SAG guidelines state: The guidelines require an experienced, qualified armorer to be put in charge of all handling, use, and safekeeping of firearms on set. These duties include “inspecting the firearm and barrel before and after every firing sequence,” and “checking all firearms before each use.” The guidelines do not make it the performer’s responsibility to check any firearm.

There was a murder that happened in Alaska in the 1980’s. A woman killed her boyfriend by hacking him into pieces and likely putting him in a crab pot. They never found a body and the girl moved to Chicago and became a woman. In the 2010’s the house they lived in was remodeled and during the remodel massive amounts of dried blood was found between the flooring and the subfloor. The Alaska Troopers cold case unit came out and tested 30 year old blood and got a match based on science that didn’t exist in the 1980’s. They flew to Chicago and arrested the woman who was in her 50’s and happily married with children and she is now serving a life sentence. All of this is to say evidence can come in decades later and if properly tested it can make a case that was dead for 30 years.

In this case Alec's constitutional rights were also infringed upon and it was the right thing to do to dismiss it.
It's such a tragedy to have that man walk free from such a terrible and horrible tragedy that happened at his very own hands and pay zero responsibility for it.

53:58 you are misunderstanding. HGR’s defense team knew about the Teske ammo, and originally was going to call him as a witness re: the ammo. during trial, they decided to forego using Teske and his ammo at trial. HGR case rested and went to the jury. THEN Teske brought this to law enforcement while presentation of evidence in HGR’s case was done and closed. the BWC footage, logging/storage of the Teske ammo, and the supplemental report all happened after the close of evidence in HGR’s case and after HGR had an opportunity to present the Teske ammo and Teske’s testimony but chose not to.
conversely, ALL of this happened while AB’s case was pending and months before it went to trial.
no Brady issue for HGR, definite Brady issue for AB.
    that’s the distinction.

The only person saying HGR's defense didn't want to use Teske or his evidence is Morrissey, whom we know is a liar. In the bodycam footage, Teske never says Bowles didn't want to use the ammo. His wife, on the other hand, makes a statement about "they didn't want to use it" as she was cutting him off. It's unclear whether she was referring to HGR's defense turning it away or the state turning it away.
Plus, after she says that, Teske tells her "its my story;" he, being involved with Thell Reed, HGR, and Seth Kenney, knows more about what went on with all this than she does. He's the witness, not her.
Please tell me where Bowles turned Teske away? It doesn't make sense that he would have knowing what I know so far.

HGR defense never actually called him as a witness. that’s not in dispute. teske went to the SFSO on the day the defense rested their case and the case was given to the jurors for deliberation.
teske says on the body cam that he was supposed to be called as a witness and was told to bring those rounds. he says they didn’t ultimately call him to the stand, so he didn’t want to continue holding onto the rounds.
the “they” who ended up not actually calling him to the stand couldn’t have been the prosecution. he was not on the prosecution witness list, but WAS on the defense witness list. the prosecution also rested their case 2 days prior on March 4.
there was never any dispute that Bowles had initially planned to call him, but changed his mind.

Thank you Peter- you are always informative. Watching this judge take control of this case and the court room was impressive. Makes the Karen Read case the greatest side-show on earth. So much prosecutorial and LE misconduct but Bev never batted an eye!

Peter, can you not put up the big comments on screen when you’re showing testimony in court? It covers up the closed captions making it hard to follow along. Or move the screen up a bit? Love your analysis!

I never thought he should be tried. It’s not the actors job to check equipment on the set. He’s given the props. The end.

Yeah, what if an actor is told to run, grab a pipe, and hit the monster pursuing them, but the foam pipe wasn’t replaced with a real one so they wind up hitting the other’s scull? When things are moving that fast they wouldn’t have time in that split second to realize it’s more solid than it’s supposed to be, they’re in the moment and doing what they’re supposed to do! (Then everyone tracks down who was assigned to set the prop pipe and tear them a new one for not doing their job.)

Hard disagree, he was not shooting a scene he was doing blocking. There was no reason to pull the trigger, also he was using a replica instead of a prop gun at his request. When using a replica you have to treat it like a real gun. He was reckless.

    • @mymai5859
      @mymai5859 3 місяці тому +4

@TheKhaliente Hard disagree with you. Alec was still an actor in a scene doing blocking or not. He was NOT a civilian in public wild with a gun. Actors are allowed to go through their motions even in blocking. Unless he was told specifically NOT to pull the trigger, it is logical for a scene he would do that if he was handed a gun.
I am a part-time actor & know nothing about guns. If I was handed a gun, I have full expectation that the armourer & safety officer are handing me a gun with blanks.
If I pulled the trigger & killed someone , would I be charged like Alec?
If I get given an antique real switch & box to ignite prop dynamite on a bridge, but it turns out to be real dynamite that kills someone - am I at fault as I had full expectation the dynamite was fake?
Whoever brought live ammo on to the set, plus whoever loaded a film set gun with live ammo is at fault.
Hannah was at fault, so was disgusting Seth Kenney. Seth was never charged as he should have been. Instead, Seth manipulated the investigation & set up Hannah to take the fall alone.

He pointed the gun at the victim and pulled the trigger. Thats why he was being charged, not because he didn’t check the gun.

This judge treated the prosecution as they deserved. She was over their games and pulling the wool over peoples eyes. This is how judge Bev spoke to the defense on the KR case without warrant.
This judge is honorable and did the right thing for justice. ❤

Related to the nursing analogy that was a live question: in Canada, it is part of nursing duties to NOT inject or administer anything we didn’t prepare ourselves. A nurse would get in big trouble for giving a patient something that was prepared by someone else 🙂

Police officers who have been dishonest are sometimes referred to as "Brady cops". Because of the Brady ruling, prosecutors are required to notify defendants and their attorneys whenever a law enforcement official involved in their case has a confirmed record of knowingly lying in an official capacity.
