Those groups don’t own the River. If everyone had just minded their own business, been polite in interactions, none of this would have happened. Growing up with a Japanese mother, i would have gotten a beat down if I had acted like that. Respect and politeness for others in public is a core principle in Japan. Just as no one litters to respect where you live and the shared spaces. I try to always give the respect I wish to get in return. Life lesson.

The most important part of the video is the whole thing lasted less than 4 minutes, the stabbing 14 seconds. Anyone who thinks anyone has any time to rationalize anything is not understanding how the mind works under that level of stress. All that can be felt in that video before the stabbings started was violence.

Speaking from someone who has been stabbed and cut with a knife in a confrontation while I was young, I can say that if his intent was to use that knife he would have just used it and not waited until he was being attacked. I truly believe he felt for it to know he had it just in case he needed it , and NOT to just stab someone because that was his intent. At the point of him feeling for it you know he was getting scared and wanting to make certain he had it, of that I have no doubt. If he pulled it out of anger, he would have been using it way before he was attacked not after. This man was in fear for his life I truly believe this, also to note : Disassociation is a common thing that happens to those who have just gone through traumatic things in which they cannot process mentally and thus why he may have not known really what took place until later.
I agree. In the video he's just standing there holding it. And the kids, in the midst of trying to shove this man into the water repeatedly, they lunged themselves into the knife. It's awful that they found him guilty.
"Then why wear the sandals?" Easy answer. If you are in a river with rocks in it, you are going to be walking in said river with rocks in it, you are protecting your feet from sharp or pointy rocks. You aren't wearing them for stability. That's like asking why people who surf wear surfing shoes in the ocean or why people wear flip flops on the beach. They don't help you with your balance, they protect your feet from debris and the heat of the sand.
Yeah, I go tubing a couple times a year and river rock is no joke, I had to buy a pair of crocs. Between the river rock and the current, you need SOMETHING on your feet.

Never before trial, did he mention he was choked until he saw the video. He had no choke hold bruising on his neck. He was checked out by the jail nurse. He didn't mention it to her, nor did she witness any marks, bruising, etc. on his body. His attorney told him, looks like that kid is choking you. It was debunked in court. You don't think that kid knew what he was doing? Like he was really going to choke this guy. The kid wasn't big enough.
Where I live a man not much younger than this defendant in age, was murdered by 4 youths aged 15 onwards, who beat him to death. This trial they were older and more of them with a mix of adults. His lies don’t sit well with me but I can see how someone would be in fear for their life given what our town suffered as a result of the senseless death of a Father of 4 by youths.

In regards to "children" vs "big person", I do believe that most people are really just implying that he was obviously older, hopefully wiser, more life experience, ect. I for one, would have liked to see him be the bigger person and make ANY attempt to deescalate before gutting human beings. I know in the court systems we follow everything down to the very specific language of the law but as a society sometimes we could do better. Just because perhaps legally you can doesn't necessarily mean you should. I do believe there is something to the term "blatant disregard of human life". Both sides handled what should have been a day of fun in the sun like real A-holes and now they will have to live with the consequences.
This wasn't a white water rafting excursion. In northern Wisconsin, it's common for groups to float down the rivers in inner tunes while drinking beer in a fashion similar to a lazy river ride at a water park. It's not a high-stress activity but more of a leisurely outdoor pastime. Someone who is older or not in the best health would have no issues doing this.
Ya it was a lazy river experience by the twin cities there is a small area of "rapids" but even that is really more equivalent to using a tube in a hot tub with the jets going.

The boy then hides the weapon and runs from the police. I bring that up to say, yes, it was a movie plot, but it also shows that one could find themselves in that situation in real life as well, kinda like in this case but that’s just my speculation.

The “adults” who came to “help” absolutely did NOT help, and I’m not surprised that 4 of the 5 victims were from the “adult” group. Here in the UK people aged 60+ don't go out at night because they are frightened. The local shops have taken out restraining orders against the local teenagers because they were hanging round scaring the customers away. I have a serious heart condition, if some one attached me I would not last 2 minutes as my heart would give away yet I can swim but not run. I can't climb stairs bu I can carry shopping bags. I would in all honesty resort to deadly force in the same situation as the defendant was in.
My mother is 70 and she absolutely goes out at night. REGULARLY. I don't know what part of the UK you live in but it can't be anywhere near where I am!
Kent Coast here. 71+ grandmother. Fit enough to horse ride every day but with knee replacements no running. My grandson is 19 years old is 6’6” but mega skinny. He’s polite, kind & caring. If I ever thought he would behave as these young adults did I would be very disappointed. So many, “if only” but drink & drugs impair judgement regardless of age. I love young people & I wish this had never happened, parents must be devastated. Mr Mui looks very haggard from imprisonment. Blessings to everyone
I started to change my mind as I listened to the entitled kids testifying. Not quite as their parents see them, and they were breaking the law by drinking. The whole time I watched the prosecutors defend their case, I thought of Miu as evil. His testimony completely turned me around. He’s not evil at all. It’s a terrible tragedy, but the kids were behaving in an outrageous way. Good kids don’t harass people, not even when they’re high. They brought him to his breaking point. They’re just as responsible as he is for the death of their friends.
I couldn’t decide until I saw Miu’s testimony. It was far more credible than the other witnesses. He is not the crazed creep they tried to portray him as. I would definitely acquit.
I didn't even know you could speed up or slow down these videos! So learned something new. But I have to say at 0.5 I got the giggles which helps after watching a lot of this sad, sad case.
To play devil's advocate (responding to some of the questions), I live in Wisconsin and have tubed multiple rivers. Most of the time, you're literally just laying on your tube and slowly floating down the river. You don't have to be young, strong or in great shape to do it. You can see where this happened, the water is shallow and not moving that fast. We've lost things in faster/deeper rivers and been lucky enough to find them again. I don't think it's unreasonable that he's looking for the phone, it wouldn't be impossible to find.
They stopped all drinking on the American river in California because of all the drunk drama. It's nice you can bring the kids out without all the bs. Cops are also watching for the booze to.

I have trouble with the consciousness of guilt concept. It's like polygraphs. An innocent person could be so terrified of being found guilty of something they didn't do, that it would induce them to lie. And I'd be more surprised to find out he hadn't stumbled, in a situation like that. Stumbling while walking in a river is commonplace, regardless of what your shoes are like. And they can't have it both ways, why would he run away before feeling terror, why is he required to. Please give our bullying children their space? And once there was terror, he was surrounded by jeering kids (being kids to me would make them seem more dangerous actually, we hear about so many mobbings, and they are prone to mob activity once they get into these bullying, mocking situations).

My husband, my son, my grandson and my son-in-law all carry knives in their pockets. It’s one of their favorite gifts to get each other every Christmas too.

At no point in my job did I ever require a knife capable of inflicting that amount of damage. I don’t think it’s fair to treat it just like your average man’s pocket knife.

I received a leatherman knife for my 30th birthday. I’m a big camper so it was something I was thrilled about. It’s definitely normal to carry a knife!

