    Do I put a check beside box B if I am an H2A-Visa worker from Nicaragua? We do not have a treaty with the United States.

      If you're a nonresident alien, then Box B might be the best choice, if no other box applies. For background, here is some info from the IRS website for workers with an H2A visa: www.irs.gov/individuals/international-taxpayers/foreign-agricultural-workers

      You can enter the date and phone number electronically. However, you do need to actually sign the form.

    Hi, not sure if i'm too late to the party, but I am Australian, and am required to fill out form w-7 to get a ITIN to claim US/Aus Tax Treaty. In the first section, what would I select? other? I live in Australia, so I wouldn't be an alien, right? if I select other, would I put into the description field? Thanks in advance.

      I'm not exactly sure, but if you're looking for tax treaty benefits, then option a might be your choice:
      Certain nonresident aliens must get an ITIN to claim certain tax treaty benefits even if they don’t have to file a U.S. federal tax return.
      If you check this box to claim the benefits of a U.S. income tax treaty with a foreign country, also check box h. On the dotted line next to box h, enter the appropriate designation for Exception 1 or 2, whichever applies (see Exception 1 and Exception 2, later in the Form instructions ). Identify the exception by its number, alpha subsection, and category under which you’re applying (for example, enter “Exception 1d-Pension Income” or “Exception 2d-Gambling Winnings”).
      Also, enter the name of the treaty country and treaty article number in the appropriate entry spaces below box h and attach the documents required under whichever exception applies. For more details on tax treaties, see Pub. 901.
      If you're using an acceptance agent to verify your documents, then the acceptance agent should be able to help you make the correct selection based upon your tax situation.

    Thank you for the very informative video. Quick question: I need to claim treaty benefits and file US income, in this case should I check both option a & b? Can we check more than one reason for the ITIN application?

      According to the form instructions, "If more than one box applies to you, check the box that best explains your reason for submitting Form W-7." I would select the most appropriate one...I don't believe the IRS cares which you select.

    Hello, im filing my return with itin renewal(w7) & I wanted to ask you if i can submit passport as a stand-alone document or do i need other supporting documents? Im not a dependent and im filing for myself.

      According to the form instructions, you cannot use a passport as a stand-alone document if you do not have a U.S. date of entry stamp on it. But assuming that you do have the required stamp, the form instructions indicate that you could use a passport as a stand-alone document.

    Also, I have another question.. for the tax purposes, since the ITIN is being requested and only sending the documents to the IRS, what happens to the state taxes? Do they wait to submit those when they receive their ITIN?

      I'm sorry that I didn't see this sooner.
      If you obtain an ITIN, I believe that state governments would accept that as an identifying number for your state tax return. However, I would check with the specific state to see if other rules might apply.

    Hello !! Best video ever about this topic! Thanks so much ! I need to submit one for my two parents but they both live in Mexico, I pay for more than half of their expenses/ - 1. what option should I select for the first part? Is it A?
    -2. The supported documentation to submit is to provide 2 documents or only one? They have passports and US visa,
    3- do I need to submit the original document or a certified copies ?

      For #1: You may select A, but if you're a U.S. citizen, and they're considered dependents of yours, then you might select D. If you're a non-resident alien with a visa, then it might be G.
      2: If they each have passports, then that is the only document each of them needs.
      3. You generally should submit the original document, unless you can get a certified copy . I don't think that's easy for visas, so you generally would submit them.
      However, here's an alternative: the IRS administers a program called "Acceptance Agent Program." This program allows certain tax professionals to verify your documents in person and assist with the application process. They have locations in the United States as well as Mexico:

      If any of those locations is relatively close to your parents, that might help cut down on the processing times.

    I am a Canadian citizen with some US dividend stocks in my RSP and need a TIN.
    The only document I have for 6d is my driver's licence.
    Is a certified copy by the issuer of my driver's licence acceptable or do need to submit the original.

