  • Fellow Patriots, On March 31st 2022 I went to the town of Irvington, NJ to peacefully exercise my First Amendment Rights (Freedom of Press) I was in Irvington because this is the town who filed a SLAP lawsuit against Elouise McDaniel I’m attempts to silence her and violate her rights.       Well, to be fair, the "oldest and most supreme law" (as you put it) doesn't say anything about filming people. That's not in the constitution. Many cases regarding the 1st amendment have been ruled on throughout the history of the US, and these rulings set precedent for interpretation considering new concepts. Much more goes into law than a simple, "just read the constitution". It takes more than that. A lot more.
      If things aren't brought to light then people aren't going to know about them. Cops are not lawyers or political historians. They aren't going to know everything.

      I did notice that as well, Brown safe to say is not a Charter member of MENSA. When the LiBerry director cannot enunciate the very place that he shows up at and steals Township funds from every 2 weeks is an abomination. Hopefully his birthday is not in February, because I’d hate to hear how he butchers the pronunciation of that month. Moving on, I believe once Sean said,” Lawyer.” And he only said it once, everything changed, cops demeanor, Brown’s policy enforcement stance, the whole sh-Bang. In my opinion, I feel that Sean could reach a bigger and wiser audience if he went to county or city meetings and educated those elected officials on 1st Amendment rights and freedom of press rights. I wonder if Sean has ever done that? Then come back to that county or city and see what happens? It would be an interesting experiment and could potentially make for a kick ass video? Jus sayin.

    The library manager is out of line and its disgusting! The law enforcement officers need to figure out why they swore an oath, and stop violating citizens rights. Good ending to the video, it shouldn't have gotten to that!

No qualified immunity, money come out of their pockets, not ours when they get in trouble, and they should have to have some sort of a degree in law to become an officer!       Isn't a 5150 a mandatory 72 hour hold in a mental hospital? It may vary state to state but that's a scary scenario. A cop can say you're crazy for not identifying yourself or complying to requests? WTF and now you get 72 hours in the looney bin with crazies, drug addicts, and sex offenders?     Sean, your advocacy is unbelievable.
    I just called the library which is around the 1 year anniversary of this video. I asked for Mr. Brown and was politely questioned as to the purpose of my call and my name. I said my name is Andy and that I had a question for him as library director.
    The lady clearly knew where this was headed and stated "I'm not sure if he is here right now.".
    So I politely asked her if perhaps she could answer my question, to which she replied "If I can, of course"
    I then asked her "Is it OK if I visit the library and took some pictures and video?"
    Without hesitation she replied "Yes, you may. It is a public building. We have a lot of people taking pictures and filming."
    BOOM GOES THE DYNAMITE!.

    I just want to say. Sargent Gonzales is an officer with the utmost integrity. A true peace officer. He is everything we need in every officer. The only thing I wish he would have done is told the manager you have the right to film and he must allow you in to do just that, upholding citizens rights should be his first priority. He made it happen, but should have happened immediately.

      LIA's "lawsuit" against the Danbury CT library was dismissed 3-30-2022. He never even served the defendants. He claimed they violated his rights and had the suit filed but didn't even try to follow through. Why? So he could invade this library too without the relevant case law being fleshed out?
      Such a con. Deletes 1st amendment speech that tells the truth. The government can't do that.

      I totally agree with Sean’s movement and nearly all his points. But it is a bit different. Organisations are following certain guidelines and working with the government. To stop crime and protect premises etc. And to be a security and evidence supplier. Individuals are not as trustworthy as organisations. Overall or on average! But I still agree that all the public should be allowed to record there interactions for their own security and safety.

    That supervisor was so worried about trying to get everyone to come together and shake hands over a compromise (which is better than what others in his position have done, escalating or treating the public like criminals, etc) that he failed to realize he could have instantly solved this entire situation by simply telling the library director, "You were mistaken, he has a right to be here and a right to film here."

    The sad part about this interaction is that the cops KNOW they can’t legally trespass him. Yet due to the fact that the library administrator is a government worker they’re trying to do everything they can to protect his delusion.

    I have to give Sgt Gonzalez some credit. Even though he should have known the Constitution Trump's policy, he did a good job deescalating the situation. And he probably learned from the situation. But more than anything else he appears to be a good cop.

      If you are a police officer, I commend you. It seems that dealing with argumentative, ignorant and bellicose people are part of the job.     Even though the Sgt. was trying to make peace, he still went against his oath up until the end. He swore to "support and defend the Constitution of the United States". He should have just allowed LIA to enter. If the library staff prevented him from exercising his rights by force, then the LEOs should detain the library staff. That's how it should be anyway.

      Doesn't the people in the library have rights as well?
      Doesn't Sean interfere with their rights?
      Also a public library is not a public forum.
      So, yes the officers were defending the constitution and what Sean didn't like it because it wasn't in his favor.
      Just like the lawsuit he had was dismissed, soon sean will be as well.

      @@thunderbird0024 It's a public building that is open to the public. It isn't any different than filming on a downtown sidewalk because it's all about expectation of privacy. Anything said or done in public, without any attempt of the individual to conceal it, is available to the public to be seen and heard. You can't limit someone else's rights to provide general protection of privacy in public because that would be discrimination.

    As respectful as Sgt Gonzalez was trying to be, this is still a big fail on him for not recognizing the disconnect between a policy which is unconstitutional and lawful conduct in public. He needs to get some additional training, it is sad that a supervisor does not know the law.

      I disagree. Sgt Gonzales was in a bad spot.He has no authority to override the Library Manager or their Policy regarding filming. If he had overridden Mr. Brown's Authority during the initial contact. then Mr. Brown would have felt compromised and most likely would have reported Sgt. Gonzales to his higher Ups. Therefore leaving Sgt Gonzales open to some form of disciplinary action from Police Brass. Remember the Library is its own entity and Managed by another authority other then Police. It is also considered to be a limited Public Forum by the US Supreme Court, Therefore Yes the First Amendment does protect the right to film or take photos when the person filming is located on a public street, a public sidewalk, a public square, or a public park. However it only provides full constitutional protection to expressive activities in a limited or non-public forum when those activities are CONSISTENT with the MISSION or PURPOSE of the facility, AND or are EXPRESSLY ALLOWED by the facility. www.oif.ala.org/oif/auditing-the-first-amendment-at-your-public-library/
      The old saying "You get more bees with Honey then you do with Vinegar." This was a great example of the fine Line Police Officer's balance on in the Performance of their Duties.

    This was an AMAZING one. You got to see everything happening here. The SGT knew it was unconstitutional but the other cops didn't. The education that was given was exceptional, This is the only way to make real change
