But the reason also has to be given...otherwise the denial will be treated as admission
Not just denial, the documents supporting the denial must be produced, mere denial with reason(mostly cooked up) is inadmissible. It seems Mr . Agarwal is failed to fathom the word 'justice' and 'truth'.

In the United States my experience is that once your conflict devolves to the point of engaging counsel neither party can prevail or satisfyingly compromise any longer anyway. A lawyer used my potential inheritance theft case (plaintiff, civil) to get me no long-term resolution as he strung me along learning how to pull off a dirty executorship against his own siblings. Justice system is such a misnomer and not just in India or one place.

In uk, i had a lawyer representing me with a domestic issue. I was the defendant and the claimant was my family. There were some bail conditions which was very punishing to me. The case was simple they had no evidence all was needed that the hearing take place. The prosecutor enlightened the court some new evidence had arisen. This didnt bother me as they never had any evidence, there objective were to delay the hearing ,meaning my bail conditions stay active, which was more of a punishment then even if i was to be found guilty.
But my greedy lawyer took that excuse and asked the court for more time, so she can make money, not caring that i will still be under bail condition for another few months ..
Those conditions were not being able to see or have any contacts with my mother. Of which both my mother and i suffered. Meaning for another few months if i contacted my mother, ill be arrested!
Really pissed me off how the greedy lawyer was seeking her own interet into wasting cour time so she too gets more money.. saked her on the spot!

Still mistakes are made..
Sometimes the advocate follows his client's instructions and sometimes the client trusts the lawyer way too much.
But it's necessary to take a (paid) second opinion, every after a few hearings... just like we do when we doubt our doctor's advice.

I don't know if you are the correct person to answer this, but anyone who has knowledge on this can answer.
Outside city limits, which type of police can ask / fine for things such as helmet, insurance, seat belt, emission test? As traffic police will be only within city limits and all the documents won't be available with the people always, especially outside city limits, police will be waiting for money and they will hold you for one or the other reason until they get paid. I got caught by a police at midnight while dropping my brother to bus, without any documents or helmet, they asked me many cases of vehicle theft has been filed recently, so show any one document related to vehicle then u can go, I requested my friend to send as it was his bike, and he was asleep. My brother gave the address and showed his reservation ticket then they allowed us to go. But this doesn't happen most of the time, they will catch you for one or the other reason, how to defend outside cities if they are not traffic police?

Based on the nature of the admission, you can still make use of Plea Bargaining. Why are none talking about Plea Bargaining, which is a very useful utility, which can work in certain special situations (don't generalize it for every single case)

Hello Sir, being a lawyer you know the importance of justice. But the senarious you are narrating (lawyers can be bought, the cases keeps adding from both end and goes on in a haphasard course) make us think that there is no point is seeking justice.
If many people come to this realization, and dont fear any conciquence, then how to you maintain peace and functioning of the country???
Its practically not possiable that everyone try to avoid getting into trouble caused by perperator. Though everone try their best to avoid getting into d vicious circle of court and lawyers.

Does not appearing in a probate hearing amount to complicity/acquiescence? I am 72 years old and there are many inconsistencies in the probate notice.I have not been shown the purported will.Do I have to pay money to see the will?
After making an admission is it not the duty of the prosecutor to prove your guilt? I thought just by admission of guilt a person cannot be punished.

It sounds like you've very dear and near to Accused/Respondents side. There is something called 'justice' and 'truth'. Mere denial(with cooked up reasons) are inadmissible unless it is supported with documents. Before pointing advocates know the truth. It is not precedent that client always tell you the truth.
If I borrowed money from any financial institution and if that financial institution files case against me for not paying back then me saying no i haven't took any money to court would it do any good cause that financial institution possesses all the required documents duly signed by me ....Just wondering

Advocates should not advise people to simply DENY accusations which are in fact TRUE. this is the basis of justice being denied to deserving petitioners. Stop encouraging wrongdoing.

