  • The plaintiff says the defendant is a menace to society. She claims the defendant sped through a stop sign as she walked her beloved dogs on leash, hitting them and breaking one of her dog’s necks, which killed him. Not only that, she says, the plaintiff then fled the scene. She’s suing for her dog’s cremation and purchasing another dog. The defendant admits she hit the dog but says she fled because of an angry mob. She’s countersuing for harassment.

    When I cross a stret with my dog, he is on a leash and it is shortened to 6"

      I think the driver was speeding and not paying attention. It was a residential area. Youre supposed to be cautious and going the speed limit. How would thr driver know if the dog had a leash if she didnt see it and drove off
      The plantiff definitely should have brought at least 1 witness tho.

      Even if the dog WAS on a leash, the owner allowed the dog to go into the middle of the street , and dog got run over... Totally the owners fault, for several reasons. Glad the Judge ruled that way. Dog owner did NOT have control of her dog.... owners fault, and owner needs to take responsibility for that.

      To add to the OP's point, the story about the neighbour shouting warnings says a lot, too. I think most of us would react to try and warn the driver when a dog is off leash (I've done it a few times), but not many people warn when a dog is on leash, because you assume they're under control...

    Seeing the other neighbors were screaming woah woah makes me think it was off leash and ran into the street.

      Exactly! Nobody screams like that at a dog on a leash and under control, because there's no danger there. But we all see the danger when a dog has taken itself for a walk near a road with approaching traffic, and there's nobody nearby to grab it...

      @@TheDerpyDog this judge do that a lot! I noticed she don’t let people tell their story. She always cut them off and talk over them. I feel sorry for both of the women though. I’m sure they both experienced trauma from the accident. I would pass out if I saw my dog get ran over and would feel bad if I hit someone’s dog. My dog is like my baby.

    There was no leash , just like there was no stop sign right at the corner by her house, it's very sad but her story changed so much and her own evidence proved different

    This plaintiff is making up her story as she speaks 🤣 she started by saying the defendant ran a stop sign only to discover the stop sign is a block away from her house. I do not believe anything the plaintiff is saying after that. None of it make sense. In the words of Judge Judy “If it doesn’t make sense, it’s not true.” Period❗️

      @@TheZogie Sure did. She should be ashamed of herself for lying in court like that. How was she behind a tree and not hear a fast speeding car coming, knowing your dog is in the street. That must’ve been a huge tree, and what was she doing for that long behind a tree to not get her dog out the street. I wouldn’t let her watch my kids. She lacks awareness and accountability. I’m glad the defendant won. It sucks she killed the dog buts it’s the owners fault, not hers, she was simply driving up the street.

      No, she said was saying the impact took the dog "meaning the leash" right out of her hands. But she never said "I was holding the dog at all.
      Sometimes I feel like ppl don't even listen or I am so used to dealing with ppl who talk a certain way that I always understand what they mean even if they articulate it incorrectly.

      I agree. She makes it too obvious of a point to say "They WERE ON A LEASH". And the defendant also makes a fair point. If the dogs WERE on a leash, and she ran the stop sign, how is it only the one dog was crushed by her car? How did it hit one and not the other dog and the owner if she plowed through the stop sign and hit the dog? And IF the lady walking the dogs was so close to the intersection, she should have seen the car coming and stopped to let her pass before going across with her dogs.....which she SHOULD HAVE DONE, because the photographs of that intersection prove there was no stop sign or stoplight there at all. So therefore, the defendant had the right of way.

      @@CeltycSparrow I think you're right, but at the same time, you're supposed to drive slowly through a residential area and keep an eye out for living things in the road. Little children can dart into the road after a ball or racing out of their driveway on a bike. And of course dogs, cats, squirrels, etc.
      What if she had run over a child? You don't have to put a leash on children. What would be her excuse then? "I didn't see him." And all would be forgiven?
      The plaintiff should have brought neighbors as witnesses of the defendant driving too fast/recklessly through a residential area.
      I think the defendant should have paid half of the bill, because it was at least half her fault.

