  • The plaintiff says she and her boyfriend rented a two-bedroom apartment from the defendant, which turned out to be a huge mistake. She alleges that as soon as she complained about lead in the apartment, the defendant served them with eviction papers. She’s suing for $10,100 in damages. The defendant says she got several noise complaints about the plaintiff and her unruly kids, so she told them to leave. She claims the plaintiff contacted an attorney after she left about lead. She’s countersuing for what she’s owed.

    Never get an upstairs unit if you have children. Children will be children and it can be a Nuisance for anyone living downstairs 🤷🏻‍♀️

      I was saying the same thing! I was shown a second floor apartment but when they said the first floor would be available in a month, I jumped on that instead. I knew I was coming in with a toddler. A boy at that lol

      How about don't move into a downstairs unit when you know kids live upstairs and you don't like the noise? Some people can't just turn down places because they have kids. Sorry but the kids downstairs make ALOT more noise than my kids do up here.

    A shame how the defendant says that she was like a scammer manipulating and squeezing out the money but evidently the landlord was the scammer she was trying to steal the girls money so that makes her a thief. Beware of who you rent from

    When she made the statement children should be able to be children, why do I get the feeling that means their able to do whatever and act anyway they want without any guidance or discipline from her? Then the picture of the door frame proves further that the tenants were right in their claims of them being a constant problem. Laughing saying that wasn’t me when the judge read out the boyfriends past convictions. Yeah, he hasn’t done that to you yet but it’s coming if he’s kicking a door in. Loved how JM called her out on her math. Suing for 10,100. Leaves with only 1300. Big difference.

      🤦🏽Right! My first thought when she said "all" the neighbors were complaining and that her children have a right to be "children" was girl get your life. Children need boundaries, structure and guidance. We all want kids to run free and have fun but if they're making noise all day everyday that means she has no schedule for them. I love children however when parents fail to provide stable, healthy, structure environments for them they tend to be wild.

      Childrens are allowed to be children means they can play I have said the same statement about my daughter playing as I’m supervising her I’m not gonna shush her every 2 mins because she’s being too loud. She’s just being a kid.

    The landlord knew she had 3 young kids...what did she think was going to happen? Smh sounds like she was in a hurry to rent it out and the heck with the other tenants..when they started to complain she could have lost them..so she booted her out..

      I’ve raised a toddler on a 2nd floor apartment and I never once had complaints. It’s called being respectful. She said it was bc the unit wasn’t carpeted, so buy rugs if you don’t want your kids running on the wood floors. It’s not the landlords responsibility to carpet a unit just bc you have kids. I have a feeling the carpet was removed bc it was disgusting and dirty and the plaintiff would’ve used that as ammo in a lawsuit lol yes kids will be kids but you can teach them to be aware of their space, inside voices, walking feet, etc. sure they might be loud here snd there but you as a parent need to redirect them. If she has a downstairs neighbor hitting his ceiling daily bc of her kids then she’s not doing anything to fix the situation. She took 0 accountability and said her kids have the right to be kids. If you don’t want to correct your kids behavior when every neighbor is complaining then clearly there’s a problem and you need to find a house to rent. The neighbors also have the right to enjoy their home without the noise, which is an actual law. Implied Warranty of Quiet Enjoyment means you have the right to live in a space peacefully and free from recurring disruptions or disturbances. So the plaintiff needs to check herself snd be a little more considerate of those around her.

      Loool you always know when people don't actually have children of their own. I worked in childcare for years and had simar sentiments. I think differently now I have a child of my own. Looking after kids and having your own child are two different things.

    As a mother of a 1 year old I understand her and the other tenants. I had to add rugs throughout the apartment and now saving for a home next year so he is able to be a kid in my home. Of course that don’t mean to do what he want because I like nice things and silent also.

    The plaintiff sounds like a nightmare tenant especially with the amount of money she was suing for. What happened to the "lead claim" I wonder? The defendant probably was annoyed with the lawsuit and that's why she bumped up the amount she was suing for. Wish she had the receipt for the damaged door.

      Lmao she don’t have the receipt because she didn’t have to replace and buy a whole new door. She had to buy one piece of the door frame lmao. The landlord isn’t any better than the tenant in this case. She tried to scam as well taking over double of the amount she was really out & should have kept. Judge fixed that quick!!

    Those blinds are 9.99 at Family Dollar. They break if you breathe on them. I have replaced about half of the blinds in my apartment with sturdier shutter blinds. If I look at windows around the building, I see a ton of broken blinds in other apartments are they are impossible to have for everyday use.

    With an FHA loan you can use that 2k ish as a down on a home. I paid $3000 down. Renting with a first and last and or dep that you lose, if you can find a home within rent range, please put landlords that charge huge dep out of business.

      it sounded like the landlord tried to evict her, she went to tenant/landlord court and ended up leaving after the ruling.. Now she is suing because she didn't get her security deposit back after she moved out and the landlord had a right to withhold some monies just not all the monies.

