    I have made this detailed video about notice period negotiations and buy-out options for a leaving employee, do check it out.
    A notice period is a period of time between the receipt of the letter of dismissal and the end of the last working day. Notice period has to be given to an employee by their employer before their employment ends. It also refers to the period between the resignation date and the last working day in the company when an employee resigns.

    I really appreciate your efforts towards explaining the terms and options in this difficult time. I am also serving my 3 months notice period and it's a very difficult time for me as I need to join my new job as early as possible.
    I was very depressed because of my current situation that my current employer is not relieving me even after offering a buyout option. I was misguided by my own manager that I need his permission for that and he won't approve it.
    From your video, I understand that buyout is my right and I don't need his approval, I am feeling a bit relaxed now.

    What amount will be calculated for buyout is it the exact net salary or the basic salary that i need to pay for not service the notice period

    I've been offered a non-managerial position in the UK and the notice period in the contract is 3 months - which seems excessive given that it's not a super senior role and there are no direct reports. Can I negotiate to lower the notice period before signing the contract?

      @vindawg you must surely try to negotiate the notice in this case.Even for managers role 3 months is too much of a notice period. 1-2 months are enough to get a replacement and finish handover tasks.

      It should be paid unless it’s waved off from immediate effect.

    Hi M’am u have explained quite clearly , I work as a teacher and have got a new job in another education organisation, my previous organisation where I was working had one month notice period..I had put my resignation in vacation in 2nd week of May and had asked for a release date in 2nd week of June considering one month notice, they said it has to b working notice which is entire month of June, I said I cannot wait the entire month and buy out what is not served by me, the Organisation has withheld my May salary too and also asking me to work entire June even if I have given option of buyout ..suggest me what to be done, what if I don’t go to work ahead since my May salary is on hold, whatever days I have completed in the month of June is with the old organisation since I’m more focused on working in the new organisation

    When i joined to x company 4 years back.. the notice period was 2 months.. it is mentioned in the appointment letter as well bt now 2 months back out hod sent a mail that notice period will be 3 monoths for every one . How to negotiate and convince to come out of the company.. please suggest me

    Hi ma’am.. I am working in a company where they have two months of notice period.but I don’t want to serve the total notice period as my new company wants me to join earlier..in my appointment letter it is write you have to give notice period or can pay gross salary in lieu thereof but in the company policy I is mentioned notice period buyout is subject to approval of approving authority…in this case can the company reject my resignation?

    Either party can terminate this employment by serving a notice of 90 days on the other. The Company may at its absolute
    discretion make a payment representing salary (basic) in lieu of notice of termination.
    i have talked to my manager but he is just ignoring my calls and hr says that once replacement is there you may go . but they doesnot seem to interested in hiring repplace,ent

    Hello, I have a situation where I am on deputation ( Different country) . I got a contract when I was deputed. But the termination policies are different when I check my offer letter and this Contract. Company claims that only India policy applies. But my Local Lawyer disagrees with what my employer is saying. What do you suggest?

      The origin of the contract has to be followed in case of temporary deputation. Local laws can’t change what the contract says.

    Hi ma’am i found this very informative. I am going through a situation where i have to join another company within one month and i talked to my manager he said that we have put so much efforts on you to make you train on this project and after 7 months you are willing to go out of this Organization. I mean he is not allowing me to leave early. I have a notice period as 2 months and it’s written in the contract that “ In case of failure to serve the notice period, you will agree to pay equivalent gross salary in lieu of the notice period not served. The company has the discretion to adjust any unused vacation against notice period.“
    Please reply me soon because on Monday i need to take action and ask for the buyout and will they allow me for the buyout as per contract.

      Based on the mentioned clauses the company might not allow you to buy out your notice(they hold the right to do so) I recommend requesting tone and offering support in whatever way you can to negotiate your notice period. Let’s see what kind of response you get.

