  • The plaintiff says she hired the defendant to build a staircase in her backyard, but she soon realized the work was poor quality. She claims the stairs weren’t even attached to the house and were dangerous, so she’s suing for her money back. The defendant says he told the defendant he had never built a two-story staircase, but she didn’t care about that or getting the proper permits.

      this was a terrible ruling - nobody should be allowed to hire someone to do free labor when they know they are paying way less money to a person who usually does not do that particular job - this woman got a free test run to see if her stairs could be done cheap and she did it on the back of this poor man . i guess the judge believes in slave labor when she feels its ok to rule like that - the plaintiff should be responsible for her decisions and not be able to escape the consequences when things dont go right .

      The judge ordered him to give all their money back because they took it all the way down. If they would have kept some of it up, she would have ordered him to just return some of their money back.

      He worked 11 full days. Even without the stairs, the door and the patio and 11 days labor was worth 1400.00.
      She gets the door & patio for free, lies to the judge about having the stairs rebuilt, then tells Doug she's going to have stairs built & starts calling the defendant names.
      She plopped a goofy carpet on the very top of her bald head so she could go on the show & admit to being sneaky, shady, & cheap...then demonstrated she's also a liar.
      Then she started calling him a bum. Like she's not? She's an awful person.

    Totally disagree with the ruling here. The plaintiff knew this guy wasn't a professional and she was doing it on the down low without a permit. He admittedly didn't do a good job but his time and effort should have been worth something. Not to mention she never gave him a chance to try to fix it. If I'm the judge here I split it 50-50.

      people need to realize that just because someone needs a job done and you have a tiny bit of skill to do it, regardless if you need money, you should pass the job to someone more qualified.

      I think the reason she won was because he passed himself off as someone who *could* do it. If he had said to her, "I've never done it before but I'll try for you" i think it would have been a different story.

      This one is tough. On the one hand, I do feel that this man put in hours of work and should be compensated. On the other hand, I do agree that the deck was worthless which means the lady paid $1,400 for nothing.

    Calling him an "undesirable" & a "bum" was just classless! When Harvey talked to him at the end he didn't like the verdict but kept his class. You never want a client like her. Yes, he did a bad job but she wanted an $8000 job done for $1400 and got what she paid for.

    How can JM give back all the money? The Plantiff hired him knowing he was inexperienced and have the audacity to call the Defendant a bum. At least pay him for his time. Such a bs judgement as I’ve seen in other cases where JM would award the Defendant some money for the 2 weeks he worked. Kind of losing creditability for her now.

      The judge didn't do a good job explaining the law. If you do this kind of work without a license, the person who hired you doesn't have to pay you if they don't want to. It happens all the time.

      "Clean hands" applies if you're actually committing a crime. Failing to get a permit can usually cause civil penalties, but is not generally going to be considered a "crime."
      That being said, I do wish there was a way the defendant could have gotten paid for his labor in this case.

      Few, if any, civil courts are going to reward someone who has filed a small claims if their part in all of it was underhanded as well.

    My deceased husband was a carpenter. stairs are VERY complicated, You have to figure out ahead of time how many steps you will need to fit your space, PLUS, the saw cut also takes up space so that has to be considered, PLUS, make sure whoever is using the steps can handle the height of of them, PLUS, make sure your foot will fit comfortably, plus, figure out the landing and foundation. That is not a job for a beginner.

      A lot of places have code as to tread width and height of stairs. I built my own, on research, not that high only 6 or 7 steps and there is a lot more to it than just cutting the wood and nailing it together. Also if you mess up you're not going to just fix it, with stairs you mess up you either have what you have or you redo them. He's just making it sound like he can make some minor adjustments, no way, not happening. That being said, you want to pay that price knowing what a professional job costs, you should be on the hook for something as should he for claiming he could do it. I had no problem doing my own but even after that, a neighbor liked my work and asked me to do hers and pay me and I refused the job because I'm not confident enough to get in to a job like that for someone else.

      Nope. You can't do contractual work like he did without a license. Not only that, he built something that was a code violation and dangerous. Even if he had done a good job, she could have stiffed him and he would have no legal recourse.

    Explains why plaintiff doesn't deserve anything. Rewards plaintiff full amount.

      Exactly I wondered why she switch up the case. She also always says the cheap comes at a price or however she says that phrase about when you try to be cheap you pay more in the end. Plus he did more than half the work building the door and patio. Her only complaint was the steps. Like they forgot the rest of the job was included in the price that wasnt just for the steps.

