being one in the same. Not that it would matter if they counted it as cash or not they merely need to invent a claim that the assets are connected with some imaginary crime whether any such crime has or is likely to occur is irrelevant because any property (chattel or real) of value meets the broad definition of asset.
The problem with theee civil asset forfeitures is it presumes and impungnes wrong motives on people just because they are carrying cash. Certainly, probably the majority of people carrying large sums of money are probably involved in illegal activity, but what about the others who are not? Off the top of the head I'm sure people can think of many reasons why they might have cash crossing state lines. Auctions for Ebay or storage unit auctions, paying a traffic ticket on many jurisdictions only accept cash or money order but getting one may not be readily available plus you dont know if you may get a lesser fee when you go to fight the ticket in court so cash is the best option, a person might be a bartender, stripper or wait tables and have large sums if money, some houses and cars being sold also require cash down payments. Also, some small business only deal in cash like hair dressers or pop up shops. This idea is ridiculous that somehow people carrying cash have to automatically be doing something nefarious and their money should be seized even if they have no charge filed against them.
