Nintendo DID have a case. They had a patreon paywall for certain benefits. That counts as monetizing the emulator and they provided support for TOTK as well. Stealing is stealing no matter how much ya try to justify it.
Paid emulators are not illegal at all as long are they are made from the ground up by reverse ingeneering the original hardware. The TOTK part is really shady tho, they really made a mistake.
I wouldn't mess with Japanese video game companies in general due to the fact that they have alleged ties to the Yakuza.

They never been great at trying to catch up with the times, there's a reason why Sony and Microsoft gave up on attacking emulation and only focused on tightening up their CURRENT-gen console security. Emulation is not illegal, sure Yuzu was playing with fire by emulating a current gen console but they REALLY got burned by trying to paywall (something no one should do) their software and offering to release a patch to play a game 2 weeks early before the game was even released. People seem to forget that Ryujinx exist and nintendo will have a very hard time getting rid of them since their headquartes is in brazil and unlike yuzu, they didnt get greedy and only offer their software on their site. So yeah, there's alot of good reasons why pepole can get away with it.

Shouldnt Tendo go after the actual ROM distributors instead of a wrongful lawsuit against a group that only made an emulator??? It wasn't until I transitioned away from consoles and enjoyed the hobby away from that mindset that I saw the bs and stopped rooting for for the these billion dollar corps. I'm here to give my money to the creators and enjoy the right to back up my purchases for future use -- additional bells, whistles, graphics included. Instead, some would rather have us being forced to subscribe or purchase the same games over and over again. Hopefully, the get it one day, stop bickering about brands and focus the hobby and not being sycophants for these brands. The generalized view of pc gamers gets tiring.

Do you not even realize that emulation as a concept was first conceived to play old games? You know, the games that the companies DO NOT OFFICIALLY SELL anymore for old consoles from those companies that they also DO NOT OFFICIALLY SELL anymore?
For example, Zelda's The Wind Waker or Twilight Princess were last available on Wii U. I've bought a Wii U and both those games on it. Unfortunately, my Wii U broke over the years (it was 10 years old, after all), and Nintendo does not produce Wii U anymore since 2017. Obviously, Nintendo does not sell neither Wii U or Wind Waker/Twilight Princess right now. So my only options are:
1) To try and fix my Wii U - no guarantee that it's possible + at some point there will be literally no spare parts left in the world to fix these consoles because Nintendo does not produce them anymore.
2) To buy another Wii U - which will obviously be used, so it might be a rip-off, or it might live for 5 minutes and then die + I'll have to pay for the console I've already bought twice, and Nintendo won't see this second payment, it will go to some rando who sold me their Wii U.
3) To wait, beg and hope that Nintendo will port/remake those games - which might just never happen, even though those are games from one of their main franchises, they still might just bury them.
Mind you, I've already gave Nintendo my money for the console and for those games. I just want to play a game that I've officially bought for the console that I've officially bought.
Or, you know, I can just get a Wii U emulator for my PC, dump the game from the disk that I physically bought and own and just play it.
The exact same thing will happen to Switch in like 5 years. And you're all celebrating the fact that you can pay for a console, you can pay for a game, and the company from the other side of the world can just decide: "Nah, I don't want you to play this game that you bought from me anymore, and there's no official alternatives and/or refunds for it".
And yes, of course, downloading ROMs or games for free that you did not buy from the gamemaker is stealing.
So if you download a copy of a console game that you haven't bought for free from an illegal website and run it on an emulator, it somehow makes emulator developers' criminals.
BUT if you download a copy of PC game that you haven't bought for free from an illegal and website and run it on your PC, it somehow does NOT make Windows developers' criminals.
Even though in both cases these developers develop a platform that yes, allows to run a stolen game, but is never officially intended for this. It's like blaming a hammer manufacturer that somebody used the hammer to commit a crime instead of it's intended purpose.
And specifically in Yuzu's case not only they do NOT provide ROMs of games in any official way, they also do not even provide Switch's BIOS files that are required to run the emulator! You can't even run Yuzu without dumping BIOS from physical Switch into emulator first, so without BUYING A SWITCH first! Or yes, you download BIOS files from somewhere on the internet, but again, I'm talking about Yuzu developers doing EVERYTHING in their power to ensure, endorse and force their users to use their emulator ONLY AFTER buying Switch AND buying a game from Nintendo!
I don't even know why I got so heated, I guess it's because it's my first time seeing such the anti-emulator opinion in UA-cam video form (why did I got recommended this?). Considering the youtuber responds to arguments in other comments with "BLAH BLAH BLAH" I imagine he or people from his audience won't read this comment in good faith anyway. Outside of this very corny ass video people need to realize emulators are for preserving older games. Why do you think nothing has happened to dolphin emulator? Nintendo dont care bout Wii and GameCube right now but to emulate the Switch, their current platform is crazy. They helped a lot of people out and now they bit the bullet.

Nintendo is way too out of touch with the times, I don't know if respecting them for "owning the pirates" is all that admirable given this is the same company that a few years ago tried to make youtubers to pay for a license just to get the "privilege" to talk about/display any nintendo owned characters in their videos. Not only that, shut down many fan projects that took many years to make, closed fan community tournaments and even demanded the custom Etika themed joycons to be shut down. Let's not get into their lack of game preservation, overcharging years-old IPs and generally being a nuisance towards fans that want to praise a game that they made.
Both sides (anti and pro emulation crowd) are really dumb with this black-white attitude. Even people who pirate/emulate, knew the writings on the wall the moment Yuzu tried to paywall their emulator (just like with mods) you NEVER want to paywall something the community unanimously agree should stay free. Even with ZeldaToTK leaked, Yuzu offered to released a patch through their paywall, had many people telling them it was a very bad idea and it would've bite them in the ass. They got too greedy and flew too close to the sun.
With that said. This won't put a dent into the emulation/pirate scene.. like at all LOL. All it did was stop further development on yuzu and citra only. Even when news of the shutdown was happening, people already had forks set up in advance. I still never understood this anti-emulation crowd that's against game preservation. I would understand why some people would feel resentment towards yuzu/ryujinx users, since those emulators are a bit of a grey area because they're emulating a "current" gen console but the same cant be said with every other emulator that's preserving 10-30 year old games that are no longer for sell.
It just seems like any criticisms towards people who are anti-emulation in this comment thread/in general just go "BLAH BLAH" the moment you tell them anything. It just makes them look shrimp-brained by default and only see people who emulate as the bad guys. There's no in-between with them, the same can be applied with this video, BG looks insanely ignorant here but hey.. he looks like the type of guy to look at the dislike bar and go "heh, look at how mad {insert crowd} are".
