@lhl9010 Often times if one party (party a) builds a structure (even a fence) that encroaches onto the neighboring property, and the neighboring property owner doesn't do anything about it for a long time, that piece of the land becomes Party A's land legally. Idk about that particular jurisdiction but it's common in the US and I'd bet that porch and everything has been there long enough to make it her land. In Virginia it's covered under the adverse possession doctrine for example.

And now it could bankrupt the development company from the delays. I would say she is winning and in the end, it will cost the developer literally millions of dollars. If I were an investor in this development, I would be turning on the developer and suing him for ALL of my investment and costs for starting the development without previously purchasing ALL of the land needed. Usually, when a developer does it this way, they are unscrupulous in their dealings and should be avoided at all costs. The longer this goes on, the more chances of that happening. In reality, there will be people involved with this development who will go broke and/or could end up dying mysteriously or going missing because not all of the investors are legit people. These are notoriously great ways to "launder" dirty money. My wife and I invest in numerous developments all around the world every year. We have been involved in deals with Drug Cartels, Russian Mob, etc. While we have no direct connection to them, it is disturbing nonetheless that our money is tied up with their money in different developments. Most of all of our developments are Commercial in nature and often are in areas of blight in larger cities where old industrial buildings are torn down and replaced with our Commercial buildings, usually Office Towers. With the city stopping the development process, the developer will either have to make some very large and expensive changes to his plans or if they are lucky they will end up purchasing this woman's property at such a large amount of money that it will more than likely cripple the development and stop it or scale it down tremendously.

Then they get a bunch of investors to back them and if they are legit, EVERYONE is happy and makes lots of money. If they are scammers, the investors usually end up getting railed and the developer slinks away after getting a lot of money.

When the developer puts expensive houses around hers, it will be worth something but she probably won't be able to pay the increased taxes. She lost that home when all her neighbors cashed in and she refused so all that's left is waiting for her to sell it before she loses it from either imminent domain or because she can't afford the higher taxes she's going to be hit with. If her neighbors had banded together with her, they could have all kept the land, but clearly being the last holdout leaves her with only the court of public sentiment on her side, and only as long as the media covers it. Being that this is a minor feel good story, it's likely to never be reported on again and in a year or two she won't own the property.

Legal bullying exactly like this happens every day and has for decades. Especially directed towards elderly people because they know they won’t put up a fight. My grandmothers neighbor tried to bully her out of the beach they shared, little did he know that sweet old woman had millions of dollars ready to fight. How do you imagine the Heirs law is being ignored? The problem isn't that. The problem is because you might end up in a situation where 20 people are technically all owners of a piece of land, and 15 of them don't live in that community anymore, the developers can go to that 15 and ask them to sell. If those 15 want to sell and the remaining 5 don't, they can get a court order to sell as the majority. Then the developers can purchase the land. Heirs law dilutes ownership with every generation. That's the problem.

They also didn't merely ask to have the items (re)moved, they want to get PAID BY HER for denying them the use of their land. slowing/preventing their development, etc. It's a tactic to bury her in legal costs & fines to either get her to settle & sell cheap, or go bankrupt & pick up the land at auction. Legal & moral are often two different things.

I feel enraged by the intrusion of development into the remaining historic Gullah Geechee land. This lovely woman is also protecting the environment there. That means no improvements to the property and more importantly, constant repair bills over trivial issues. It happens every single day. I know atleast 20 people personally, that this has happened to. Out of all the 20 people I know, only 5 of them still has their land.

I feel so SICK - to harass a 93 year old in attempts to pressure her into selling what she rightfully owns. This is so disgusting that this company would stoop so low low. That's how they do there i have seen it for years when i visited my uncle and aunt and he would transport workers to the island . He would tell us all the stories of what was going on from his church members. That was in 1993 and up til they both passed 2000 and her in 2020. She has some Northern in her as well so they messing with a smart grandmother . Praying for her and she has a great team of people behind her. My mother in law was born near by in Ehrhart and father in law but moved to NY in 1940s then moved back after retiring in 1987. So visited there for many years loved going to the Gullah area. Developers have slowly crept in on the Gullah People for decades. The entire area should be marked as a historical site and protected at all costs to avoid further encroachment. @lhl9010 Often times if one party (party a) builds a structure (even a fence) that encroaches onto the neighboring property, and the neighboring property owner doesn't do anything about it for a long time, that piece of the land becomes Party A's land legally. Idk about that particular jurisdiction but it's common in the US and I'd bet that porch and everything has been there long enough to make it her land. In Virginia it's covered under the adverse possession doctrine for example.