I purchased vacant land in 1999 through a local Advocate who prepared my sale deeds. On 26.3.1999 I witnessed the fraudulent registration of my sale deeds since I believed the Advocate who supposedly scrutinize the parent doc in the name X and he prepared my sale deeds in the name Y. But in one sale deed there is an endorsement that the land remaining unsold belong s to X and the vendor signed in the right margin as X and at the bottom of the same page he signed as a vendor Y. When I received the sale deeds with these two names. I questioned my Lawyer about both different names. He answered me that the vendor has odd names and since I paid the sale consideration by crossed A/c payee only DDs and the money was paid to the vendor with a fracture of my mandate I can file a criminal case against the Banks who do not maintain any A/c. in my mandate and I will get my money back. But quickly the vendor filed a suit and injunction declaring that it is only a simple typing error factually committed by my Lawyer so his prayer was for the court to declare that both names for the same person and prayed that I, the Banks and Banking Ombudsman should not be permitted to take criminal action against him. The Banking Ombudsman is in the case because on the advice of a Lawyer friend from Punjab asked to file a complaint before the Banks and RBI. Banks wrote to me that both persons are same and they paid the correct person. I took it up with RBI for fracture of my mandate and I was advised to file a complaint before the Banking Ombudsman which I did in Jan. 2000. The Banks were called and they answered the Banking Ombudsman that they will get the parent doc. In whatever name I want (all they wanted was to dump the fraudulent sale transaction on only the buyer and seller). I saw through it and refused. The vendor was called and he asked for time to generate funds about Rs. 5 lakhs and immediately he rushed to the court that it is only a simple typing error. The City Civil never agreed and dismissed his case saying that it cannot be taken as a simple typing error. After him being cross examined by all the Lawyers the Judge herself asked him about his different names and in open court he admitted that Y was a false name. She asked him to rectify my sales deeds since my sale deeds are otherwise invalid and he had got the banks into problems, but he answered that he could not rectify my sale deeds. When asked why he chose to remain silent and he is silent till today. The Final Judgment was in my favor and against the vendor and Bank respondents. The vendor appealed in the Fast Track Court but he and the Banks lost the case. The Decree was against the vendor and Banks. During the course of hearing the judge shouted loudly that this land has no papers for the parent doc. and questioned the Lawyers why was the case running in court on fake documents. The Lawyers were punished with a short term ban from practicing. The Decree was in my favor. No Lawyer took my case after that.
In 2014 as party in person I filed a CRL.OP 9862 for the fraudulent sale transaction and Prayed for FIR to be registered. I got an excellent order mentioning that the Sub Registrar consciously participated in the fraud having on record the name X yet he permitted my sale deeds to be registered in the name Y. Also that the vendor had no right to deal with the said property and also states the fraudulent bank transaction. The Police disobeyed the order and instead issued me 3 identical letters covering 7 different Crime No's. but not the Crime No. Given by the nominated DCP Anti Land Grabbing Cell. I filed Contempt petition, but the order is not in my favor when the High Court order states conscious participation of the Sub Registrar for the fraudulent sale transaction.
For the Bank transaction I filed as party in perperson CRL.OP 22353/2014 and earned an excellent order directing the local Police to deal with the case as per the Apex Court direction in Lalita Kumar case. For this the Police filed a dummy FIR 2015 of 2014 claiming that it was filed in JM Court, which is a lie. For that FIR nobody was arrested no enquiry no investigation no statements or evidence collected. I filed Contempt Petition No.343 of 2017 for which Order DT.9.3.2018 was issued that FIR was filed. I questioned the Govt. Lawyer and Inspector then where are the accused and their evidence or written statements. They had no answer. I told the judge then that was perjury. The judge answered me that I should go another route.
I also filed WP 31079 of 2015 against the Public Servants who are responsible for registration of land but which was ordered only on 5.22.2016 after the prescribed petiod of one year and contradicts the Final Judgment and High Court order DT.18.6.2014 in CRL.OP 9862 of 2014.
I filed WA 1267 of 2017 which order DT. 30.1.2018 directed me to approach the Apex court.
Till date there is no FIR registered, no defense by the Respondents and senior Officers of the Company in the Registration and Revenue department who ought to be accused. The vendor is absconding. Hence I prepared a Review petition against all responsible for the fraudulent sale transaction. I would highly appreciate if Adv. Mr. Amit Agarwal could please take up my case.

I have tried some Madras High Court Lawyers who only took payment in advance but never did anything. In my Review petition I claimed all that money back.
