I live in a neighborhood with an hoa and we love it. If you don’t like it there are plenty of places to live that don’t have one. The reason people buy in neighborhoods with hoa’s is the fact that they look nice and are taken care of.
I used to be in the apartment business as leasing agent and business manager, and I wish there was a way to force people to read the fine print on refunds. If someone is telling you that no matter the outcome, you’re not getting your money back… RUN!! She’s in the business and that’s why she fought. As a person who has been on the inside, there is no reason except greed to keep any part of your money if you’re not approved. This kind agreed feeds the homeless situation in our country because if you’re applying to a bunch of apartments and leaving money on their gluttonous table, it takes away from the money you need to start your new life. It’s great that she won, and hopefully other people will join forces and revisit previous cases against him.
I'm sorry, but that's absolutely untrue. I'm a licensed realtor, and I also managed a property management company for 7 years. Our application fees are $40.00. We'd spend at least 1hr per application verifying proof of income, calling prior landlords or emailing them for references, running criminal background checks and the credit report, reaching out to the applicant for missing info or documents, etc. Plus, we pay a fee for the credit reports. We print the application and all documents and reports, we record the application fee and have to deposit it in the bank if it was paid in cash, then we have to reach out to the applicant to either approve or deny, along with an explanation. If denied, it is likely we spend another hour of combined communications with the applicant going back and forth on why they're denied. We do not refund app fees, and for you to say that's simply GREED and to run from companies that don't refund them, is quite silly. If you think we are making so much as a penny off of application fees, you've lost your marbles. We try to make our fee as adorable as possible, but there's always someone who complains and wants a refund and is never happy. Makes us want to raise it to $100 just because of the hassle and headache we deal with on a daily basis.

In 2016 I applied to rent an apartment and after one week I called to see it was approved. They said they were still checking my background. I told them I work for the Texas Department of Health and Human Services and my background should be easy to check. I had worked for the state of Texas for over 20 years and they did a FBI and fingerprint check. They called me back that same day with an approval. I think apartments/condos just want to keep people's money.
They do the same to active teachers in many areas. You would think that if you're actively employed with an organization that requires a clean record during employment would be good enough to cancel the need for fingerprinting and background checks to rent a place.