      It seems that if you have a certified copy by the issuer, then it meets the IRS requirements (outlined below):
      "A certified copy of a document is one that the original issuing agency provides and certifies as an exact copy of the original document and contains an official stamped seal from the agency."

    I have a question. I am a non-resident alien in terms of a student in USA. I am looking to apply for ITIN number to get a new credit card. In the top section, what box should it tick in between a,b,c,d,c,e,f and what is it mean witht he word that for b,c,d,e,f you should file US federal tax return.?

    Hello You said they don’t accept the passport with no visa on it But my visa entry date is on my expired passport should I send both of them ? ( the new one and expired one

      The form instructions state that a passport with no visa entry date cannot be used as a stand-alone document. This means that you have to submit another form of identification along with the passport.
      However, the form instructions also state that the IRS only accepts current versions of documents, not expired versions. What I might suggest is discussing this with the certifying acceptance agent closest to you to see what other documents that you have that would fulfill the ITIN requirements, besides the current passport with no visa.

    ITIN is being requested for a friend and her living partner.. on her, they do not meet the entry requirements, so they will be answering (d) under her name.. but it has extra fields such as the name of her partner and the SSN or ITIN.. is it ok to answer the name and then right after - ITIN application attached?

      So (d) should be used if the partner is a U.S. citizen or resident alien, and that your friend meets the criteria as her partner's dependent. Under those conditions, then your friend's partner's name and SSN/ITIN would be in that space to the right.
      But if they don't meet the criteria for (d), then they might need to see how else they would qualify.

      According to the form instructions: Original documents you submit will be returned to you at the mailing address shown on your Form W-7. You don’t need to provide a return envelope. Applicants are permitted to include a prepaid Express Mail or courier envelope for faster return delivery of their documents and to ensure the secure delivery of valuable documents, such as passports. The IRS will then return the documents in the envelope provided by the applicant. If your original documents aren’t returned within 60 days, you can call the IRS.
      You don't need to submit a marriage certificate, but you do need to submit the documents that verify your identity as well as your status as a foreign citizen. According to the form instructions, a marriage certificate is not one of the requested forms of documentation, but could be used to verify a name change (i.e. from a maiden name to a married name).

      I'm not sure that I'm qualified to answer this question. I believe that it has to be stamped as part of your entry into the United States, not as part of a package that you're sending to the United States. But I'm not sure.

      I'm not sure. The additional info field is for either:
      Box A: a situation in which you're claiming a tax treaty benefit (which you have to cite the treaty article number for), or
      Box F: if you are a nonresident alien student, professor, or researcher filing a U.S. federal tax return or claiming an exception.
      It seems your situation is Box B: Nonresident alien filing a U.S. federal tax return.
      In this situation, you don't need to put any information in that field. Is there another situation that you feel is closer to your actual situation?

      Did you figure out what to put in that field, same for me. I know it is Exception 1d-? But not sure what to replace ? mark with. Also not sure which treaty article to use.

      If you're applying on your son's behalf, then your son's information should go in these boxes. At the bottom, there's a box that you can check indicating that you're the parent applying on your son's behalf.

      If your wife is a resident alien, then I think you would select E unless either Box a or b applies to your situation.

      I do not know for certain, but I do not believe that it matters, as long as you're able to provide another form of ID or documentation that verifies your current address.

    Can you please let me know where IRS said they won't accept a passport w/o an entry date to the US? My spouse is applying for an ITIN but she lives abroad and never enters into the US (think there are many people in this situation). Thanks a lot!

      I don't believe that the IRS has stated that they won't accept a passport w/o entry date to the U.S. If there's anything about the video that gives the impression, I apologize.
      However, the Form W-7 instructions clearly state that a passport is the only stand-alone document (i.e. you don't need a second document to establish either foreign status or identity). However, a passport is NOT a stand-alone document for certain dependents if it does not have a U.S. date of entry.
      In that situation, you would need to send a second document from the supporting documentation table in the form instructions.

