Yeah but they have two problems:
A. If they appeal that holts the entire proceeding, and if Trump gets elected - he can legally pardon himself and can't be touched.
B. if they choose to issue different ones, they'll have to go through grand jury again, and if it fails - they can't add any of them ever again.
@@naosay Trump can't pardon himself for the Georgia case. Federal pardons don't work on State crimes. Only the Georgia State Board of Pardons and Paroles can pardon and I believe there is a requirement of a certain amount of time served before you can request one.
If the counts are not watertight the give grounds for appeal.
@@jonathans9710 thats right. In fact, Georgia state pardons can only be considered after the entire sentence is served along with another 5 years of no record. In other words, pardons in Georgia are designed to take things off of reformed criminals' records.
Don't panic, everyone. The judge dismissed these counts because they were not written with enough specificity. The charges can, and almost certainly will be, re-filed.

No one is saying whether they will refile or that even if they do that they will win. A lot of us are hoping they do both, but this is the most benign comment for you to hate on.

It shows how egocentric and cowardly dictators really are. They need absolute approval constantly.
I appreciate that the judge is taking this very seriously. He clearly wants this to be said and done. Being particular and forcing the DA to specify is a great way to make sure things go exactly as they should and make for concrete precedent going forward.
If it makes for a more solid, airtight case, without any minor bs loopholes, I'm all for it. Whether you like the turd or not, being a president is a big deal and the courts should handle it with utmost care.

Kinda disingenuous to refer to them as “random prosecutors” when they’re prosecuting the former president of the United States in a case that could not only influence the 2024 election, but the future of American elections. Idk about you, but I’d like to try to set as perfect a precedent and example as I could, and Fani Willis hasn’t been doing a good job of that.

@@jackmurphy8635 The claim of a conflict of interest needs something more substantive than, the two people on the same side slept together in my opinion. What is the conflict that would change anything? I.E. If she or he was sleeping with Trump, the judge or the defending attorneys there could be a conflict as they are all meant to be unbiased towards one another. At this point, Trump appears to be doing everything he can, throwing shit at the wall just to see what sticks and gets him off.

honestly it's a BS amount and just goes to prove how partisan all of it is. The property case in NY was by far and away the most egregious example as all debts were paid in full with interest. Not to mention the bank approved said appraised values with their team and independent appraisers.
Both sides are in the business of getting the most out of their best interest. One party wants the most money they can get for their assets and the other party is trying to manage the risk of loaning out the money. These types of transactions happen thousands of times a day.

If you don't think they care that they didn't get as much money as they could have, you don't understand banks very well. It's like lying about your income when you pay taxes. The IRS doesn't just want you to "pay taxes", they want you to pay the RIGHT amount. The bank doesn't just want their loan paid back, they want the RIGHT AMOUNT of interest that they are due based on the ACTUAL facts of the loan, because that's how they make money. The fact the appraisers initially fooled the bank doesn't pardon them now that it's been revealed they lied their asses off. TL,DR; if you or I did it, the bank would rake us over the coals, thinking Trump is subject to a different standard is blatant hypocrisy.

I remember listening to the Trump-Raffensperger call in disbelief when it was leaked. It's absolutely wild. If the prosecutors aren't able to get this one over the line then I don't hold out much hope for any of the other charges.

It’s so blatantly criminal. If this doesn’t go through, a president could get away with anything short of knifing a person live on stage.
Perfectly reasonable. The government needs to be very specific about what the defendant is accused of doing, otherwise how can it prove that the defendant did it?
I'm glad that they are going to have to refine the charges. There's an old saying, if your gonna take a swing at the king, you better not miss. So let's hope they narrow it down and remove any loopholes that the defense can use to appeal.
You never hear about anybody drilling down to that level of detail on all of these second amendment lawsuits. Now that it's explained to me, the case should be that we see this more often, not that this ruling is wrong.
because the big debate is on what the 2nd amendment actually means and how it can and should be restricted by the SC, which depends on your personal opinion.

The rules of procedure are the only guarantee you have of "due process under the law". They are very important, and it is refreshing to see a judge paying this much attention to it.
Damaging the due process guarantee is too high a price to pay to convict anything.
Problem I have with it is where is this level of attention when literally anyone else is on trial? _Only_ in this case where trial is virtually guaranteed to result in a conviction which would be harmful to the political party that is in charge of Georgia, and even then the excuse is flimsy. “Indictments need to be specific enough that defendants know what crime has been alleged” Literally everyone on earth knows what crime has been alleged and we know most of the extremely detailed evidence proving it too.
@@joeschmo3844 And that's why it has to be specific, why it has to be perfect. There are a lot of powerful people that don’t want it to go through. Any mistakes could result in him walking out on a technicality.

