@LegalEagle The allegations? They remind us that New York has been allowing the Trumps (and the rest of the oligarchy) to get away with this kind of thing for close to a century. They'll get a slap on the wrist, perhaps. The near-total lack of accountability among the rich is the key point here, and your failure to lead with it earns you a well-deserved, resounding Downvote.

I teach at a local college and have to talk about 3 hours straight for each class, and I can just imagine how physically and mentally exhausted Trump must've been doing that.

"Keeping two sets of books" is right up there with "Heading to my shed in the mountains to work on my manifesto" in the list of key indicators that you're walking an ill-fated path.
My dentist kept two sets of books and ended up owing $300,000 plus in back taxes and fines and spent a short stint in federal prison. Not sure why she did it as she was and is an excellent dentist. Her partner did the same. Lesson: don’t cheat on your taxes. Eventually they will figure it out, especially with the hiring of more agents.

As a person who has sat on a grand jury hearing the 5th amendment answer for 1 hour was horrible. I can't imagine how 4 hours felt.
I feel like I’d get angry at the prosecutor for continuing to ask questions more than the defendant refusing to answer. Go too long and you might lose your jury.

Meaning, if the prosecuter asks you did you commit this crime, you can refuse to answer because to lie and say no, is perjury. when the lawyer asks open general questions, like, what did you see? You can't play the fifth. But if they ask you where were you, and you were doing that, or a entirely different crime that they don't know about, you can then.

The problem with our justice system is, if that I had broken any of the laws that Trump might have committed (I know I know), I would already been in jail. I can't afford top lawyers to delay delay delay. I think some discussion about the faults of system would be interesting. I know you touch on it with certain cases, but would be interested in your thoughts on what could be better.
They bring up the unfairness of those with and those without money all the time, particularly when two parties facing off are those of widely-unequal financial standing.
The only way to break those laws in the first place is to be rich.
@@KOVIK Can anything be done to make the situation fairer? It seems to me that there is a distinction between legitimate appeals (unaffordable to many) and un-serious delaying tactics. Delaying tactics which include deliberate non-compliance (which incurred the $10,000 a day fine) and insincere appeals. There may be technical solutions to the delaying tactics, and there is a good argument for legal aid for legitimate appeals for those who could not otherwise afford them. But these are overwhelmed by the sheer scale of the legal representation and court time that money can buy. The injustice is essentially a function of wealth inequality. As long as wealth exists and can facilitate access to the system, injustice will be felt in cases like these.
Maybe reforms such as heavy fines for delays which were later proven frivolous, or more affordability-scaling of financial penalties, or the rationalisation of the hierarchy of different courts (i.e. have fewer levels of courts), could help? But these would face overwhelming opposition from those who would stand to lose: corporations and the wealthy. Or worse, the implementation of these ideas would get twisted in the process of law making and lobbying, so that the rich were exempt in practice.
The entire state and federal system of laws and courts was constructed, from the constitution onwards, by and for wealth owners. Ironically the meaningful rule of law is now threatened by monopolists (think Peter Thiel) and outdated historical wealth such as the Trumps and the Kochs. As wealth consolidates, the principles of competition and liberal freedom are undermined or made irrelevant by economic reality. Economic liberalism makes sense where the market distributes power as widely as possible between equal (or at least comparable) participants. As such, liberalism becomes irrelevant, not only to those who lack the invulnerability of extreme wealth but also to those who have it. I hope America is able to think seriously and openly about what comes next and how to keep power (and therefore exercisable rights) distributed widely. Trusting the government and the judiciary of the day to do the right thing has been proven insufficient.
@@KOVIK perfect example is traffic fines. $200 is a lot for someone on minimum wage but nothing for someone making $100,000.
Totally agree, you wouldn't have had the chance to do all this illegal stuff because your would have been in jail way earlier. Justice may be blind but that scale is obviously used to measure wealth.

