Dirk brings up signing a waiver as an analogy, not realizing that the waiver is evidence of hospitals and insurance being bastards and not of a doctor's capabilities. When a doctor makes a mistake then the evidence of that mistake can be taken to a court of law and tried as malpractice regardless of the waiver. When you waive rights you don't waive the legal system. Malpractice is still malpractice. Negligence is still negligence. Just the same, he mentioned mechanics working on your car. You expect a mechanic to know their stuff, but you also know you can sue for damages or ask for them to cover a repair when they screw up. I worked at a tire and lube shop and one time we had a customer come in and inform us that their mechanic had accused us of damaging their vacuum line, claiming we removed it. We told her that wasn't part of any service we provided. She asked if she could get that in writing, so I grabbed my boss and he was absolutely cool with giving her a written statement that we never opened the vacuum line, and to top it off he put that we had footage to back up our side of things. She didn't take our word on faith, she had us sign a document in case she could not trust us. She did not take her mechanic's word on faith, she came to us to either confirm or contradict his statement to her. My boss was confident enough to not rely on policy and procedure in our store, he was willing to back up his claim with video evidence. This is what it looks like when you leverage trust with evidence. You get a better understanding of the truth. There's a UA-cam video series on a law firm's channel showcasing a bunch of depositions regarding a medical malpractice case where a man's foot was amputated due to a myriad of bad decisions, poor work culture, and improper communication. If the man who signed the waiver said, "Well, I waived my rights when I signed, I guess there's no way to make up for my losses", THAT would be putting faith into a document and ignoring the facts of the legal and social systems he resided in. That's what Kirk sees when he makes these poor analogies, because he is viewing everything from faith instead of from evidence. I would hope Kirk wouldn't take the L if his foot was amputated. Dirk is just wrong about eye witnesses in courts. They are largely considered the worst pieces of evidence and even now a days there are judges who straight up do not allow it in court. Several states have laws where a judge can strike eye witness testimony for any reason.
Only a few years ago I was called for jury duty on a murder trial. During jury selection I spoke out against eye witness testimony being reliable. I was immediately dismissed.
