How Fighting the Ban on Gay Blood Donations Could Hurt the Christian Right

    This video's a little long, but I found the topic really interesting, and maybe you will too, even if it's a bit tangential to atheism.
    When it comes to donating blood in the United States, you might be aware that gay men aren’t allowed to do it if they’ve had sex in the past year. Technically, the ban applies to men who have had sex with men, which is slightly broader than just gay people, but I'll use the terminology interchangeably for the sake of this video.
    The one-year “deferral” is actually a recent change; in the past, sexually active gay men couldn’t donate at all. A version of that FDA regulation has been in place for decades as a result of the AIDS crisis in the 1980s - even though technology has now evolved to let us screen blood for HIV much more quickly and effectively.
    So why hasn’t the U.S. taken a hint from other countries that have either shortened that deferral period (like Japan and the UK) or eliminated it completely (like Italy and Spain)? Excuses range from imperfect screening tests to opposition from the Religious Right.
    It’s silly, in some ways, because a straight man who sleeps with many women is much more of a health risk that a gay man who’s monogamous. Yet only the gay man is prevented from donating blood.
    But we live in a country where same-sex couples can now get married and where LGBTQ equality is on much firmer footing than it used to be (even though Republicans are in power). So why not sue the government on grounds that the FDA’s restrictions discriminate against gay people?
    The simple answer is that a lawsuit like that probably wouldn’t get anywhere.
    The FDA’s ban isn’t in place because the government is actively discriminating against gay people; it’s a safety issue, they’ll say. If we could test the blood for HIV in an instant, we’d let everyone donate. But since we can’t, we’re screening out the people with the greatest likelihood of having it. That's their argument.
    But maybe there’s another way of winning the legal battle.
    In an absolutely fascinating paper, Professor Brian Soucek of the UC Davis School of Law thought of an alternative approach to overturning the ban.
    Even if it didn’t work, he wrote, the end result could still weaken the “religious freedom” laws that Christian Right groups have been using to great effect. As he says, “the case is a coin toss: heads, gay rights advocates win; tails, religious conservatives lose.”

    I used to donate plasma a lot. It's pretty much the same process as giving blood, only it can be done more often and I was paid. I guess that's not really donating, but that what they called it. Anyway, they would have you fill out a questionnaire like blood banks would, and one of the questions I had to answer was if, as a woman, in the last year I had slept with a man who had ever slept with another man. For some reason, that question always stuck out in my mind.

      I don't know about blood, but I know you can't donate plasma if you have schizophrenia. Most likely because everyone who doesn't have any knowledge of it think we're all murderers who have no self control and constantly have voices telling us to kill everyone. That, and we have multiple personalities, which has NOTHING to do with schizophrenia. I have multiple personalities, but there are no mental illnesses that are recognized that deal with multiple personalities. DID is not recognized and doesn't exist. If someone shows to have multiple personalities, they are not considered mentally ill (in fact, they're considered attention whores by 99.9999% of the internet) but it has nothing to do with schizophrenia. In fact, schizophrenia is genetic while having multiple personalities is a result of trauma, and those two are not related at all.

      I wonder how they expect you to answer that question with any sort of certainty. It doesn't seem very reliable to ask a donor about somebody else's personal life and past that you may or may not have a clear picture of

      That question is insane! Lol. Totally illogical. What if you had slept with a man - and then - he slept with a man long after you slept with him?
      These donation centers must think STDs are retroactively transmitted.

      Because that technically puts you in nearly the same risk category as a gay man. The questions are stupid though because people can lie, forget or not know who their last partner slept with

    There is definitely a risk of HIV transmission if a person frequently has new partners or their partners have new partners. All donated blood is screened before use, but it can take up to 12 weeks for an HIV positive person to test as such. I think a better ban would be to bar people who have had a new sexual partner in the past 6 months to allow time for anyway accurate test results. Although gay men are at a slightly higher risk (the virus passes more easily through anal sex due the more delicate tissue) there are many more significant risk factors (number of partners, frequency of new partners, use of protection, etc.).

