It's ridiculous. If you put your art on somebody's body, you can't keep intellectual property of it by the most simple of logic. If I get a tattoo and somebody takes a picture of me, do they have to pay the artist? No. You were compensated once. That's all you get. You can certainly display the art, but you're not entitled to further compensation.

But even that's not necessarily an IP violation because it isn't the piece itself that is making the plot work (ex: you could swap in just about any painting that we're informed will sell for a high value and it will still work), the case of Tyson's face tattoo was specifically used in that movie *because* of the recognizability of that facial tattoo and Tyson's role in the first film; if they'd just tattooed something else on his face it wouldn't have been the same kind of joke (there are different tattoos you could use for the sake of a joke of course). Hogan sued because (allegedly) there were aspects of Russo’s promo which were not agreed upon when the worked shoot was being planned, hence the defamation of character claim. Supposedly Russo went “off script” with some of the insults he levied against Hulk, but no one knows for sure.
