    Workplace transition only after you do a resignation, complete your notice period & finish the exit process. Many things after giving your resignation can be challenging. There are so many questions that people have while on notice period.       Can you pls give me some advice. Im just thinking to drop off from organization due health issues. But I have a bond of one year. Can I apply or will I receive any negative feedback so that will it effect on my further career on job.

      It depends on the terms and conditions of the contract. If you are still on probation you may consider leaving but if it’s a bond signed by both parties company can take legal action if you leave early. Go through your contract and let me know if you have any questions.

    Should I disclose my new company..? This industry is pretty small and they know the company I’m going to be working for. So Im sure they’ll find out pretty soon

    Mam,what to do if they are not giving experience letter and sal slip

      In this case, do everything on official email. Send a thank you email on your last working day and ask for an employment letter mentioning only the dates of employment. Regarding salary slip you can always use your bank statements blurring out other transactions. They should solve the purpose.

      Hi Athira,
      An experience letter is your right by law but there are some difficult organizations.
      I would recommend you to talk to the new company’s HR about your situation- tell them frankly that your company is denying to provide you an experience letter or payslips. You can only show a google pay transaction if that is fine.

      An employee is generally not entitled for unpaid leaves during notice but few sick leaves can be taken with medical certificate.

    Ma'am, My bond ends on March 2022 , can I move forward with resignation 90 days prior of that , since I can save time , and serve 1 year also , is it possible, I'm working in a IT company

      The first thing to consider are the legal consequences. Leaving without completing the
      Bond may interfere with your employer’s policies, which could lead to termination and/or an absconding case.
      Yes, the notice period is generally covered in the bond period. For example if you have a bond that completes on 20th March. And you have a notice period of 3 months, then you can resign on 20th December and serve both the notice and the bond period simultaneously.

    Greetings for the day!!!
    I have 90 days of notice period and I am expecting 20days earlier then reliving letter. I have tried to discuss with my Manager but no help. Can I know other ways

      If the notice period is as per your contract you are bound to serve complete 3 months.
      Regarding relieving letter - you receive it on the last day or after exit interview. What are you expecting 20 days earlier to leave or have a relieving letter?

      The only way to leave early and complete exit formalities is by talking to your department manager in good faith,followed by HR discussion for relieving documentation.
      If you can recommend someone as your replacement that would be great as having an early joiner would make them allow you to leave early.

    Hello mam, I have got an offer but my future employer is asking to join me in one week, I am on introductory period of 3 months, how can I join future company , can i leave during introductory period because current employer have a clause of "must serve 90 days introductory period". Please suggest me what should I do in this situation?7 days starts from 27march2022

      Generally the employer/ employee have the right to leave with minimal notice during probation ( which is must for all employees) what is written in your contract about exit during probation/ introduction period?

      @@Careervues Thank you so much for the reply mam, it's written " upon being hired new employees must serve 90 days introductory period. your performance will be carefully monitored and if it has been satisfactory, you will become a full time employee.". so I could not understand that is it a probationary period is like all other peoples' in which no notice period is required for probation, or I will need to complete 90 days because after then 2 months notice period will start. However there is an option to settle the notice with pending leaves or buy out the notice for an early exit.       Generally employees can’t take casual leaves during notice period but sick leave is permitted with a medical certificate ( as stated no. Of days by the doctor).

    Hello mam,
    I am on notice period ,notice period is 60 days but i already served almost 45 days of notice period. I asked my manager to release but he deny and hr is totally depend on my manager.
    I did not understand how to recover from this situation.

      Hi Ravi,
      Notice period is always as per the employment contract terms. Incase there’s nothing urgent complete your notice period otherwise you will have issues in final settlement or release letter.       Yes it can not be forced if there is nothing written in the employment contract/ offer. What does your contract says about notice period??

