I used to manage the UA-cam channel for a friend of mine, a recording artist who had a couple of hits (including MTV airplay of the video) in the 90s. She had been on Atlantic Records at the time, so Atlantic owned all her videos from that period, even though she hadn't been on the label for years. Somewhere around 2010 or so, we found some old 3/4 Inch U-matic videotapes of her videos, which we had digitized and posted to her UA-cam channel. We thought the fans would enjoy the blast from the (relatively recent) past.
The videos lasted, if I remember correctly, something like 4 or 5 days, at which point they were taken down due to a copyright claim by Atlantic Records, and we were warned not to try it again lest we lose the channel. We tried to argue, but there was basically nobody to argue with. I think YT has a challenge process now, but it didn't back then. So basically, my friend couldn't put her own videos on her own channel. We even had her lawyer (who happens to be a pretty high powered entertainment lawyer who represents some pretty big name people, way bigger than my singer-songwriter friend) try to reach out to Google, or to Atlantic, or to anybody, and basically he said it wasn't worth fighting. So we gave up. But you want to talk about a broken system? How about a system where a musician can't post their own videos? It's insane. And it serves no one.

    • @denaeads9745
      @denaeads9745 2 роки тому +4

They aren't her videos. Atlantic Records paid for them and hired her as an employee. She sold her songs to them and possibly her name and her likeness.

    • @tonycamas9747
      @tonycamas9747 2 роки тому +3

@@denaeads9745 Sure. And that points to another problem of the music industry. For every one artist that "makes it" there are dozens, or hundreds that just scrape by, or, worse, end up in hock to their labels because they never are able to make back the money the label spent on them, resulting in them losing all, or most, rights to their work product. I don't know what the answer to that is, but it's a shame, especially when you consider how many incredibly talented people toil in obscurity and never work their way out of indentured servitude. The labels aren't necessarily the villains in this story -- they're just businesses, trying to feed their families like everyone else. But the system is flawed; I don't think anyone would dispute that.
But, as I said, that's a different topic. My point here is that the videos that the labels spend all that money on, they are created for one purpose and one purpose only, and that is to promote the songs they cover, along with the albums and the artists in general. The album that contains the songs whose videos were blocked is still sold (albeit in very small numbers) by Atlantic, because yes, they own it. So what purpose does it serve for them to block the videos from being shown by the artist who wrote the songs in the first place? They can only stand to benefit from the videos airing. Why try to stop it?

    • @BobKerns4111
      @BobKerns4111 2 роки тому +6

@@denaeads9745 That's NOT how it works. Musicians are not employees. What Atlantic Records owned would have been specifically *recording* rights, that is a specific recording.
Note what Taylor Swift is doing, re-recording her own songs.
Of course, she might have signed away the rights to the compositions themselves, which would be a poor business decision. But it definitely is not automatic, and definitely is not part of buying (not hiring) buying rights to a recording.

Music is blocked out of FOMO. Fear of missing out on royalties. Fear of losing a revenue stream that dried up years ago. When the Eagles and the Beatles were current on the charts, record deals were THE thing. Gold, platinum, and double platinum meant money. The aged musicians don't know how to deal with gravy tap being turned off. Your point of introducing new, younger listeners is extremely valid. Someone needs to explain the situation to guys like D.Henley.

@@vibratingstring Except it isn't. As Rick pointed out, YT can monetize the video and pay the copyright holders that money. It's actually more democratic than a bar owner getting a license, because that license fee is split up among artists who might never actually have a song played there. Radio stations submit audits of what was played in a fiscal year, but bar owners? Nope. YT only blocks stuff if the copyright holders jam a bunch of lawyers up their ass to make them do so. It's an interesting point Billy raised and it may well be something of a factor, but the fact that there are (for instance) lyric videos all over YT which are obviously monetized by the actual copyright holder proves that YT does in fact have a way to get the correct people paid.

