    How stupid is the staff at this bank? It took them OVER 50 DAYS to figure out if a GOVERNMENT CHECK was real or not. Let THAT sink in.

      @@MeneTekelUpharsin Money Laundering Laws go into effect with transactions over $10k. Many institutions start questioning the transactions at $2.5k. But this was excessive, the Max should have been the 10 days, not 50.

    A hold was not appropriate. A hold for 50 days was wrong. Closing her account was insane! Having to file a law suit was crazy! Having to put pressure on them with the media should not have been necessary! I am glad she got the money back but the bank should be required to pay her legal fees!

      Another black guy couple years back was arrested for trying to cash in/put in his work check. His boss(white man I think) closed his(not the black guys) bank account. I think I'm remembering that right. Cuz they arrested the guy for tryna get his paycheck(that's the word. So tired I couldn't remember. )

      I know this is true I get a US Govt check for Social Security and VA retirement and my checks are to be direct deposit in my bank account on the 1st of each month. My bank said we had to wait for the check to clear a US Govt check. So I called the US Dept of Treasury and ask them they said the US Govt check was clear the day it was deposited but they send them out a week 7 days before the due date. Under the Bank rules on post-dated checks, the fund is available the day it is deposited. So if the bank gets the check a week before it is due and waits up to 9 days after the 1st to post it in your account what are they doing with your funds? By the Banks holding a US Govt check that is direct deposited and not posting the funds in a person's bank account when the fund is deposited, the banks are breaking the law under the US Constitution under the 14th Amendment Section 4 * The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. *

    My Mom passed in March. I received an insurance payout for less than $5000 and BOA held that check for 10 days, written under their bank. I'm so sorry you went through that.

    That almost happened to me at Chase. I've had an account at Chase for more than 20 years. When I tried to deposit a refinance check for 25k from Wells Fargo, the teller called another teller over and they were examining it and asking me where I got the check. I was so mad I yelled at them, you don't want my check give it back to me right now! I took it to a credit union back where I did not have an account and they opened one for me and took the check and even asked if I wanted some of the funds.

    I stopped going to the bank to deposit checks over 15 years ago. I use my banks mobile app to take a snapshot of the check and deposit it electronically. The funds are usually available the next day. I would also suggest that you email your senators office and ask them to intervene on your behalf instead hiring an attorney and paying their extremely high fees. Glad that this elder was able to get her money back.

      I went to the court's website and read the full complaint of the woman's lawsuit against BofA. You can read it yourself if you google _Warren v. Bank of America, NA_ , Case No. 1:23-cv-03254).
      BofA had been notified by the government (Social Security Administration?) that the woman may have owed back taxes, so the account was frozen.
      How interesting that the woman never mentioned this to the news reporter. It's pretty goddamn relevant and important so the fact that she didn't disclose it makes me not believe one word out of her mouth. And the news reporter could've easily found this out on her own by questioning the woman's lawyer, but then again that would ruin the race-baiting narrative.
      Oh, and did I mention that the woman's lawyer (Gail Eisenberg) has just filed a Notice of Dismissal with Prejudice on June 16, 2023. That means the woman has dropped her lawsuit. The bank gave her back her funds with interest and the matter is settled. There's no discrimination, case closed.

    That happen to my husband when his mother died. It took him over a year for Bank of America to release funds from his mother’s account. He had all the right paperwork needed. And we still had to get our Attorney involved.
    So glad you got your money. God Bless you, I do understand your frustration and stress you went through. That’s a BAD BAnK!

    I’ve had a BOA account since 1996 and I am outraged at how the bank treated Charlotte Warren. At a bare minimum, the bank should have included interest on the money they refused to release for each day they held it. I am closing my account immediately and sharing this story with other account holders.

    This story and incident really hurts my heart for many reasons. For one because it’s entirely wrong, discriminatory and abuse of power. Simply put, this organization along with the Branch Manager and his employees were engaging in criminal behavior no matter how many false precedents they tried to hide behind. The reporter said herself that basically Bank of America could not prove or back up their reasoning for holding the check.
    It’s a shame that POC, Elderly and foreigners are treated this way; in my opinion, Bank of America still should be sued for what they put this woman through because if they were brazen enough to do it to her, they’ll do it again.
    Oftentimes, people in these positions think that POC, the Elderly or Foreigners do not know what their rights are or that they do not have any power. It is absolutely completely wrong to automatically assume that a POC is a drug addict, drug dealer or that their funds were obtained illegally. After all, criminals come in all different colors, classes and ethnicities.
    This video reiterates the fact that I will never open an account with Bank of America.

