I understand that different states have different laws when it comes to elections and how elections are run. What is the reason that when it comes to a federal election that all states shouldn't have to hold the election the same way since it is for the federal decision and not a state decision

Florida was intentionally set up to count votes early, because Republicans knew they'd get a lot of Hispanic vote through those channels, so they didn't want it included in these discussions. Trump in fact encouraged his base to mail-in vote strictly in Florida.

They went so far as to send out mail-in ballot registration forms to registered voters in every FL district back in August around the same time that the administration was actively discouraging mail-in voting and obstructing the postal service in other swing states. Their inconsistent messaging & hypocrisy on mail-in voting made it abundantly clear that their intent was to strategically undermine the election process.

Strange that the other channels such as Sky News Australia, OAN, etc., do not provide an actual lawyer to comment on the efficacy of these law suits. People seem to think a signed affidavit implies that it is true, not that the person creating it is deluded or unaware of the consequences if it hits court.

I get the whole system isn't what everyone thinks it should be but the process has always worked as intended with minor hiccups. These lawsuits were all frivolous and didn't expose any actual fraud, so I'm not sure why these videos would make you feel having elections with laws determined by each state is awful.

They didn't even give her that ultimatum. She could have invalidated the ballot she mailed in without implicating someone for fraud. She went there with the intention of undermining our elections then got caught and wanted to make something up so she didn't look like an idiot. Which backfired and made her look idiot on the news.

@Luís Andrade Not necessarily. If I were legally blind, I might prefer having someone with me in my home helping me fill out my ballot rather than having to get up and go out and be assisted on election day at the polls. By itself I don't think mailing in the ballot is fishy.
I think it's far fishier she wouldn't file a complaint against whomever "stole her ballot" or however it's being presented. If someone has taken away your right to vote why would you protect them? They didn't give you that consideration when they stole your ballot.
It just sounds like this lady was looking for an excuse to try to somehow get all the votes thrown out.

Courts are, anyway. I work in education, and our child protection training is quite clear there hear-say - however tenuous - needs to be reported. One of the training scenarios involved a child's father's sister-in-law's mother mentioning to a teacher that her son-in-law had joked about hitting his child. The correct course of action is to report this to social services.
In practice everyone in education ignores the training and uses common sense, because we all see the flaw: The standards for what needs to be reported are so broad that there's perhaps not a single child in some schools who doesn't merit reporting to social services. The Powers that Be are so insistent that not a single incidence of abuse be missed, they created a set of rules which - if anyone actually followed them - would just bury everyone in a mountain of false positives. Not only is hear-say and rumor grounds for an investigation, but the list of signs to look out for includes a number of opposites: Student works too hard, student doesn't work hard enough, student is fat, student is too hungry, student has clothes that cost too much, student has clothes that cost too little, student is rude, student is overly polite, all on the list of abuse indicators.

In my experience, when a judge says to a lawyer, "...as a member of the bar of this court..." they are essentially asking said lawyer if they're wanting to continue being a member of said bar.
True, sounds like they're putting the attorney on the spot to get real.
In addition to that, it's also I'd assume a reminder that the judge has the power to cite and even jail said lawyer for contempt if necessary.

@Albert D That's not directly relevant though and people trying to make it seem so are being disingenuous. A lot of poll stations have technical issues of all kinds and those issues are usually worked out and then things resume.
What they didn't do is provide any proof that those issues affected the election in any tangible way, or more importantly, that any were intentional, hence the OPs post.

They weren't willing to change voting rules close enough to the election that it could well drag on until after the election. 4 justices said that if they really wanted clarification and not an attempt at a do over then they could bring a case after the election.

The Trump legal team are unable to provide evidence of election fraud or tampering but they are also the most incompetent legal team ever assembled. So incompetent that they failed to file the proper documents for an appeal. And it's all assembled by the same guy who was responsible for the acquisition of PPE, son-in-law Jared Kushner.
My fellow Americans. I would like to forward you this message from a Constitutional Attorney.
"Okay, in a nutshell... This is gong to the Supreme Court. Where they will rule that the election is invalid due to fraud or mistakes on the country wide scale. It will go one of two ways, either they will rule that all the unconstitutional mail in ballots will be removed and the States order to recount without them OR they will simply rule the election is invalid due to mass voter fraud and at that point it will be sent to the congress and the senate for a vote. This is where it gets good.
The house/congress votes on who the resident will be. It has nothing to do with what party that has power. Every State gets one vote and 30 States are held by Republicans and 19 by Democrats. They have to vote down party lines, they have NO CHOICE due to the 12th Amendment and the Constitution. The Senate votes for the Vice President where a similar event will take place. This is the LAW.
This is why the Democrat are so mad at Nancy Pelosi. This will all happen in January. The only way President Trump won't be President is if he concedes the election and that will never happen.
So stop watching the fake news and don't let your heart be troubled and live your life knowing this will hall work out. President Trump will remain President I have researched all of this and it is FACT!
Another fun fact, the media called Gore the President Elect for 30 days in 2000 until the courts ruled against him and declared Bush the winner. And two people that were part of that decision was none other than new Supreme Court Justices, Brett Kavanaugh and Amy Coney Barrett. Whey do you think the Democrats tried so hard to keep them from being confirmed."

