They are correct that the president is not an officer of the United States and neither is a Senator, House member, Governor, or state legislator. An officer of the United States is a person who has been APPOINTED to their position by the one by either the president or governor with the agreement of the Congress or legislature. However that does not mean that Trump can't be held accountable if he engaged in an actual insurrection. He can still be banned even if he isn't an officer. If you look at the wording of the clause, it does not say that "no officer who participated in insurrection shall be allowed to hold any political office". It doesn't say that at all. What it does say is "any person who previously took an oath to support and defend the Constitution of the United States". Qoutes are paraphrased. The important thing here is that it says person, not officer. Even if Trump was not an officer of the United States, the fact remains he is still a person who took an oath to defend the Constitution and by engaging attempts to overthrow that same constitution he engaged in insurrection and can be banned from office. The other confusion about the clause is in regards to what constitutes an insurrection. Protests and riots are not insurrections for one. The second thing most people have not bothered accounting for is that when Section 3 of Amendment 14 mentions insurrection, it is in fact not talking about insurrection against Democracy or about trying to deny election results. Instead, when speaking of what it means by insurrection, the 14th amendment refers specifically to people who having sworn an oath to defend the US Constitution turn against it, bad mouthing it or calling for it to be abolished or seeking to use violence to abolish it. There are very strong feelings on both sides but the reality is that neither Trump nor his supporters engaged insurrection because it was never their goal to over throw the US Constitution, but rather to challenge an election they sincerely believed was rigged due to foreign interference. Many people already know or should know that just because someone says they believe something, does not always mean they are right and just because something is true does not mean everyone will believe it even if their own eyes show it to them. I suggest that just as Americans can't agree on what an insurrection is, the primary root of their dispute between each other is they can't even agree on what constitutes a democracy or even a republic. The result is that the country becomes more divided because the two main groups are speaking in different languages, having assigned different and opposing meanings to words that both of them use frequently. Trump isn't anti democracy. It's that his idea of Democracy is different from Biden's. But both Trump and Biden in fact continue to support the right of the American people to choose their leaders through democratic elections that follow the rules of the US Constitution. But they have different approaches to that end so it sounds like they speaking ancient greek to each other's followers.

The drafters of the 14th amendment, and those that passed it into law, had VERY recently buried Abraham Lincoln. Lincoln had his detractors but at that time he was nearly deific. Whether out of a desire to avoid inadvertently insulting the reputation of or open respect for the recently deceased president, the drafters left the president out of of the 14th amendment, section 3. Having just lived through the sacrifices that a president, and the country, had endured to protect and save the United States of America, they could not conceive of a holder of that OFFICE who would act against the government.

Was it necessary for him to have been tried and convicted of insurrection before he could have been prevented from running for an office after the civil war? The amendment in no way indicates that a conviction is necessary.

Whether Trump engaged in an insurrection is an opinion, not a fact. Article 5 of the 14th ammendment clearly states that Congress must create a process for determining this. They did this when they passed am insurrection clause with a criminal statute. Jack Smith not to use this criminal statute to charge Trump, and trust of he even had a shred of evidence that Trump had anything to do with the violence on j6, he would have charged Trump with that criminal statute. Not to mention, Congres did charge Trump with insurrection but Trump was aquitted in the Senate. Its not complicated folks.
