Honestly the thing I find funny about his denials is that Nintendo is the most retro game manufacturer atm... So as a retro gamer ofc it comes up he is a Nintendo 'tuber, because they are the bread and butter unless he goes PC only or actually sticks strictly to the oldest Sony consoles, the only real modern options on new systems are locked behind services and poorly announced to keep up his workflow.

Yeah but if a judge made a ruling in this then anything yuzu has to say was confirmed by all parties not just one or two of them. This was not a forced lie of a statement it was a statement to show you that there are laws in place and picking and choosing laws is not okay even if your first intentions were not bad. My personal understanding is that Yuzu did not include (or *publically* develop) any patches/fixes for TOTK until after official release, where they then put into their early access version which was locked behind the patreon. Before the official launch date, no unmodified version of Yuzu could play TOTK, and using Yuzu to run the game required manually installing community-created patches. Additionally, there was nothing wrong with their patreon - my only guess was that the size of the patreon is what got Nintendo's attention (legally speaking). Why Yuzu would settle so quickly is where I get into conspiracy territory, but my guess was that it was a mix of factors ranging from "We don't want to risk setting a disastrous precedent for all emulators if we lose" to "This just isn't worth our time", but my main suspicion, is that the development of Yuzu itself involved some legitimately shady or outright illegal stuff, and Nintendo had hard evidence to support that, that would've come out should the case had gone to trial, and so rather than risk total and utter reputational destruction along with potential criminal charges, they settled. There were a few instances of developers making public statement regarding how/where to obtain pirated copies, etc, so I wouldn't be that surprised if it turned out Nintendo had some more comprehensive examples. Additionally, Yuzu is owned by Tropic Haze LLC - the LLC standing for Limited Liability Corporation, meaning (typically) the owners cannot be held personally responsible for business debts and liabilities, meaning the $2.4M fine should just go away if they file for bankruptcy, which is another reason why I think they settled. The biggest loss of this whole case is the developers themselves, because really, Yuzu was the best switch emulator on the market, and the lawsuit settlement states that any person, group, entity, contractor, etc. that ever received monetary compensation by Tropic Haze LLC to work on Yuzu is banned from ever touching anything to do with the source code or project. This is also why Citra got caught in the crossfire - because they were receiving monetary support from Yuzu/Tropic Haze LLC in a mutually beneficial aggreement.

If Yuzu allowed this to be settled in court, a new precedent would have been created. It could have been used against all other emulators. By settling out of court this possible ruling is avoided.
That makes sense, maybe the Switch 2 was going to release this year but since the architecture is so similar it got delayed until next year especially since that Migg switch or whatever flash cart got released so maybe they needed more time to work on more encryption measures.

I get emulating a console that is not still in production since it doenst effect the original company any way financially. But emulating a current system with current game releases that i do not agree.

Another possibility related to the Switch 2 and why Big N may do this now is what if the Switch 2 is NOT backwards compatible and they plan on re-releasing current switch games remastered or reworked for Switch 2. "piracy can happen on emulation". No it's the main thing that happens. The original court case from 30 years ago was you can make/use an emulator to play your own games you own physically or digitally. 90% of emulation is piracy.

The Yuzu developers are completely aware that people commit this. Why? Because there are many people caught for doing it on their discord server. They set up a bot to detect it for a reason. So their statements seems like they're suddenly surprised this is happening. If Nintendo had not issued a lawsuit, they would've continued as they always had been. Granted, as most people pointed out, their statements sounds like something Nintendo would say and not the devs themselves.
I think Yuzu's comments helped them keep a lot more of the money they made from this. If they were willing to pay 2.2 so quickly, they must have made a lot more
Very interesting thing is that most repackers that do upload switch games bundle it together with yuzu emulator for ease of use already configured. Could be that this could also cause some issues and be seeable as oh, yuzu together with game and piracy.
Yeah, if the next Switch 2's architecture is drastically similar to the Switch's architecture then I can easily see something like what happened with Dolphin happening with Ryujinx and Stratos. For those who don't realise, Dolphin released in 2003 and for the same reason as above, it runs GameCube and Wii.
Yuzu can blame the pirates all they want, but that was the majority of their community - whether they support it or not. Of course, officially they never supported piracy. But just look at the majority of their users - pirates.

Wrong. UltraHLE was around in 1997. Bleep was around the time of its console marketshare too. Almost no famous emulator surfaces (and works effectively) after the console dies. After the PS3, it's all a different story. But even the DS got emulated well before the 3DS was launched.

