Not just that, but the poor fellow is a USC student. If he were to be kicked out, he would've forfeited tens of thousands of dollars in tuition for nothing. Even if he attended another university, no employer in any field he'd be interested in would be likely to hire a felon over other applicants. Similar scenario is playing out with a sibling of mine right now. He's been expelled from the top engineering program in my country. He worked hard and paid tens of thousands to attend that program. However, luckily, there's evidence to the contrary so a conviction is inconceivable. Luckily, I'm in a fiscal position to bankroll a lawsuit on his behalf. Sucks a lot.
She didn’t do anything wrong pal. The police arrested this man because they found him in bed with an unconscious girl who he admitted he had intercourse with. It’s a double standard, a man sexually assaults a woman and he gets arrested (as he should), or a woman can make a false SA accusation and everyone will believe it in a heartbeat, but when a woman sexually assaults a man she’s still the victim while the man is made fun of and even accused of “enjoying it”.

She didn’t accuse him. The police were called because her friends had reasonable suspicion that she had been SA’d. Anyone who falsely accuses someone of SA needs to face jail time, not just cause it's the right thing to do but discourage the act all together. It makes it harder for real SA victims to come forward.

It's a serious issue that needs resolving, then you have this woman who is absolutely gross who just abuses the system and nothing happens when it clearly shows they were abusing the system. I fully understand, you cannot imprison those who "think" it happened due to obvious reasons, it will instill fear for people who have. However the case should be completely investigated properly before any claims are made, the person under watch with ankle bracelet so they can live their lives whilst it is investigated, and if they are guilty they go to prison, if they a innocent but the person isn't clear about it (too drunk or took their own drugs etc) then move on from it, and if the person clearly is lying, they go to prison. If I put and gender in there, I do apologize I tried not to, this happens to men and women, though less men are open about SA than women... It does not mean that both sides needs the support necessary to live their lives as happily as they can.

For men it’s “guilty until proven innocent” but not the same for women. Tons of my guy friends have been assaulted by women especially drunk women. If men started to REPORT things in the same numbers that women do, we might see this double standard change. I’d personally be happy to have true equality which means equal accountability. We should not view one sex as innocent and one as immediately guilty.
Nobody should be "believed". Accusations need proof in all crimes, especially SA due to the intense damage such charges can do to someone's life. The standard of proof really needs to be extremely high even if this means some guilty people remain free. It is better for 10 criminals to go unpunished than to imprison 1 innocent person.

In this case, yes. Double standards are here. Prettyyyy clearly. From what the video showed, why weren't the people who accused, received any kind of reprimand? Seeing two drunk people sleeping, and immediately accusing of a crime like that, friend or not, is pretty harsh. Double standards indeed.