      How: by banning people who know they carry a disease that can be transmissed through blood it people who are at high risk for carrying and being unaware of their status.
      Why: because we don't want to pass the disease onto a new person.

      A. as stated above, I am aware that all donated blood is screened before use.
      B. as state above, a person infected with HIV can carry the virus for 2-12 weeks and still test negative (aidsinfo.nih.gov/understanding-hiv-aids/fact-sheets/19/47/hiv-testing), so it is possible for a sample to be tested, pass the test, and still carry the virus.
      3. I agree that it is ridiculous to ban only gay men (and I said this on the original upload that was accidentally cut short, I forgot to use this phrasing in my new comment, my apologizes for not being more clear). That is why I used gender inclusive language "bar people [men or women] who have had a new sexual partner [man or woman] in the past 6 months" (again, because it takes 2-12 weeks for a person carrying the virus to test positive, so time should be allowed to ensure all blood is clean).
      When I said gay men are at a slightly higher risk I meant EXTREMELY SLIGHTLY, and I acknowledged that there are may more significant risk factors. I do not think the minor increase in risk is enough to validate the banning of men who have had sex with other men in the past year, but I do think it is important to acknowledge and to understand why others think the way they do in order to communicate effectively.

      Yeah I 100% agree it's naive to assume someone is morally corrupting society because of their sexual orientation/gender/etc. And I agree that the current laws unjustly blame gay men in transmission of HIV. However, I do think there should be some restricted based on current research to prevent the spread of HIV because it negatively impacts a persons health.

      @@KeonAureii The FDA can say who can and cannot donate. That's how it works. Anyone with a vein can have blood extracted, but being a donor means the red cross, FDA, etc would or wouldn't be allowed to take it.

    Het latey me and my parents have been fighting over religion and I mentioned how she forced religion on me when I didn't want it. I was woundering if you have or can do a video about how religion is forced. I was forced to go to church and if I didn't I would get yelled at or grounded so I just went with it.

      James Millerick in the past I rejected anything coming from the Bible and God, but I was sad and kind of mad all the time and my cousin who believes in God was so full of life that one day she told me “if there is no God I don’t want know, I rather live thinking that there is one and be happy” Later i bought a house and grow a nice garden and I started to notice how the seeds and all the little creatures wanted to live and it made me question what was behind all of this...there have to be something behind all of this.. I used to be a fan of this UA-camd and now when I see his video I can see how unhappy he is with life and how hard he tries to make his point..

    Here in Arizona I am not allowed to donate at all because I'm gay. They don't have a 1 year stipulation, and obviously if you were to lie to them you can be charged with a crime. =/

    Hello, I've been watching a lot of your videos lately. As a person who still practices Judaism, I am very paranoid of being judged and ridiculed by anti-theists. What I mean is, whenever I see, hear or do something of religious context, I always have to turn my head around to see who's watching. It's not what I think of atheists, it's what atheists think of me. Whenever I go outside and listen to music, I have hide the phone away so I wont get caught listening to gospel music, which I really like. In fact, just the other day, when was watching and enjoying The Prince Of Egypt on my laptop, I closed the blinds, turned off all the lights, threw a blanket over my head and laptop, and put on my ear pods so no one could see or hear what I was doing. I am very worried of how I'm viewed by non-religious people, because I fear of being shamed and talked down on for something I just can't help but enjoy.

      As an atheist myself, I can say your fears are purely paranoia. From what you describe, your hiding away religious related actions ASSUMING people will judge you when no one is. Dude, everyone loves The Prince Of Egypt, we watched in my Highschool History class, not because it was religious but because it was an actual historical event. Slaves leaving Egypt to a new land was really a thing, even atheist know that. Whether there was plagues and golden cattle that people were forced to melt and drink or Moses parting the red sea is something you may believe in that I don't, but the main events are still pretty much true. You are way too paranoid my friend. I love singing religious songs of many faiths. If I hear gospel I will yell praise the lord and hallelujahs because that's how the music is sung, it's great music.
      Trust me dude. You're fine.

