Charis Kubrin, a renown specialist in criminology and law, shares with passion and mastery a story of Rap on trial that elucidates the fundamental issues our society faces in relation to freedom of speech, liberty, equality and justice.

    Charis E. Kubrin, Professor of Criminology, Law and Society at the University of California, Irvine researches and teaches about crime and justice. In addition to publishing five books and dozens of journal articles, she is a frequent media contributor whose writing has been featured in the New York Times, Los Angeles Times, Forbes, CNN.com, Seattle Post Intelligencer, OC Register, and American Banker.
    She has received many awards including the Ruth Shonle Cavan Young Scholar Award from the American Society of Criminology, a national award given to recognize “outstanding scholarly contributions to the discipline of criminology.”

      Benisjamin55 she couldn't really do much in all honesty. Her in depth research was followed after the sentencing. So maybe she might actually be able to help shmurda. It wasnt her fault that the jury was full of racist and stereotypical cunts.

    Still you can't just make assumptions, but most people no matter rich or poor have such ignorant views especially when in a group.

    Excellent talk! Very useful to point out the covert racism that our society, specifically the socio-legal system continuously uses, yet ignores. My only point of criticism is regarding the notion that with rap "the more violent, and misogynistic the better", I think this is only true for mainstream rap. That is the rap that reaches the masses, which is through record companies, largely owned by older, white, males. There is rap out there that challenges stereotypes and misogyny. However, these artists are probably less likely to receive million dollar contracts, unless they change their music to fit what the companies want.

    Everything this woman argued is 100% true. The hard part is what do you do when you shoot a music video with lyrics like this and the artist is arrested 2 weeks later for first degree murder (like we have). And when kids are dying by the dozens from violence in your city (Chicago). How are you supposed to think then?

    Dang free speech is free speech! It should be defended! I got in trouble once for drawing a gun in school. I got pulled aside and asked questions by the school counselor with the campus cop in the room and I was just thinking about James Bond when I drew it, no bad intentions lol.Bringing race into the picture gives you the disadvantage though. I remember ICP the rap group got really big for a year in my neighborhood and my parents worrying about it lol. It's not about racism. Rap is the most prominent right now so of course it's going to trump other genres in the stats. I definitely think you should have won the case but much of the research you mentioned focused on the race card where we lost steam on the right to speech. Honestly there will always be racists! I hope that there will always be good hip hop though! If theres no freedom of speech than technically we couldn't have either. Again though, awesome talk. Made me think... Thank you

    6 years ago I may have agreed with her but today... The music especially gangsta rap has a different kind of ring to it and they are dying by these lyrics and the youth are agressively trying to mimic these words!       As I said, Republicans and their allies in academia stopped criticising violence in white music in the 1990s around the time of the Republican Revolution. The same is true of movies, if to a lesser degree perhaps. The goal was to attract poor whites who were extremely resentful of blacks possessing even basic political and other rights (as far back as the Fifteenth Amendment) but who nonetheless disliked the economic policies of the Reagan and Bush Senior administrations. That this policy has been a resounding success for the Republicans there can be no doubt, because it has allowed them to pursue extreme right-wing policies for over a quarter of a century and at the same time solidify their base on a basis of racial fear.

    Misogyny is misogyny. Misandry is misandry. It doesn't matter if it is never spoken or acted on. If you feel compelled to be violent towards someone, there is something wrong with you. It is not ok or justified to be violent or aggressive towards another person or group of people. Hate speech is hate speech. I don't care if it has a nice melody or beat attached to it. We excuse people's violence way too much.

    Seems like these comments either have people in strong support or poised rejection of her arguments. The critics seem to be trying to pick apart her argument by choosing one thing she said that they didn't exactly like, whereas the supporters aren't discussing or contributing relevant arguments/information, but simply stating support.

      True.
      Moreover, heavy metal is usually seen as even more fictional than country. I have never noticed anything that could potentially be viewed as autobiographical in heavy metal songs - indeed heavy metal has drawn massively from fantasy literature ever since its beginnings in the early 1970s. That may mean that conservative rap critics, if they do notice violence in heavy metal lyrics, see it as a form of fantasy, or a depiction thereof.

    We need more talks like this and more people like Charis. We go to galleries and pay millions for the art of Dali and Goya. The homes of horror films scriptwriters are not searched by police. But the people of color, especially young men, and especially those who aspired to be rappers are viewed as thugs. She is right, until we acknowledge that the racism is alive and rampant in the good old USA, we won't be able to move forward as ONE nation, in liberty and justice for all.

    Music, video games and movies DO NOT make people violent. Proven time and again, violent people gravitate to aggressive media because it resonates with them better. Do people listen to Taylor swift and play super Mario when they're enraged? Media can show you aggressive actions, but they CANNOT pass aggression on to you. The people who listen to aggressive music and do violent things are generally toughened people who already have a violent history, mental problems, or have been pushed to the edge by circumstances.

    I agree and disagree, there are actual statistics that link negative behavior to rap music, most of it is filth, and there is a general difference between the way it effects different CULTURES, if you only have one parent in the home you are most likely to be negatively affected by it, in my personal experience it seems as if some cultures view it as a proper lifestyle while others look at it for what it is, JUST ENTERTAINMENT

    This is exactly the question I was asking a group of young incarcerated men. I asked them to explain why I (an old white lady) should not be scared by the hip-hop and gangster rap lyrics. I was preparing a class session for them and found this video. I will use it...but I don't know what conclusions we will draw from the predominantly rural, white and poor young guys who are listening to this kind of music. :-)

    Hang on, those people convicted in the 'rap cases' did commit crimes, didn't they? I really can't imagine you can be convicted just for writing lyrics if there is absolutely no further evidence. Why where they in court in the first place? And could it be that many people are less suspicious of other genres of music because country and metal artists actually do commit fewer crimes?

    Stables of gangsta rap. Your analysis is so off. You have provided no real context or history. Your research provides no talks of environment or community that pioneer artists have endured. Race always has a factor but the defendant wasn’t bright at all. You needed to address so much more. So disappointed the way you approached this so serious and the follow through was lacking. The other cases just show the injustice for African Americans.