@Rill It is completely beyond dispute that the Kremlin attempted to help Trump win the 2016 election, every intelligence agency agrees and even most Republicans will admit that it's true. There was also evidence that people in the Trump campaign coordinated with the Russians. It turned out there wasn't enough evidence that Trump himself was involved, so he wasn't charged or impeached. It may well be true that Trump is innocent of these accusations, but the investigation was still completely justified, and it did result in many of his associates being convicted.
I don't think Biden would have gone to any of the lengths that Trump is going. He would have conceded once it became clear that he lost. Trump just has the ridiculous mindset that admitting that your wrong and losing is bad.
Just like how Clinton still can't admit she lost to Trump? What about Al Gore?
I think Trump was a lot more aggressive about it and made a lot of theater out of it, but he didn't start it. He just takes it to a weirder level.
@@comradenb1261 I haven’t heard at any point her not admitting defeat. And Al Gore was completely different. That was down to one state where the vote difference was well within a margin of error, so he was within his right to call for a recount. He then conceded when all and said was done. Trump on the other lost by several states with larger margins then Gore. He refused (and still does) to admit he lost claiming voter fraud but never providing evidence to his claims. And let’s not forget him riling up a crowd to to stop the certification of Biden. Name the last out going president or losing candidate that did that.

We even had an observer, who walked into our precinct ARMED, call the police to protest legally placed campaign materials outside of the polling place. The officer was on the phone with the state Attorney General's office for over an hour. Everything was above board. We allowed challengers and observers every single one of their rights. The law was followed scrupulously.

Rewatching this in 2021 (late 2021), it still astounds me that Republicans thought that arguing that any form of voting which didn't favour them (mail in, mostly) could just be deemed 'unconstitutional' and be done with it.
I mean, if you discount all the votes that were filed against you, of course you're going to win an election. Why they ever thought they could pull something like that off just boggles my mind.

This forces us to assume that if any party were trying to determine how many additional ballots they would need to slip through in order to win, it would be the Republican Party.
The voting extensions and "curing", as structured initially when broadened in light of the pandemic, was to include processing ballots as they came in...not unlike as was done in previous years. And then Trump lawsuits were levied that pushed back when mail-in ballots would be processed.

It’s very strange that the government in Pennsylvania subverted the constitution. In the constitution, the right to delegate how election take place is given to the legislature of each state. The Secretary of State in PA and the Supreme Court of Pennsylvania are NOT the legislature. Trump has a very convincing argument in my opinion.

That old lady was trying to vote twice. Who on earth would have a problem with naming someone who stole their ballot, especially when that person was also evicted from their home recently? And if it was a member of her family, then why would she risk kicking up a fuss which might get them in trouble?
I can see it being a family member who you know is doing bad things, but you want to get better, and throwing them into jail isn't going to help them long term. But to deny your chance to change the vote, and then go to the media and complain about things that didn't happen to you, I think that invalidates the claim.

Well, at one of his super-spreader events in North Carolina Trump did encourage his fans to test the system by trying to vote twice. Which is a felony that would backfire on the double-voter, but not on Trump himself.

Edit: Guys, this isn't science, but it's not exactly up for debate either. These court hearings are literally asking the lawyers what evidence they have and they say none aside from they've heard about it. I have a lawyer as a family member (and a pretty good one at that) and he tells me the same thing, that this is a disaster on the lawyer's part and there was never any legal ground to stand on in any of these cases except one in PA where the judge agreed to let the observers get a little closer (BECAUSE THE LAWYERS ADMITTED THAT THERE WERE REPUBLICAN OBSERVERS IN THE ROOM UNDER OATH). Its not political opinion, it is literally down to do can they provide evidence that Democrats organized and selectively created and removed ballots? No. Can they throw out entire counties worth of ballots because observers were 20ft away and couldn't read individual details on the ballots? No. Are states in charge of handling how they process ballots and create their own laws on how to do so? Yes. Do any of these states violate some federal voting laws? No.
They way it's proven in court is not "there is fraud until proven otherwise". Its "unless proven otherwise (i.e. given any evidence greater than 'surely it's there"), there is no fraud". You can't throw out votes because you are certain it must've happened IF YOU DON'T HAVE PROOF. Trump's best chance at this would be to get this issue to the supreme court, as there may be enough republicans and Trump loyalists on there that they just decide to ignore literally every legal rule and overwrite every case (and I mean every, PA alone isn't enough).

Simplest terms if they lie in court potential legal damages, outside of court excepting certain boundaries like gag orders, they have the same rights to free speech you and I have.
To answer your question unless Giuliani committed slander/libel, violated a gag order, or actively sought to twist a jury via public opinion not much a judge could do within the bounds of specific legal punishment.
That said generally not a smart move to piss off a judge if he isn't already biased against you, but given how political this has all become expect plenty of bias both directions in this circus.

The only hope this tactic may have -- and I may have completely misheard the explanation -- is if it delays the selection of delegates, which would then mean it goes to the House, where it may in some incredible fluke of 2020 become deadlocked, and then it goes to the pre-packed Supreme Court. Any way I look at it, it seems to be a hell of a desperate gamble.