I feel for this guy for sure. I think his personality played a HUGE role in this. My husband and I are the same age as him, we also tube down a river nearby, and have for 20 years. We go with friends, take a lunch and have a couple of beers for sure. However....my husband, of the SAME age, would never ever have done what Nic Mui did ever. Maybe go look for the phone for a few minutes, but as soon as there was a small issue with some teens he would have come back to our group, if for no other reason other than to not delay or ruin the beautiful day. I do think he was defending himself and in fear of his life, I just don't think this would have happened if he had just walked back to his group as soon as these kids started making a scene.

I agree. I’ve watched that video many times. At first, I think he thought one of the kids might have had the phone he’d been looking for. I think he went up to them with the intention of looking at it more closely. However… once he got there, once they all started taunting he seemed to have backed away a bit. He didn’t seem to respond immediately-not until Madison and the others came to help. Then it all escalated. They were pushing, throwing punches, knocking him down and shoving him from behind. The knife was out and at his side. If he punched Madison, I think she’d have hit the ground (size difference etc), regardless it drew the others and he brought that hand up and shoved(not stabbed) first. The one who died did not back away, he came at him anyway. I’m still going with self defense… he had been trying to walk away at first(he moved away from them a bit & was still looking in the water)the right to defend himself became necessary when they put their hands on him.

Prosecutor made a great opening statement and i was leaning toward guilty. After watching the video, my view started to change. After listening to ALL of the witnesses on stand lie to help their situation (it was different when talking to police). The video shows it all to me. The teens were drunk and out of control (liquid courage does that to some people). I also feel they were going to use on one of their personal internet platforms (SnapChat, TikTok or the like).Miu was definitely shoved, punched, knocked down with his head under the water while being surrounded by a gang-like group. You can tell by his face he was in fear and trying to figure how to get out of the situation. I do think he was in shock along with the others that were present. I think the prosecution should have included a manslaughter charge. Intentional Homicide doesn't fit the situation, IMO. No one in the case wins. Even if Miu is acquitted, he still has to relive the memory of being attacked and then killing a teen in self-defense. It is so sad.
I have actually found myself in a river more than one time with unstable sandals. I have forgotten swim shoes, and just worn what I had on because there are rocks, etc. Those aren’t easy to navigate in. The shoes get pulled one way, while your foot is going the other direction. It’s why water shoes are made differently than just regular sandals. I constantly was falling, but it was better than being barefoot. The rocks were slippery as well. I have been in that situation at least 4 times. Adhd Baby!!!
Watching this so far, I would personally feel threatening with all those YOUNG ADULTS shouting, crowding me and gesturing in my face. Age shouldn't matter, most of those young adults were physically stronger and taller than him. I don't agree with him fatally stabbing someone, but if i'd been pushed down, a group of young men kicking on me AND putting hands around my THROAT I would also feel the need to defend myself. My family calls what his bowels did as "nervous poops". It happens during times of stress. It's an actual medical condition triggered by stress. He already had medical history that would react to his initial response to fear or stress. So all of this triggered a physiological as well as a flight or fight situation for him.

The other day I was at an event with hundreds of dogs. While having lunch at the picnic tables my little dogs leash came loose and he slipped away (looking for food under the tables.) For about 40 seconds I was in a panic. I could not tell you anything that happened around me at that time. So, I get the confusion. I have not seen enough to know what I would do as a juror.
One point is that he doesn't need to convince the jury, he only needs to convince one member of the jury that he is not guilty. If he convinces enough there won't be a retrial.

During the nurse testimony it was revealed he was on several medications. One mentioned can be used to treat PTSD as stated in court. along with a statin. When interviewed at the station he pauses a long time when asked what meds he takes. He says "one more" he can't remember after that long pause. He did not mention the PTSD med. He said himself he had been drinking beer all day during that questioning. Those drug interactions with alcohol should have been looked at more. Two are noted to cause aggression and irratability. now mix those together and with alcohol... Wondering why this was looked into more.

@@hughjorgen108 I believe he said aspirin, potassium, maybe heart medication..lots of uh i don't remember, a very long pause and then I'll tell you later. I think it was the defense that brought up the PTSD med for like one second and tge nurse said she had no understanding of that medication. I was almost strangled out of the blue by someone who mixed SSRI with beer so I hear ya. I've seen people in that situation, raging way too many times. It amazes me how people mix things not understanding that many things CANNOT be mixed with alcohol or other substances without some effect. But docs aren't pharmacists they say sure go ahead, a couple beers a day is fine.

The Walsh Institute has been working to share this scientific into with the media, but the media doesn't share it. The term they use when people snap under these drugs is over methylation.
IMHO justice would be Nic Miu guilty of a MUCH lesser charge and punishment of time served. Similar charges and varying incarceration time for others who share culpability, most notably Jawahn Cockfield, Madison Coen, Dante Carlson, AJ Martin, and Ryhley Mattison.

You questioned about why did the defendant wear sandals if his footing would be slippery. I have never worn sandals in a creek or river but I make it a point to wear old shoes even though my footing would be slippery. I would rather have slippery footing than to step on a possible fish hook or broken glass.

I didn’t watch cross but I did watch direct. I’ve been switching between apple river and YSL, the attorneys and the judge from Georgia should take a trip to watch trials in a well run court. When it takes 2 hours to examine the defendant in a huge stabbing case but takes literally days to examine a witness that has no bearing whatsoever on any of the counts charged there is a reason the state is taking 6-9 months to get through their case in chief.

Why would Mr Mui have to listen to Madison? Who was she to demand that he leave? None of her business. This was a public place that every had paid entry. No one except park employees could ask some one to leave. Madison made a bad situation worse. She escalated a situation caused by the teenage boys.

The "blonde" lady should have stayed in her own space and talked to him reasonably instead of like a complete drunk. The boys started the confrontation and the "blonde" escalated it. Liquid courage was a powerful motivator with both of those groups.

If i got punched hard in the face that left visible injuries, and that act of violence was the catalyst that led to 5 people getting stabbed and one killed, i would have had many pictures taken of the injury, and i would have kept them even if the cops didn't want them. Yet there is not one single photo of the woman's injury supposedly perpetrated by the defendant. That should tell you right there that any narrative involving her getting punched hard in the face by the defendant is BS.
I agree! She's what bothers me the most. I feel she jumped this whole thing off. He pushed her, she screamed that he punched her in the face, the boys jumped on him. I think the memories of the sound of getting punched by the boys were self created because she kept saying it happened. If something is said enough times you convince yourself it happened. When the police first get there, the first thing she says is "he punched me in the face". Not "a bunch of people were stabbed". Not " my friend was stabbed. I think he's dying in the river". The fact that she's the only one to not have audio or video of her testimony shows she knows she caused this. The fact that neither her or her mother had any pictures of any injury to her speaks volumes as well.

