Family courts are so fun. They always do whatever is most stressful for the parents and the worst for the kids.
Family law is by far the worst law practice. I interned at a law firm (in MI) that specialized in it and it doesn't stop with the parents. It can come down to where you're located or the judge that presides over the case.
These are the facts
Yes family court is complete trash! And the judges are so stupid!
They drag it out because its a money grab.

If you think this is a waste of money and you live in Michigan you need to write your Representative and tell them that you want this law change. The courts need to follow the law I guarantee you people who have to follow these laws and enforce them think they're stupid. But if they don't enforce them they'll lose their job.
State Legislatures write the laws. Tell your representative. Vote.
Plus it’s not even like the surrogate is fighting them on rights or anything! This can easily be fixed but the courts just don’t want to make it easy

Because the law is ignorant. They claim they can’t do it before the babies are implanted. Cause there are no babies to adopt. Like it isn’t some human created law that can be changed!

@@vikib1758 Well, the courts don’t see them as babies. Hence abortion being legal. If the law admits that they are alive, a life, a baby, then an abortion would be murder. So the courts will never say that an unborn child is A CHILD. They are taking so far now, that the baby can be born, and LEFT TO DIE, in the hospital! It is up to the mother. It’s evil. It’s gone way too far! But it also affects laws surrounding cases like the one in the video. It is a sick cruel world.
This shouldn't happen to them. A judge should just do a DNA test for legal proof so it can be on record that they're the parents them sign the paperwork. They shouldn't have to adopt their own children
The really horrifying thing to me is that he is probably unable to be listed as the father because their surrogate is married so her husband would legally be considered the father. At least, that was the case the last time I heard of a situation like this. Same state, too.

Well, at least the kids are in their home! When I clicked on this video, I thought it would be a much different kind of video. I'm soooo happy to see that the surrogate has supported and stood by them! That's amazing. Wishing this family a long, happy, healthy & prosporous life together.

Yeah, you guys it’s a Michigan Law. Check your State laws, lots of States have much better laws on the subject, more family friendly- Michigan (outside Detroit) is super conservative and they made these laws to make it difficult for gay couples who use surrogates - they just didn’t expect a straight, white couple to use a surrogate in Michigan.
What an absolutely disgusting law, this law needs to be changed.
This mum has fought her way through breast cancer and having this unnecessary stress is enough to cause extreme health issues and make anyone very ill.

It is a disgusting law because you believe it is OK to buy a woman’s life for 9 months to have your child?
The law isn’t perfect, but it is there to protect the surrogate, whom in many places has no parental rights after birthing a child.
@@thomasreedy4751 the law shouldn’t prevent TWO biological parents from having custody of their biological children because of the vagina they came out of. I understand the need for laws to protect the children involved and the surrogate in certain cases. What I don’t understand is how in a case where the surrogate shares absolutely no biological connection to the children yet she is still given legal custody of them. These parents should not have to go through The adoption system to have legal rights to their own children. 90% of people who have children would never have kids if they had to go through the adoption system just to take them home.

No surrogate should ever have parental rights over children they birthed as that is the entire point of being a surrogate. They have zero biological connection to the child. The egg and sperm came from the paying parents. It is their biological child. Point blank period. Surrogates are essentially an oven to bake goods, but the goods do not belong to them. Crude analogy but it is what it is and that’s why that are paid so much money. American law is a shitshow.

Change it to contract based. Must have a agreement prior to birth and if no contract then who ever gives birth is responsible for the kid and no other is responsible for child support.

It's not the judicial system. It is the laws. They need to have some law changes then the courts could follow those laws.
They didn’t birth the kid. A guy who doesn’t have any dna, isn’t married to a women can be liable for child support so a person who birthed a kid should have the right to keep it.
@@lastlime3792 it’s biologically their child, all their DNA, and the woman who “cooked” them isn’t trying to keep them. The twins live with their parents. Also, in what state is a man with no biological attachment libel for child support unless he adopted the kid? Haven’t you ever watched Maury, that’s why these people do paternity tests. They want to prove they aren’t responsible for child support… all this is, is a way for Michigan to capitalize on this situation getting paid for background checks, home visits, court fees, etc. There is also a contract that says these are the parents and lays out what the woman providing a womb will get for her service, no reason to require these extra hoops!
The State Legislature and state Representatives create and vote for these laws, not the Judicial system that has to apply them. Contact your Reps. Vote.

We adopted our son out of the foster care system. It was the worst experience of our lives. The system abuses the kids in ways you and I would be arrested for! They deny these kids medical care. They expect them to miss school for a meeting with someone the state decides needs to see them and expect you to travel four hours one way. It doesn’t matter what the system is the kids are NEVER the focus. The money is always the focus.

I'm very glad to hear that the surrogate herself is sticking with the parents and that she isn't the one trying to keep them. This is a ridiculous situation and it's not like the woman had surgery to put the fertilized eggs in her or anything crazy like that... 🙄

This is not the first time Michigan laws have screwed parents. Why have they not been updated, yet? And why is the father not recognized immediately? He had as much to do with the pregnancy as any other father during a traditional pregnancy.
It’s an odd law and sounds like a stressful process but I’m glad they actually have physical custody of their babies.

