I screamed when the plaintiff walked out to the hallway and you could see the giant tie was over his collar. Why did no one tell him before he's on tv looking crazy?
On a windy day a woman opened her door and damaged my car. The woman wouldn't give me her insurance information. I had her tag information. I called the police and they wouldn't come out. I called my insurance company and they gave me all her information. I called her insurance company and they denied it ever happened. I told the company I had the receipt to prove I was in the parking lot. I told GEICO I would find a shady mechanic and then sue the woman. I would win. They paid the claim. GEICO is horrible about paying claims.
Why are we here?? The insurance should take care of it - period! This feels like double jeopardy (?) because what if the Plaintiff receieves a check from insurance and it's not disclosed to the Defendant.
Double jeopardy doesn’t apply to civil suits like this, nor is there any indication that the defendant will need to go to court over this matter again anyway. If the insurance company screwed up, they owe the defendant the money once he pays the plaintiff. He has to submit court records to them, and they reimburse him (or he sues them). If they pay the plaintiff without notifying the defendant, the defendant will at least learn about it when his premium goes up. And he can access any claims against him. What do you want the plaintiff to do when neither the defendant nor his insurance company will pay? He has a right to sue.

Not sure I'd believe the wife's affidavit or defendant's testimony regarding the amount, especially when the defendant was implying he saw a Pontiac the day of the accident. The issue of credibility should have been taken into account.
(pre watching deduction) Def is at fault a flashing light is a stop sign you stop behind the line in most cases you will need to roll forward so you can see and you may need to stop if there's oncoming traffic regardless had the def been paying attention he wouldn't have crashed and with the trunk lid out of alignment that is no tap Urethane bumpers bounce back and hide the fact that the rear panel has been pushed in so far as to widen the trunk and 1/4 panel gap that's a hard hit as the brackets are designed to crush and absorb the hit before the rear panel bends. . I'll bet the def didn't even come to a complete stop these days only old people and Nuns stop at stop signs
The police doesn't come out in a lot of the cases unless there is injury 🤷🏽♀️ I called the police multiple times and even had police past by with out stopping while my car sat in the middle of the street smashed up. Really depends on the city you live in.
As an insurance adjuster, being that the deck lid was pushed up, $2600 is not too much. Should have a given the man what the estimate said. Hopefully, the insurance company will fix it properly.
My thoughts exactly. Sometimes, JM frustrates me with her judgments based on her experience unrelated to the law. An insurance adjuster may have knowledge close to an autobody mechanic, but her? Not so much, lol
I am not saying weather the defendant was at fault however I hate that law with a passion. The law of if you are the car behind you are automatically at fault. That is such an outdated law that needs to go away. I see so many cases with peoples court or Judge Judy where the accident is obviously the front cars fault but b/c of that stupid law the back car has to pay. Also the plaintiff definitely changed what car it was and the money amount. I dont know what the judge was talking about with the registration. That doesn't prove he didn't change which car it is. He did it b/c damage more than car is worth.
He should be able to bring an estimate from the body shop of his choice.... plus I do not believe he called and ask for $1400.... seeing the way the trunk does not align, that was more than a tap, it would have needed a new bumper too.

Granted, he did tack on "....or anybody else". My gut says he got more than one estimate (possibly a $1400 estimate), but conveniently left that behind and provided only the highest estimate. Could them win the verdict and get it repaired for much less (nearly 50% less) and pocket the extra. He should have sued for rental car though!
Crazy how some cases this judge wont allow a writtin statement from a witness "because they arent there 2 cross examine yet N this one she let it B the reason the guy doesnt get his full cost of damage per a liget estimate just like she loves callN litigants stupid morons and sweety hunny but gets upset when they call her ma'am or miss "its judge" shes a joke

The police should always be called if there’s an accident! A lot of things can change, or be noticed in minutes after everyone drives away.
