In the US, I have a tag saying not for children under 5 years old if they have safety eyes. If you want for a child under 5 I will embroidery the eyes and nose on.
Not too long ago there was a news article where someone had bought a baby item on Etsy, I think it came from Lithuanian. The item wasn’t tested and broke, choking the child. Testing is frustrating, in the UK you can self-certify and there’s plenty of help (a great Facebook group that keeps many certificates for materials). It sounds very silly and petty to many toy makers, but the time to certify is a lot less stress than the loss of a child.

I think it's just the price of it all that is my concern here. (And I even understand why it might be financially demanding. But in the scale of small bussiness, it's really quite high.)
There a lot of people crocheting with TEMU yarn which has toxic chemicals and Somme stores in Etsy sell items for babies or kids which can be dangerous . So I agree with there should be some regulation. Safety eyes are not always safe either .
I hear your struggle. I'm in Canada. We have the same situation. I make quilts, no toys except what I create for my grandkids. Not worth the chance of anything going wrong and financial destruction.
Wow! That's too bad. Here in the US don't have to be certified. We put certain warnings and instructions on any type of products we sell that might be useful for consumers to look out for.

Whilst watching your video I have been looking up certification for toys over here (I am in Australia) as there has been issues in the news about cheap toys out of China being removed from sale but the only issue has been about "button" batteries. I cannot find "anything" else about limitations - particularly about plushies. I know there are quite a few channels on UA-cam for people who make and sell Plushies in US. Is this just a EU thing? I get toys need to be safe but I do not understand what can possibly be dangerous about plushies. If the Authorities say the definition of a toy is anything a child can find and play with then that could be ANYTHING. I could sell a blanket online and a child could carry it around with them and suddenly that makes it a toy? That is crazy! Am I missing something?
I am still researching the issue and I might have some interesting news, but the thing I mention is definitely an European thing, part of the CE certification rules. The attestation process includes pull and tear tests as well as making sure the materials used (fabric, yarn, stuffing, dyes/colours, plastic) are safe. So the toy needs to be proven sturdy and safe in all of its components. With crochet toys, one can ensure to use materials that are already certified, as the yarns I use usually are, but it may be more complicated with the stuffing and eyes. It's not exactly "anything a child can find and play with", but everything that looks as a toy. So stuffed animals absolutely do fall in this cathegory. Blankets are visibly blankets, a thing meant to cover one up. Clothing is it's own cathegory as well. But once it's a lovey with a stuffed animal head, it falls into the toys cathegory.

I have found a website here that states clearly that all we have to do is have labelling regarding washing/drying/do not tumble dry/may be flammable on it (it said to copy the ones in Kmart) put out by the government and that is all. I agree with the poster below that I would probably embroider eyes and nose for the ones for children under 5. I did find one page that had a company that does the testing for EU but it appeared to only be for the mass produced market. Thank you for raising this - definitely warrants more research as it is a learning curve for us all. 😀
I sell in Etsy and even if you write in your item description as WARNING ⚠️ not for children under 5 years old . People keep buying the item for children . I sell 7:01 small crochet items and most of them go for decoration however people buy for their children 😢. I’m m trying to be extra careful and slowly embroidering eyes 👀
that's the thing, the warning only goes so far... if people decide to disregard it, it's pointless. Embroidered or separately crocheted eyes can be sooo pretty though!
Why sell your plushies as “toys”? Can they not be marketed as object d’art or decorative pieces? Semantics? Absolutely. Stupid regulations don’t deserve better. Good luck!🍀

But once the inspection comes to check them, they're sure to get the high fine, because the "disguise" of a decoration object is not valid and the rules basically say "if it looks like a toy, then it's a toy," (and has to be certified). Again, I understand the reasons, it's basically the price of the certification that bothers me as it is really high for small business owners.

I am doing small blankets for families pets, and then will donate to animal charties. My friend donated a knitted toy to charity and they put on it "not a toy, for decoration only." 😮 take care. Thank you! For giving stuff away to friends and family, the business rules do not apply, so that's alright. But the same "not a toy" statement is something that would not protect a creator over here once they wanted to sell the thing commercially. I am not sure how liking on your TV works, it might depend on your TV type. With ours it's clicking up twice on the remote while the video is on and then twice to the right to find the like button on screen, then confirming with the OK/enter central button.
There there. The certification is brutal, when you are not producing on a large scale. Unfortunately each certified model has to go through the same process, regardless if you make five or five milion copies and the cost is for the process, so the certificate cannot be cheaper for smaller producers. On the other hand, making plushies for the people you know as decorative objects is always possible, as those people will not write you up to authorities. :) P.S. I was making a salad - all that chopping and mixing takes way more time than how much time it takes to eat it. :D
That's always my beef with the cooking/food prep. It takes so much time to do and then it's gone in a moment :))) I'm glad my video kept you company. And yea, I do understand. It's just a very fresh thing to me and I am only now realizing what all goes into it and how it all works. It's a struggle for the small business owners.

Jakože ne že bych si myslela že podvádí, ale jakože něco takového fakt navážno existuje i pro tyhle případy? O_o Možná když se to neoznačí jako hračka ale "dekorace" nebo jako... já nevím... ruční výrobek, tak to ten certifikát mít nemusí? Jinak je to teda fakt brutální, 10 tis. na jeden typ. Právě, v tom článku jsou věci, co si ještě musím dostudovat, ale to označení za dekoraci podle jiných zdrojů prostě není funkční ochrana před úřadem a jeho pravidly. Chystám další update a ten návod na síťovku, snad se to povede brzy. Ráda bych měla nějaký videa do zásoby, ale časoprostor na natáčení je omezený. (já vím, že to byl vtip. Ale stejně. Nicméně tohle video asi kvůli lehce negativnímu vyznění zaujalo YT algoritmus a já jen zírám na statistiku :))) )

true. I avoid Temu, Shein and simillar shops entirely, so that is completely off my radar, but it would be a good point to address.

Yes you need a CE certificate in uk to, but you have to go through different things like, ie try pulling them Apart, burning etc