    Hello Ma'am: Struggling to get the 90 day notice reduced. the clause mentioned is "terminable by either Party giving the other ninety (90) days’ notice. The company may, however, reduce this notice period at its discretion by accepting / paying basic salary in lieu thereof" - would it be possible to ask for buy-out with this? Thank you

      You can surely ask to buy back your notice as this clause is mentioned in the contract.
      Make sure to send a written request and it should be settled on your basic salary upon approval of your line manager & HR.
      Send a polite request and see if they agree.

      You must ask for the reason for rejection of buy back. Try to ask for support of your line manager. See if you could offer completing any critical tasks and have the exit before time.
      What does your HR Says?

Now I resigned and wanted early release, but HR says no buy out option is available and wanted to serve 90 days notice period even though I am on bench. Can I say them that the offer letter which I signed in 2013 has only 30 days notice period and I have the right to get relieved in 30 days?

    I have give resigned from my current employer of 30 days but after signed documnet he waive off notice period to ten days and said free her in two days.
    And its hurt my gratuity 20 days pay

      As per the labor law both parties have to abide by the notice period stated in employment agreement. Your employer can ask you for an early exit but it cannot be forced on an employee. Read your contract what does it says about leaving the company?

    Hi Ma'am, nice video , I have an issue regarding notice period, as per appointment letter notice period "mentioned 90 days .However, it would be permissible at management's discretion to allow you the waiver of the shortfall in the notice period by buying (Basic Salary) the said shortfall period in lieu thereof".I want to complete 30 days notice period & rest of two months I goes for buying out but management not ready for buying out & pressurized me for survive 90 days notice period. I didn't want to complete 90 days Notice Period What can I do?

      Unfortunately it is clearly mentioned in your contract that final decision will be by the management so there is not much of choice for you. Though it says that 2 months can be bought, try to resolve this nicely. Request your manager or HR to help you with exit process in return offer them a proper handover or assistance in replacement.
      Lot of people are job less due to Covid, they may find someone for a lesser salary.
      Talk to them one more time with a strategy, hope it will work!

    Hello..My appointment letter says I have to serve notice period and if employee wants early relieving it's company's discretion. However company's exit policy says if notice period is not served, the short fall will be calculated for recovery. This exit policy is mentioned under HR policies of the company. Can I go according to exit policy

      Both the rules mentioned regarding notice period are in company’s favor. As per #HRpolicy You are eligible to pay for unserved notice but having payment against notice or making you serve the complete notice is upon company’s discretion.

      You have to take professional approach. If it’s mentioned - employee can buy out but upon employer decision, you can’t do much.
      As first step understand your legal rights than Try to reach out to labor department in your city for advice.

    Hi Madam, in the offer letter they have mentioned 90 days max or compensation in lieu of shorter notice. Subsequently they changed it as compensation in lieu of shorter notice at management discretion in HR policy. I asked to shorten my notice period from 90 days to 60 days to which my manager did not agree even if I was ready pay compensation. Is this legal. And if I deny to stay for 90 days can the company hold my service certificate and F&F

      The company has smartly addressed in the policy ‘At management discretion’ which means they could approve or reject it. I would recommend you to negotiate again. Following videos might be helpful for you to understand the notice negotiations & legal consequences.

    Hi Ma'am I found right video which suits me in my current situation. I do have a query ma'am that I worked in the organisation for more than 5 years and I got a new offer. I need to serve notice period for 60days which is in the contract. So, my last working day will be Mar17th. But joining date is on Mar14th. I tried to explain my manager but said the date will not change. Any suggestions Ma'am.

      Congratulations on the new job offer. Since it’s just 3-4 days you can settle them with your pending leaves or buy them with your per day salary.

      Make sure you read your contract before doing so.

      It depends on the company’s requirements what documents you need to submit. Some examples are :
      Reference letter
      Payslips
      Release letter
      Kindly ask your employer for their joining documentation requirements.

      I got resignation acceptance letter from my previous employer . They didn't give me a proper relieving letter. They are not responding to my calls & mails.
      So my question is, will new employer accept this resignation acceptance letter as a proper relieving letter?