    I am from The Bahamas and just formed an LLC. I am thinking that my reason for applying is (B). I have learnt that the supporting documents required are : 1. Passport 2. (2) Local Utility Bills in my name (from my home country) 3. US Company Certificate. Do I use my LLC certificate for #3? Thanks in advance for the reply.

      If you're applying as a nonresident alien filing a U.S. tax return (Reason B), then I don't know that you need anything except a passport. Here is the guidance, verbatim, from the form instructions:
      If you submit an original valid passport or a certified copy from
      the issuing agency, you don’t need to submit any other
      documents from the table, unless the passport is for a
      dependent and it doesn’t include a date of entry into the United
      States.
      However, I don't see company formation documents or a company certificate as a required (or desired) form of supporting documentation. However, if someone gave you different guidance, it might be worth determining where that guidance came from, and how it relates to your situation. I don't see it in the form instructions.

      You will need to work with the acceptance agent on making sure that your documentation is correct. Depending on the location, your acceptance agent should also help you ensure that your completed Form W-7 is accurate, based on your situation.

      I don't think that I can answer that question without knowing the tax treaty (or country that the U.S. has a treaty with) or what tax benefit you're trying to claim from that treaty. Could you give me some more info?

      According to the form instructions, you should pick the option that *best* represents your situation. So if you're not aware of the tax treaty benefit that you would apply for, then you probably should select (b). However, if you select (b), then you *have* to put down a foreign address in Line 3.

    I would like to apply for an ITIN for my wife, however, her surname field in the passport is empty, and her full name (First Middle Last) is given in the given name field on her passport. So I am wondering how to fill the W7 without any surname available in the passport. Any help would be appreciated.

      I don't want to give you the wrong answer, but I don't know what the correct answer is in this case.
      This website contains different ways (besides filing a Form W-7 by mail), that you can help your wife obtain her ITIN. I would suggest at looking at either Option 2 (visit a Certifying Acceptance Agent) or Option 3 (visiting a Taxpayer Assistance Center): www.irs.gov/individuals/how-do-i-apply-for-an-itin
      If you're outside the country, Option 2 contains lists of CAAs by country, as well as by state.

    If there’s no stamped date on passport how would we fill out the date of entry because we are filling out form as renewing an existing itin but she just got a new passport?

      You would fill out the date that she entered the United States. However, if there is no date of entry on the passport, then you might need to submit another form of identification, such as one of the following:
      -A U.S. school record
      -Rental statement from a U.S. property
      -Utility bill for a U.S. property
      -U.S. bank statement
      -U.S. state identification card
      -Driver’s license that lists the applicant’s name and U.S. address, or a
      -U.S. visa.
      The “Date of entry into the United States” must contain the complete date on which you entered the country for the purpose for which you’re requesting an ITIN (if applicable).

      @@shantanum3395 The form instructions do not specify which date of entry you should enter. However, since the instructions state that you should attach a copy of your I-94 (if you have one, in the Line 6c instructions), then you might consider using that date.

    Hi I am Canadian, just received 1042-s from my bank for my us dividend, this is the only thing I need to report. First, fill out application for us tin? I make check mark at A , H states that us dividend. Then mail out my certified Canadian passport and 1042-s I received from my bank. Is that all I need to do? Do I need to fill out any other forms? On my 1042-s, they already filled out by the bank, like income code, tax rate, total withholding credits, withholding agent’s name, EIN and my home address been entered by the bank, question is do I need to fill out anything from 13h to 17b? Please kindly help, need your professional advice. Thanks for a million . Liz

      I do not know what you would need to complete on your Form W-7. You might check box A if there's a tax treaty benefit that you're looking to claim. But if you were filing a tax return based upon your Form 1042-S income, then you might check box B.
      It seems that your passport should be enough supporting documentation for you to obtain your ITIN. But I don't know enough about your situation to say whether or not this is something you need to do. You might consider discussing this with a tax professional to see whether this is warranted.