I’m not disagreeing with you, but I’m curious if you think younger generations have the attention span for a lot of Jimi’s music?
I went through a long phase in my early 20s of listening to Jimi almost exclusively, and also learning to play his songs on guitar, drums, and bass guitar. My friends were all thoroughly annoyed and didn’t care for most of it, and this was late 90s early 2000s
Long guitar solos and rough recordings are better in my mind than modern pop with all of its production and sterility, but I’m not sure how many young people agree

Jimi's half sister is in charge because their father is gone. And neither of them is exactly record business savvy. Hell Jimi wasn't! She has lawyers and advisors telling her what is right and all she wants to do is to protect his legacy, because the record industry chewed him up and spit him out. You know he was mostly broke when he died right? Well his record company sure as hell wasn't. She is a sister of a dead guy who got taken for a ride and used and abused by the record business. Try and remember that when you are assigning blame.

I'm 20 years old so maybe you are referring to people younger than me, but I would heavily disagree with you here. Spotify (streaming services collectively) have allowed people to listen and explore any style or genre that they want to, the only people who aren't actively seeking out music they haven't heard are the ones who don't want to. All you have to do is just go to any of the thousands of currented playlists for every genre including classic rock and get exposed to stuff you have not heard. The music of the 60s and 70s came out 50-60 years ago, its like being sad that the young people of the 70s were not appreciating the music that was made in the 1920s. Of course his popularity is fading that's what happens over time to everyone and everything, but there are still a large amount of people my age into this music.

The 2001 compilation called "Voodoo Child: The Jimi Hendrix Collection" has all his best performances condensed in one package on disc 2. You can't find most of them on UA-cam, but It is on Spotify, or you might be able to buy the compilation still. If they would allow these versions to be on YT, more people would get the chance to hear these amazing live versions, they are MUST listens for any fan of his IMO. His version of Killing Floor at Monterey is amazing as well, but again, it's unavailable on YT.

In 2017, Haley Reinhart's 3rd album was a cover album of songs her parents raised her on from the '60's. She flew her parents to LA to have them record on it, on analog tape, using engineers who worked on the original songs. After the album came out, Jefferson Airplane, The Zombies (pre their Hall of Fame induction) and the Turtles all reached out to Haley to thank her for bringing their music to a NEW generation. REAL musicians want their music, their legacy to go on, to be enjoyed by their fans, to be discovered by new fans too young to have known the songs when they came out. This is why the music business sucks. They only think about now and what 'belongs' to THEM, they don't give a fnck about 'legacy' and 'artists'

Could it be the artist were appreciative and there were no problems because they would be getting paid if they had publishing? I wonder how the artists would have felt if the music was covered on UA-cam with no income for them? It could be artists from yesteryear have made their money and hopefully are doing OK now and just enjoy hearing the music go on and inspire but there are many who still need or want that money. It’s a tricky decision. Do you clamp down on any infraction, protecting your creation or hope that it’s presence in a popular medium actually generates an increase in DL’s or purchases that would eclipse people finding it because it is blocked on free outlets? So glad I’m no longer trying to make a living as a musician. It was an impossible dream when there was a traditional industry…now…no way.

Beato isn't doing either-- he's discussing OTHER people's music and he is repeatedly complaining because those people want to be paid for their work, but he's not making enough (off of THEIR work) to share with them. There's an easy solution here-- he can make his own music, break it down to explain those same concepts to us, and keep all the money to himself without anyone else having a LEGITIMATE claim to it. If he can't create his own compelling music (no shame there), then it simply proves that he needs other people's music to do what he does-- and they absolutely have the right to not permit it.

