His attorney didn’t need to be there, but they did take the the necessary legal steps beforehand. They executed a search warrant on his teeth, literally. A judge signed off on the warrant.

For whatever it's worth, I hear they no long consider teeth impressions as acceptable or admissible in court. It's not as precise as one might expect.

They do know bite marks aren't used in court anymore because its sudoscience and has been found to be usually pretty inaccurate