      Again it depends on the company. Very few organizations are ok to take resignation acceptance and make employees start.
      But some companies follow a list of documents before proper onboarding.

      Do not ask them to renew your labor card. If they ask for it, try to buy time before resignation.

    I am on probation period and not a full time employee till now but i have got a better opportunity in some different organisation and i was selected as a fresher to join immediately. My notice period is 30 days and I have to exit within 2 weeks as I have to join in time there and currently being a trainee I don’t have that much work load or responsibilities, so ma’am what should I do in this situation.       In this case review your contract if there is a mandatory notice period even during probation and talk to HR for an early release. They should be able to assist you. Let me know what they say so that I can guide you further.

    I have a medical emergency in my family for which I want a early release from my current organization, but the Hr is denying saying that you have to serve 3 months of notice period, I had given my resignation mentioning my last day after 32 days and I'm asking for a replacement resource to whom I will train and give the project KT but the company is just making delay as my last day as mentioned in my resignation is coming near and after that I will not be available..So kindly guide me in the same..

I have around 67 paid leaves pending, But the Hr is not ready to discuss or negotiate for my last day in the organization..I'ad asked her whats the sense in paying me for 2 months if will not be present in the company after say 32 days.. plz reply..What should be my next action ??     Ma'am actually I have joined an organization in November 2021 and due to my family issues it's not possible for me to serve the notice period which is of 3 months.
    I can give only 15 days to my employer and for the rest one I'm ready to do buy out.
    Ma'am could you please suggest me how to approach to my employer and ask for buyout and release me ASAP and what if they won't agree so in that situation what should I have to do?

      Hi Ayush,
      As a first step check your eligibility for buy out.
      You can write an email to HR of your company keeping your boss in Cc - request them for early release through buy out.
      Additionally understand from HR how buy out of notice period is calculated and EOS documentation to be completed.

      Waived off notice means exemption of employee from serving the entire notice period. There is no buy back involved when notice period is waived off by HR

So i tried to negotiate the 3months notice period with my HR and manager of current company but they are not ready for it. They are forcing me to stay for 3months and also talking to rudely to me.       As first step check your legal obligations. If it’s not mentioned in the contract, one cannot buy out. If the problem is from employer you can complain against them (if nothing else works).

    Hello Ma'am.Currently I m working in Here Technologies.But I got an offer letter on 24th May from Capegemini on which joining date was 23rd June.So I had to resign in current company asap in order to serve my notice period of 30 days before joining date of 23rd June.During HR interview of Capegemini I had clearly mentioned about my 30 days notice period.But after resignation,she is asking me to negotiate on my notice period with my current manager as they want me to join on earlier than the mentioned date on offer letter.She also threatened me that she would offer this opportunity to someone else if I am not available on the earlier date as mentioned by her.I also asked about buying out of my notice period with my current manager and HR.They are also not ready to compensate my paid leaves with notice period.As I have already resigned,it can't be reverted.So it seems that finally I am going to lose both the job.Please Ma'am guide me on what I should do??

      Hi Rajneesh,
      It is a difficult situation primarily created by your new employer by their unjust demands. Once you told them clearly they should not be pressurizing you. At the same time current company should adjust any pending leaves in your notice period settlement as per labor law. Hope you make a well thought decision about your job.

      I am sorry for the situation. You must have some documents regarding your employment visa with the employer. If they have canceled your visa you do not always get a paper, sometimes it’s online. If you have another offer ask them to check the visa status or guide you on how to help them.       Check your eligibility to buy back notice period
      Keep taking sick leaves as and when you need them to pass your notice of 3 months
      Tell your employer due to pregnancy complications you would not be able to continue beyond 2 months

      I am based in Dubai.
      The companies generally deny the buyout option for employees. It’s sometimes mentioned in the contract that one can settle the notice payment only upon employers approval. I would suggest you to keep following up with them politely to get more clarity about your contract.

      First you need to check if A notice period is a mandatory requirement in your case. If yes, I am not sure if company would except the resignation before completing the bond.
      Buying your notice is the last thing to be concerned, Incase you are eligible to do so.