And she absolutely set the whole thing off. I also understand him stabbing everybody that came near him, too many people had laid hands on him for him not to believe that they were ever going to stop.
Hello Peter! First time commenting. Between what he said to the police at 20:45 and him walking towards the group and grabbing the tubes is what has me at guilty so far if I'm a jurror at this point of the trial. Been streaming on Law and Crime but love your perspective.
It doesn't really matter which way he was walking at first if he was looking for a lost phone. I am given to believe that when he moved toward the group of tubes it was because one of the teens had held up a phone that resembled the missing one. I don't understand why the teens began to call him a raper and a predator or why they thought it was amusing to do it.
31:26 no River rafting is not a physically involved thing basically you sit on that tube and you float until you hit the end. Also the water is very shallow there so you don’t so you can get off and get wet to cool down but you don’t have to worry about actually physically getting yourself back up when you can’t touch the bottom so that would be not a physical activity. It should’ve been a relaxing afternoon.
Depends how the river is, I've been on it multiple times and the first time I went the rapids at the end tossed my buddy out of his tube and he lost his glasses. Then my other friend went out to help him and they had to fight the current to get back and we got nicked up by the rocks a bit since we weren't wearing good footwear. Second time I went the current was much calmer. To be fair I didn't know the rapids were going to be like that when I went the first time.
Weren't they floating down river and he was standing there? Looking for something in this area and they floated into him across him. Why didn't they just continue on floating down the river? Why would he have to move on down when he was the one that was there looking for something they were just floating by. Why didn't they continue to float on by why? Stay there and continue in the altercation. He's there looking for something. They came into his space right? Or did I not understand that correctly?
I showed the original video to my 17yo son. I made sure that he watched the entire thing. The first thing out of my son's mouth was "why were they doing that to him?", "why were they calling him that, was he doing that -looking at little girls-?". He wasn't surprised that he had a weapon and he had the mind to use it. He stated that the "kids" were stupid to keep going after Mr. Miu and that they shouldn't have pushed him down and into the water numerous times. He's an obvious older man and his weight was not a benefit for him. That isn't the only thing that was what caused him to attack them. I show these things to my kid so he doesn't have to be in that situation in his life if I show him right from wrong (and teach it to him!!). With a mom who loves true crime (and is a crime scene investigator) and a dad that is a police sergeant (with 15+yrs as an investigator), we try to do our best to teach him how to be a good citizen and to know when to walk away from his friends when they are acting like a$$e$. I look forward to the jury return. I see it as Mr. Miu used force to keep himself alive and that he was justified as self defense. It's a shame that the interaction had to turn out with a death and serious injury. I feel bad for the parents, but I don't think the kids acted inappropriately.
Totally not guilty!!! Madison is the catalyst in this case and I believe she knows it, that’s why she refused to testify live on camera. I hope Mr. Miu gets acquitted and presses charges against all those kids.
I think maddie and the guy video taping are both the catalyst. The one video taping started calling him a pedophile... a complete stranger. I can't even imagine doing that to someone I don't know, don't have proof of those allegations and to someone who was totally unprovoked. He just simply walked by them to look for a phone.
This seems like a bizarre defense NON-theory of his lies (basically, "as far as I'm concerned I didn't tell those lies because I don't remember"), and his attorneys allowing this strategy seems inexplicable. Why would they let him do this? Maybe he insisted he didn't remember the police conversations and the attorneys couldn't budge him?

I’ve commented on this before, when a traumatic event happens our brain tries to process and can miss some things that happened. Fear makes people due some weird things and the brain has a way of completing the circle to make sense of things. Ask a family member or a sibling about an event that happened in your life, some people can even think someone else memory as your own.

As a person who has experienced adrenaline spikes and then subsequent dumps, you feel completely numb, drained, and disoriented. It is hard to focus. All you want is quiet and to go rest. Voices or sound at all are like piercing stabs to your head. You can't process much of what is going on. The recovery time varies depending on how severe the spike and dump was. Somtimes it can take a few hours. Other times it takes a day or two. Even when you recover and feel a bit more normal, you are still sluggish and not quite 100%.
So as a lawyer, can you tell me. Didnt the female lieutenant who interviewed him lie to him when she told him he wouldnt be able to speak to a lawyer untill monday? In the uk, our lawyers are on call 24/7. We can speak to them at any time. If we get interviewed at 3am, we will have a lawyer there at 3am. How does it work over there? Only because i just wish he had got advice before giving an interview .
If it was the weekend and needed a public defender then she was telling the truth because the courts in the US are not in business on weekends. Also Public Defenders can only be assigned by the court, and this usually happens during the first hearing in front of a judge.

Police are allowed to lie to suspects. I suppose he was going to spend the weekend in jail no matter what he decided, so he should have waited to have a lawyer present.

In wisconsin you do not have a duty to retreat , BUT the Judge can instruct the jury to take in to consideration that he made no effort to leave the situation .
I don’t think he brought the knife thinking he would kill somebody but he definitely got mad and lost his temper and got in too deep and a 17 year old kid is dead and AJ Martin had an injury that caused him to flat line twice. I don’t think he should get to walk away now when he did not walk away then.

Everyone I know from factory workers to independent contractors has a knife with them at all times, and I also live in Wisconsin. It's just an everyday tool. It's not suspect for someone to have a knife on them.

How can you say the teens lied, and then watch Miu testimony and not say he wasn’t full of lies? To me his testimony was worse than anyone else! Freeze, flight or fight. My husband and I were held up with a gun and surrounded by 4 men. I ran and left my husband in the dust. He was so angry I left but it was seriously out of my control. My Instinct was to run and I had no control over reason or logic. My husband was fine. He just walked passed the men. I think my reaction shocked the men and in my mind I saved our lives. Lol.

I know one and only time I've ever done the freeze, my newborn premie baby finally got to come home from the hospital at 6 weeks. Her and I were home alone she was in the room across the hall. I woke up and thought I heard somebody in the house we just moved into the city so I could go back and forth to see my baby at the hospital. We weren't in the worse part of town but also not the best either. I seriously just froze I couldn't move I've never been one to do that let alone my newborn baby maybe in danger for all I know. I finally came back to my senses and went and got my baby. Thankfully nobody was there, I never want to do that again!! Lol such a helpless feeling. But your response literally had my sides hurt and laughing so hard. All I could do is picture your husband standing there watching you running. Omg how hilarious 😂😂😂