The surrogate has nothing to do this. It's Michigan law. And it happens all the time
She probably did do temporary guardianship at the birth but the want legal custody of the kids. She couldn’t do the full custody without court approval
Extra money for politicians, also stops trafficking of kids, and set legal financial responsibility.

Thank god the surrogate is so supportive. When I saw the video title I thought she was going to be the one fighting for custody.
They should have gotten a surrogate in a state that doesn't require adoption.

Hiring a surrogate is insanely expensive, people are crazy lucky when they have a friend or family member willing to do it.

But you have to follow state law, if it’s illegal to do surrogacy in a certain state you DONT do surrogacy in that state-you find a different surrogate in a different state. Period. It’s not right, but it’s how it is. The USA has hodge podge surrogacy laws, no federal law. Do I think it’s right? No. But you do have to follow state laws to not be put into a legal mess.
Btw, it doesn’t matter where IPs live it only matters where the gestation carrier lives whether it’s legal or not. So no IPs are moving states. 🤦♀️🤦♀️🤦♀️

The law in this situation bogles the mind. Simple DNA proves who the bio parents are; the surrogate knows her role. What on earth
would make it so difficult? When you think of all the children being abused, and Child protective services barely able to handle those cases, why are we spending so much negative time, money, and energy on this situation?
Plus the surrogate isn’t fighting to keep the kids It would only be understandable if the surrogate and birth parents were fighting for custody of the kids but in this case they aren’t since the surrogate is a family friend and is on the birth parents side . This law should be taken away for those that have a surrogate on their side. It makes no sense if the surrogate is not fighting for custody of the kids then the kids are defiently legally their birth parents kids their surrogate is not trying to keep the kids for herself.
As a Michigan resident, is there anything we can do to help? Prayers to you two and your cute family. I am at the very least happy the surrogate is on your side. I can't imagine how devastating this must be for them.
@BrianaLoveW I wondered that too. I find the whole thing strange. In Canada, family law is the purview of the federal government, so it's consistent across the board.
I'm also from Michigan and my fiance and I listen to this story and are completely heartbroken for this family, we've had similar issues in conceiving and have considered many options. This is scary to see happening

I've been a surrogate several times and the paperwork was always done before implantation so that it was clear that this doesn't happen. We also looked at the laws in the states so that the implantation is done in a state where this law isn't in place.

The surrogate has no rights to the child, that's what a surrogate is, just a vessel. They're saying it's a technicality because they were premature and not full term so it would technically violate their contract. I do hope they adjust the laws after this because really any legal representation can look at this case and see that nothing has changed to the arrangement at all. The timing of the birth should have nothing to do with it. It's all technical jargon that they unfortunately got caught up in.

They are both the biological parents, not just the father. The surrogate just carried them.

That’s what I’m confused about too. Why isn’t he accepted as the bio father??? A child HAS to have a biological father no matter what. That can’t be disputed. So I don’t get why he can’t be listed. I also don’t understand why the surrogate can’t just sign over her “rights” to them. It doesn’t make any sense.

The whole surrogate thing is a disaster waiting to happen. Sara and Hagar modeled what happens when you go this route. To this day their seeds battle in the earth to be recognized as the rightful birthright. Even the best of intentions go wrong. Years of lawyers, court battles, and not to mention the emotional toll. There are many beautiful babies and children waiting in foster care, you don't have to birth them to be their parents and love them like your own. Hopefully everything will sort itself out for this couple.

Just know when looking for a surrogate, you should research on the surrogacy laws on where the surrogate resides. This is a nightmare and I cannot even fathom how hard this is for the parents.
So relieved it's a bureaucratic issue that they are fighting. It will happen - after alot of expensive, time consuming and soul sucking red tape. With the title I feared that someone else was claiming the twins. Beautiful family - God bless you all! 💕
Eames is one of the happiest most joyful looking babies I think I have ever seen. Did they even show a single frame of him NOT smiling? They are both so perfect. God bless your family I hope you are able to easily find an affordable solution!

How ridiculous that they are having so much trouble adopting their own children! What's wrong with the court? As far as I can see this case is clearcut and simple. The surrogate gave birth to the babies and has given them to their biological parents without objection so why does the court have to make the adoption so complicated? I initially thought that the surrogate was refusing to give the babies to their biological parents but this is not the case. There was no need for the court to drag this out for so long.

I worked in MI as a medical social worker. I hated adoptions and birth certificate issues due to the very issues they’re involved in. I once had a case where the couple that had the baby wasn’t married but both married to others. Under MI law, they had to go to court to get the rightful paternity placed on paper. In Michigan, the father of the baby is presumed to be the one you’re married to and he gets named as father of baby. One must go through DNA testing to prove otherwise. Michigan has such antiquated laws out the $$$$$. But, of course.