      If you are starting a new career journey in Canada you might have already gathered lots of documents for your previous experience, so it would not be a problem. Incase you are going to mention this company’s name on your cv, your future employer might do a reference check, so make sure you give the details of the person whonis in good terms with you.

      @Jabeer you need to request your manager & HR to help you with the matter. If they don’t have a buy out policy what is the provision for employees to leave early. Help them with replacement or handover if you can and try to solve it professionally.

Which is their backend fault but they are forcing me to take up 90 days i have good a very good offer with Accenture (they are okay for 2 months not 3 months ) my Hr , my Managerd no one is helpful!!!     Hi, I have a query on termination of employment. If my contract stated: After completion of your probation period, either you or ABC Ltd may terminate this agreement at any time by giving 3 months' prior written notice to the other party. ABC Ltd may provide you with a payment in lieu of all or part of the applicable notice period.
    Does it means as an employee, I have the option to skip the notice period by paying 3 months of my salary to the employer in order for them to release me without serving my 3 months notice? This is because they only stated ''ABC Ltd may provide you with a payment in lieu .....'' and it doesn't mention ''either party''.

      For sure you are entitled to buy out your notice period as stated in your employment contract. HR is declining it unethically. Talk to your manager or anyone from HR whom you think could help you to negotiate an early exit. Let me know what they said, I shall suggest you accordingly.

      @Sudhir it’s not true that only employers can decide about the buy out. There is no law like this. You are in your early career don’t be concerned about such Management. If you have a job and leave the company by going on an emergency leave.
      Ask new HR what documents they need from your training. If there is nothing crucial plan to leave, the employer can’t do much to stop you.

      Firstly- Your company has clearly mentioned in your appointment letter about buy back option Incase you are not able to serve the complete 3 months notice period which is good.
      Second- To buy back notice generally per day salary is given by the employee in lieu of working days remaining for the notice period (excluding the weekends and public holidays).
      Third- Make sure to adjust any of your pending leaves to reduce the notice if possible.
      Lastly, you can request your company/ HR for a buy back calculation from their side through an email. Based on which you can settle the early release from notice period.

      Buy out is calculated on the gross per day salary ( not on the basic) To start the process, the employee needs to find out the amount paid to the current company for relieving form the accounts or the human resource department based on the company’s policies. So it’s crucial that HR communicates everything in written.

      Using FNF for settling the notice varies on company to company. Unless your HR respond I cannot say if it could be done.
      Regarding their non response, keep writing emails with polite reminders on the same thread. Attach a screenshot of your contract stating about your notice period buy out. Try visiting HR and talking to them in person, ( do not call as there will be no proof of follow up) If they do not respond gather your documents and be ready to reach out to file a labor complaint.

      As per the labor law a signed employment contract by both parties makes the terms and conditions legitimate.
      Sending an email for increased notice doesn’t mean employee acceptance on a legal contract.
      You can serve the 2 months notice and decline any extension. Employer cannot take any action against you. If they trouble you for EOS documentation, you can file a complaint against them.

      first go through your employment contract and check if there is a leave adjustment or buy back notice option.
      How are your terms with your boss or HR Incase you need to reduce notice?

      When you go for an interview do mention that you have a 3 month notice but you are willing to work out an early release.
      Based on your notice period some companies have concerns but there are companies who are willing to adjust based on your interview performance.

    Hi ma'am,
    I resigned from my job on 10th of November mentioning notice of one month upto 8th December. I am a permanent employee serving my 3rd year in the company. I work in the lighting industry. There is a provision of buy back. However, my managers are asking me to serve more than 1 month and stay upto 31st December. Should I contact my current company HR as I want to buy out my notice period.

      You are not obligated to buy any notice in above case. You are serving a month’s notice ( I assume it’s mentioned in your contract).
      Your manager is unethically asking you for extension. Politely request him that you can’t do it as you have your joining in the new organization.