In responese to a question on live stream. RIVER RAFTING and TUBE FLOATING are very different activities. River rafting can be a very strenuous sport using team efforts at negotiating fast moving water. FLOATING is just that. Sitting in a tube and floating.
This is going to be a horribly unpopular opinion but I just don’t… care about 99% of these “lies” and/or “lapses in memory”. And this case has given me a lot to think about because without the video, nicolae’s dishonesty would’ve felt a lot more important to me. At the end of the day, the case is really not that complex and the only “lie” I see as a potential determining factor is whether or not he hit that lady and if so, how hard. Funny thing is, I don’t think ANY of them are being totally honest about that part.
So the only lie that matters is the one sticking point of video evidence not showing a certain instigating slap that everyone testified to, but the myriad of video evidence immediately after of the defendant lying his ass off is totally not relevant? I think Nicolae’a behavior is the entire point of the court case. What would the jury debate if it wasn’t about the defendants action during and surrounding the incident? If he got caught killing a dog 20 years before I would deem it pertinent to his current situation, but he hasn’t so his words and actions surrounding the immediate incident weigh more. I really don’t know what’s hard to understand about my comment but I will elaborate a little further. Almost every question I had about the altercation was answered in the video of the altercation and associated witness testimony. The only part of the altercation I can’t express an opinion on with my whole chest is the one moment I cannot see. Unfortunately, everyone has a different description of that moment and because of whole situation with mattison telling the police she took a photo of her facial injury, then telling the police she took a photo but deleted it, then finally the police evaluating her phone’s data just to find that she never took a photo in the first place… it would be unreasonable for me to harp on his “lies” or “lapses in memory” after the fact, when there are “lies” or “lapses in memory” happening on both sides. LYK himself explains multiple times that the only factors that really matter when arriving at a verdict is what happened during the altercation itself… but that a lot of juries have an emotionally difficult time seeing past possible lies. He also explains that consciousness of guilt does not mean someone is guilty of murder. These are just factors that need to be considered when trying to sway a jury because a lot of people operate on emotion. I’m not even saying that the jury won’t debate all the lies. I said nothing at all about what the jury will or will not be debating. I’m just saying his inconsistencies are not what made me arrive at my own opinion. IT’S OK.

He’s seen in the video hitting the ground more than once with his dominant hand grasping the knife so those knuckles definitely could’ve been scraped up on the ground. The other hand could’ve been scraped up on the ground too and even though in my mind I’d expect those knuckles to be less injured, I can’t see his hands under the water. Without photo evidence of visible injury to her face, broken sunglasses, SOMETHING I don’t think they will all agree on where those injuries really came from. Do I suspect he hit her? Absolutely lol. Can I confidently say what kind of hit it was, what hand he used, or if that hit made contact with her head? I cannot because there’s just no undeniable evidence to work with. I suspect the jury will spend a lot of time going back and forth about it.
We cannot discount what it feels like to have this altercation in water. If it was on dry land, it likely would've transpired differently. Getting pushed over in a few inches of water, for an old man, can mean death.
It meant death for 1 and serious injury for several others. Miu could have simply walked away but he didn't want to. He wanted to stab them and he did.

such a tragic case, one where i have empathy for everyone and no one at the same time. empathy for the situation they all found themselves in but frustration for how they all acted. whether it was the victims friends initially creating a confrontation for entertainment and a tik tok video, the other group coming over and needlessly escalating the argument or miu so recklessly and excessively defending himself in the way he did. ultimately it was this that cost a kid his life, as a society we need to do better.

I’m still siding with self defense. I can definitely empathize with how he must have felt. It was extremely intimidating and the moment it became physical he must have been unbelievably fearful. One of those “minors” could easily take him let alone a big group of strong, fit young men AND a bunch of drunk obnoxious women looking for trouble which is why they inserted themselves into the drama unfolding in the first place…they were looking for a confrontation. I would even go so far as say the women were responsible for escalating the whole situation. I still can’t get over listening to that video…all the shouting and cackling and laughing going on….they were big bullies…plain and simple snd they were playing a sick game of intimidation towards the defendant. In fact they were trying to get a reaction…it’s why they were recording it. It was a big game to them….bullying that giuy. And river tubing isn’t strenuous at all. It’s a great activity for people who want to be outdoors and have some physical limitations. As someone who has recovered from a major surgery…it can definitely make you feel very physically vulnerable for a very long time.
He brought knife over, why he was confident, never clearly said shy he was in there space. Never revealed knife and threw it away. He was looking to get away with situation.
Two words -- walk away. Teens acting like idiots. Drinking. Saying hateful things to him that made him mad. He's an adult. But he goes toward them and engaged with them. Things escalated. He stabbed 5 kids, killing one. Then he got rid of the knife, tried to get away, and tried to cover up what he did. Obviously not premeditated, but not self-defense either. He came up with that for trial, NOT when he was arrested.

Older people know a lot of these words, but the vast, vast, vast majority of us have NEVER had them screamed at us by a bunch of people who are also pushing and shoving you..I’m 66 and I would be plenty scared in this situation. I don’t know, maybe you’ve done something to get this treatment, but most other people just go through life with the occasional disagreement and maybe a long term enmity or rivalry with some people, but those don’t descend into having a group of people calling someone a sex offender and roughing you up. And if he can’t play the old card, the youth card doesn’t work either for the young people. I don’t care how young you are, you should know that surrounding someone, shoving him, punching him, screaming foul things at him, and trying to drown him is a dangerous situation. (And I’m also sure that none of these people thought he was one, it was just a cry they took up in order to taunt him and rile each other up.) If you think he’s threatening you, you call the cops and let them handle it. Yeah, I know it sucks to break up your party for this, but what was to be gained by beating this guy up? I do too and everyone responds to traumatic situations differently but to have the wherewithal to dispose of the weapon and not call for help in so much fear? This is partially why he was convicted.

I used to live near the Apple river. I've only tubed on it once - no incidents. The apple river is known to have a lot of drunk people on it. There usually is "drunk drownings" and /or fights....nothing like this. I haven't seen this whole trial so I don't have an opinion regarding the outcome. But being from Wisconsin and witnessing out of state (IL, MN) people come into my state and cause problems time and time again....literally trashing the beautiful state that I live in, really pisses me off. This whole thing is a shame.
I have cpstd . I wish they'd have had a therapist as a witness. I was in a tornado in 1974 and I still have no memories of it except for the smell of fresh pine. I imagine that the kids felt like they were supposed to have an answer. Trauma is weird. It's taken me years to understand what little I do.
That's interesting .I was just listening to a podcast about something completely different but a lady claimed she was super traumatized by a tornado and didn't have many memories from soon after that period. I thought it was kinda hard to believe at first.

This is self defense. It certainly is NOT murder in the first degree. If you're on a jury and have any kind of conscience, you'll think about if your choice is going to put someone away forever and/or leave a victim without justice. They provoked him and surrounded him. No one wanted this but a lot of bad choices were made. If the state had brought difference charges, the result may be different but for 1st degree, if I were on the jury and saw the evidence I've seen so far, I'd vote to acquit. They came at him as he defended with the knife. You should not harass a stranger....you don't know anything about them.

The average user is not going to know how to calculate such adjustments. I saw a custom option in the settings a few minutes ago, but now it's gone, and the only settings available are in .25 increments. Without a custom setting it's impossible for a viewer to play it at normal speed given your chosen speed settings.
Now the custom speed setting has reappeared for me. The options are in increments of .05, so one can get closer to normal speed using this tool. The setting .65 is the closest option to counteract your setting of 1.50.
Prosecutors should have to MAKE their charges BEFORE trial and they should NOT be allowed to move the goalposts w lesser-included depending upon how poorly their case is going along. This has always been unsettling. 🤔🤷♂️ (Regardless of this specific case.)