    Thank you Rick!
I spent a HUGE amount of time recently, recreating Vangelis' Chariots of Fire. (Based on my notes... I spent around 50+ man hours working on my homage.)
I used every modern DAW method to make sure I 'nailed it' as far as composition, orchestration, mixing and final UA-cam audio compensation went.
Unlike you, I was THRILLED that I got copyright claimed. To me, the 'claim' means I was close enough in my version that 'AI' could not tell it was not the amazing artist that made the original. Even though I used a more modern orchestration method, modern voicings, and even a totally different tempo....
I don't try to make any cash from UA-cam. It's a losing situation in the current environment but, I was VERY happy that I got 'claimed' for my version. I will not link the video here cuz that is just bad conduct.
If you wanna hear it, it's on my channel (not hard to find if you are interested).
I can totally understand your frustration and I get it! Your videos BRING listeners to 'older/forgotten' music.
This is a noble effort and I am sure, at least some of the 'used to be big names in music' are fine with that and don't shout foul. After all, you are brining in Spotify listers and other streaming dollars... none of which you claim.
Many other of these 'stockpiles of songs' are more about the $DOLLARS than the music. That's the terrible part of the industry really.
When a Homage or and Educational video gets blocked or flagged, it's because (usually) some know nothing 3rd party has a massive group of chimps that hear something and decide, HEY! we should make money on this... we know who owns it!
I don't get it. Again, I am not trying to make any $$ from UA-cam. I am just trying to be the composer I wanna be.

I think you hit the nail on the head with the difference between older and contemporary artists, and those who control the rights to the music of each. It's all to do with intellectual property. Those who control the catalogues of the older artists are still in the mindset of the pre-internet age, when tight control of IP rights was how they made their money. They still haven't updated their approach to the realities of the internet age, when control of IP rights, while still important, is actually a bottleneck in gaining exposure to new (i.e. younger) audiences when exercised so tightly. When will this change? Probably when the companies that control the catalogues are finally run by executives who grew up in the internet age, as the current generation of auld bastards dies out! So, ten or so years from now, when you retire from UA-cam, you just might see the change beginning to come into effect. In the meantime, I expect you'll still be making videos like this, pointing out the folly of such outmoded policies, each and every year.

    Hi Rick,
I first want to thank you for all your labour of love here on UA-cam!
The passion you radiate in this and all your other videos really touches me.
Hopefully the artists and record companies who watch this, and previous videos on this subject, starts to realise that blocking is futile.
They probably are afraid that the sales of physical and digital albums are going down or some other distorted reason.
In the case of Jimi Hendrix and other less contemporary artists you shouldn't be too afraid of them disappearing on the horizon of forgetfulness is that the kids these days still appreciate and recognise great music and lots of them prefer to buy their records, as in Vinyl. Spending my time in many record shops through the years I can safely say that's true. And the general Vinyl sales are even going up compared with a few years ago.
But most of us are lazy and stay with the platforms like Spotify to supply the music. Downside is that the whole albums are not always getting playtime, from the first song till the last, like the artists intended them.
To prevent blocking it could be a possibility for you to try and talk about music and songs, other than theory, in live videos.
Like Sam from Vinyl Junkies is doing.
Vinyl Junkies is a record shop based in Montreal, Canada.
Sam is live every day (!) since Covid started.
He basically is a DJ playing old and new LP's and talking about music and whatever comes in his brilliant, borderless and funny mind live on UA-cam.
Check out his 'Old Man listens to' videos where he listen to a record for the very first time, for example Radiohead's Ok Computer.
P.s. have you ever heard of Motorpsycho?
This Norwegian band is very versatile (Rock, Hard Rock, Prog, Psychedelic & even Country) and productive and could earn some more recognition across the globe.
    Great live band and improvisers!
    Keep on keeping on Rick!