And people who have been sa ed, most are too ashamed/afraid to report and the ones who do report, less than a few percent of the perpetrators get placed behind bars and its less than 1% for rape. Nearly all victims never get proper justice which is an enormous injustice that i feel is overlooked as mens main concern is being falsely accused of sa not that its an invalid fear. Its just theres far, farrr greater fears to worry about that are huge injustices and farrr more likely such as potentially being a victim of sa or the utter lack of justice for the victims
Shame he had to go through that. It can be devastating and can take years to get over. More important though is why she did this. If you don't find out why it will keep happening from time to time.
To bad they don't start charging these women for fake allegations. People think I'm strange because I have cameras all over inside and outside of my apartment as a single man. I been there and I will never not protect myself again. Even more strange according to other people is I downloaded a coitus concent form to be filled out before anything happens with a checklist of acceptable acts and what's of limits. In the last 10 years only 1 woman was willing to go through all of this and she was just a friend's with benefits agreed on by both of us. Other than that I've started single and to myself. Not worth the risk anymore.
Okay, It's a great idea, but some women might feel scarred at the fact that they are giving full consent to a stranger over their bodies, by writen. Which means that, if things go really bad (which by the way... happens more often than fake r-pe allegations), and they happen to survive, that document can be used against them. So I don't blame you for taking actions to protect yourself, but I don't blame them either for not wanting to go through it. As a woman, you're more vulnerable in those situations, signing something like that feels dangerous.
@hanashin7077 yeah might be but it's also more dangerous for me if they don't. Ever seen what other prisoners do to someone that goes to jail on those kinds of charges? They don't care if it was a false charge or not only that your papers say it. Mutilation stabby stab death no thanks. I'd rather go sexless for the rest of my life. I already got my kids out of this lifetime and risked my life doing so. Wasn't none of what I've had so far worth the risk of what those inmates will do to you as a man in there on those kinds of charges. To make things even worse the guards help them by releasing your papers into the wild so if you cannot afford bail until your court date they gonna treat it as true before you can prove yourself innocent. Happens all the time. They force people on those chages to eat their own feces mutilate them and kill them just to name a few treatments. Now you see why men have stopped dating or even dealing with women in mass? That's why american men are going to other countries where women are less likely to do that to them, where they are respected and cherished more. American women know this is what happens to men and they still make these allegations some studies showing 80% of the cases are false. Can't blame us for protecting ourselves.
Also, she's not at fault. Not the way you imply at least. Her friends accusing him and her going with it is the same as her making the accusation herself tho But waking up besides a random stranger and not remembering anything from yesterday could make anyone think they got ro0fied. How would you catch cases where the victims were drugged? But getting That drunk is totally her fault. And also her friends fault for not taking care of her in case they weren't as drunk as her was. But still, the law works this way in order to let real victims speak up. If they were punished in case they can't give enough proof that they got r@ped they would be afraid to speak up. They Are afraid to speak up even now for more reasons. Yeah, false accusations hurst real victims the (second) most but in this case it wasn't intentional. That's why it's not so black and white Still we need a better solution. Without the cams and a firm background with money and lawyers the guy would've been cooked. And also the double standards. Don't even try to sell this story with the roles reversed.
@@ItsMeBarnaby (* Copying here one of my other comments from here *) I'm more concerned about the double standards here Yeah, the girl can't remember and thought the guy ro0fied her or something and pressed charges immediately is understandable but this mistake got the dude into jail. I know, not accepting "not remembering" would enable drugging ppl but the worse and more dangerous argument that goes further is that "drunk girls can't give consent" and I think that's ridiculous Just flip the sides Imagine a man getting so drunk he can't remember and SAing a less drunk, willing girl. (* Because in the OG story the girl made all the initiatives, and did it pretty forcefully. If anything is considered SA it *Would* be the case if a dude have done the same) If the man would press charges wouldn't he became a laughing stock? Or wouldn't him ending up as the r@pist after the cam footage is up in the air? Being blackout drunk and not remembering wouldn't be an excuse for a man, would it? I believe it would even make things worse. Tell me it wouldn't be like "Of course he r@ped her. He can't even remember! He was so drunk he couldn't control himself for sure" It's just scary. Hearing stories like these takes away the fun and easy flow of clubbing and stuff In the end of the day the best thing you can do as a guy is to not hookup if either of you is drunk. It makes hookups impossible but you won't end up like this. Or at least that's the best idea I have 🥲 * Also for gals, don't get p1ss drunk. It makes you all vulnerable for bad situations or worse. This story was "just" a blackout hookup. There are Real dangers out there what you should try to avoid. * Also in both cases, getting drunk is your own responsibility. And if you don't know your limits and shoot over it then it's your friends "job" to take care of you in case they aren't as drunk as you are. Or at least pay attention for your buddies. It's a good act of kindness to get them out of the crowd, bring them some water etc. and making them know they took too many shots. Safety first * In cases of relationships, hookups and debates involving different genders always imagine flipping the sides. If the flipped story makes you feel the same about their roles then your point is close to be valid. Otherwise it's not. It could be even sexist by your own biases. It is fine but we have to root out those from our society. Edit: typos
@@ItsMeBarnabyDo you expect every college student who goes to a bar or nightclub to bring a breathalyzer with them? Also, let’s say a man and a woman go out to a club, and both get drunk. The woman is the one with the car keys, so she decides she’s fine to drive them home, and she hits a pedestrian on the way. If the woman doesn’t remember what happened the next morning, but the man does, who is held responsible? You’re effectively saying that the driver is innocent, and the passenger should be held solely responsible, because they should never have allowed the more intoxicated of the pair to make any decisions. I would say that BOTH are responsible, to *some* degree, but the driver is still the one who actually committed vehicular homicide. The passenger is not wholly innocent for letting their more intoxicated companion take the wheel, but it definitely isn’t *exclusively* their fault just because the driver doesn’t remember.
Sooo let me guess, the girl got off without any sort of warning? Absolutely baffling and disgusting. [edit: didnt realize it wasnt her that called the cops, but her friends. oops]
@@UnivrsalsuniverseThe friend is fine, if I randomly saw my friend passed out with a stranger, yeah id be a little worried too. She could have asked other friends what happened (because there was that one girl when she was making suggestive hand signals), or maybe asked around? (I was going to say ask the guy, but thats risky if you have no memory) So fact is, yeah she may have had no memory and was trying to protect herself, but she still went immediately to the most extreme option. Plus, its not even known if she really had no memory or not, that could have been a lie as well
And this is why I support cameras in public places. You can't argue with the image. This would save so many people the trouble of dealing with court cases.

