I’ve got a bunch of years of civil practice in both state and federal courts. Please, please let him file his notice of appeal of his state criminal case to the US District Court. As Mike mentioned, he will discover some real rules about subject matter jurisdiction. Hopefully, the feds will get to collect the filing fee before they throw him out the door.
Years ago we just tested before and after shift. But then we switched to A best practice of testing the tuning forks on the set at the beginning of shift, and then again after each ticket. The tuning forks are kept in a protective case.

Last I looked the filing fee in US dist Ct is about $400. Should be a "somewhat" different argument he makes regarding "jurisdiction" in that court.