Determining what is transformative-and the degree of transformation-is often challenging, in order for court to accept fair use as a defense you need to have strong transformative quality. And what Rick is doing is not enough to justify a fair use defense.
The less you take, the more likely that your copying will be excused as a fair use. However, even if you take a small portion of a work, your copying will not be a fair use if the portion taken is the “heart” of the work. In other words, you are more likely to run into problems if you take the most memorable aspect of a work. For example, court would never accept fair use defense if you copy the opening guitar riff and the words “I can’t get no satisfaction” from the song “Satisfaction.”
Another important fair use factor is whether your use deprives the copyright owner of income or undermines a new or potential market for the copyrighted work. Depriving a copyright owner of income is very likely to trigger a lawsuit. This is true even if you are not competing directly with the original work.
Claiming fair use doesn’t mean that the work qualifies as a fair use. Only a court can determine that, not you or Beato, only court!
For example, in a case involving a Seinfeld trivia book, the publisher included a disclaimer that the book “has not been approved or licensed by any entity involved in creating or producing Seinfeld.” Despite the disclaimer, the court held that the use of the Seinfeld materials was an infringement, not a fair use.

Just to clarify, it’s not the artists blocking the videos! UMG, SME, WMG and BMG all have blocking policies however, because the videos are used for educational purposes there’s a claim of Fair Use! Once a legal precedent is established the video will be unblocked! (it’s just algorithms)

Why do they block? They (Eagles, AC DC, Beatles, ECM etc...) don't understand digital music or streaming. They think UA-cam streaming is like Napster. They think viewers are stealing. They don't understand how they (labels and artists) are going to benefit from you promoting their music. Idiots.

And those ads are at least double the volume. I'm driving along in the car, listening to Rick's usual excellent points when all the sudden a Marvel ad blasts in with a deafening, startling explosion.
Other ads blast in later and I have to reach for the "skip ads" button to stop the racket. If I don't, a second ad starts in. If I turn it down, I can't hear Rick's voice when he finally returns.
Why can they blast the commercials so loudly? Do they think we'll like the product better if we're blasted by it??
3 ads while typing this short post.
      First world problem I guess..lol.

    • @whitefantom

It may be UA-cam itself inserting the ads. They changed their policy a year or so ago so that they now can insert ads on videos the creators have chosen not to monetize. The creator still gets no ad revenue (because they didn't monetize it themselves), but UA-cam does.

@@prezadent1 It means if YOU, or Rick, or anyone else, posts a video containing a particular artists music, that video will get blocked, meaning no one can see it or watch. I always look at the videogame industry as a comparison to the music industry and how it should be. Could you imagine if game companies copyright claimed all the youtubers and streamers playing their games? It would still be a niche thing "just for nerds". The gaming industry exploded because the developers embraced streaming and content creation. They realized it was a beneficial symbiotic relationship to growing a community, and games from the 80's and 90's are to this day still played as a result.

    • @amymalina5073

I think you are onto something when you talk about “growing a community”, as it pertains to the video game industry. Clearly, that industry gets it and the music industry and also the movie industry clearly don’t. They choose to mothball all this material where guess what, it will all eventually die on the vine.
I had a vintage King Super 20 alto saxophone and always figured I’d be able to sell it cause that’s the same brand of horn played by Cannonball. By the time I wanted to sell it, younger players barely knew who he was. By the same token, there are people in their 30’s who never heard of Elizabeth Taylor or Paul Newman. Greed, closed-mindedness and a lot of thinking that is stuck and stunted. It’s tragic.

    Hey Rick,
In the last year or two, ECM finally made their catalog available to most of the streaming services. It was a long time coming.
For streaming, I subscribe to UA-cam Music, the paid service. A key perk is that you receive ad free You Tube video’s. Love it!
The copy right crap continues. Often, I make playlists and then all of a sudden, the song or video is blocked. Yep, it sucks but little is going to change.
My uncle’s brother, also a guitarist, was a dear friend of Joe Pass (alaqua). One time, he brought Joe Pass to my Mom’s house for a traditional Italian Sunday afternoon dinner. I was already a fan but lived out of state. When I heard about it after the fact, I could not believe it and that I was not there.
Loved your Sting / Dom and Pat interviews. Keep ‘em coming!