      One time I was stopped at a stop sign and obviously waiting for it to be clear to turn left when the inpatient lady behind me decided to go around me and turn into the road while someone was coming from our right. She damn near caused an accident and the guy was so pissed, I was able to turn right after and watched this guy just harass the hell out of her! Lol! I was happy she got a little it if what she deserved, I wish she would have caused a crash I would definitely had been a witness. I hate assholes who can’t drive and expect me to risk my life so THEY don’t have to wait.

      And she kept changing her story. First it was a stop sign, and when the Judge saw there was no stop sign from her own pictures, then it was speeding, and then when that didn’t work on her way out it was “well she almost hit me.” Ok lady.

    I don't believe the Plaintiff had them on a leash at the time he got hit. The defendant was not negligent, and did not hit the dog on purpose. I feel awful for her, but definitely just an accident and no one's fault.

      Nissan altimas can speed as well. The type of car shouldn't even be used in this case. All types of cars are flying up and down my street all day.

      I didn't notice that at first, and combined with her ever-changing story, she wasn't watching her dogs, and I'm venturing to say they weren't on a leash. If they were, the plaintiff would be bending over backwards to show the broken leash.

      Not at all really. Like the judge said roads are for driving, a dog owner needs to be aware of what they’re doing. In my state you aren’t legally required to stop for animals because swerving to avoid them can lead to a worse accident. ie the plaintiff could have swerved into a tree and killed herself and her passenger.

    So unfortunate, but the defendant did nothing wrong. The plaintiff knows she did nothing wrong. She's lucky the defendant didn't countersue for damages to her car... If she wants to be rude and ignorant, then I would be rude and ignorant, too, but the law would be on my side, because the only person in the wrong is the plaintiff.

      BOTH ARE VERY WRONG, all drivers must by law be in control of their vehicle at all times. ok for one moment let's say it was a small child who ran out on the street. Regardless; a responsible driver stops and gets out to see what was hit.

      I agree. I am a dog owner myself and I see so many dogs off leash running around on trails, sidewalks, in unfenced yards. Makes no sense and puts animals and people in danger. There should be more regulation for animal owners.

      And here I am taking my 80lb Lab outside always on a leash and with my Pooper Scooper. Yes I have had other dogs run in my yard to fight him, so I have my pepper spray and stun gun on me, in my yard.

      I hate it when I’m out in public and someone with a dog allows the dog to just run up on me to sniff or jump up on me... if I look or say something out of the way the owner always has the nerve to say - he won’t bite or he’s just being friendly- listen !!!! An animal is still an animal at the end of the day- you simply just never know how your pet is ever gonna respond to new people. For all you know just me standing there backing away could trigger an attack or something-- pet owners keep your dogs away from people if they don’t ask to be involved.

      Even if the dog WAS on a leash, the owner allowed the dog to go into the middle of the street , and dog got run over... Totally the owners fault, for several reasons. Glad the Judge ruled that way. Dog owner did NOT have control of her dog.... owners fault, and owner needs to take responsibility for that.

I think Judge Milian even said it was her favorite case of all time. The poor boy said it was so sore and raw that he couldn't go on and just needed a few days to recover.
      Judge Milian said, "Ladies: he is ONLY HUMAN!"

    I feel the dog owner more than I care to admit. No one wants the be the reason their beloved pet has passed but she should forgive herself as it was just an accident. This poor defendant has been put through hell and did nothing wrong! If the neighbor noticed enough to get her to stop, the plaintiff should have noticed enough to yank her dog out of the road. It’s a tragic situation for her but she has mad herself into villain for attempting to bully this woman into accepting blame over something that wasn’t her fault.

