Ive read a lot from non-lawyers that he never expected to win this case and that this is just a delay tactic to stall until midterms where he hopes the GOP will retake the house and senate. Is this a sound theory or has trump hurt himself more than helped with the special master?
@@ignitionfrn2223 same here cause before that case I was under the impression self defense meant that- defense, so when you're no longer defending but are actively offending you've crossed the line. Now you can call me a bitch, but I'm not willing to put that to the test, so I'll keep running from fights until I get a clear answer cause I like my freedom and not being bent over against my will.
Dearie has done a phenomenal job showing how a Judge should actually rule on this case. Cannon should be removed from the bench for her nonsense.

There will almost certainly be behind the scenes actions that will all but end her career progression after this. This was her application for a political position from Trump in the future. Now, unless he wins again, she will never move forward professionally.

I read the document. It was great, a real blow by blow of how laws and logic are supposed to work and all the ways Cannon and Trump failed to understand both.

Her reasoning for the documents being possibly damaging reminds me of that bit in Liar Liar when Fletcher objects and the judge asks him under what grounds and he says "because it's damning to my case!"

Hopefully, this is ends up as step in the right direction to holding United States' politicians accountable for their crimes. Too many politicians get so prolific and powerful that they are above the enforcement of the laws that would have every other normal citizen put away for years.

Trump did a lot of crimes before he became president, so it is rich people as a whole who are not held accountable. If Trump was treated like everyone else, he would be in jail and never could have run for president.

Because I am willing to bet that according to the CURRENT President those documents marked classified are in fact classified. @@bryanbenaway5411 Classified documents are only declassified when they have been marked as such. You can't "declassify" with telepathy or mere words, no matter who you are. Those procedures were from an Obama EO that Trump never rescinded (you also can't rescind EO's from prior Presidents with telepathy).
@@bryanbenaway5411 That's not the way it's done. However, aren't we are discussing documents still marked "classified?" So why were they still marked classified if they weren't? Trump hasn't been in office since Jan 2021, so he has no right to them anyway. In addition, some of the documents found in Mar-a-:Lago are highly sensitive documents that only belong in a SCIF which stands for Sensitive Compartmented Information Facility. They should never have been kept at Mar-a-Lago. In any case, all of the thousands of documents, classified or not (except for the former president's personal property) belong to the government. Period, end of story.
Was one of the arguments literally "The govt. can't have the documents b/c Trump will come to harm if/when the documents are used to prosecute him for breaking the law"? Like, wouldn't that invalidate literally any search and seizure of any person ever?
Which is exactly why Legal Eagle mentioned there is a supreme court ruling that sometimes it is painful to be a citizen because you have to be subjected to searches in the process of your own prosecution, even if you are later found not guilty.

Trump and Co's roundabout on the fly "this is how it works" attitude reminds me of those skits of a young guy in a show or whatever making shit up as he is being confronted. I think it’s clear that Cannon was letting her personal opinion of Trump override what should have been common sense. Ruling in favor of Trump and aiding him should be enough to remove her from the bench.

Her big mistakes were 1. helping trump, and 2. thinking he'll keep his word.
I think that would require an impeachment, which in our political climate is almost impossible.
The only way an impeachment can happen any more is if the judge does something really bad and one party holds the majority of the house and senate as well as the WH to impeach and appoint whoever they want to replace.
I don’t see how anyone can come to any other conclusion. She made an unprecedented ruling to defend the person who appointed her. The corruption and conflict of interest is glaring and obvious.
Cannon just overruled Dearie and moved the deadlines back to December. Is there no remedy for such a blatantly corrupt judge? She is practically acting as Trump's defense counsel.

It really is insane how our country is the only developed democracy that has election officials and judges picked by politicians. In most other countries, elections are run by independent commissions and judges picked by independent legal experts. Of course, ANY system can be corrupted, but I guarantee you that no Judge Cannon's ever would have made it to a federal bench if the American Bar association was in charge of approving judges (or at least had a veto).

I think it's rather odd that Cannon is sticking to Trump at this point. She has a lifetime appointment. That means that sticking to Trump is optional. Moreover, she's not incredibly old, so she has a long career ahead. Trumpism is unlikely to be how things work out in the long run. She's destroying her credibility now, potentially opening herself up to impeachment, and for what? Surely she isn't dreaming, like some congresscritter, of a dream lobbying job after retirement.

If you listen to Roger Stone talking about the election months prior where he talks about "our judges" you start to understand why Trump appointed more judges than anyone even after he was fired and why it's problematic.

