- Maine Secretary of State Shenna Bellows is set to issue a decision soon on whether former President Donald Trump can stay on the state's Republican primary ballot in 2024. On Wednesday, the Colorado Republican Party asked the U.S. Supreme Court to overturn a ruling from the state's high court that said Trump was ineligible for the presidency. CBS News legal correspondent Jessica Levinson joins CBS News to discuss these challenges and more.

Until the S.C. rules, that's not how it works. Heck, there are some questions (qualified immunity being one) where the Federal District Courts actually get the final say on what constitutional rights we can demand from police, and which we can't.
... on that topic, there was a recent ruling in one District that the people who live there can't engage in Satire against local police.
@@Machinegundon64 The 14th Amendment was written to insure that no confederates could be either elected or put into federal positions of power either through a state election, cabinet post, judgeship, etc. The President was not named in the Amendment because that is a position that gets voted in through the electoral college. At the time there was zero chance a confederate President would make it through the electoral college process. NY and the north would never have let that happen. They have nothing to stand on.

Thing is, Trump has not been found guilty by the courts. This is key because our nation primarily puts forth innocent until proven guilty. This is also important because he is currently in proceedings to dictate whether he was actually part of the insurrection or not. Until the courts make their ruling, there is no legal action that can be taken while proceedings are occurring

That doesn't mean he's entitled to run for office in the meantime. Typically, when someone is charged with a sex crime, most jurisdictions don't allow that person to adopt a child in the meantime for obvious reasons. Just because Trump hasn't gone through the trial processes yet for a conviction, that doesn't mean he's allowed to do whatever he wants. And besides, we all know if/when he does get convicted, it's not going to matter anyway, because MAGA will just shift the narratives and move the goalposts like they always do anyway.

Once Congress enacted criminal code on insurrection, this question was answered. I hate Trump, but he hasn't been convicted of insurrection. And I don't want administrative judges and secretaries of state to determine such an important question under less difficult standards of proof. If we go down this road, it never ends.

They are responsible for interpreting the Constitution and deciding it's validity and application. The Supreme Court of Colorado ruled that he was guilty of insurrection per the 14th amendment.

This is a really obscure constitutional concept so I’m surprised it’s being discussed on a UA-cam forum, but trump doesn’t have to be convicted of insurrection for the a disqualification clause to be enforced. First the plain language of the 14th says “engage in insurrection” not CONVICTED. Big difference. Also as you bring up, disqualification is a civil issue that doesn’t involve jail time so criminal laws don’t apply. Trump needs a conviction to go to JAIL but only a court order for DISQUALIFICATION.

The amendment doesn't state that a person has to be criminally convicted to be disqualified.
I hope SCOTUS moves the 14th amendment issue to the top of their docket, because this constitutional issue shouldn't be decided based on the emotions of "the court of public opinion"

Note: SCOTUS could also spare states the costs of litigating this individually, in some cases for regular courts, appeals courts, and State Supreme Courts for each primary ballots, final ballots, and the eligibility to ultimately hold office!

The reson for this ploy is that Colorado is so certain of the reversal that they are trying this deal in an attempt to get SCOTUS to DELAY it's decision on the Colorado Ruling.

I lost my faith in the SCOTUS when it refused to hear the case brought by Texas against Pennsylvania during the rigged 2020 election. The Supreme Court had jurisdiction, but it refused to hear the case, saying Texas had no standing. Don't be surprised if the Supreme Court says it is state's right in election matters. You will then see all the Trump hating states clamoring to take Trump off the ballot.

The U.S. Supreme Court should pass on taking up any case involving the validity of a candidate, refer to Article 1, Section 4 of the Constitution!
Each state is in charge of the validity of a candidate. Federal courts can not weigh in on a states decision.

I don't believe the US Constitution, or for that matter, any constitution of any nation, is a word from God. If it were, there wouldn't have been any amendments. If there is such a provision in the constitution, it should be amended for the sake of the people and for the sake of democracy. Please note, the constitution is written for the people.

What happens if he waits till the last possible minute like he's known to do, in order to keep things tied up in the courts, biding for time, until he's re elected president? Will the ruling still be upheld, even if he's already in office by the time it's decided, or will it be automatically thrown out then because of some kind of privileged presidential immunity clause?
The only exception to 14th amendment disqualification is a 2/3 vote of Congress to remove it.
Hopefully they can still kick him out of office like the dude in NM who participated in the insurrection he went back home and to his office where they informed him he no longer qualified for the position he was holding