I've honestly given up hope of him ever facing justice in a court of law.
He's the president. If he gets charged, imagine the precedent that would set. Suddenly, every former president who tried to manipulate state elections could face an indictment!

Drop 'iffy' charges, pursue the solid charges with more vigor.
Nothing out of order, Courts do this sort of thing all the time in complex cases.

@@joeschmo3844 Iffy from a procedural perspective, i.e. more likely to lead to time-consuming challenges later on because of how they were written up. The judge implies that the dismissed counts have a case, but just need to be rewritten before going to trial. Better to not jeopardize the entire case over weaknesses in a small fraction of the charges.

It sounds like they will likely try to bring back these charges in a new indictment that will be more likely to hold up; in the meantime, anything already in motion that is likely to result in convictions without dragging on forever is a good thing.

The DA working real hard to see that there is as much delay as possible. In fact, given her unprofessional and unethical conduct, cited explicitly by the judge's recent ruling, the lead prosecutor just got ordered off and this case effectively goes back to go.

Here in California at least, when a judge grants a demurrer he can and should grant leave to amend if the plaintiff could plausibly amend the complaint to fix the issues that were grounds to demur. Surprised that Georgia doesn't have something similar and instead just tells the prosecutors to refile the dismissed charges correctly.
Georgia probably does have a means of doing that, or similar, but this judge, who has a wife and two small children, is doing all he can to avoid pushback in the form of a successful appeal or God forbid, a personal attack on himself or his loved ones. Just a guess, but after hearing what Stormy Daniels has been going through, it's probably correct.

Hell yes. If Trump were black or a woman, or both, he'd be into his fourth year of a 25-year prison term already, and we could be directing our attention to urgent matters, like Ukraine or Gaza or getting rid of Republicans obstructing the border bill.
How can the US system and its prosecutors be so bad Trump is still not even in court on these charges, let alone not convicted. Is the entire system working to protect him at every level?
Its more like there are enough scummy people who will support trump no matter what that they have to take every single precaution imaginable to prevent him from weaseling his way out of it, and that takes time. Now why they didn't start sooner, i can't really tell you.
Quite the opposite: it's working diligently and methodically to ensure that when he does go to court, he can't win on a technicality.
I will admit when Trump left office I did not want to see prosecutors waste time and money prosecuting him. I just wanted him to go. Sending an idiotic old man to prison seemed pointless. If the prosecutors only filed when they realized he simply would not leave, I can't say I would have done any better.

All thats happened is that the DA *was not specific enough* with the crime they were charging Trump with. As such, the judge dismissed 3 out of 13 (meaning 10 charges remain) felony charges because they were not specific enough. The DA screwed up, not the judge here.

If this happened on Law and Order, it would *definitely* be portrayed as a "the bad guy got off on a technicality" situation.
A lawyer on a different channel suggested that she thought Judge MacAfee was being too nit-picky. The dismissed charges related to solicitation of violation of oaths, which is one step removed from what those oaths are. If I asked someone to rob a bank and they declined, would it really matter whether I told them how to get there, which weapon to use, what kind of bag to put the money in, and how to escape? No, the act of soliciting bank robbery would be the fundamental crime.
Yeah I feel like the specifics could've just been stated in an opening argument or something during trial. If someone is on trial for murder, they don't have to document and outline how and when it happened or the different injuries on the body, etc. They do that during trial. Especially since multiple oaths and levels and positions are involved, does it really need to all be spelled out in the indictment? I guess an airtight indictment is technically a good thing but all of this has already dragged on too long. If this man doesn't end up physically behind bars, our country will have demonstrated how broken it is from top to bottom.
It sounds like law school exam stuff... The R in IRAC is the requirement to cite the rule that applies to the issue. The allegation is the oath was broken, well, what oath and what part of it (the literal text) needs to be cited with specificity so the defendant can prepare their defence.
The prosecutors' paper got returned marked F but, unlike law school exams - they can resubmit this with the fixes made. Maybe they were distracted playing too much hide the sausage in the office?...
It's even stupider than that. You asked the bank's own security guard to rob the bank. What the judge is picking at is the employment contract of the security guard. Is there anything written that explicitly forbids him from robbing the bank himself? I mean, he was given a gun, and nobody said he couldn't, so....

The failing of the indictment in question would have been closer to saying you attempted to suborn a felony, without specifying armed robbery. Your lawyer doesn't have enough information to prepare to defend you.
There is so much damning evidence IN HIS OWN WORDS that would have jailed any citizen 20 times over already. How much do we need? If its this hard to imprison someone that is obviously guilty through direct evidence, how is ANYONE in prison?