    I’m in the process of moving my stuff out bc my landlord complained about my 2 yr old. She knew I had a toddler when I moved in and I suggested I take the bottom unit but she wanted the bottom unit and sent us to the top unit. The 2 units look exactly the same for both floors so it didn’t make sense to me and I had a feeling this would happen bc my daughter was only 1 when we moved in and couldn’t walk very good. If you have kids and are on there top floor ppl will complain even if you don’t think your kids are that bad. I’m not sure what to do exactly.

    How unfair that the plaintiff is being held financially responsible for a criminal act of another adult, especially when the violence to the property was directed towards her.
    Imagine being in a shopping mall parking lot, having a disagreement with someone and that person punches and breaks someone's car window, and then getting the bill because someone else broke the window during a disagreement with you.

    My Son once lived below 3 kids upstairs. The rolling ball popper & riding toys up til 10 pm was over the top. Wood floors didn't help. When you get up at 6 & can't watch a movie, that shit gets old.

    Nowhere in Philadelphia do those plastic blinds cost $107.00(for 2)! The apartment looks dated & CHILDREN SHOULD BE ABLE TO BE CHILDREN! with respectful discernment and consideration for the neighbors. However, we know when 1 person complains of noise, they "all" complain! Most neighbors are grumpy! You dont pay rent to carry children around the floor to suffice the bottom resident!

      No you did not. You saw a judge following the law. That’s why weeeeee went to law school and not yoooooou, because you couldn’t logic your way out of a fucking paper bag. Clear your ears out, get all your remaining brain cells to hold hands, and rewind to the sentence that starts with, “Doesn’t matter for my purposes.” That means it’s irrelevant-the situation is governed by black letter law that is unaffected by whether that accusation is true or not.

      I was confused by that as well. The show has people who do legal research for these cases. It shouldn’t have been an issue for the judge to take a quick break to look at the law the plaintiff was referencing. That’s what she would have to do in a real court.

    Totally agree, my mother and I had to move when a tenant moved above us with five children we have been at our unit for five years without any problems soon as they arrived it was hell! Never again we’re very quiet people and we respect our neighbors. From then on my mother and I always rented the upstairs unit. And we have never had any complaints

    All right I'm gonna tell the true story about what happened when the downstairs neighbors kept banging on the ceiling because our toddlers were walking around - any noise and she'd hit the ceiling of her unit. We tried the best we could but the lady downstairs would immediately bang the ceiling wherever our kids were walking- which was scaring the hell out of our kids.
    I had a friend who just got out of prison who was one of the most buff and dangerous looking people you could imagine. I think it's fair to say he was a sociopath.
    He was very friendly and charming- a true sociopath. Good looking guy. No remorse. No fear. He beat up cops.
    We left the apartment for one weekend and let him have the place along with a couple 12 packs of beer and a simple request:
    "Yo, the lady downstairs keeps banging on the ceiling. Do me a favor, whenever she bangs on the ceiling, go down there and ask her if she wants sex or something."
    He was thrilled.
    She had a very muscular husband and I think she had no fear. Big mistake!
    He was happy to oblige. Every time she banged, he went down to ask if she wanted to bang with him.
    He kept knocking on her door asking her to make up her mind.
    Her husband was useless against this guy. He went down there even when he was there asking if she wanted to "f" or, if not, why was she banging? He was very descriptive with his offers, husband or not.
    We never heard anything from that lady after that weekend. They moved out soon after.
    He went down there to let her know he was there whenever he came over "in case." He brought condoms to show her, etc.

    Anyone who has a problem with kids playing and running around IS THE PROBLEM!! Don't rent to a family with kids to a 2nd.floor apartment if you know kids will be loud !     As much as the judge brags about knowing construction, she does not know the difference between molding and a door jam. It’s very difficult to replace the jam and not the door. Both get replaced. 😅

    In PA she can't charge twice for that. most POS landlords here will even charge 3x & turn around & just call them different things. Big BIG time scams going on in this state with landlords screwing over tenants.

    So we were renters most of my life and my dad who was retired military had several rules for rentals as the father of 4 children. We always got a bottom floor apartment and if that wasn’t possible then he always bought inexpensive large are rugs to cushion the noise. You do what you gotta do to not get evicted.

    They’re TODDLERS y’all they’re just learning how to behave indoors and not make a lot of noise. The 5 year old on the other hand should know better. You can’t be mad because toddlers are loud, it can’t be helped. It doesn’t matter whether they’re on the top floor or not because kids make noise downstairs as well. Not to mention I’ve heard ppl without kids be just as loud as ppl with kids upstairs and downstairs. Also if you really don’t want to hear kids, move into an apartment complex that doesn’t allow them lol.

    It’s against the law to charge a victim of DV= domestic violence for damages that they suffered on account of their abuser & the judge should have known that. It’s also illegal to evict a DV victim because of damage their perpetrator has done to a residence. The DV victim Needs to file a police report to make sure they are protected from the perpetrator & to keep from being responsible for damages & being evicted

    I have children and my house was always the ones my little cousins wanted to come to! This is the reason I ALWAYS requested a bottom unit! I'm never going to make my kids tip toe in their home! If you want to dictate your neighbors movements maybe you should buy a house!
