@@MerysKey I posted an EP and then like a week later they took down my EP for “artificial streaming” so they started an investigation to make sure it was official and it took almost MONTH and a few days for them to finally put my music back up and for them to apologize for the inconvenience at that point the songs lost its traction and I wasted money on my ad campaign with Facebook , their system I feel like just needs to change whatever they are using
Oh this was the EXACT video I've been looking for: an actual lawyer going over what's abnormal or otherwise potentially alarming in the very confusing ToS of the companies I'm looking into. Spot on! And the thought that Spotify and Apple Music may incorporate a direct-to-fan model is something we hadn't come across but makes a lot of sense. Loving the content!
They updated the contract, and as far as I can see. They are also taking more money now 70%(you) 30%(them) for the money you make; It's in the contract now. And they can keep your money until you meet a threshold of 50 dls. which can be more if you misbehave.
Have you determined if the term "(Irrevocable) in the sentence "you hereby grant to symphonic an irrevocable non exclusive, fully paid, royalty free right to license, distribute, prepare derivative works , incorporate into other works... and to grant sublicenses of the foregoing rights etc... " actually means that their "right" to do exploitaion of ones music 360, remains legally in force forever and does not even end with the ending of the contract or voiding the distribution agreement with them because of the term irrevocable ? that would be crucial to know.

We watch all these exposure videos. They’re very informative. But how about helping us find distros that are good. I’d love to see an Exposed video where you show an amazing TOS.
She is right that, pretty much, all of the distros have similar terms, but with my current experience, ONErpm seems to be a little more friendly. They don't have near the harsh language in their contract like Symphonic. I know a lot of people don't like the % being taken out, but I like them, overall.

And there are other options, especially if you have already built a community. -> There is always the possibility of uploading your album as a torrent, and politely asking for donations in the read me, explaining why you chose this type of distribution, and why you hope they will "give back" if they enjoy it, and that it's ultimately fine to listen for free, if you can't afford to pay for it... Then advertise this on your platform to your community... YT, Twitch etc etc... I know about people making more money this way than with all the distribution platforms combined... One of them, I'm sure you know.. Benn Jordan also did that as an experiment once... with pretty much the same results.. Or like Mary Spender, who first built a YT following, and is now selling her album through there, next to streaming platforms.. I think that will make her more than any single, or even all streaming platforms she's on, combined. And some people will enjoy your labor for free... Maybe they needed it... I personally copied half the local music library as a kid, because empty tapes was all I could afford (yes I know I used to be a filthy pirate even before the internet, I nowadays do pay for music I enjoy since I can now afford it, and as an artist I know it's important to do so)... And as an artist, I must say I'm fine with that kind free use (if they don't pay but still get inspired by it and go on to make their own stuff).. But it turns out if just a small percentage of people that enjoy your music actually donate something.. you already made more than on streaming platforms... in the same time period... It's become very ridiculous. It always has been, but nowadays it's in full public view and it just keeps happening...
Here's an idea : An international alliance of distribution cooperatives. 1 cooperative in each country. Could even put up a new international streaming service where very artist members can get into as part of the distribution. I don't know, coopify or something? An artist can become member, get their music distributed, keep 100% royalties and no fees. Only include in the agreement that the pool of royalties will be used to make interests, which will be used to pay for all costs. Any profits get redistributed 50% to artists, and 50% in the cooperative's coffers.
@simsoms Except interest rates are way on the floor rn... So for them to recoup their part through just interest, might mean they will have to hang on to your money for about 20 years or so...
@@jazzdirt If the pool is properly managed you could expect to generate 5% to 10% a year. Also add the costs to clients if there's a streaming platform coming with it. Also could generate donations and bring in volunteers at beginning since it would be a cooperative/non profit. Make artists pay a fixed one time price to become member of the cooperative to fund the initial growth, at worst add a fee per release for as long as the cooperative is not generating net positive cash flow. Once it would be going, artists wouldn't need to pay anything to publish, and keep 100% royalties.