      Just be careful with banks .. period .If it's a new bank account you don't owe them unconditional loyalty
      All these new banks are opening where you can deposit checks . Just read the reviews and make sure they are licensed so that in the event of employees fraud computer error or what have you .
      Because of the Thunz activities with crime and embezzlement they are going to side eye all BLK people but especially BW . They expect us to admonish or punish bad behaviour which reflects badly on the decent folk .

    As a longtime BA/financial software analyst, that check and the customer’s background analysis is completed within Seconds. In some cases, it can take 30 min. because of a possible match of a flagged criminal name.
    B of A, will be writing a million dollar check to this lady. And I hope she makes B of A pay all legal fees.

    I just complained about an issue with BOA 2 months ago! I never felt so violated!
    In 2010, they put a Lien on my grandmas house after a fire that burned it almost to the ground, foreclosed on it, my father received the payout not them. They sued my father yet… it wasn’t their money! They refused to take care of the responsibility of the house! Black folks need to stay clear of BOA and WF

    I used to work for Bank of America back in 1996-98 and you can only place a hold on a check for 7 days and no holding for government checks.

      I recently deposited a lottery check for $17K to a Wells Fargo account. They held the check for 2 weeks then dolled the money out in small amounts over a few days. It's a nice win but relatively small still. With all the fraud out there I totally appreciate the banks being cautious on paper checks. It's odd this woman opened a new account to deposit this check rather than use her current account she's received distributions monthly for years. She could have requested a direct deposit of her reimbursement and saved the headache. She's not telling the whole story here.

    No punitive damages? If the bank thinks it may be suspicious for whatever (illegitimate and discriminatory) reason, put it through and see if it clears. I was a BOA customer for over 2 decades but they lost me for their constant nickel and diming. Stories like this seal the deal that I'll never do business with them again. I'm glad she got her money and hope that her quality of life continues to get better.

      There's a lot more to the story. I went to the court's website and read the full complaint of the woman's lawsuit against BofA. You can read it yourself if you google _Warren v. Bank of America, NA_ , Case No. 1:23-cv-03254).
      BofA had been notified by the government (Social Security Administration?) that the woman may have owed back taxes, so the account was frozen.
      How interesting that the woman never mentioned this to the news reporter. It's pretty goddamn relevant and important so the fact that she didn't disclose it makes me not believe one word out of her mouth. And the news reporter could've easily found this out on her own by questioning the woman's lawyer, but then again that would ruin the race-baiting narrative.
      Oh, and did I mention that the woman's lawyer (Gail Eisenberg) has just filed a Notice of Dismissal with Prejudice on June 16, 2023. That means the woman has dropped her lawsuit. The bank gave her back her funds with interest and the matter is settled. There's no discrimination, case closed.

    Bank of america did this to me several times. Holding my certified checks from Chase for two weeks. Certified checks are supposed to be as good as cash. Then they didn't want to give me my when I went to withdraw $10k.

    I know this is true I get a US Govt check for Social Security and VA retirement and my checks are to be direct deposit in my bank account on the 1st of each month. My bank said we had to wait for the check to clear a US Govt check. So I called the US Dept of Treasury and ask them they said the US Govt check was clear the day it was deposited but they send them out a week 7 days before the due date. Under the Bank rules on post-dated checks, the fund is available the day it is deposited. So if the bank gets the check a week before it is due and waits up to 9 days after the 1st to post it in your account what are they doing with your funds? By the Banks holding a US Govt check that is direct deposited and not posting the funds in a person's bank account when the fund is deposited, the banks are breaking the law under the US Constitution under the 14th Amendment Section 4 * The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. *

    Not unusual for certain banks to discriminate against color and class. I had a friend who could not go to a bank to open an account to put her paychecks in due to her skin color. And this still goes on in the 21st century.

      I know that black people commit a disproportionate amount of crime but when it comes to overall crime with the exceptions of murder and non negligent manslaughter and robbery white people commit more crimes because of them being 3 quarters of the population. I don't know why you say skin color when you could just say black but whatever. A white person is more likely to commit a crime that would be related to trying to cash a check with a large sum of money and obviously there's reasons that people come up with their ideas of other people and why they might be more cautious of some people when it comes to certain things. They look at the actions of those people. So with white people more likely to commit fraud or drug crimes what makes you think that being black would make a person more suspect. Obviously you have no proof but just pure assumption and your assumption actually makes no sense whatsoever.