Trump appointed so many judges because McConnell held up judge appointments for the last two years of Obama's term, not just the POTUS appointment.
What you say is completely true but doesn't get to the root of the issue. The whole confirming of judges at breakneck speed wasn't DT's idea, he as ignorant of that process as I am of performing brain surgery. The plan was/is McConnell's and it's about being able to control the country even when Republicans are out of power inside the beltway like they presently are. Looks to be working to me!
Actually, Biden has appointed more judges than Trump at the same point in his term. I think it was as much as Trump, Obama, and George W. Bush together. If Biden keeps the pace up as he has been he will definitely appoint more Judges in his 4 year term than Trump did his.
@@donkrapf McConnell most certainly stole hundreds of judgeships, including 3 Supreme Court seats. But, at the same time, Obama screwed up by not making appointing judges a major priority for the other 6 years of his presidency.

Trump: Now, I want a special master!

Special Master: Okay, provide evidence for it.
Trump: Um......The entire system is corrupt!!!!

It seems like the 11th Circuit dealt with Cannon the same way a law professor would deal with a first year student who just turned in a poorly written exam. She should resign from her post in disgrace. Everyone who appears before her in the future will point out how bad she is at her job and that any decision she makes is suspect.
I'm an attorney too. Although it was appropriate, I was surprised a bit by the severity of the language in this opinion. It was scolding, even mocking, Trump and the district court judge. It's about time that Trump gets that. It's frustrating seeing him using utterly spurious arguments in court.
I think the Courts can still actually be shocked that a former President can go so off the rails. The smackdown is a proportional response to the current, and potential future threat level of assertions by Former gov't officials. And thankfully, is already setting precedent with the ruling. (See Mike "Pillow".)

And even more so the trend of them making misleading to outright slanderous public claims relating to the cases which they are unwilling to make inside the courthouse, and again having nothing happen as a result.
If those people (Trump team and Cannon) had any self respect, they would be mortified by that opinion. It's like saying "not only do you not understand how this works in general, you don't have a f'ing clue how to apply the meaning of the most basic parts." BURN!
It's not scolding or mocking. It's simply stating the facts. But when you state the facts about a narcissist that's used to getting away with everything, it inevitably sounds quite harsh.

Playing stupid games that support the argument that the system is corrupt and biased needs to be smacked down, hard.
If they can’t maintain the veneer of justice and honor and other glittering generalities, who would follow their rulings?
Things like Cannon getting smacked should happen much, much more often. Corruption and favoritism are lethal to the credibility of the system, and credibility is the only reason it means anything at all.
That lawyers like Powell haven’t been disbarred for their obvious fitness and character issues also raises serious questions.
Not that the cynics will ever be convinced that the system is anything more than just “pay enough money and you get the ruling you want.”

As a trial lawyer myself, I truly enjoy your videos and subscribed to your channel for a while now... along with other informational content providers.

If anyone deserves that treatment it's honestly Alex Jones. I'd say he is even worse than Trump at handling the legal system.

The only issue I can see for punishing people for nonsense lawsuits is the question of who's gonna be deciding what counts as a nonsense lawsuit.
@@peggedyourdad9560 Don't judges already decide what counts as a nonsense lawsuit? They can call it frivolous, dismiss it, and even ask the plaintiff to pay for the defendant's attorney fees.
Cannon’s initial ruling could conceivably have been bad “judgement”. That said, from an outward perspective, it certainly appears to have been less than impartial. Could she face any of her own legal fallout?
She straight up said she's not impartial before she hear any argument from both sides. As if being failed president is suppose to be granted immunity from rule of law

As great as it is that Dearie is finally putting Trump's legal team to task for their BS, it should have never gotten to this state to begin with. Cannon should have denied even having the motions brought before her. The only positive thing is that the Trump team is finally learning that delays and misdirection can only go so far in the US legal system.
And Trump bringing up Hillary's emails...I know he was trying to deflect but holy crap that was the most insane and most awkward way I've EVER seen someone do the deflection thing I have EVER seen. Very clunky, very awkward... That's the level of something who just heard about the deflection tactic the day before and decided to try it out, not knowing how to slide it in in a natural way.

It almost makes me wonder if he actually does have them ,and it holding them to keep some kind of leverage over the Clintons or others who he thinks could be implicated.
But ironically it would also be illegal for him to knowingly have possession of her emails with classified materials and not tell anyone. I've never seen someone so mentally entangled by an opponent they didn't even lose to. For which said opponent doesn't have political power nor relevance enough to even be worried about. If you want the biggest definition of a sore winner and a sore loser, at the same time, his picture needs to go there.

The real question is: why is "Judge" Cannon still allowed to practise law under her current position? She not only knowingly and willingly involved herself in a case in which she has DIRECT conflict of interest (her job being granted to her by the defense), but then also openly sided with him (her employer) in a manner in which basically all other independent judges agree was not actually legal (and furthermore not even well-veiled in its corrupt purpose).
If she continues to hold title in her current position, it will be a testament to law ruling over justice in this country, rather than justice ruling the law -a testament to a system that is fundamentally broken, where judges can be openly bought and never challenged in their corrupt actions. And if our courts of law cannot be trusted......well, then we are in total chaos and anarchy, then we are back in the dark again, uncivilized and without greater purpose, no higher ideals to be protected and lived by in pursuit of grand dreams.
Glad to see the special master and the 11th circuit actually doing their job.
12:12 That removal of language didn't just mean that Judge Dearie wasn't required to submit reports and recommendations, it meant he wouldn't be allowed to. It's entirely irrelevant to the 11th circuit ruling, its removal was another disgraceful attempt by Cannon to do Trump's bidding and sneak in a delaying strategy and Judge Dearie just called her out on it.

