I love Mutula Junior as well as Dr. Kangata, two very intelligent young men who unfortunately find themselves in opposite political camps enslaved by their respective party leaders. Sadly, the major political parties in Kenya are not driven by ideological political believes. This is true for Jubilee for Uhuru; ODM for Raila; Wiper for Kalamazoo; Ford Kenya for Wetangula; ANC for Mudavadi; KANU for Gideon and UDA for Ruto and the other smaller parties that hibernate soon after the general elections only to emerge at the next general elections. With regard to the BBI, it’s nonsense for Mutula Junior to argue that President Uhuru could in his personal capacity initiate and promote popular amendment as a citizen and at the same time sit pretty in the State House to appoint and gazette the BBI review committee that is funded with government funds, whose report is then handed to the very same appointing authority to consider for the next step that include review and passing by the County Assembly fraternity that meets the threshold stipulated in the Constitution after the executive offered a two million Kenya shillings to each member of the Assembly that votes for the BBI amendment Bill. Finally, the National Assembly and Senate members have been whipped by both Jubilee and ODM leaders to vote for the approval of the 2020 BBI Amendment Bill in the manner directed by these two leaders.

Kangata is right . we do not need to spend more resources on expanding govt with more mps and deputy presidents in order for Kenyans not fill excluded. What Kenyans want in order to feel included is services brought to where they live. They want better run hospitals, schools, agri investments, roads, affordable electricity etc
The proposed new constituencies and deputy presidents will cost a total of 20b a year to service this big govt plus referundum costing 14b a total of 34b just to please a handful of elites against a population of 50m. Instead of creating constituencies why not use the current wards as centers of development.
Every Kenyan belongs to a Ward. Use the 34b to fund the wards with structures put in place to ensure no theft or mismanagement of the funds and no funds to be spent without public participation. (Structures akin to cdf funds). All you need for this to happen is legislation in parliament which will cost zero to tax payers.
The reason why Kenyans fight after every election is because people dont trust the out come of the elections. Fix IEBC to make it more transparent and keep it away from the influence of the executive. There will never be peace in Kenya as long as the executive has oversight over IEBC. IEBC needs to be completely independent.
Lastly fight corruption at all levels of govt from national to county level. Have life style audits of all civil servants including legislators and ensure no one in govt does business with govt. make contracts public names and directors who win the tenders.

Now Mutula Kilonzo should understand that if Wanjiku cannot raise 1 million signatures then it will not be a popular initiative, and when it becomes one, wanjiku will easily raise even 10 million votes like in 1992 and 1997. the million signatures cap is meant to keep off jokers away.

Methinks any proposal on a change to the constitution is subjectively "unconstitutional" until it is made part of the constitution i.e. it is illegal until it is made legal.
Any proposal which aligns with the constitution is constitutional, in two ways:
1) the procedure follows guidelines of the constitution
2) the proposed amendments do not clash with other articles of the constitution
You cannot escape (1), and if you want to go past (2), you simply use (1) to draft a whole new constitution.
By going through 1 & 2 the proposals would be constitutional and legal and that is why the constitution guides on how to amend itself in articles 255 to 257 I think. Constitutional amendment can be legal or illegal.

These ammendment can be done without hullabaloo of referendum that is costing an arm and leg to a poor suffering Kenyans. Let parliament work thats why they paid
Some amendments to the constitution must go to the referendum according to constitution 2010. Things like number of constituencies etc according to article 155 must be voted on in a referendum.

I don't know whether this comment will be addressed and change peoples' mind, either way, in that case, I would love to inform my learned friend Mutula Kilonzo Jnr that when a person is deemed as president, there is a transition that takes place from a citizen to a president hence there are things which he cannot do as a president, though he is a citizen same as a soldier before him been admitted and later commissioned, he/she was a regular person until they have joined, he gives away his rights of being a civilian and swore to protect his life for the life of others, in fact, he/she ceases to be a civilian to be a military, now from the Judges point of view in respect to the constitution that a president cannot start a popular initiative, I beg to agree with them for that was a fact as it is and as they had indicated in their Judgement of the BBI