Except it's not a game. it's real life. If there's a trial and the evidence leads to a clearer view of what truly happened, shouldn't the charges follow the revealed truth. If a crime is overcharged, thus not upheld, does that mean no crime was committed?

Those groups don’t own the River. If everyone had just minded their own business, been polite in interactions, none of this would have happened. Growing up with a Japanese mother, i would have gotten a beat down if I had acted like that. Respect and politeness for others in public is a core principle in Japan. Just as no one litters to respect where you live and the shared spaces. I try to always give the respect I wish to get in return. Life lesson.

Same! But I was in the Army, about to take a long flight with the guy who did SA me. And when I did finally say something, I didn’t say what happened but asked a friend to not let the guy near me. Then I broke down to my roommate and told her everything.

Speaking from someone who has been stabbed and cut with a knife in a confrontation while I was young, I can say that if his intent was to use that knife he would have just used it and not waited until he was being attacked. I truly believe he felt for it to know he had it just in case he needed it , and NOT to just stab someone because that was his intent. At the point of him feeling for it you know he was getting scared and wanting to make certain he had it, of that I have no doubt. If he pulled it out of anger, he would have been using it way before he was attacked not after. This man was in fear for his life I truly believe this, also to note : Disassociation is a common thing that happens to those who have just gone through traumatic things in which they cannot process mentally and thus why he may have not known really what took place until later.
I agree. In the video he's just standing there holding it. And the kids, in the midst of trying to shove this man into the water repeatedly, they lunged themselves into the knife. It's awful that they found him guilty.

Easy answer. If you are in a river with rocks in it, you are going to be walking in said river with rocks in it, you are protecting your feet from sharp or pointy rocks. You aren't wearing them for stability. That's like asking why people who surf wear surfing shoes in the ocean or why people wear flip flops on the beach. They don't help you with your balance, they protect your feet from debris and the heat of the sand.
Yeah, I go tubing a couple times a year and river rock is no joke, I had to buy a pair of crocs. Between the river rock and the current, you need SOMETHING on your feet.

Never before trial, did he mention he was choked until he saw the video. He had no choke hold bruising on his neck. He was checked out by the jail nurse. He didn't mention it to her, nor did she witness any marks, bruising, etc. on his body. His attorney told him, looks like that kid is choking you. It was debunked in court. You don't think that kid knew what he was doing? Like he was really going to choke this guy. The kid wasn't big enough.
Where I live a man not much younger than this defendant in age, was murdered by 4 youths aged 15 onwards, who beat him to death. This trial they were older and more of them with a mix of adults. His lies don’t sit well with me but I can see how someone would be in fear for their life given what our town suffered as a result of the senseless death of a Father of 4 by youths.
But they were just "cHiLdReN" he should have been a "big person" and took the beating. He was "bigger and stronger", so he would have been just fine.

In regards to "children" vs "big person", I do believe that most people are really just implying that he was obviously older, hopefully wiser, more life experience, ect. I for one, would have liked to see him be the bigger person and make ANY attempt to deescalate before gutting human beings. I know in the court systems we follow everything down to the very specific language of the law but as a society sometimes we could do better. Just because perhaps legally you can doesn't necessarily mean you should. I do believe there is something to the term "blatant disregard of human life". Both sides handled what should have been a day of fun in the sun like real A-holes and now they will have to live with the consequences.
This wasn't a white water rafting excursion. In northern Wisconsin, it's common for groups to float down the rivers in inner tunes while drinking beer in a fashion similar to a lazy river ride at a water park. It's not a high-stress activity but more of a leisurely outdoor pastime. Someone who is older or not in the best health would have no issues doing this.
Ya it was a lazy river experience by the twin cities there is a small area of "rapids" but even that is really more equivalent to using a tube in a hot tub with the jets going.
Doesn't matter how exerting it is, just that it is. You have a health claim when you're bedridden, either your healthy enough to be in public enjoying yourself or you aren't, its pretty well binary.

@@3goats1coatomg the last part of your comment immediately made me think about the film The Outsiders. A boy in the film is getting jumped and ends up stabbing and killing one of his attackers. The boy then hides the weapon and runs from the police. I bring that up to say, yes, it was a movie plot, but it also shows that one could find themselves in that situation in real life as well, kinda like in this case but that’s just my speculation.

@@CT-vm4gf He wasn't out to cause harm, but he was irritated with the young men who started harassing him for no reason and his ego wouldn't allow him to just walk off, especially since the boys were calling him a pedophile and saying he was looking for little girls(when there were literally no little girls in the entire river). Which was itself likely the catalyst for Madison coming over and yelling in Miu's face(and grabbing him). The increasing belligerence of the "teens" alongside their increasing numbers is what caused Miu to pull his knife; So that when Miu pushed Madison out of his face and she fell, the boys jumped Miu and got stabbed. I find it difficult to find fault in Miu's behavior outside of his lying(including lying about not remembering). All of the teens were awful. All of the teens were drunk and high. All of the teens have terrible parents and are an absolute embarrassment who FAFO. They were so eager to post their video to youtube/TikTok "for the culture"(IE to get fame/upvotes). Well, they got their online fame. It wasn't the fame they wanted.
A kind word turns away wrath. None of the victims had a kind word for this man. The “adults” who came to “help” absolutely did NOT help, and I’m not surprised that 4 of the 5 victims were from the “adult” group. They said they went over to defuse the situation, but instead they struck a match and lit the fuse. What a horrible, tragic, preventable event this was.

Here in the UK people aged 60+ don't go out at night because they are frightened. The local shops have taken out restraining orders against the local teenagers because they were hanging round scaring the customers away. I have a serious heart condition, if some one attached me I would not last 2 minutes as my heart would give away yet I can swim but not run. I can't climb stairs bu I can carry shopping bags. I would in all honesty resort to deadly force in the same situation as the defendant was in.

Kent Coast here. 71+ grandmother. Fit enough to horse ride every day but with knee replacements no running. My grandson is 19 years old is 6’6” but mega skinny. He’s polite, kind & caring. If I ever thought he would behave as these young adults did I would be very disappointed. So many, “if only” but drink & drugs impair judgement regardless of age. I love young people & I wish this had never happened, parents must be devastated. Mr Mui looks very haggard from imprisonment. Blessings to everyone

I started to change my mind as I listened to the entitled kids testifying. Not quite as their parents see them, and they were breaking the law by drinking. The whole time I watched the prosecutors defend their case, I thought of Miu as evil. His testimony completely turned me around. He’s not evil at all. It’s a terrible tragedy, but the kids were behaving in an outrageous way. Good kids don’t harass people, not even when they’re high. They brought him to his breaking point. They’re just as responsible as he is for the death of their friends.
My husband was the gentlest, kindest man I’ve ever known. He carried a knife. I think this situation would have broken him, too.
I couldn’t decide until I saw Miu’s testimony. It was far more credible than the other witnesses. He is not the crazed creep they tried to portray him as. I would definitely acquit.