    My mother had the same issue for a $10k investment check. Was with a different bank.She had to fill out forms and wait for the check to clear...even though she had a checking and savings account balance to more than cover this check and had been a customer for over ten years..she clearly has a history with this bank and can prove where the money came from..governmental overreach..Took almost 7 days for funds to be released... Real easy..don't like the bank?..fk'em..go to another bank. Lastly ...look at the food program fraud in Minnesota and the National covid funds fraud...our government watchdogs are more like lapdogs

      Transactions over $10,000 have to be recorded and reviewed by federal law. Been that way for decades. You cannot expect to get funds right away.

      I second what O’Hare said. It’s a federal money laundering law with physical checks. Plus, the banking industry, IRS, and Social Security historically has had high rate of having to deal with counterfeit, identity theft, mail and check interception by scammers. She could’ve had social security help her apply for the direct direct express debit card that has been an option in lieu of a social security or government check for over a decade.

      So at the end you bring up fraud. Do you not see why banks have these waiting periods ? It's because of fraud and their losses from it. This is standard procedure . My credit union does it too. If the bank could tell who was honest and who wasn't , that would solve everything wouldn't it ? Having money wired into your account solves this because that makes them " good funds" and available right away.

    What should be included in repayment was the interest earned while the bank had possession of the funds. Corporate greed, discrimination and willful action against the client should also be incurred for the aggravation including lawyer fees and client's inconvenience and time.     Happened to my uncle after receiving back payments of $14K and the bank, Banco Popular deemed it fraud, even with a letter and documents. He had to close his account with them and take it to Wells Fargo 😒

      Yes genius. Not only is it legal for banks to hold a check, they are REQUIRED to do so. Federal Reserve rules require banks to hold checks for a “reasonable period of time” , which means two business days for checks issued by the same bank and no more than seven business days for checks that are drawn from a different bank, which was the case here.
      It’s possible that a bank may impose a longer hold window on checks in certain circumstances if the bank can demonstrate that such a hold is necessary.

    I left them decades ago when they told me a direct deposit from my Employer, State of NJ was fraudulent. Mind you they had regularly received my paycheck for at least a decade. That same day, I went down there and removed all my money. I told them as soon as it cleared after the investigation, I'd be back for that too. Yep, they called the Manager and I sat in the office in silence. I dont even remember the justification. I said: Thanks and left. Credit Union, Investments, or under the mattress. Lol

    My mother passed and my dad received insurance death benefits. EVERY SINGLE TIME I went to conduct business on my dad’s behalf with this institution, I had to jump through hoops and red tape to access my dad’s funds.
    Whether it was on phone, in person or electronic transaction, it was ALWAYS something. When my dad relocated and was purchasing a home, I depleted my account to pay for the home in cash because I knew messing around with this bank, inevitably a problem would ensue…risking my dad to lose the bid for the home in an aggressive housing market.
    Once when my dad went to reimburse a portion of the loan, the BOA rep asked me “Why is you dad giving you money?” “Why are you using your dad’s money to pay your bills?” “Why does your dad owe you money?” Because of the hassle we always experienced, my dad was on the call an given me authorization to conduct business on his behalf.
    I thought I was on candid camera!
    The next dad I drove an hour to the nearest brick and mortar (of course there are not convenient branches nearby)and had my dad withdraw all of his fund and close the accounts. He banks with local credit union down the street from his home.

    Now this is ridiculous! I went to that bank one time. That was way before I found out how crooked they are. I needed to cash a paycheck that was drawn to their bank. The check was a pro I ate place in the same town and BOA. They told me that they charge 10.00 to cash a check even if it is drawn on their bank. Forget that… I went to a check cashing place that took only 1.25 I will keep my out of state bank that I have had for over 25 years!

      If you cash a check at any bank and you're not a customer, they will charge you money. It is usually in the $5-10 range. Either go to your own bank or a check cashing place.

    This is so sad! BOA did not have to go that far as to closing her account, nor keeping her check that long. They could’ve easily verified it; and it iterally takes 2 seconds to verify a Treasury Check.

    It only takes a matter of hours to verify a check and if funds are available in the account it is drawn on. Its none of the banks business what crimes may be connected to the check as long as it clears and the money should have been in her account the whole time even if a few days hold was placed on the funds.

      I worked in the Fraud department of a large bank for years, and it takes much longer than a “matter of hours” to verify a check. It can take weeks.
      Next time don’t comment on things you have no knowledge of or experience in.

    I was sent a pay out check several years ago from BOA. I tried to pay off a debt and BOA would not honor it stating it was too old. I closed my account and will never deal with BOA again.