      @Ratnajit if mentioned in your employment contract you have every right to buy back your notice. Keep insisting on the buy back :
      ask for a response on an email
      Attached a screenshot of the contract but back clause in the second email.
      Keep communication formal and written.
      Inform the future HR that you are trying to buy back notice period and will keep them posted.
      Let me know how does your communication goes and I shall advice further.

    Hi ma'am,
    My org have 60 days NP mentioned in the offer letter with no mention of buyout section. But when I checked in my exit tool portal, it was showing 30 days NP. Currently I am with this org for less than 6 months(Maybe due to probation but no mentiin of it in offer letter).
    I have resigned from the org stating that I can serve only 30 days NP as mentioned in the exit tool portal.
    But I am getting pressure from my org to serve 60 days NP. They are saying there is no option of reducing NP in any way be it buyout. Further I will not be provided relieving letter and experience letter.
    My new offer will also be invalid if i can't join within an month. Please help in this situation, I will be very grateful.

      Hi below is my response:
      Please do not take the pressure of serving 60 days when your employee portal says it to be 30 days.
      Talk to future HR and ask them what documents they need.
      2-3 days before completing 30 days notice send an email that your last day would be ___ and ask about the exit handover formalities.
      Your employer is trying to take advantage, follow written probation notice. They cannot do anything.

      Why don’t you ask for the release documents from HR?
      It’s your right and they cannot deny it. Ask and Review your company policies for employees who resign during probation. (FYI 6 months with 3 months extension is the maximum probation - even if not mentioned in contract)

    Madam I am in probation period in a insurance company after joining 9 days I put resignation.but not served 60 days notice period now company asking 2 months notice period pay out what should I do please replay. I not need any experience letter

      Hi Arun,
      In this case you can simply ignore because an employee can leave during probation without or minimal notice. There is no need for service 3 months based on 9 days at work.

    Hello Mam, How often there is chances that new employers HR extend the date of joining for 2 or 3 weeks.

      Incase there is a genuine reason to postpone the joining of an employee it could be extended to few weeks but the reason has to be clearly agreed and understood by both parties.

      @@Careervues my organisation has changed the HR policy and just before 1 day I joined so for that reason my NP increased from 60 to 90 days.
      In my current organisation same grade but have different NP.
      No new organisation as me can you buy out or not I tried to buyout for 3 weeks but HR and manager till now didn’t approved yet, so if in case they didn’t approved should I ask my new organisation HR to extend the DOJ due to that reason. Can you advise?

    Hello mam,
    I have recently resigned from an organisation as I am getting a better career option, the joining date with the new organisation falls somewhat in the middle of my 30 days notice period, so roughly i can serve about 17 days. But, my present employer is not agreeing to pardon the remaining days. I have enough leave balance to compensate for the remaining days, the other organisation is agreeing to buy me out. But my manager and HR has stonewalled me into serving the complete 30 days. I have also referred to my offer letter, and they do have the option to pay in leu of serving notice. Please advise what needs to be done as it has happened twice and this is causing much grief.

      Hi Abhishek,
      It’s your legal right to adjust your notice period with pending leaves or buy the remaining days.
      Send an email request to HR and your boss to understand on what grounds they are rejecting your early release.
      They cannot deny this adjustment as it’s mentioned in your contract, follow up by mentioning your last working day and ask what needs to be done before you leave.

      Ive tried doing that, they have stated that buyout is an option in case you dont have any responsibilities. But your present responsibilities wont allow us a buy in until or unless they are served in 30 days. Which doesnt make sense, because ill still be serving 17 days. I do plan to go to my organisations ombudsman, not sure if its gonna work out.

Now my HR told me that as i complete 6 months so i am confirmed employee and have to serve 45 days notice period otherwise she will deduct my salary. Plz help me .

      As per labor law, a permanent employee has to serve the notice as per company policy.
      You can ask them about buy back options or any other early exit options that you can choose to reduce your notice period.