To play devil's advocate (responding to some of the questions), I live in Wisconsin and have tubed multiple rivers. Most of the time, you're literally just laying on your tube and slowly floating down the river. You don't have to be young, strong or in great shape to do it. You can see where this happened, the water is shallow and not moving that fast. We've lost things in faster/deeper rivers and been lucky enough to find them again. I don't think it's unreasonable that he's looking for the phone, it wouldn't be impossible to find.
The police did end up finding it.

I have trouble with the consciousness of guilt concept. It's like polygraphs. An innocent person could be so terrified of being found guilty of something they didn't do, that it would induce them to lie. And I'd be more surprised to find out he hadn't stumbled, in a situation like that. Stumbling while walking in a river is commonplace, regardless of what your shoes are like. And they can't have it both ways, why would he run away before feeling terror, why is he required to. Please give our bullying children their space? And once there was terror, he was surrounded by jeering kids (being kids to me would make them seem more dangerous actually, we hear about so many mobbings, and they are prone to mob activity once they get into these bullying, mocking situations).

My first husband ALWAYS had his pocket knife on him. I know a lot of men especially who do.

I feel for this guy for sure. I think his personality played a HUGE role in this. My husband and I are the same age as him, we also tube down a river nearby, and have for 20 years. We go with friends, take a lunch and have a couple of beers for sure. However....my husband, of the SAME age, would never ever have done what Nic Mui did ever. Maybe go look for the phone for a few minutes, but as soon as there was a small issue with some teens he would have come back to our group, if for no other reason other than to not delay or ruin the beautiful day. I do think he was defending himself and in fear of his life, I just don't think this would have happened if he had just walked back to his group as soon as these kids started making a scene.

If you look at the woman standing behind them when he’s being strangled, she’s smiling and cheering with her hand raised! What’s wrong with society? I think both sides are guilty to some degree, you can’t start a riot without being held responsible for what happens. The first Blackman started yelling rapper , pointing at him and repeating saying that, is starting a riot. He admitted he was doing it to post on media, also he kept filming when one of his friends was bleeding to death!

I agree. I’ve watched that video many times. At first, I think he thought one of the kids might have had the phone he’d been looking for. I think he went up to them with the intention of looking at it more closely.
However… once he got there, once they all started taunting he seemed to have backed away a bit. He didn’t seem to respond immediately-not until Madison and the others came to help. Then it all escalated. They were pushing, throwing punches, knocking him down and shoving him from behind.
The knife was out and at his side. If he punched Madison, I think she’d have hit the ground (size difference etc), regardless it drew the others and he brought that hand up and shoved(not stabbed) first. The one who died did not back away, he came at him anyway. I’m still going with self defense… he had been trying to walk away at first(he moved away from them a bit & was still looking in the water)the right to defend himself became necessary when they put their hands on him.

Prosecutor made a great opening statement and i was leaning toward guilty. After watching the video, my view started to change. After listening to ALL of the witnesses on stand lie to help their situation (it was different when talking to police). The video shows it all to me. The teens were drunk and out of control (liquid courage does that to some people). I also feel they were going to use on one of their personal internet platforms (SnapChat, TikTok or the like).Miu was definitely shoved, punched, knocked down with his head under the water while being surrounded by a gang-like group. You can tell by his face he was in fear and trying to figure how to get out of the situation. I do think he was in shock along with the others that were present. I think the prosecution should have included a manslaughter charge. Intentional Homicide doesn't fit the situation, IMO. No one in the case wins. Even if Miu is acquitted, he still has to relive the memory of being attacked and then killing a teen in self-defense. It is so sad.

I have actually found myself in a river more than one time with unstable sandals. I have forgotten swim shoes, and just worn what I had on because there are rocks, etc.
Those aren’t easy to navigate in. The shoes get pulled one way, while your foot is going the other direction. It’s why water shoes are made differently than just regular sandals.
I constantly was falling, but it was better than being barefoot. The rocks were slippery as well.

Watching this so far, I would personally feel threatening with all those YOUNG ADULTS shouting, crowding me and gesturing in my face. Age shouldn't matter, most of those young adults were physically stronger and taller than him. I don't agree with him fatally stabbing someone, but if i'd been pushed down, a group of young men kicking on me AND putting hands around my THROAT I would also feel the need to defend myself. Not sure why he had a knife but not got that far in the video. He should of just ignored them and walked away really but again why should he go? He's got as much right to be there as anyone else. And those women were being threatening and shouting in his face, he has every right to move them away from him. Watching more, I feel the group of teenagers were antagonizing him to a point where he was getting worried and also angry. They didn't let up on him even when he was walking away and minding his own business. They just kept pushing and following him. The teenagers shouldn't of been so aggressive towards a single lone old guy. They also shouted horrible accusations at him, calling him a P*edo and a r*per. Horrible bullying. He Shouldn't of reacted with violence but the teens didn't make the situation any better either. They are old enough to know what they were doing.
I feel as though he'd have a stronger case though if he had just tried to disengage and walk away. if they still tried to grab him and follow him around then i think the jury would be more understanding.
No one kicked Miu and no one put hands around Miu's throat. Isaac shoved Miu in the neck, reacting to Miu stabbing Tony in the gut as Miu thrusted his knife into Isaac's heart . Miu wasn't choked.

He got hit in the head when down before he stabbed anyone and they were over him etc? So at that point I'd be pretty scared and vulnerable

My family calls what his bowels did as "nervous poops". It happens during times of stress. It's an actual medical condition triggered by stress. He already had medical history that would react to his initial response to fear or stress. So all of this triggered a physiological as well as a flight or fight situation for him.
I showed my 73 year old mother the full vid and she sh!t her pants. Running across those teens was the definition of terror that day.
Part of his anxiety was that he had just stabbed 5 unarmed people

The other day I was at an event with hundreds of dogs. While having lunch at the picnic tables my little dogs leash came loose and he slipped away (looking for food under the tables.) One point is that he doesn't need to convince the jury, he only needs to convince one member of the jury that he is not guilty. If he convinces enough there won't be a retrial.

During the nurse testimony it was revealed he was on several medications. One mentioned can be used to treat PTSD as stated in court. along with a statin. When interviewed at the station he pauses a long time when asked what meds he takes. He says "one more" he can't remember after that long pause. He did not mention the PTSD med. He said himself he had been drinking beer all day during that questioning. Those drug interactions with alcohol should have been looked at more. Two are noted to cause aggression and irratability. now mix those together and with alcohol... Wondering why this was looked into more.
@@hughjorgen108 very good point. Yes having that bypass could have been traumatic at such a young age. I think it is more likely that he is not mentally the same after that surgery than him being physically frail from the bypass 2 years later.

I didn’t watch cross but I did watch direct. I’ve been switching between apple river and YSL, the attorneys and the judge from Georgia should take a trip to watch trials in a well run court. When it takes 2 hours to examine the defendant in a huge stabbing case but takes literally days to examine a witness that has no bearing whatsoever on any of the counts charged there is a reason the state is taking 6-9 months to get through their case in chief.