@rj_4mp100 TLDR: Yuzu settled so quickly because the $2.4m fine could be easily waived by filing for bankruptcy, and because the devs were potentially doing illegal stuff which could aggravate their punishment/fine had Nintendo found out earlier.
I think if Yuzu lost, this could have made software that breaks DVD and Blu ray encryption illegal too.
If Yuzu allowed this to be settled in court, a new precedent would have been created. It could have been used against all other emulators. By settling out of court this possible ruling is avoided.
That makes sense, maybe the Switch 2 was going to release this year but since the architecture is so similar it got delayed until next year especially since that Migg switch or whatever flash cart got released so maybe they needed more time to work on more encryption measures.
I think the only reason why yuzu got killed is legit the patron because im sure nintendo would of sued all other switch emulators aswell.
Cause EggNS skyline all definitely would've got shut down but what I don't understand is that if YUZU was collecting money from people giving the emulator support why not do the same to EggNS because you need to pay them like 1.99 And up just to use the emulator itself smh make it make sense

Like it was stated doesn't matter if you have a case anymore in this day and age because all of your time and money can't compete with the backing of big corporations. Another possibility related to the Switch 2 and why Big N may do this now is what if the Switch 2 is NOT backwards compatible and they plan on re-releasing current switch games remastered or reworked for Switch 2.

The Yuzu developers are completely aware that people commit this. Why? Because there are many people caught for doing it on their discord server. They set up a bot to detect it for a reason. So their statements seems like they're suddenly surprised this is happening. If Nintendo had not issued a lawsuit, they would've continued as they always had been. Granted, as most people pointed out, their statements sounds like something Nintendo would say and not the devs themselves.

Very interesting thing is that most repackers that do upload switch games bundle it together with yuzu emulator for ease of use already configured. Could be that this could also cause some issues and be seeable as oh, yuzu together with game and piracy.

Yeah, if the next Switch 2's architecture is drastically similar to the Switch's architecture then I can easily see something like what happened with Dolphin happening with Ryujinx and Stratos. Yuzu can blame the pirates all they want, but that was the majority of their community - whether they support it or not. Of course, officially they never supported piracy. But just look at the majority of their users - pirates.

The situation with Yuzu basically they were profiting from these downloads that is the biggest bowl of contention for Nintendo if they were not caught taking money behind their Patreon then Nintendo probably couldn’t be able to do anything legally But Yuzu shut themselves in the foot by doing that.

many games stop being produced, some games are not officially sold anymore, the older it gets the harder and harder it gets to find to the point it gets to be impossible, so in this case games that are not officialy sold anymore you should have the legal right to download it for preservation purposes, we need preserve art, we need to be able to preserve books, music everything.

i use emulation my self, but if you see my profile on steam, you will see i buy most of my games even on microsoft store, i don't emulate switch games, because the console is still alive i don't think its right to do that, to be honest in my personal opnion emulators should be for consoles that don't are active anymore, a switch is still a active console so i don't agree at all for having emulators for it,
i use emulators to play SNES/64/gamecube/wii why? because i love mario/donkey kong franchises, i already had the games as a kid i had super mario as a kid, i had dk as a kid, i no see a issue at emulating then. i already paid for the games im emulating for, and if the game is not sold anymore i think u should have the right to download anyway even tho im not really intersted in much other games.
my ps2 stopped working around in 2015, i used to play a few games like ssx3, god of war and a few others, i still have the Dvd but my compuer don't have a dvd player whats the problem in downloading the games if i paid for then?.

This is pretty much the first time there was emulation for a current gen console on consumer grade hardware.
Wrong. UltraHLE was around in 1997. Bleep was around the time of its console marketshare too. Almost no famous emulator surfaces (and works effectively) after the console dies. After the PS3, it's all a different story. But even the DS got emulated well before the 3DS was launched.

Usually im always against Nintendo in situations like this. But this time i can kinda understand where Nintendo is coming from. My question is why do we need emulators for current gen hardware? Emulation is supposed to be for platforms that are no longer easily available.

Besides piracy, mods and better performance. You can run games at 4k and 60fps with no frame dips with better hardware.

Nintendo was clever as to how they went after Yuzu. They didn't attack the emulator directly yet they took it down swiftly.
Yeah. A big company like Nintendo which has operated for over a century is not something you can mess with. You would think they didn't act but when they had enough evidence, they would strike emulators down unexpectedly and heavily.
That's a CYA statement so that Nintendo don't go after them again for the 3DS, unless that was part of the Switch suit.