My favorite part is that, when accused of undervaluing assets to defraud the Government of Tax dollars and/or overvaluing assets to defraud financial institutions, his defense and main talking point has been that defrauding banks is too hard because they do their due diligence to verify property value. Which is, effectively, an admission of guilt of tax fraud
As much as I would like to agree with you, that's bending logic a bit too far. That's like saying someone is automatically guilty for trying to give reason. Off the top of my head - something stupid would be like an HOA or something - "Hey, I got this fine on my door for repeat offenses of not keeping my lawn mowed. But, I have kept my lawn mowed - all you have to do is look in your records! Those fiends come around every week diligently to make sure there's not some kind of little thing they can charge you for, and I've never been charged for anything..." etc.
I don't know, random example out of nowhere, but we gotta do better than that if we don't want to get pilloried be the dolts. :)

@@MandrakeDCR But the logical point is that a property can't have two realisable values simultaneously. If you're acting in good faith and you've got a valuation endorsed by a bank, then that's what you declare for government/tax purposes... or vice versa. Really, for both (and insurance purposes) the most recent 'snapshot' should be used... with a bit of wriggle-room for rising/falling prices.
Sure, the actual court case(s) are much more complex in terms of proving the allegations, but in terms of setting off any ordinary person's BS detector that explanation from Trump should be sufficient.
@@jajabez8379 That's my point. We have to go on the assumption that this is the absolute truth that there are two different values which haven't been provided yet.
Plus, we also have the problem of the previous attempt to 'get him' on tax records... where it ended up that he was not only paying his taxes, but he was paying an order of magnitude more than what he needed to in some years, just in case so as to offset some of his projects.
Basically, I'm kinda tired of getting kicked around, every time there's a 'revelation!' or lawsuit and people keep jumping onto the logical fallacies that don't have any basis unless we have the underlying truth of it first. I'm tired of everyone following everyone blindly. It's rubbing off on both sides now.

I would like to thank this channel for all the legal knowledge it shares. I'm taking a module at uni that includes law, and even though it's in England and is about English law while this channel covers US law, there has been a number of times where I've recognised a word, definition, or concept from this channel. It's made what other students think is a boring and pointless module into something that I'm finding really interesting. While I don't have any intention of studying law as a main subject, I enjoying learning about it.
To be fair a lot of the U S criminal law is based on English common law.

They don’t call it the Anglo-American legal system for nothing! Some of my 1L textbooks had English cases in them to teach us where some of our jurisprudence came from.

The fraud is blatantly offensive, but what irks me more is that I feel like this practice of accounting tomfoolery is quite widespread among people who have a lot of real estate. It would be nice if more prosecutors could find it in them to get such people back on the accounting straight and narrow.

As a NYer who had to live in a property that his son bought...and then was kicked out after living there for years because of rent hikes. I will never be tired of this man getting bodied by lawsuits. I will always have my arms wide open for whomst ever sues this man into oblivion. This must be satire, right? I mean I'm sure this guy is a good or even great lawyer but he is so boring. Every few minutes his voice turns into the teacher from Charlie Brown and my eyes glaze over. I think because it's not technically their circus, nor their monkeys, as it were. Like
was stated in the video, they handed over a lot of this evidence to the IRS and other authorities. I think they also need a victim to press charges in order to go to trial, but I could be wrong on that. Plus, a criminal case might not give them the relief they'd prefer, that being for all these people to be unable to operate a business or borrow from New York institutions ever again. That's more often a civil punishment than a legal one, from what I can figure.
I'm not happy that a new speaker was brought into the Eagle Cinematic Universe without some sort of teaser trailer of Devin recruiting him like Nick Fury.

You have a good ear for writing then! Plenty of people can't tell one narrative voice from another, not that it's a highly useful skill to have. But, yes, you can tell the script writing beats are mostly the same, with some input from other parties, probably what Devin felt he needed to include.
The cadence of Devin's videos is one of my favorite parts! He gets to the point quickly and doesn't waste my time!

Something that is never discussed about pleading the 5th, answering a question may not prove they are guilty of the crime they are being questioned about, but could show they committed another crime, or act they don't wish to know. For example, A person is accused of robbing a gas station. At the time, they were across town, shoplifting auto parts. They know they aren't going to be convicted of the robbery, so why admit they were shoplifting? Or they were across town having an affair, and they don't want that to be known.
While nothing could be done about it, concealing an affair is not sufficient justification for pleading the fifth. Not unless the affair also involved crimes.

I think you're an important source of clarity on a topic that's often obfuscated and spun in ways that bear no resemblance to reality. The legal issue I’m fuzzy on is, what’s to stop him from just throwing lawyers at the problem forever? Appeal the appeals until hell freezes over? For him, another lawsuit, another indictment, it must be Tuesday, right?
The US court system only has the legal obligation to grant you a single appeal. They may grant more, but they aren't obligated to do so. Most of the time, you only get one shot at an appeal. If the relevant Supreme Court doesn't want to hear it, either on a state or federal level, they don't have to. And most of the time, they don't. So, no, you can't just keep appealing ad nauseam. That'd be a massive waste of the court's time, and of money.