If i got punched hard in the face that left visible injuries, and that act of violence was the catalyst that led to 5 people getting stabbed and one killed, i would have had many pictures taken of the injury, and i would have kept them even if the cops didn't want them. Yet there is not one single photo of the woman's injury supposedly perpetrated by the defendant. That should tell you right there that any narrative involving her getting punched hard in the face by the defendant is BS.

I think the memories of the sound of getting punched by the boys were self created because she kept saying it happened. If something is said enough times you convince yourself it happened. When the police first get there, the first thing she says is "he punched me in the face". Not "a bunch of people were stabbed". Not " my friend was stabbed. I think he's dying in the river". The fact that she's the only one to not have audio or video of her testimony shows she knows she caused this. The fact that neither her or her mother had any pictures of any injury to her speaks volumes as well.

Hello Peter! First time commenting. Between what he said to the police at 20:45 and him walking towards the group and grabbing the tubes is what has me at guilty so far if I'm a jurror at this point of the trial. Been streaming on Law and Crime but love your perspective.
It doesn't really matter which way he was walking at first if he was looking for a lost phone. I am given to believe that when he moved toward the group of tubes it was because one of the teens had held up a phone that resembled the missing one. I don't understand why the teens began to call him a raper and a predator or why they thought it was amusing to do it.

31:26 no River rafting is not a physically involved thing basically you sit on that tube and you float until you hit the end. Also the water is very shallow there so you don’t so you can get off and get wet to cool down but you don’t have to worry about actually physically getting yourself back up when you can’t touch the bottom so that would be not a physical activity. It should’ve been a relaxing afternoon.
Depends how the river is, I've been on it multiple times and the first time I went the rapids at the end tossed my buddy out of his tube and he lost his glasses. Then my other friend went out to help him and they had to fight the current to get back and we got nicked up by the rocks a bit since we weren't wearing good footwear. Second time I went the current was much calmer. To be fair I didn't know the rapids were going to be like that when I went the first time.

I showed the original video to my 17yo son. I made sure that he watched the entire thing.
The first thing out of my son's mouth was "why were they doing that to him?", "why were they calling him that, was he doing that -looking at little girls-?". He wasn't surprised that he had a weapon and he had the mind to use it. He stated that the "kids" were stupid to keep going after Mr. Miu and that they shouldn't have pushed him down and into the water numerous times. He's an obvious older man and his weight was not a benefit for him. That isn't the only thing that was what caused him to attack them.
I show these things to my kid so he doesn't have to be in that situation in his life if I show him right from wrong (and teach it to him!!). With a mom who loves true crime (and is a crime scene investigator) and a dad that is a police sergeant (with 15+yrs as an investigator), we try to do our best to teach him how to be a good citizen and to know when to walk away from his friends when they are acting like a$$e$.
I look forward to the jury return. I see it as Mr. Miu used force to keep himself alive and that he was justified as self defense. It's a shame that the interaction had to turn out with a death and serious injury. I feel bad for the parents, but I don't think the kids acted inappropriately.

I’ve commented on this before, when a traumatic event happens our brain tries to process and can miss some things that happened. Fear makes people due some weird things and the brain has a way of completing the circle to make sense of things. Ask a family member or a sibling about an event that happened in your life, some people can even think someone else memory as your own.

As a person who has experienced adrenaline spikes and then subsequent dumps, you feel completely numb, drained, and disoriented. It is hard to focus. All you want is quiet and to go rest. Voices or sound at all are like piercing stabs to your head. You can't process much of what is going on. The recovery time varies depending on how severe the spike and dump was. Somtimes it can take a few hours. Other times it takes a day or two. Even when you recover and feel a bit more normal, you are still sluggish and not quite 100%.

In the uk, our lawyers are on call 24/7. We can speak to them at any time. If we get interviewed at 3am, we will have a lawyer there at 3am.

If it was the weekend and needed a public defender then she was telling the truth because the courts in the US are not in business on weekends. Also Public Defenders can only be assigned by the court, and this usually happens during the first hearing in front of a judge.

The uk is totally different. We don't have court on Sundays but even still, if we need to speak to a public defender (we call it a duty solicitor) or have one present during an interview, they're on call 24/7.
Police are allowed to lie to suspects. I suppose he was going to spend the weekend in jail no matter what he decided, so he should have waited to have a lawyer present.

In wisconsin you do not have a duty to retreat , BUT the Judge can instruct the jury to take in to consideration that he made no effort to leave the situation .
I don’t think he brought the knife thinking he would kill somebody but he definitely got mad and lost his temper and got in too deep and a 17 year old kid is dead and AJ Martin had an injury that caused him to flat line twice. I don’t think he should get to walk away now when he did not walk away then.

Everyone I know from factory workers to independent contractors has a knife with them at all times, and I also live in Wisconsin. It's just an everyday tool. It's not suspect for someone to have a knife on them.

Freeze, flight or fight. My husband and I were held up with a gun and surrounded by 4 men. I ran and left my husband in the dust. He was so angry I left but it was seriously out of my control. My Instinct was to run and I had no control over reason or logic. My husband was fine. He just walked passed the men. I think my reaction shocked the men and in my mind I saved our lives. Lol.

I know one and only time I've ever done the freeze, my newborn premie baby finally got to come home from the hospital at 6 weeks. Her and I were home alone she was in the room across the hall. I woke up and thought I heard somebody in the house we just moved into the city so I could go back and forth to see my baby at the hospital. We weren't in the worse part of town but also not the best either. I seriously just froze I couldn't move I've never been one to do that let alone my newborn baby maybe in danger for all I know. In responese to a question on live stream. RIVER RAFTING and TUBE FLOATING are very different activities. River rafting can be a very strenuous sport using team efforts at negotiating fast moving water. FLOATING is just that. Sitting in a tube and floating.

This is going to be a horribly unpopular opinion but I just don’t… care about 99% of these “lies” and/or “lapses in memory”. And this case has given me a lot to think about because without the video, nicolae’s dishonesty would’ve felt a lot more important to me. At the end of the day, the case is really not that complex and the only “lie” I see as a potential determining factor is whether or not he hit that lady and if so, how hard. Funny thing is, I don’t think ANY of them are being totally honest about that part.
So the only lie that matters is the one sticking point of video evidence not showing a certain instigating slap that everyone testified to, but the myriad of video evidence immediately after of the defendant lying his ass off is totally not relevant? I think Nicolae’a behavior is the entire point of the court case. What would the jury debate if it wasn’t about the defendants action during and surrounding the incident? If he got caught killing a dog 20 years before I would deem it pertinent to his current situation, but he hasn’t so his words and actions surrounding the immediate incident weigh more. Almost every question I had about the altercation was answered in the video of the altercation and associated witness testimony. The only part of the altercation I can’t express an opinion on with my whole chest is the one moment I cannot see. Unfortunately, everyone has a different description of that moment and because of whole situation with mattison telling the police she took a photo of her facial injury, then telling the police she took a photo but deleted it, then finally the police evaluating her phone’s data just to find that she never took a photo in the first place… it would be unreasonable for me to harp on his “lies” or “lapses in memory” after the fact, when there are “lies” or “lapses in memory” happening on both sides. LYK himself explains multiple times that the only factors that really matter when arriving at a verdict is what happened during the altercation itself… but that a lot of juries have an emotionally difficult time seeing past possible lies. He also explains that consciousness of guilt does not mean someone is guilty of murder. These are just factors that need to be considered when trying to sway a jury because a lot of people operate on emotion. I’m not even saying that the jury won’t debate all the lies. I said nothing at all about what the jury will or will not be debating. I’m just saying his inconsistencies are not what made me arrive at my own opinion. IT’S OK.