I'm just now realizing that they picked this specific special master not because he was a republican but because he was old and they thought that would allow them to drag out the legal proceedings and stall and delay.
I still think the special master could be totally in the bag for Trump. I don't believe they would appoint someone they already confirmed would be on their side.
My guess is they know the problems with classified stuff is unavoidable at this point, but there is some much heavier incriminating stuff in the seized documents that they are really working to block the DOJ from seeing. The special master is making moves and comments now to create an appearance of objectivity now, but will bend over backwards to block the DOJ from seeing anything else.
I read some where that they choose him because he was part of the investigation of Trump on whether Russia interfere with 2016. This could play of role of prejudice maybe Trump team could bring up though wouldn't make sense since they picked him. But more importantly the investigation did not really end well for Dearie mostly making mistakes in part of investigation. As we know eventually didn't lead anywhere. So they are probably hoping he makes mistakes and Trump gets away.

3:38 Note for those who arent privy to how the Circuit Courts work, a "unanimous" decision by those courts is not a decision made by all 11 judges. It is a decision made by 3 randomly selected judges out of those 11; in this case, two of them were Trump appointees even.

Cannon keeps going back to this loopy notion that he has some sort of rights over ANY of these government documents. He's no longer President. Biden wisely cut off his security clearance right away. Any access he has to ANY of these government documents are on a case by case voluntary basis by agencies like NARA and the CURRENT executive branch can make those decisions.

It kinda bothers me how often nowadays people mention, who appointed a judge. Everybody seems to assume that this is important which does not shine a very good light at the justice system. It would be naive to assume that judges are completely objective, but one would hope that laws are clear enough and there are enough checks and balances to prevent a heavy impact.

the 11th circuits response was brutal.
smart move of the DOJ to focus only on the classified docs, made it easier to rule on quickly and if there is going to be an indictment, those docs will bear more with with the grand jury than the 11k public available docs.
The laws being used considering defense secret don't require documents to be classified thus Trump declassification changes nothing even if he actually did it which he did not. But the actual charges do depend on documents that would be classified and all the Government needs to convict are them.
The other stuff only extra crimes not yet charged or in rare cases something that never was classified but should have been.
It also established the grounds and precedent for all the other docs in the case.
It feels like the people in the upper ranks of our government are immune to the law.
It would make me so happy to see these people held accountable for their crimes.

The argument wasn't a psychic power, but a claim that an unexpressed decision to declassify would be completely valid if its existence could be inferred from subsequent actions, an argument applicable to executive actions of other presidents. When Obama went on national TV to reveal that they just killed Osama bin Laden, Obama was implicitly acting on an unwritten declassification of that previously classified fact. Similarly if president Trump (while still in office) ordered the movement of certain classified documents to a less secure location, he may arguably have acted on an implicit unwritten declassification of those documents. It's a logical argument, that is only slightly stretching the truth.

It never ceases to amaze me how little Trump seems to understand of what a President can and can’t do, despite being one for four years.
When you've spent your life getting whatever you want by being the loudest and most abrasive, learning what "limits" are just doesn't compute.
Trump never wanted to be "President." He wanted to be King/ Dictator/ Autocrat/ Whatever, which, in his little pea brain, meant having unlimited power. He has little knowledge of the actual workings of government, never had any interest in learning, and has, indeed, remained remarkably stupid over how the government actually works. He still doesn't realize how proscribed ALL government functions are by rules and regulations, which is why he keeps making totally inappropriate and incriminating statements and actions, which, while they wouldn't affect the average citizen, will get him, as a former government official, in very hot water. Sometimes, a person's stupidity is a blessing!
He simply does not / will not / can not acknowledge any limitation to his power or ability, including, you know...the law...reality...whatever.

At the beginning of Trump's presidency, he was given some crib notes on the Bill of Rights, so he could understand them before taking the oath of office. According to what I heard (and this might be partially apocryphal), he got through #4 (unreasonable search & seizure) before he got bored and gave up.
If a U.S. office holder lacks the mental fortitude to read the Bill of Rights, plus amendments 11-27, then it does not surprise me that there are significant limitations to his understanding.

Yeah it doesn't really matter what he says in Fox News. He could say he murdered someone and it wouldn't have any legal weight.
Fox "News" is a great example of that. They have news in the title of the channel, but when faced with legal issues, they say in court they're an entertainment company, not a news provider. Additionally, they say under oath that no reasonable person would believe some assertions they "report on" to avoid legal liability.
The saddest part is, every one of their viewers could be made aware of this, and still gulp down their kool-aid.
