An axle breaking has absolutely nothing to do with upkeep. Axles aren't crazy expensive to fix either. The defendant is a disgrace. Admitting to causing the damage and refusing to make things good. I'm glad the plaintiff won!

She's got to realize that she doesn't understand certain things and use other people to help her think through it But when you listen to Harvey in the end What's the value of the car when the car gets damaged... When his axle was damaged We all know if we were buying a car and know the axle is damaged we not paying a high price for it
If they knew that they were going to have to cause damage to the car they should have had him sign a waiver, but the truth is that it was only damaged because the tow driver was being lazy.
I drove a tow truck for 6 years. Mainly roadside assistance but I also have done my fair share of accidents and police towing. There's always a way to tow something without causing more damage. The only time that I can even possibly think of that actually requires you to cause more damage is if the car is already rolled over on its roof or on its side because you have to get it back over on the wheels and there's no gentle way to do that. The towing company absolutely damaged his vehicle and he deserves to be compensated.
I have driven a rollback with a wheel lift and I agree. All it takes is a little more effort to make sure that I don’t further damage a vehicle. These guys know that, but are lazy and don’t care because it’s an old, crappy Saturn

I’m not a tow driver but I’ve had a lot of cars towed to my shops. They can still tow a car with broken axles or separated ball joints. ‘There’s no way to tow it without damage’ isn’t anything a tow driver should be telling you. If they say that then call someone else and don’t pay the first driver anything. Even if they wanna charge you for just showing up. Don’t pay anything because THEY are saying it can’t be towed without damage. You’re not forced to use a company that says they’re gonna damage your stuff.

I once witnessed a tow truck flatbed drop off a car at the mechanics where I was sitting in my car waiting for parts. It tilted too high and the driver backed the car off catching the bumper and releasing the headlights. He heard the sound, paused but didn’t get out to look, then proceeded to put it in drive and drove over the lights. Poor lady only came in with a flat tire! When I confronted the driver he denied it!!! I was aghast! I wrote her a letter to give to the insurance company.
I think next time they should of just let AAA tow it and stay out of it if it was gonna cause damage because of it already having a broken axle. Idk why but the older defendant reminds me of somebody anyone know who?
By no means am I saying that the defendant should have gotten away with damaging the plaintiffs car but my question is in a situation like that where a vehicle is damaged and one wheel won't spin and a reputable company like AAA won't tow it because the only way to tow it will cause damage how does someone tow it without causing damage and being liable? There are lots of cars that are wrecked and have damage and aren't in working condition and able to be towed without causing further damage, there's got to be someone that's willing to do it or there would be wrecked cars that no one would move for fear of liability.

You clearly don't watch many judge shows. Dog cases are VERY circumstantial. For example if a dog gets sick/injured and has vet bills... The person has a right to get the dog "whole" so as the vet bills are reasonable. But you don't get things like pain and suffering, lost wages, anything like that. There ARE legal and financial limits that a person can receive in dog cases. Just as there are limits for cars. A goal of court is to make a person WHOLE not to be enriched.. For cars it is the value of a car is because an insurance company would consider it totaled. Hence the blue book value. As that is what an insurance company would pay anyway at BEST. There has to be limits in place. otherwise people would make $1,000 cases into million dollar cases for no reason

Looks to me light the marker light snaps in and the tabs are still intact. He doesn't need a fender though it does appear to have minor damage. Hood looks fine as far as the bumper pull it off any bent brackets are easily bent back by hand. And since the car was towed no way is the $300 refundable, SCAM ALERT

Plaintiff case is very credible, and I believe tow company damaged car more then it was. Sure he couldn’t sue for the tow and storage, but he should have received what it cost to repair car. Just because some value book ( insurance scam) say it’s only worth x amount, it still isn’t going to cover cost of him replacing or repairing car. Damage done should be damage paid.
I had Crown Vic and my lower ball joint broke which left my control arm hanging my wheel was not able to be stabilized and moved around. When I got it towed the guy knew my Dad and took extra care not to do what they did to his car. Took about 45 mins and a lot or care and patience on his side.
My car was damaged when my ball joint failed and I called a tow truck and he pulled it onto the flatbed without making sure the front wheel as facing forward and the driver side wheel got pushed into my fender and bent the fender and bent my strut tower. I told him I want at least a used fender but in good condition and that was about 4 years ago and he has only called me once but that was to tell me somebody was selling a car just like mine for like 500$ dollars and I had to pay for it, and the dumbass was like”this car is much better then your car” I said no and I just wanted the fender and the owner wasn’t selling it for parts so basically I got screwed and had to pay for the damage myself
Plaintiff is a scammer. He knows darn well he was in a wreck. Usually tow companies have signs and paperwork not responsible for damages. I hope they correct that so the next scammer doesn’t try to take advantage.