    Namaste madam, I'm working in Pvt Company there is no formal appointment letter and selection procedure, all procedures done by oral. and also it is informal Company and also there no EPF. 15 days is enough to serve notice

      If you have no written/ signed offer letter or contract you are not legally obligated to work for the company. Neither you nor the company can take any legal or formal action in this case. If you have a better job opportunity, You can resign verbally and leave the company anytime.

      Check your employment contract to understand what are your liabilities while resigning. Give them a written and online resignation by mentioning you abide by all resignation duties and let me know what is their response.

    Dear Madam, I've a question !
    This is my 1st resignation in 8 yrs of my service.
    My company, a core company has a mandatory min. Notice period of 3 months. The company B (a service based IT company) I interviewed & they selected me after a negotiation of 45 days notice, they didn't accept 90days. I went back to my company HR & resigned, requesting for 1 month notice, keep some 15 days time in hand, in case of any exigencies.
    Now, my present company said that they accept my resignation, but they cannot relieve me within 3 months, instead they say that after 1 month notice, I can take bal. 2 months leave (which i actually have OL/EL) & then come back after completion of 3 months & collect the Relieving letter.
    1. How to join my new opportunity ? 2. Can I take leave here & join in company-B, then collect relieving letter after 3 months?
    3. How can I negotiate with Company-B now, after accepting their offer ? Will they entertain?
    4. Should I talk to company-B HR & ask for any alternative legal solution to this issue ?
    5. Should I even go to company-B HR at all ? Or wait for few weeks to pass & approach again to my HR ?
    Please suggest a way out Madam !

      Please see below answers in order of your questions:
      1 - Your current company is trying to save money by sending you on leave instead of relieving you, ask them to give you a relieving letter early but final settlement later since your last working day is before your actual end of notice.

    Hi ma'am, I got opportunity for going to higher education and I will not be able to complete 3 months notice period. My manager was very supportive and he is willing to release me before notice period if HR was ok with it. I tried reasoning with the HR and even asked for buyout. He is saying that many employees are coming with the same reason and I need to serve full notice period and to plan my academics likewise. I don't know what to do next. Please help

      Hi Sayooj,
      The HR is making a decision based on situation not tge policy. If your company has a buy out policy and you are entitled for reducing your notice through buy it out, the HR should not have any issues no matter how many employees reach out to them.
      Did you check what is the policy for buying your notice?

      It is said that if I violates the 1 year bond I have to give 50000rs and 3 months written notice or salary in lieu thereof. It does not mention about notice period alone. I want to resign in good terms. Please guide me how to negotiate further.

      If it’s a bond of 1 year the terms are more strict. Out of the 3 terms you mentioned even if 2 are mandatory you need to speak with your supervisor to help you in talking to HR. Additionally offer them to find your replacement if possible so that they can release you early. Best of luck!

      If you want to understand the transition process it goes like this:
      1. Signing of the employment contract by both parties
      2. Submitting resignation to current employer
      3. Serving notice if applicable as mentioned in the contract. Or settlement of notice for early exit between company & employee
      4. Handover by employee / Exit interview/ final settlement by company/ release letter
      5. Joining new job

      Did you already mention that your notice will be 3 months? They must not push you in this case but however,
      Share the resignation email as a screenshot with the concerned person and tell them you are going to negotiate your notice.

    Mam, if I am in midst of a Performance improvement plan (45 days) and I resign, then will I be allowed to serve the entire notice period (60 days) and then leave as usual or I will be immediately terminated?

      Hi Anindan, I am sure you are aware that performance improvement plan only leads in 2 directions 1) improved performance parameters 2) termination.
      If you have a good opportunity you can resign otherwise wait for PEP to complete.
      Regarding notice period look at your contract and check what is mentioned regarding notice period. Based on the terms you will be required to serve notice or leave if on PEP.

      On a PIP, your employer is basically saying "improve or be fired." You can still quit at any point. However, keep the following in mind, if you are terminated for poor performance you are much more likely to receive end of service settlement and letters. if you quit because the job is stressful. You still have to serve the notice period to get the settlement and end of service documents. These benefits can really help while you look for new employment. Hope this helps.