    Just visited hiv.gov to find an answer to my question. It is stated on the site that homosexual males belong to the group with the highest infection rate with blacks/African Americans and Hispanics next in line. If the testing methods have a high degree of reliability then no worries but taking the possibility of human error into account I can certainly understand the concerns.

    Are blood donors still paid for their donation in the US? This to me seems to be the biggest problem inasmuch that if you are using donation to get much needed income, then maybe you are not taking the prohibitions to donation seriously if you are not in the best of health. In the UK, a blood donation is given without payment. It is a long time since I signed up as a donor, and I have no idea what is on the questionaire these days, I had to stop once I was diagnosed with multiple sclerosis, but I do remember that you were prevented from donation if you had visited certain countries within a year and questions about HIV were certainly asked.

    Great video... I am Bolivian and I was educated in a fundamentalist environment were theories like the Big Bang or Natural Selection were just ignored and forbidden to discuss. Now I'm 20 and I'm and atheist but I'm an ignorant about this kind of matters. I would like you to recommend the best books about evolution and that sort of fundamental scientific theories.

    Hemant, I have decided to change my focus to this channel (TAV) and then just not read the comments. I am becoming more and more passionate and dare I say intolerant regarding my viewpoints on the multifaceted damage of religion to societies, the environment, animals, science, logic, truth, courage, reality. So when the religious trolls and tormentors come to the FA site weekly.....their true intentions, their depravity of mind, ethics, morals, truth and compassion,.... I can no longer be friendly, and feel I am at risk of violating your "Friendly Atheist" platform. Here I am again apologizing if I have said anything that is excessive or too "unfriendly". The more I am exposed to the afore said generated comments of these religious instigators and bullies, the more verbally uncensored I become. I apologize for the 10th? time. What you are doing is heroic, exposing the evils and myths of entities that claim to be pure, holy and truth--all lies. Thank you Hemant. You are a true hero!

    Former Christian, then in my young teens i understood that they fooled me, and im a ateist since.
    A statement/question
    "A boy called Harry who NEVER heard of God but has always lived a friendly careing way, concerned about other people, will he go to hell?, and a mean boy who goes to church and get forgiveness, does he get in to Heaven?" We are ALL Gods children, BUT only the one who heard about GOD, the others go to HELL!!! (specially other religions) :( all poor kids in other countries that havent heard about GOD, and a REAL BAD GOD to punish all those kids, dispite they all live in "Gods way"

    Just test the blood every time, problem solved.
    They will allow me to donate with all the meds I'm on and the fact that I'm a medical marijuana patient. I'm such a chicken though. I have O+ and my blood is the most common and they really need it. I've tried, but I get to the door and go nope, can't do it. I wish I could convince myself to overcome my fear of it. I can get shots fine, bloodwork... eek. I know I have to do it, but I hate it! Most phlebotomists do a good job, but the bad ones make me fearful again.

    You asked what I wanted a video about, I would love to hear your thoughts on the current administration & church state separation. I live in PA & while we don't have a lot of religious nut jobs , I still fear for that separation being asserted into my children's school or even worse, being forced religion as "rule of law". Since the religious right is now the majority of the house, it's something I think of continuously. Please help! I'm very worried! Trumptards are out to take that church state separation & stamp it out & they're literally EVERYWHERE! Other than vote, what can we do?

    Can you make a video on the recent Asia Bibi blasphemy case? Although it is not really a recent case, most of the Muslims in Pakistan are murderous right now. The government won't let her leave the country. Her husband has pleaded to Trump, Trudeau and Theresa for having them taken out of the country but the situation is getting out of hand.
    Also, I believe that you should make more videos focusing on cases in different countries and not just in the US. You make good videos so I would love to get your views on those cases.

