I have seen 1st Amendment Auditors back down when they have been asked, "Did you just take photos/video of this 'victims' children?" Actually, the law makes no distinction between taking photos of adults or children in a public setting -- YOU CAN DO IT -- LEGALLY. But many 1st Amendment Auditor cower to this question because they themselves might be concerned if an adult person took an interest in their children to the degree they would photograph them. It may be totally innocent but I am a parent too and the hair on the back of my neck would be raised for sure!! In this case "You constitutional rights end where the parent of that child's feelings begin...." in practice anyway. Nothing legally the parent or cop could do but you could take a bruising non-the-less.

Great audit, LIA! How these cops and public servants are not aware of landmark cases like Glik v. Cunniffe, which established in a unanimous decision by the United States Court of Appeals for the First Circuit that the right to film the police carrying out their duties in public was "clearly established," and that Glik's actions did not violate state law. However, the court also noted that the right to film public officials was subject to reasonable limitations with respect to the time, place and manner in which the recording was conducted. All of the legal and relevant factors were met by LIA regarding any requirement on time, place and manner. Furthermore, the landmark case of Brandenburg v. Ohio established concrete case law in which the united states supreme court stated: "before the government can punish speech, there has to be an immediate and specific risk of actual violence to a real person." It's quite clear that every singe public servant in this video does not know the laws of the land. I'm tempted to call and complain about the atrocious behavior that they displayed so ignorantly in this video.

This audit slipped away when they started the exercise of asking the employees if they wanted to be filmed, then throwing Sean out of each office. That’s when Sean should have stood his ground, although I don’t fully blame him as that leads to unnecessary arrest. Ideally explain its as if they are in a public park, office is not an unrestricted area, and there is no legal ground to remove him based on asking employees subjectively about filming, then explain you will go into the next one and this time refuse to leave, they need to think very carefully about what they are going to do next and the safety of their pensions. But then he’d have to get arrested and physically removed. Easy court win but with a lot of bullshit.

Anytime a person, with or without authority uses the phrase “listen to me” followed by “are you listening” is demonstrating that you have effectively removed their perceived “control” of the situation. As a Marine combat veteran I was so angered by the conduct of the staff and the police officers. I made it a point to contact the mayor and police department and demand they properly educate their employees on proper and respectful conduct towards its citizens and respect of the constitution.

The auditor maybe carefully listening for such things and making mental notes of it so when it it doesn't happen and the Law Enforcement Office makes such a false statement they can immediately say, "No... I was never told to leave the building..." and they are adamant about it and ultimately have the video record that will bear that out, So many times I see that... often even when the person is present and they can say, "Well... I am asking you know to leave the building" -- they don't even do that!! Why? Cause the auditor seems to know "too much about the law" to be a lay-person... maybe they are a Constitutional Lawyer looking for an easy law suit? LOL
I love how these cops asks questions and never ever lets you respond without cutting you off, it's ridiculous. I commend you for remaining calm & respectful because there's no way I could, those officers were so demeaning to you which says everything about what kind of people they are.. foul.

People that actually feel uncomfortable may not actually feel uncomfortable for good reason. For instance, someone may have an irrational fear of paper. This does not mean that paper is an actual threat to that person.

I have seen 1st Amendment Auditors back down when they have been asked, "Did you just take photos/video of this 'victims' children?" Actually, the law makes no distinction between taking photos of adults or children in a public setting -- YOU CAN DO IT -- LEGALLY. But many 1st Amendment Auditor cower to this question because they themselves might be concerned if an adult person took an interest in their children to the degree they would photograph them. It may be totally innocent but I am a parent too and the hair on the back of my neck would be raised for sure!! In this case "You constitutional rights end where the parent of that child's feelings begin...." in practice anyway. Nothing legally the parent or cop could do but you could take a bruising non-the-less.

The Officer Frank was doing everything he was accusing Sean of doing. Putting a camera in Seans face. Bothering Sean by following him everywhere he went. Putting his hands in Seans face multiple times. Harrassing Sean. Escalating the situation instead of deescalating it. Not hiding behind the Constitution. Great audit, LIA! How these cops and public servants are not aware of landmark cases like Glik v. Cunniffe, which established in a unanimous decision by the United States Court of Appeals for the First Circuit that the right to film the police carrying out their duties in public was "clearly established," and that Glik's actions did not violate state law. However, the court also noted that the right to film public officials was subject to reasonable limitations with respect to the time, place and manner in which the recording was conducted. All of the legal and relevant factors were met by LIA regarding any requirement on time, place and manner. Furthermore, the landmark case of Brandenburg v. Ohio established concrete case law in which the united states supreme court stated: "before the government can punish speech, there has to be an immediate and specific risk of actual violence to a real person." It's quite clear that every singe public servant in this video does not know the laws of the land. I'm tempted to call and complain about the atrocious behavior that they displayed so ignorantly in this video.

This audit slipped away when they started the exercise of asking the employees if they wanted to be filmed, then throwing Sean out of each office. That’s when Sean should have stood his ground, although I don’t fully blame him as that leads to unnecessary arrest. Ideally explain its as if they are in a public park, office is not an unrestricted area, and there is no legal ground to remove him based on asking employees subjectively about filming, then explain you will go into the next one and this time refuse to leave, they need to think very carefully about what they are going to do next and the safety of their pensions. But then he’d have to get arrested and physically removed. Easy court win but with a lot of bullshit.
That was crazy. It's a shame how those public employees act on ignorance of the law. If you went back there now, I'm not sure if cops would be straightened out.

Anytime a person, with or without authority uses the phrase “listen to me” followed by “are you listening” is demonstrating that you have effectively removed their perceived “control” of the situation. That is a last ditch effort to gain compliance through intimidation.
They were trying to get you to react to their actions in a manner that would then give them the grounds to remove or arrest you. Some auditors are just asshats who try to bait cops into reacting like these two were doing to you, I appreciate your approach because you literally allow them to “step in it” all on their own.

As a Marine combat veteran I was so angered by the conduct of the staff and the police officers. I made it a point to contact the mayor and police department and demand they properly educate their employees on proper and respectful conduct towards its citizens and respect of the constitution.

The lady at the reception area is not doing a job at all, literally stealing from the citizens. A sign on the wall does her job. That reception area was an afterthought and built for no reason.
I am also amazed that Law Enforcement will often make blanket statements like, "They asked you to leave the building but you refused." The auditor maybe carefully listening for such things and making mental notes of it so when it it doesn't happen and the Law Enforcement Office makes such a false statement they can immediately say, "No... I was never told to leave the building..." and they are adamant about it and ultimately have the video record that will bear that out, So many times I see that... often even when the person is present and they can say, "Well... I am asking you know to leave the building" -- they don't even do that!! Why? Cause the auditor seems to know "too much about the law" to be a lay-person... maybe they are a Constitutional Lawyer looking for an easy law suit? LOL
