I would love to have seen you get a ticket just so you could go to court and create an interesting case for a judge to rule over, something that would become potentially historic and set a precedent for future self driving car.
Doesn't seem like it would be a dilemma at all. If you are operating your vehicle, you are always responsible for it, regardless of whether you're operating it remotely or not. If you are using autopilot, you are also responsible to ensure it is functioning properly and remain fully liable.
@@kevinklassen4328 I'd argue he's not operating it remotely any more than calling a taxi to your location would be. He looks to have no direct control of the vehicle other than starting and stopping the process and telling it where to go.
@@plasma070 The difference is a taxi cab has a taxi driver controlling the vehicle. If you are controlling the vehicle you are responsible for everything the vehicle does whether you're inside or outside. Until Tesla legally takes responsibility saying their vehicles are fully self driving and autonomous, which they haven't yet.

I kinda agree with the original comment that something like this would need to be tried in a court before we had a clear answer. @@plasma070 until Teslas are considered fully autonomous you are supposed to be ready to take control at all times. Including in summon mode if it's going to run a stop sign you would have to tell it to stop. That's in their policy for a reason. Good discussion though!

my 2011 vw golf had that feature. It was weird to sit and watch the car move on its own.
I was young once and didn't know my car had cruise control or what it really did... till i accidentally turned it on at 70mph and the breaks/gas pedals started moving on their own.
I bought a kia that does this.. sales guy didn't even tell me. I thought something was wrong with the car until I realised it was trying to keep me in the lane.

I think other officers might interpret this situation differently. Technically, by summoning the car, the owner could be considered as "controlling" the car, and therefore would be responsible for the car's actions. Either way, it's obvious that this feature isn't fully baked and I'd be very nervous about relying on it from a safety standpoint, especially in a busy, high traffic environment.

You could have a stop sign on a private condominium association property, and it would be enforceable because the association permits law enforcement of it. It also depends on whether or not disregard of a traffic sign has put anyone in danger. If that happened on private property even that would be enforceable.

In Florida police generally have jurisdiction for traffic violations on private property such as parking lots that are open to use by the general public.
This is limited to the boundaries of the city of their employment.
In the case cited the Pembroke Pines officer was in Cooper City and not within his jurisdiction as the incident initiated in Cooper City only.
They probably just had a cop friend and had him help film the video.

Moving violations only apply on public roadways. Private property is only trespass or maybe wreckless endangerment (wreckless driving). Also if a stop wasn't started on the roadway (lights not on) then there is no case.
In most areas, they can enforce traffic laws on private property, if the property owner gives them permission. Unfortunately in some states, they don't need permission if the property is open to the public
with this thinking, anyone who was getting followed by a cop who was about to turn his lights on but you pulled into a parking lot before he did.. would get out of a ticket.. simply not true in most cases
@@xxteep No your mistaken. If the police have probable cause to pull you over on a public road, they can follow you on to private property. But depending on the state, mostly they cannot enforce running a stop sign that is on private property.

So after seeing this video a friend and I engaged in a debate about the question asked in this video: "Who gets the ticket?" Will the laws be re-written to mandate that you take responsibility for the actions of your car? If you register a smartcar, will you be required to sign an affidavit showing you take responsibility for the actions of the car? Is the car manufacturer or auto-driver software company liable? The legal system that is in place today is *_not_* ready to handle this.

legally it's actually the owner of a car. However, the owner can sue tesla if tesla's software causes them grievance.

That's honestly a very good question. I understand that the car is the owner's responsibility, but they didn't create the software involved or the technology at work. I guess if it would be the owner's responsibility completely then they would have to sign something that says you understand the risks and take responsibility for the car. But that brings into question if the car is marketed that this feature is viable on the road then is that in a form of misrepresenting a product if something is to happen? That is quite a deep dive into a lot of things that have to be thought about in a scenario like this. This is honestly a really good thought experiment that is going to have to be taken into consideration with how technology is evolving.

@Chicken nuggets unless the parking lot is regulated and serviced by the state, city, or county you are not subject to the laws like a public road. This was in a shopping center which is definitely private property, you can drive around with your lights off at night or pass through a stop sign without stopping. If you were to receive a ticket you can easily get it tossed out.

Spot on about the AI and summoning, that's a big issue for Transportation as a Service (TAAS). Once that is solved, these cars are really going to change how transportation is perceived and applied.

Common sense would tell you if there was legitimate jurisdiction like an accident on a public street the owner of the vehicle in the case of Autonomous would be responsible for proper maintenance and lack thereof causing any accident would be that owner’s responsibility.

Agree that the tech has many “real world” challenges that currently prevent effective execution of options such as summons mode. I think that the driver is still ultimately responsible for any scenario because he or she made the decision to “activate” FSD. My test was very similar and I haven’t used it again since. Great video though!!!
This is exactly why I do not see states allowing vehicles to drive by themselves without having someone behind the wheel to take over the controls when the vehicle messes up. Just like with airplanes with autopilot, I think someone will always have to be behind the wheel. Luckily, this was in a parking lot and no one got hurt.

The idea of autonomous cars at first always brought the reaction to me 'Why on earth would you want a car that drives itself? I love driving'. Then I started to think 'Well, I don't always love driving, like in an unfamiliar city. It might be usefull then for some automation to take over', but then I've got the trust issue. How could I ever relax in such a car? Would I not be a nervous wreck? I would need some serious reassurance even when going at slow city speeds, but as to highways speeds I don't think I could ever trust it, so therefore what would be the point?
Easy reply: imagine the first few drivers to use 'cruise control'. Did they trust the car controlling the gas?

It is my understanding that the point of self drive cars is to allow you to take your eyes off the road, read a book, get on your mobile, whatever, even have a nap, you don't even have to sit at the wheel.
This sort of feature brings up all kinds of interesting questions. Not only traffic law enforcement but how the vehicle will respond to police and other emergency vehicles like fire and EMS. I am also curious to see how the insurance industry responds with liability for a vehicle "driving" in autonomous mode.
Tesla should have a "stopped by the popo" mode that rolls all the windows 9/10 of the way up and blasts "AM I BEING DETAINED" over the speakers.

Imagine how many dirty cops these driverless cars are going to fish out once they get fully normalized. If they're programmed not to break any traffic laws then they shouldn't get pulled over for traffic violations right? We'll see.
Sensors aren't flawless and will miss stop signs, yellow lines due to a dirty road, fail to yield to emergency vehicles, etc. There are a host of possible infractions that an autonomous vehicle can perform.
There is a video of a man sleeping in a self-driving car, the car passed the speed limit and police had to chase him. Hope they will make a new driving class for self-driving cars soon.

I just looked up the statutes in my state and it refers to the operator not the driver so whoever has the control to summon the vehicle is the operator because without you operating the device that tells the vehicle to drive it would not be in motion.

Im sure In the uk there are no road laws on private owned carparks owned by asda, sainsburys etc. Markings and directions are put there to make it a bit easier to direct high traffic flow but there is no law to uphold them. If someone knows different pls inform me. So in the states in these pvt carparks the road law still stands? They are allowed to pull u over and ticket you cos u went against the advise of that premises route/directions to follow? This seems just wrong to me