      @@peachesandpoets the defendant is being sued because the plaintiff couldn’t control her pet properly. She was harassed and the plaintiff was humanizing her pet while vilifying the defendant in a way that made the defendant seem like a murderer. All the while, the defendant didn’t do anything wrong and she was gaslighted by the plaintiff into believing that she was some how at fault. Regardless if she held her innocence, she still spoke of a hope for justice for the plaintiff and apologized. She has nothing to apologize for and there is no justice to be served. It’s traumatizing!

    The plaintiff caused her dogs death period. Leash or no leash.....if on leash, the owner did not look before crossing and the tree isn't big enough to block her view down that street and if it was, she is responsible to 'look' before crossing.

Let's say the dog was on a leash, and car was speeding, the dog owner would've seen her coming IF she had stopped and looked before crossing the street. Even if she didn't SEE it how did she not HEAR the vehicle?
      Lots of accidents happen when people are driving speed limit and someone steps out in front of you.

But just from experience, i rarely, if ever seen roadkill in residential areas outside of slow ass possums (who people hit on purpose at night) but i hear. Im holding other people going by my excellent driving standards. Plus shes a woman, so off rip shes a bad driver.
      I agree with the judgement btw, plaintiff couldnt prove anything.
      Her not stopping was suspicious and didnt sit well with me because she "was scared" but that wasnt enough

      I owned a dog that I trained to sit and wait for the cars to go by and then look both ways before crossing, he was an Australian kelpie/cattle cross, very intelligent breed.

    Plaintiff is a liar.
    Defendant was driving in the lane on the opposite side of the road. At least 10ft on the other side of the road. Add in the space for parking on the curb and you're even more than that. If she were behind the tree, the leash would've had to been over 10tf long more than likely longer based on her statement that the defendant almost hit her in the process, it couldn't have been that long.
    If the dog was on a 6ft leash, that would've meant the plaintiff was practically in the middle of the road, easily visible to the defendant. If the statement about the defendant speeding were true, that would mean the plaintiff practically had to run or even walk a brisk pace to get that far out into the road in time for this to happen.
    A neighbor wouldn't be running into the road to wave down a driver if the dogs had been on leash as it would be assumed the owner of the dogs was in control. Also, a neighbor willing to try to wave down traffic would likely be willing to come as a witness to testify that the dogs were leashed.
    Dogs weren't leashed and were likely running across the street to see the neighbor. The neighbor tried to signal to the car to stop but wasnt able.
    The lady didnt ask a neighbor to be a witness as she knew the incident was her own fault for not having the dogs leashed.
    Trash.

    How did the plaintiff see the defendant coming from a stop sign a block away at a very high rate of speed but at the same time was crossing the road with a tree obstructing her view and her dog was wandering far enough ahead of her to be in the opposite lane to be hit? Just trying to write that sentence was making my brain melt because of all the contradictions. Her whole defense made me not believe a word that came out of her mouth. Even if I believed that the dog was on a leash… which I do not then it really sounds like she’s trying to blame somebody else for her carelessness.

    one of my dogs got out of the house, run into the road and a car hit him. My dog's mom got to him first and held him in place till I could get to him. (I have both his parents.) The lady who hit him stopped and said sorry and wanted to talk. I wasn't mad at her I just wanted to get my boy inside and check him over. I told her it wasn't her fault and went inside with my dog. The poor lady felt so bad she went to the police station and turned herself in. When the officer came to my house, I told her it wasn't her fault and asked if I was getting a ticket because my jackass got out. The cop laughed and said no, they just wanted to make sure the dog was ok. I told him yes, he was just bruised. I chewed that dogs butt up one side and down the other once I knew he was ok. That was nothing compared to what his mom did to him when he was better and allowed to be near her again. lol

    The plaintiff was 100% lying. Saying she gunned it and people were screaming but she had it on a leash and "couldn't see"? It sounds like the dog ran into the street without a leash. And judging by the plaintiffs demeanor I definitely think they harassed the defendent.

Not to mention that unless the girl was in the wrong lane, the dogs leash would’ve had to been 8-10 feet long since the owner said she was behind a tree at the time!