And at the same time upload it to a torrent site (free but with a read me asking to donate if you enjoy it), and advertise it through your channel... YT Twitch etc... It's archaic... and doesn't line up with todays reality. Copyright was meant that artist could monetize their art and prove they made it... I used Symphonic as a label under their older label services contract since 2016. I too had an issue with content ID as well as a couple of other things with them... I have one song from one artist, that I am trying to get them to release the money. They went downhill since 2020
The same issue you had is the reason why I stopped sending artists to them. They are applying content ID to all the music they receive and don’t give users the option to opt-out.
Take out from this ..go direct to fans ..its the only way ..or once you have a following direct your fans to your own website away from the the music platforms ..sell to your fans direct from your own website ..your music ..merch ..tickets everything !! You then dont need these distribution companies then !! All the tools are there now to do this !! Run all your promotion and adds on your socials and send them to your website !! If say a just a 1000 super fans spent just $40 on you as an artist a year thats $40,000 a year of income .100% all yours !! This has to be the way to go !!!👍👍👍

What frustrates me the most about the distros is that everything is ZenDesk. It's formula responses, no human anything. Ultimately not helpful, in the slightest. It's absolutely stupid and ridiculous. Ineffective. Give this comment a thumbs-up if you agree.

Someone should start an artist owned distributor, kinda like Nebula did for video. With enough artists they could get better terms with the streaming services and offer better deals to their artists. Unionize!
This is an excellent series. Keep it going. Every indie distributor has become terrible because Spotify has made them terrible. It always seems to be Spotify accusing artists of fake streams without proof. It's Spotify who is imposing fines on distributors for alleged infractions without proof. I'm sure the other streaming services are on the watch for phony streams, but when was the last time you heard of anybody on UA-cam Music or Tidal or Pandora or Apple Music complaining about being kicked off due to alleged fake streams? Has it even happened much? Yeah, it's mostly Spotify doing the accusing. Maybe I've watched too much Curtiss King lately, but I agree with Curtiss that Spotify is the problem. Daniel Ek and his sketchy past and his creeper head. All those fake bands on there since 2016. Stop distributing to Spotify! Abandon the platform. Just STOP. Quit feeding the beast!
It's time to change "having to go through distributors" change that back and you'll change the game when enough people say you're right that is a better game. So what if not every platform gets you. Good, it'll change that streaming game too. All of a sudden they'll want you to have more. Make them battle it out for your place

The term derivative is pretty broad and nebulous. I am learning these terms. If your cue is whole or in parts found inside a video, that is repurposed derivative work. Ideally I am fine with that as long as I may receive some compensation royalties or some benefit My opinion all AI music is purely derivative work. (I would not use any part of an AI generated piece. One will likely get into issues.) Likely in all cases music released across streaming platforms is derivative work. You are automatically allowing the distributors to use it in a changed format. The only way music and video is deemed non derivative if its hardcopy, vinyl, interactive cd cassette etc... I may be wrong and any clarification is welcomed.
So it now apparent that all the sharks have moved from big labels to online distribution deal? Well I guess the only thing left for musicians is create their own distribution system. Like we use have with vinyls and tapes . If a few musicians with money take the task seriously. We can kick all of these sharks out of the water. Or everyone has to sale on his website. 👋

100% agree with you. I was with them on their original partner agreement from 2014 - 2023. They have taken such a nosedive in recent years

I hate ZenDesk. Whenever I see a company using ZenDesk, I avoid them. ZenDesk means CHEAP and THEY HATE CUSTOMER SERVICE.

The term derivative is pretty broad and nebulous. I am learning these terms. If your cue is whole or in parts found inside a video, that is repurposed derivative work. Ideally I am fine with that as long as I may receive some compensation royalties or some benefit
My opinion all AI music is purely derivative work. (I would not use any part of an AI generated piece. One will likely get into issues.)
Likely in all cases music released across streaming platforms is derivative work. You are automatically allowing the distributors to use it in a changed format.
The only way music and video is deemed non derivative if its hardcopy, vinyl, interactive cd cassette etc...
