If you, say, write a book and someone plagiarizes and publishes it, you have a case. Patents are filed with the government and internationally recognized and enforced. That's the difference between the two and yes, Nintendo has a case here.

The fact that it took this long to sue means that they did not find good enough evidence for a copyright suit, and is instead suing on the grounds of "we patented the idea of capturing a creature by throwing a ball in a field." When you know what they are actually suing for, the suit makes a lot more sense and makes you hate nintendo even more.

On the whole social interaction with phone thing, I kind of get stuck between wanting to have a picture to remember, and hating being in a photo so much it's unreal. I get the appeal of Instagram not as a social media, but as an album of sorts. Memory started getting worse with medical issues and it makes me happy to see old pictures of events that have become pretty blurry. It's a strange conflict.