      A "deal" being illegal doesn't omit it from being trialed. Sure, you aren't guaranteed certain protections the way you would be otherwise, but there isn't a "I get to scam people if the deal is illegal" rule in America.. And for the record I was on the guy's side. The Plantiff was a complete b!tch.

    With due respect, our favourite judge got it wrong this time. The plaintiff seems to be one of those people who are never satisfied. Also why didnt her husband work with the carpenter especially when all parties knew that the carpenter had not experience in that type of work - in other words they all knew that they were taking a chance.

    BS judgement. The plaintiff was advised ahead of time that he had no idea what he was doing. She shouldn’t have received ANYTHING back. It’s not as if she didn’t know! She KNEW!     I am very disappointed with JM here. The defendant seemed like a straight up guy. He was doing the job for a fraction of the cost. Why did she not let him come back and finish? As always you get what you pay for and he was doing his best. JM is so inconsistent.     She would have had to tear it down even if it looked like the best deck and staircase in the world since she didn’t have a permit.
    “You shouldn’t have to return any money, why?”
    Well….because I did the work, wasn’t allowed to fix anything and had the work torn down. That’s how business works. Stairs can be corrected, nails can be hammered more. This was an insane ruling and I’d be ashamed to call myself a judge after making the ruling.

    Wow this seems like such an odd ruling for JM. She usually will give you something for your time and labor. She doesn’t usually reward people the entire refund. He spent time there doing that work and he told her he didn’t know how to do it lol.

    This judge pisses me off sometimes, you get what you pay for, the plaintiff should have did her homework and asked to see pictures before offering him the job. Poor guy did work, put labor in and he gets nothing. This lady is something else calling him a bum when they both work at the same place. She's a bum because at least hes trying hustle on the side !

    I understand this. For three years I was mowing a client yard for his mother. Last year I would just mow over their dog waste and say nothing about it. This year they have four pitbulls. Two additional then last year when all they had were two. I went to do their yard a couple of weeks ago. Get to the house and there's like five patches of wet dog waste in one area. I went to pick it up and place it in the trash can. Then I notice there were dog waste all throughout the yard. I text him and told him that I couldn't do the yard until someone came and cleaned up the poop cause after picking up five wet patches of it. I wasn't doing it anymore. That Monday I text to ask if he was home and he text back. I found someone who will do the yard for a cheaper price. I said ok. In a way I was hurt a little but at the same time. I was happy because now I don't have to clean up four pitbull waste anymore.

    I think the plaintiff is a pos. His work was crappy but I don't see any reason she should have called him an undesirable and a bum. To be honest, she should have gotten half her money back and not the whole thing. At the end of the day, he was up front about not being licensed and she knew that hiring someone qualified would be EXPENSIVE. She wanted pro work at an amateur price and has the nerve to call him a bum.

    The judge only complained about the stairs being a problem. What about installing the door? What about the deck? What about the money this guy put out for supplies? They chose to tear the whole thing down rather than just redo the stairs. That is on them. Now they have all that free lumber and this man gets nothing for all his hard work. This lady called him a bum and put him down when he was trying to do his best and save her money. That shows poor character. I do like the defendants attitude and hard work ethic. This will serve him well in the future and I wish him well. They paid for a $1400.00 job and expected a $14000.00 job.

    I love this judge but your inconsistency is insane. He still worked. They still got materials. No reason he should be paying it all back even regardless of state laws. One day you give the contractor some credit one day you don’t. Pretty insane. Seems the public agrees too.

    I hope justice finds this man, because it didn't in this case. What happened to her saying her spanish phrase, "The cheap becomes expensive?" I'm not saying he shouldn't have paid anything back, but he did spend 3 days, and likely at least a couple dozen hours on that project. He should be paid SOMETHING. He was in over his head, and so was the plaintiff who who was trying to bypass the proper process. Unfair.

    Since I always skip the snarky bit at the opening, I thought this was going to be a case of the underqualified contractor underquoting himself and asking for more and more money until the client got fed up or something...
    I think he should have had at least one more chance to fix it and she knows damn well she had family come over, comment on the steps and then she realized just how bad they were.
    That said..I'm scared those steps wouldn't hold anyone's weight let alone being wide enough to traverse...he should have realized he bit off WAY more than he could chew and quit instead of trying to power through. Stairs aren't something you try your hand at....