He’s seen in the video hitting the ground more than once with his dominant hand grasping the knife so those knuckles definitely could’ve been scraped up on the ground. The other hand could’ve been scraped up on the ground too and even though in my mind I’d expect those knuckles to be less injured, I can’t see his hands under the water. Without photo evidence of visible injury to her face, broken sunglasses, SOMETHING I don’t think they will all agree on where those injuries really came from. Do I suspect he hit her? Absolutely lol. Can I confidently say what kind of hit it was, what hand he used, or if that hit made contact with her head? I cannot because there’s just no undeniable evidence to work with. I suspect the jury will spend a lot of time going back and forth about it.
We cannot discount what it feels like to have this altercation in water. If it was on dry land, it likely would've transpired differently. Getting pushed over in a few inches of water, for an old man, can mean death.

such a tragic case, one where i have empathy for everyone and no one at the same time. empathy for the situation they all found themselves in but frustration for how they all acted. whether it was the victims friends initially creating a confrontation for entertainment and a tik tok video, the other group coming over and needlessly escalating the argument or miu so recklessly and excessively defending himself in the way he did. ultimately it was this that cost a kid his life, as a society we need to do better.

One of those “minors” could easily take him let alone a big group of strong, fit young men AND a bunch of drunk obnoxious women looking for trouble which is why they inserted themselves into the drama unfolding in the first place…they were looking for a confrontation. I would even go so far as say the women were responsible for escalating the whole situation. I still can’t get over listening to that video…all the shouting and cackling and laughing going on….they were big bullies…plain and simple snd they were playing a sick game of intimidation towards the defendant. In fact they were trying to get a reaction…it’s why they were recording it. It was a big game to them….bullying that giuy. And river tubing isn’t strenuous at all. It’s a great activity for people who want to be outdoors and have some physical limitations. As someone who has recovered from a major surgery…it can definitely make you feel very physically vulnerable for a very long time.
He brought knife over, why he was confident, never clearly said shy he was in there space. Never revealed knife and threw it away. He was looking to get away with situation.

Two words -- walk away. Teens acting like idiots. Drinking. Saying hateful things to him that made him mad. He's an adult. But he goes toward them and engaged with them. Things escalated. He stabbed 5 kids, killing one. Then he got rid of the knife, tried to get away, and tried to cover up what he did. Obviously not premeditated, but not self-defense either. He came up with that for trial, NOT when he was arrested.

Tbh playing the old card is a double edged sword. So he's a helpless old man scared. But as an old man, he also shouldn't be so bothered about someone calling him names as he put it. He didnt stab people in a flailing motion. He gutted a bunch of the very same teenagers who he claimed were so much bigger abd more poweful than him. Also. It is creepy for some old man to be snorkelling all around you in 2 feet of water. Teenagers were def being assholes but you don't get to kill someone because they're being mean to you

Oh come on. Older people know a lot of these words, but the vast, vast, vast majority of us have NEVER had them screamed at us by a bunch of people who are also pushing and shoving you..I’m 66 and I would be plenty scared in this situation. I don’t know, maybe you’ve done something to get this treatment, but most other people just go through life with the occasional disagreement and maybe a long term enmity or rivalry with some people, but those don’t descend into having a group of people calling someone a sex offender and roughing you up.
And if he can’t play the old card, the youth card doesn’t work either for the young people. I don’t care how young you are, you should know that surrounding someone, shoving him, punching him, screaming foul things at him, and trying to drown him is a dangerous situation. (And I’m also sure that none of these people thought he was one, it was just a cry they took up in order to taunt him and rile each other up.) If you think he’s threatening you, you call the cops and let them handle it. Yeah, I know it sucks to break up your party for this, but what was to be gained by beating this guy up?
I think they thought it would be cool to beat up someone who they thought couldn’t or wouldn’t fight back. Somethng to brag about later. Well, surprise.

I do too and everyone responds to traumatic situations differently but to have the wherewithal to dispose of the weapon and not call for help in so much fear? This is partially why he was convicted.

I used to live near the Apple river. I've only tubed on it once - no incidents. The apple river is known to have a lot of drunk people on it. There usually is "drunk drownings" and /or fights....nothing like this. I haven't seen this whole trial so I don't have an opinion regarding the outcome. But being from Wisconsin and witnessing out of state (IL, MN) people come into my state and cause problems time and time again....literally trashing the beautiful state that I live in, really pisses me off. This whole thing is a shame.
I have cpstd . I wish they'd have had a therapist as a witness. I was in a tornado in 1974 and I still have no memories of it except for the smell of fresh pine.
I imagine that the kids felt like they were supposed to have an answer. Trauma is weird. It's taken me years to understand what little I do.
That's interesting .I was just listening to a podcast about something completely different but a lady claimed she was super traumatized by a tornado and didn't have many memories from soon after that period. I thought it was kinda hard to believe at first.

All of them were fueled by alcohol. They acted stupidly, he acted stupidly. Imo, if he'd done the right thing and let them pass, all that would have been avoided. He stayed because he's stubborn and was trying to do the " you're not the boss of me." That led to him murdering 1 and nearly murdering 2 more. He's an idiot and deserves prison.

This is self defense. It certainly is NOT murder in the first degree. If you're on a jury and have any kind of conscience, you'll think about if your choice is going to put someone away forever and/or leave a victim without justice. They provoked him and surrounded him. No one wanted this but a lot of bad choices were made. If the state had brought difference charges, the result may be different but for 1st degree, if I were on the jury and saw the evidence I've seen so far, I'd vote to acquit. They came at him as he defended with the knife. You should not harass a stranger....you don't know anything about them.

I saw a custom option in the settings a few minutes ago, but now it's gone, and the only settings available are in .25 increments. Without a custom setting it's impossible for a viewer to play it at normal speed given your chosen speed settings.
Now the custom speed setting has reappeared for me. The options are in increments of .05, so one can get closer to normal speed using this tool. The setting .65 is the closest option to counteract your setting of 1.50.
Prosecutors should have to MAKE their charges BEFORE trial and they should NOT be allowed to move the goalposts w lesser-included depending upon how poorly their case is going along. This has always been unsettling. 🤔🤷♂️ (Regardless of this specific case.)

Except it's not a game. it's real life. If there's a trial and the evidence leads to a clearer view of what truly happened, shouldn't the charges follow the revealed truth. If a crime is overcharged, thus not upheld, does that mean no crime was committed?