Full Context: "I feel like this video glosses over some stuff, especially regarding the Arshia's level of drunkenness and the witness statements. General recap: Armaan and Arshia ubered to his frat house where his frat bros said she was too drunk and to call her an uber. The frat bros reported the incident the next day. Armaan and her took an uber to her place. One uber driver stated that she looked significantly more drunk than he did. They went the her dorm, and did the deed. roommates 1and 2 (rm) heard them. rm 3 sees partially and leaves to use the restroom. after the sounds stop rm 1 and 2 try to wake up Arshia but she was unresponsive. After Armaan leaves, rm 3 comes back and all rm try to get a response from Arshia by pouring water, blanket shaking etc. to no avail. At around 1:28 she is taken to the hospital and diagnosed with alcohol poisoning(BAC:0.325). The doctor who treated her stated that she was almost unconscious and was in no state to consent based on what he saw. After Armaan left the room he texted his friends: “Bro I fucked up. Or at least I think I did ... I don't know if this qualifies as sexual assault or not: this girl was blackout drunk but really wanted me to fuck her. Initially I said no way because she was so drunk and I didn't want her to make a decision she would regret the next day. After constant persuasion by her I finally agreed. And eve during sex, she was sloppy and all over the place But I did it anyways. And I feel so bad When she met me she was blackout drunk, when we had sex she was still blackout drunk. She could not walk straight ."

That additional context was much needed. Thank you.
Hol up, so r ppl just lying about him being falsely accused of SA? Bc she couldnt consent bc of drunkenness and it wasnt her who called the police.
@@Shapeshifter_V
She didn't even charge him. It was the DA who pursued the charges.
@@davidmays8974 bruh lmao thats what made me confused bc its stated in the video that the police handled it and the girl just said she didnt remember. Thx for the context. The fact ppl taking advantage of lack of context and listening skills in the comments is staggering. Since when is this related to false r@pe charges which is extremely rare compared to real r@pe charges that barely give the perpetrators any punishment if at all.
People forget consent requires being aware of the decision youre making. You cant consent when youre black out drunk. She had no recollection when she woke in the morning she might as well been unconscious. But he did have memory of it even if impaired he was conscious enough for the thought that he shouldnt be doing this to cross his mind. His frat bros pointed out that shes too drunk and should go home. The uber driver even noticed it. His texts the next day showed he was aware of the fact he took advantage of her. The comments here are so mob mentality. Minute long videos like this rarely tell the whole story. Men are afraid of being falsely convicted of sa, just be respectful and aware of the situation. Anything but an enthusiastic sober “yes” is a no. And if you have to ask more than once to thats coercion and still a no. Actual false accusations of sa are messed up and the accusers should be punished but also these false accusation stories are propped up to seem like an ubiquitous thing when men are far more likely to be victims of sa than to be falsely accused of sa because of how rare it is.
At this point guys need body cams more than cops.😂
Yup
Not worth the risk anymore.
watch the video again. you are projecting your fears.
@@hanashin7077 actually, you said the opposite. 70% of the time it's fake allegations.
My dude if you’ve been single for 10 years and are printing out s*x contracts, it’s time to rethink your life
And the woman doesn't get any punishment...
Yeah cause she didn’t even accuse him dude how come you can’t remember what has been said in a SHORT.
Also, she's not at fault. Not the way you imply at least.
Her friends accusing him and her going with it is the same as her making the accusation herself tho
But waking up besides a random stranger and not remembering anything from yesterday could make anyone think they got ro0fied.
That's why it's not so black and white
Still we need a better solution. Without the cams and a firm background with money and lawyers the guy would've been cooked.
And also the double standards. Don't even try to sell this story with the roles reversed.
@@ItsMeBarnaby
(* Copying here one of my other comments from here *)
I'm more concerned about the double standards here
Yeah, the girl can't remember and thought the guy ro0fied her or something and pressed charges immediately is understandable but this mistake got the dude into jail.
I know, not accepting "not remembering" would enable drugging ppl but the worse and more dangerous argument that goes further is that "drunk girls can't give consent" and I think that's ridiculous
Just flip the sides
Imagine a man getting so drunk he can't remember and SAing a less drunk, willing girl.
(* Because in the OG story the girl made all the initiatives, and did it pretty forcefully. If anything is considered SA it *Would* be the case if a dude have done the same)
If the man would press charges wouldn't he became a laughing stock?
Or wouldn't him ending up as the r@pist after the cam footage is up in the air?
Being blackout drunk and not remembering wouldn't be an excuse for a man, would it?
I believe it would even make things worse.
Tell me it wouldn't be like "Of course he r@ped her. He can't even remember! He was so drunk he couldn't control himself for sure"
It's just scary. Hearing stories like these takes away the fun and easy flow of clubbing and stuff
In the end of the day the best thing you can do as a guy is to not hookup if either of you is drunk. It makes hookups impossible but you won't end up like this.
Or at least that's the best idea I have 🥲
* Also for gals, don't get p1ss drunk.
Safety first
* In cases of relationships, hookups and debates involving different genders always imagine flipping the sides.

@@UnivrsalsuniverseThe friend is fine, if I randomly saw my friend passed out with a stranger, yeah id be a little worried too. She could have asked other friends what happened (because there was that one girl when she was making suggestive hand signals), or maybe asked around? (I was going to say ask the guy, but thats risky if you have no memory)
So fact is, yeah she may have had no memory and was trying to protect herself, but she still went immediately to the most extreme option. Plus, its not even known if she really had no memory or not, that could have been a lie as well