This is so infuriating!! The prices they offered, the audacity of the lawsuit and scare tactics, and above all, always gentrifying an area that needs the trees and space. Leave the area and that woman alone
It’s so annoying that this 93 year old woman has to spend the last of her years being on edge and fighting a corporation for the sake of her children and their children, when they know damn well they could just leave her alone, if they weren’t trying to bully her into debt
And now it could bankrupt the development company from the delays. I would say she is winning and in the end, it will cost the developer literally millions of dollars. If I were an investor in this development, I would be turning on the developer and suing him for ALL of my investment and costs for starting the development without previously purchasing ALL of the land needed. Usually, when a developer does it this way, they are unscrupulous in their dealings and should be avoided at all costs.
The longer this goes on, the more chances of that happening. In reality, there will be people involved with this development who will go broke and/or could end up dying mysteriously or going missing because not all of the investors are legit people. These are notoriously great ways to "launder" dirty money.
My wife and I invest in numerous developments all around the world every year. We have been involved in deals with Drug Cartels, Russian Mob, etc. While we have no direct connection to them, it is disturbing nonetheless that our money is tied up with their money in different developments. Most of all of our developments are Commercial in nature and often are in areas of blight in larger cities where old industrial buildings are torn down and replaced with our Commercial buildings, usually Office Towers.
With the city stopping the development process, the developer will either have to make some very large and expensive changes to his plans or if they are lucky they will end up purchasing this woman's property at such a large amount of money that it will more than likely cripple the development and stop it or scale it down tremendously.

@@richardgibson2158 These are rarely big corps but usually small corps with one or two people running them. They are only corps for tax and security purposes. Then they get a bunch of investors to back them and if they are legit, EVERYONE is happy and makes lots of money. If they are scammers, the investors usually end up getting railed and the developer slinks away after getting a lot of money.

When the developer puts expensive houses around hers, it will be worth something but she probably won't be able to pay the increased taxes. She lost that home when all her neighbors cashed in and she refused so all that's left is waiting for her to sell it before she loses it from either imminent domain or because she can't afford the higher taxes she's going to be hit with.
If her neighbors had banded together with her, they could have all kept the land, but clearly being the last holdout leaves her with only the court of public sentiment on her side, and only as long as the media covers it. Being that this is a minor feel good story, it's likely to never be reported on again and in a year or two she won't own the property.
I'm glad to see that she has help with her legal costs. These people are such bullies. The encroachment claim is bull. If there is any, it goes back a long time before the company acquired their land. Them suing for "loss of enjoyment" is a pathetic, bully tactic. They pushed through with the project, despite not owing her property right in the middle. That only makes her land MORE valuable. How do you imagine the Heirs law is being ignored? The problem isn't that. The problem is because you might end up in a situation where 20 people are technically all owners of a piece of land, and 15 of them don't live in that community anymore, the developers can go to that 15 and ask them to sell. If those 15 want to sell and the remaining 5 don't, they can get a court order to sell as the majority. Then the developers can purchase the land.
Heirs law dilutes ownership with every generation. That's the problem.

That means no improvements to the property and more importantly, constant repair bills over trivial issues. They are ruining my home there. My family goes back in that area of SC and Georgia many hundreds of years mostly around Hilton Head to Savannah. They are wiping away the Gullah, Geechee culture and I think it is sad..

That's how they do there i have seen it for years when i visited my uncle and aunt and he would transport workers to the island . He would tell us all the stories of what was going on from his church members. That was in 1993 and up til they both passed 2000 and her in 2020. She has some Northern in her as well so they messing with a smart grandmother . Praying for her and she has a great team of people behind her. My mother in law was born near by in Ehrhart and father in law but moved to NY in 1940s then moved back after retiring in 1987. So visited there for many years loved going to the Gullah area. Visiting there soon to see in laws. Prayers to you all there it is gorgeous people there and awesome heritage.

The fact that they could’ve just gave this old lady peace, and pay the kids a nice amount of money for that land is true greed.
The offer was so low, she would not qualify for a down payment on a home in many of the areas in this country.

Developers have slowly crept in on the Gullah People for decades. The entire area should be marked as a historical site and protected at all costs to avoid further encroachment. There are bodies buried throughout. I really hope this story continues to get traction and the developers are exposed for their cruelty and disregard.

What's to stop them? She is the only person in the neighborhood who refused to sell. Now she's going to be left with a property that suddenly balloons in tax cost when it's surrounded by expensive homes, but nobody will pay her the increased value for it and then the tax burden will bankrupt her eventually.