      Hi Dexter,
      For sure an employee can demand to buy out the notice by paying for the unserved notice days but some employers put a clause: applicable only upon management’s/ employers discretion. So do check if something like this is mentioned in the contract.

      If there is a buy out policy then only buying your notice period is applicable.
      There are many factors to take in consideration:
      How long you have worked for the company- if less than 3 months leaving is easier
      How supportive is your boss or HR in buy out?
      What action company can take against you if you don’t follow protocols?
      What documents you need for future employment?
      But above all priory must be given to your health & well being.

    mam thank you so much for this , I request you to please let me understand below statement mentioned in my offer letter
    “  The company shall be entitled to accept your prospective resignation with effect from a date earlier than the one offered by you and thus relieve you at any time during your notice period as the notice is for the benefit of the management and balance notice period can be waived at
    any time by the management. In such an event, however, you shall be paid basic salary for the
    remaining period of your notice. In case the management at your request accepts a shorter period of notice, you shall be entitled to receive your salary only for the actual number of days worked.”

      If your contract has a buy out option, request HR that you want to use your legal right to settle your notice with payment. If they don’t agree offer overtime/ your replacement/ handover to your successor in good terms. They may understand your support and get ready to negotiate.

      @@Careervues I was on bench at the time of my resignation and after my resignation they mapped me to a new project and now saying that project currently don't allow payoffs. My contract clearly mentions payment in lieu of notice period. What I can I do now

      Irfan, the contract stated clause will follow. Unless you have signed a new contract/ responsibility amendment during notice. Stick to buyout or ask for the policy stating that you can pay for early exit.

    Currently I am having 3 month notice period - Now My manager giving me new role and new work and saying do this work for next 2 months and transition back the new work in my last month of notice period ....
    I felt over pressure now reason 1. I have to complete my daily target 2. I have to give transition of my current role 3. taking transition of new role
    I am stressed out a lot and happened to work on all weekends - Please advise the better solution for this situation.
    Please advise how I can be polite and assertive

      Do not follow any instructions rigidity since you are already on notice period. Just complete it and do a handover to your replacement.

    Hi Maam In my appointment letter it is mentioned my notice period will be 1 month but they have added one more claws saying "All other standard and general rules, practices and policies of the Company as existing now and which may be amended from time to time will be applicable to you and you will be expected to abide by the same" now they are asking me to serve 2 months notice period.       Hello Suraj,
      You are legally obligated to serve one month notice period only. Change in policies are to be shared with employees and contract changes are to be signed by both parties to make them acceptable. They cannot force you for an extension of another month if you have not signed any amendment.

      Hi Yash,
      You must follow your company policies, if it’s written that buyout option will be applicable based on company’s decision- you can’t do anything.
      Talk to your boss to support you for an early exit, ask him how you can help the department for an early release. Maybe your supervisor can talk to HR for you. After all the decisions are all inter connected between departments HR & finance.

      Settle it with your pending leaves and if you don’t have them enough go on an emergency leave,
      Ask your future HR what documents are required for your joining then settle your pending documents later accordingly.

      Hi Manish
      If it is mentioned in your appointment letter signed by both parties than your company have to follow it.
      From now make sure to communicate through emails and follow up on the same email thread requesting buyout or an early release politely. If it doesn’t works within a week - In your final email tell them you may do a labor complaint if they do not respond or let you buy out.
      The consequences of leaving without a closure are:
      No relieving letter
      No proper final settlement
      No references by HR
      Holding the pending salary if it’s due.

      @@Careervues sure madam, iam communication through email since the begining hr dgm is not even checking email until unless i called her up .
      I was doing honest reasoning from the begining ..but iam regretting for being honest. Iam thinking to post some medical emergency and stop logging in from 25 of oct . I will keep you posted mam . Please suggest me if there is any way around .

      I assume your emails are being read but not responded by the company but all you could control is your side of interactions. It is a good idea to mention about medical emergency and manage the situation. The only drawback would be getting into the hassle of final settlement discussion later. Just Make sure your future employer doesn’t require any documentation from this company before taking any action.