      There is no such clause in labor law that if you resign in between your PIP you will not get any benefits. Resign in good terms and offer support, rest unofficially things are to be discussed and sorted between you and your boss for the initiation of formal exit process. Being on PIP should not impact your lawful rights.

    What if I am resigning during probation and they are telling me to serve 90days notice period?? I am unable to serve that period due to health issues.. My employer doesn't want to talk about it either to his boss...Things aren't just moving as they should be..They can waiver my notice period but they aren't since there have been such issue before...What should I do?

      Firstly there is no notice period service of more than a week is required by the employee if he is on probation. If your signed employment contract says that you have to serve 90 days notice, in this case you must do so.
      Every communication regarding leaving the company or resignation has to be in written or in email form as they serve as a proof of all actions taken formally.
      Don’t talk directly but write to the concerned person after reviewing all clauses in your contract, if everything is fine they have no right to stop you from leaving.

      @@Careervues My offer letter didn't say anything about notice period during probation...I have even mailed them my medical certificate from mbbs doctor asking that I would be able to serve max 1month as notice period of 3months due to health problem... But not getting any reply or call from office... What should I do? Should I submit my assets to office? ... Can't keep this going on for long....Please help

      Hi
      As a next step you must send a final email to your supervisor and HR department, mentioning your last working day( do not miss to attach again your sickness certificate).
      Ensure you are ready for handover formalities and await a reply from them. If no response follow your last working day and submit your assets before leaving the organization.

      @@Careervues my manager is ready. But my manager's manager is not ready . I have assured company to join in 2 months. I also have offer letter . But current company have not yet confirmed that they will release me in 2 months or atleast 15 days earlier

      @baygya you can either :
      1. buy out notice period
      2. Adjust with your pending leaves
      3. Go on an emergency leave and finish exit process later on.

    My company management has said on call that they have already decided to relieve me from my duties with the company and I do not need to serve any notice period. When I asked them to say the whole thing in email rather than on call. They are delaying the process of giving me relieve letter.
    I have recently received an offer from another company. Can I join the new company even if my previous employer is not giving any relieving letter?
    They have even stopped my salary from 1 month before I applied for resignation.
    (P.S- my reason for resignation is that not only they didn't appreciate my efforts but also they kept making bad remarks on my monthly evaluation reports.. I felt mentally exhausted.. even now as u can see they are intentionally delaying things)

      Hello Lily,
      I am happy to know that you have a job in hand. Your employer is playing mind games to be at the benefit somehow. Following is my advice:
      If you have resigned it’s considered a resignation not an unlawful termination.
      Incase have sent them a written resignation it should mention your last working day.
      Check your contract for notice period clauses, how much time to serve notice after resignation.
      Ask your current employer to take the handover and provide a relieving letter based on your official resignation ( mention the date)
      Do all communication in written to keep as an exit proof if needed.
      Based on above you might need to involve your future HR, but try to sort things with your current HR first.

      @@Careervues Thank you so much for taking out time and responding to my queries ma'am.. I'm really very thankful.
      Ma'am around 15-20 days ago, I fell ill and took a day's leave (with permission from my immediate supervisor). They called me the next day.. I was in such a bad condition that I couldn't talk on call. Then a day later they called again and I talked to them and told them that I'm currently ill. Then they sent a "absconding notice" the very same day stating that if I don't go back and join office they will take legal actions against me.
      I wrote my resignation letter mentioning my last working date and attaching my medical records.
      Despite everything, they said you might be lying.. you have to come to office at any cost..
      For the last 15-20 days they are dragging this but 5 days back they called and said that company has finally decided to relieve me of my duties and I do not need to serve any notice period if I pay a compensation money.
      I asked them to mail this new conditions of theirs.
      They stopped communication.
      Now I can't join the new company if they don't send me a relieving letter stating they accepted my resignation.
      I can't tell you how stressed I am right now. I tried looking for a labour law advisor but I couldn't find anyone near my location.