      If you're the person who needs to file a tax return, you would definitely need to fill out the form. I don't know enough about your wife's tax situation to know whether or not she would also need to. My guess is yes, but I can't be sure.

      I'm not an attorney, so I can't give you specific advice. However, I've seen nothing in the form instructions or Publication 519 (U.S. Tax Guide for Aliens) that would preclude someone from requesting an ITIN based on their visa type.
      Below is what the instructions *do* say:
      The following individuals are eligible to complete Form W-7.
      1. Any individual who isn’t eligible to get an SSN but who must furnish a taxpayer identification number for U.S. tax purposes or to file a U.S. federal tax return must apply for an ITIN on Form W-7.
      Examples include the following.
      • A nonresident alien individual claiming reduced withholding under an applicable income tax treaty for which an ITIN is required.
      • A nonresident alien individual not eligible for an SSN who is required to file a U.S. federal tax return or who is filing a U.S. federal tax return only to claim a refund.

      • An alien individual eligible to be claimed as a dependent on a U.S. federal tax return but who isn’t eligible to get an SSN. Your spouse is never considered your dependent. For more information about whether an alien individual is eligible to be claimed as a dependent on a U.S. federal tax return, see Pubs. 501 and 519. Dependents can be claimed as exemptions only for tax years prior to 2018.
      • A dependent/spouse of a nonresident alien U.S. visa holder who isn’t eligible for an SSN. See Pub. 519. Dependents and spouses can be claimed as exemptions only for tax years prior to 2018.
      Note. The deduction for personal exemptions was suspended for tax years 2018 through 2025. For tax years beginning after 2017, spouses or dependents aren’t eligible for an ITIN, unless they are claimed for an allowable tax benefit. The individual must be listed on an attached U.S. federal tax return with the schedule or form that applies to the allowable tax benefit.     can you apply for a TIN for a girlfriend if living together for more than 5 years or do you have to be legally married in order to apply for a TIN for a spouse

      If you apply for a TIN on behalf of a spouse, the IRS will expect you to provide verification that you are indeed married to that person.

    Hi there, my husband is filing first time. Would he check the box for b or e, since I am a U.S. citizen? Also, what should he put down for foreign address? His Mexican passport isn’t stamped so can he still submit his passport?

      If you are a U.S. citizen, I would encourage your husband to use Box e. If there is no date of entry stamp on your husband's passport, he may still use it, but he would need to provide additional documentation. Your husband should use his foreign address in Line 3.

      Page 4 of the Form W-7 instructions contains a complete list of acceptable documents. I am not sure that your husband would receive an ITIN if you don't provide at least one of these items: www.irs.gov/pub/irs-pdf/iw7.pdf

    in your example how he has a date of entry to USA and doen't have a visa?

      I didn't enter any information about a visa. I'm not an immigration attorney, so I can't give legal advice. However, I imagine that there are scenarios in which people from other countries are in the United States without a visa. And the IRS publications and documents give specific information that don't necessitate the use of a visa.
      For example, the form instructions state: "Certified copies of a passport from the issuing agency must include the U.S. visa pages if a visa is required for your Form W-7 application." This implies that there are situations for which a visa is not required for a Form W-7 application.
      If there was a technical aspect of this video that is self-contradictory, I would definitely like to have a better understanding of the context, so I can correct it in the future.

    I’m married to a Mexican citizen what do I need from her? Marriage license we have,passport she’s got, but no date entry birth certificate she has ,and a voters registration card as well applying for a new itin#

      It appears that you have enough documentation.
      The form instructions state that you need 2 forms of ID. One form must verify the applicant's foreign status, and the other must verify the applicant's identity.
      If your wife's passport had a date of entry, you could use it for both (as a standalone document). Since it doesn't have an entry stamp, you can still use it as one form of ID. Then you can use either the birth certificate or the voter's registration card as the second form of ID.
