- The plaintiff applied for an apartment and paid a deposit fee. She changed her mind about the apartment, but the defendant won’t give the plaintiff her money back, so she’s suing. The defendant doesn’t think he owes her anything.

I live in a neighborhood with an hoa and we love it. If you don’t like it there are plenty of places to live that don’t have one. The reason people buy in neighborhoods with hoa’s is the fact that they look nice and are taken care of.
I would NEVER live 2:10 in a condo or HOA housing. Their rules suck.

he does it on purpose in order for the applicants to cancel and he gets to keep the money . but what i want to know is whats up with the corrupt court in his town that keeps allowing him to win when he gets sued for this same scam ?
Plantiff almost lost her case by not wanting to shut up. I know she was chomping at the bit to give her side, but sometimes it's best to stay quiet.
Yeah, I noticed that, too; however, she won based upon something other than what she expected, and that's why she couldn't answer exactly what was being asked of her in the hallway. The JM is a judge for a reason.

It's bad business, in general. Why have a whole process undocumented? Unless you playing around. I believe the plaintiff when she said that he has ties with court officials in their town. For him to skate by with no evidence of anything, he seems to be in their pocket or riding with them in their golf carts. That's shameful that if you are friends with a judge that a innocent person can't get justice. It's a boy club mentality(though not exclusive to men. Female judges are also corrupt)

"approval" should mean when the applicant was notified of the approval; otherwise the landlord can always claim she was approved before she asked for a refund.
The defendant said right at the very end that he's been to court many times.... Management has got to be swindling the board.

If they have had many lawsuits before and gotten away with it, you have to wonder at the integrity of those judges. Two hours after changing her mind, she gets approved? Too late.
I am hoping maybe after watching this some of those cases will appeal.
I firmly believe that security deposits should only be given when both parties sign the lease

When he said: "60 days for a background check"....I was like she's just moving to ANOTHER condo apartment in the SAME complex...why would she have to wait 60 days if they already have her information. That's crazy right there.

She didn't change her mind. The board had to except her application and signed by the tenant.

What intrigues me about Judge Milian is that she majored in psychology during her undergraduate studies, which complements her role as a lawyer and allows her to easily understand many of her show guests.

If he had been suing her, he’d point to the contract and how it clearly says in writing bla bla. They don’t follow their own written contracts, they think that internal “policy” trumps what they’ve signed and agreed to.

Wow - the Defendant kept going on (and on!) about the Association NOT putting the approval in writing, but the document says it MUST be in writing. Saying "this is how it's always been done" doesn't justify it.

In 2016 I applied to rent an apartment and after one week I called to see it was approved. They said they were still checking my background. I told them I work for the Texas Department of Health and Human Services and my background should be easy to check. I had worked for the state of Texas for over 20 years and they did a FBI and fingerprint check. They called me back that same day with an approval. I think apartments/condos just want to keep people's money.
They do the same to active teachers in many areas. You would think that if you're actively employed with an organization that requires a clean record during employment would be good enough to cancel the need for fingerprinting and background checks to rent a place.
The Board documents said "in writing".

They run a big company like it's a pawn shop. The contract doesn't hold them accountable, but I'm sure they know every word of it when the renters have a problem.
OMG the arrogance, the board doesn't ever sign a document that says board signature here. Look your board can have any rules it wants but this does override the rule of law. If you say must be signed this means must be signed, if you mean something else put it in the contract. It says a lot about the judge in hi8s area that they support this mess as being legal.
All they have to do is change the wording in the contract to reflect how they actually do things. These people are just lazy.

Why does the plaintiff have such a chip on her shoulder? She's so off-putting and unpleasant. The defendant is just a slippery weasel but neither person is likeable.
He's a thief, who has done this before and expected to get away with it again. He knew the whole time what proof he needed, he knew he didn't have it. He thought if he repeated his lie long enough others would believe him. It's wonderful seeing such people being told no.