    I am a Christian. And I respect you guy’s opinions. In my opinion, ppl who arent religious get hated on way too much. I just wish this world would respect the rights and thoughts of others.     I'm not religious, I do support the LGBTQ community and same-sex marriage, but I'm against gay men donating blood. This has nothing to do with homophobia, gay men objectively are a risk group and donating blood is a virtue, but not a right. Somebody can't donate blood if they got a tattoo recently. Somebody else can't donate because they lived in the UK between 1980 to 1997. That's normal safety regulations and nobody calls it uk-phobia or tattoo-phobia. Not everything what seems like discrimination is a discrimination and sometimes the concerns are genuine. Like we don't issue blind people driving licenses for the reasons of traffic safety, when it comes to blood donations we shouldn't compromise our safety just because somebody might feel bad about it.

    Problem is many Christians seem to believe religious rights apply only to Christian sects. For example, they'd rather not a 'satanist' sacrifice animals. So, it's labeled a cult rather than a religion. Which... I really don't think there is a difference between the two aside from interpretation. If a gay man said that Jesus told him he must donate blood, he'd likely gain more ground.

    Blood is blood. If it is clean, (disease free, HIV Negative) then it is safe to donate.

      The testing is the same here from what I've read (about 2-12 weeks for accurate results). I wish we would adopt that policy!

    I live in Australia and can't donate blood because I lived in the UK in the 90's. The reason for that ban is mad cow disease. Sometimes the rules are dumb. I'd love to donate blood, but can't.

    What religion would require you to donate blood and still allow you to have sex that is recognized by the supreme Court to allow them to use religious freedom laws? Even Muslims aren't affected by the religious freedom law, and they're the second largest religion. I'm pretty sure it only applies to Christians. If a non Christian tries to use religious freedom, the supreme Court will just find a way around it.

    According to the Bible, how old did adam look when he was a one year old? It doesn't say but I feel we can all make the same conclusion that he didn't look one. So this is why I don't understand the scientific arguments that God isn't real.

    Why do you want to "hurt" the Christian right? There's children who grow up that way at no fault of their own. I was such an one. I changed my mind on a lot of things because of God friends, not people who were mean to me.
    Why not help them understand reality?
    If there was no statistical difference between gay and straight blood, I'm down to get some James Charles type A, and I've got Christian tendencies.

    I honestly don't see this as discrimination. Their argument for why they do it isn't a bad one. There should be other regulations, though, if they're going to keep this one. For example, anyone who has had unprotected sex with multiple partners in the last year should be considered a risk as well.

      I 100% agree on expanding to anyone who recently had new partners, but I think the time period should be 6 months rather than 1 year since testing for HIV is accurate 12 weeks after exposure to the virus.

    It's weird how many antiquated laws you can still find on the books. This is still left over from a time not much was understood about the disease. Mean while in California you get laws put in effect that make intentional (this is explicitly stated not accidental but purposeful) exposure of HIV a misdemeanor. Annoying everyone wants to go to opposite ends of the spectrum.

    I'm not gay, but I always questioned the fairness towards gays in America. In my opinion, America bullies the LGBTQ and it's disgusting. It may not appeal to most, but we should all respect each other regardless of sex, race, sexual orientation, identification, And religion. This channel opened my eyes to the flaws in society and the wrongs of...should I say bullying rather than evangelism? I'd personally like to thank the gay community. And one last thing..
    Does anyone remember all the times the gays marched And protested against racism and discrimination.. How about judicial unfairness... If I was a classic American bully I wouldn't peaceful blood either.

    I've never understood the ban on men who have anal sex with other men from donating blood, yet they don't enact this ban on women who have anal sex or men who have anal sex with women. The risks associated with anal sex are the same regardless of your gender - not to mention vaginal and oral sex are not without risks either. It seems like pretty blatant discrimination to me.

    I understand what you are saying and it is mostly if not all factual. I just don't like how you are making us christians look bad cause not all of us are the same. I think being gay is absolutely fine and there is nothing wrong with it. I just live my life to be nice to people and help out everyone.
