    I love it. Big advocate for following the law and using common sense, but also a big advocate for law enforcement to also follow the same rule of law. Good show MCDO!

      As a former Deputy Sheriff, You may be correct. But define sleep or sleeping??? Know what I mean? Don’t want to be vulgar. And I don’t speak from personal experience. I speak from what I have seen from just a few bad apples. And that officer on the radio saying that they could make it where the drone flyer doesn’t want to come around them. He was terribly wrong!! In my hometown I go to the Police Dept. and The Officers Fly with me.

    Seems to me if the judge made a ruling, that would take away any LEO's qualified immunity. Sue the arresting cop personally. He/she has been warned.

      Qualified Immunity is a federal protection, and lifting it applies to violations that have been adjudicated for the exact circumstances at the appellate court level in the federal court system. I am unaware of any similar QI at a state level since the concept was completely fabricated at the SCOTUS. But I do love how you’re thinking.

      @@johnwilliams1091 it gets into blurry territory when cops intentionally disobey laws. A cop telling someone "I don't care what the law says, I'll do what I want" is a horrible look

    I had a cop curious to what I was doing....long story short, he ended up flying my drone briefly and wanted to get one of his own. I guided him what to buy and all he needed. Ever so grateful, then a year later, I see a news blurb about the local police getting 107 certified and using drones as a valuable resource. There he was, the police officer I had assisted, right there on TV being interviewed.

      @@bugsy742 would get a written warning or probation at work like normal people would for making a mistake but they can arrest you and let it go all the way to court to find out it was all a big mistake. He should be reprimanded or some form of punishment. Has to be repercussions who polices the police??

    For me these officers are not only showing a naivety of the law but also an above the law attitude to to it. I'm stoked that people like Jason and others in our drone community are doing all they can to remove the negative stigma around our hobby /vocation. Perhaps the police should try harder to improve their reputation too.

      They aren’t naive they are intent on this which means no immunity. They know they lost this battle in court and they want to push their egos over this. So these drone pilots need to push back. Strip these officers immunity and sue them personally. Make these rouge officers pay out of pocket. Force an arrest and confiscation of equipment and sue for damages as well as pain and suffering, embarrassment, lost work damage to reputation, social status the list goes on. Like I said by now these Rangers know this battle was lost and they can’t stop you from flying. Take the arrest and go from there.

    As a Police Detective of 30 years. Those officers integrity is in question now and they should relieved of duty if they still continued with their actions even after the court has made a ruling

      their actions are the exact reason good police officers have to deal with verbally combative civilians. its the unlawful actions of corrupt police officers that give every GOOD cop a black eye in the public spotlight

      we do not need to abolish something that does NOT exist in law. What we need to do is remove judges who do not respect the constitution which mandates EQUAL protection, NOT "special protection". SOME animals are NOT more equal than others.

      I’m a cop and a drone pilot. I teach drone classes to the public at the library and I help other public service agencies become familiar with drone laws and start search and rescue programs.
      If you think getting rid of qualified immunity will help anyone in any way, you’re out of your fucking mind. A simple lawsuit would make the people in this video a lot of money and probably get some serious administrative action on these dumb ass cops.
      Ending qualified immunity will do nothing but ensure the police won’t show up when: step dad gets drunk and beats his wife and kids, the jealous ex boyfriend tries kidnapping his ex girlfriend, the local bangers decide to rob the 7/11, the dick head in the corvette wants to do 80 through a school zone, the hundreds of fatal car crashes that happen every winter, the infant is choking to death and mom has no clue what to do.
      I’m not saying police are hero’s, but uneducated people such as yourself are the ones who should “think twice”. #dronelife

      Yes and no. Because when a cop makes and honest mistake they should not be charged. Remember they swore to an oath. You should read on qualified immunity. But yet when going to court there should have been a clause to say that by such date all county police or park rangers need have receive a e-mail of the court rulings with a copy of the drone laws for educational purposes and if that was the case they would not have qualified immunity protection because at this point its harassment which is a crime.

Just like in the video whats the need to go talk to them if you know they not breaking the LAW? Thats harassment and your quilified immunity should not apply. You should be able to tell by the recorded conversation the cop was not going over there for a friendly chit chat the recording tells the tail you know it and we all do too. If the table was turned any civilian would be in cuffs. It's events like this is why some of the public is not for the police. I feel the feds should be over all police academies. Please recite your oath.

      Do it anyway and make sure you are recording when you do. They can not in good faith argue they didn't know. If they choose not to look up and or verify what you are telling them, that is entirely on them. Any action they take against you at the point is a constitutional violation.

    Huge Thanks to Jason and Geeks for sharing this. As a FAA107 Pilot I fly by the rules the FAA have set. These officers don't go and bother manned pilots at the airport. Same rules for the part apply, they shouldn't be bothering an unmanned pilot while their conducting a flight. The FAA really does need to start doing something about these incidents. Before an accident occurs.

      @@Geeksvana Yeah these sort of incidents really spin my props. I'm a big proponent of education over punishment What we're seeing here though, they're making their own law. With nothing more then OOPS as a consequence. Since here in the States with only one government agency that has any authority over airspace the FAA. It's beyond time for them to do their job. I have yet to meet any pilot unmanned or manned that doesn't take flying seriously and works diligently to ensure the safety of each and every flight they conduct, that even includes the FPV pilots. Who are very talented and skilled pilots, which is why they are able to fly the way they do. I recently hung out with a bunch of them, not a one took flight without respecting the rules and being sure of flying safely. It was nice to see!

      Thank you D&Ds, an excellent point well made! The vast majority of drone flyers are very responsible and as you state, that includes our FPV friends. The image some try to paint of the hobby and profession is based on a tiny minority.

      @@sferg9582 : This is the era of constant video recording. Many fine old thug traditions loved by cops are not going to hold up. Like blacksmiths of old, many may need to find a new trade. The blacksmiths did have the advantage of knowing how to do an honest days work without stealing or robbing others

    SUE, SUE, SUE!!! Since it's obvious this bunch don't care about the law, you may need to appeal to their economic side. You should sue to recover every penny of your legal fees plus punitive damages and for harassment by the local PD. Capturing the radio transmission proves they were very well aware of the legal aspect of this but deliberately chose to ignore that and instead sought to bully. Just what every town needs, a bunch of bullies with badges!

    Part of the duty of being a cop is to ensure that they are up to date with all new laws, changes to laws and laws that have been repealed. In most PDs cops are REQUIRED to sign for having received such notifications affecting laws. It literally is their job to know the law and ignorance of law, as we all know, is not an efective defence when you are standing in court accused of a crime.

    I feel your frustrations, that is just crazy. A park no one around all of sudden a park ranger shows up. Yet they love our aerial photography.

    An incident occurred on September 3, 2023 and the PA State police now have my Air 2S. I was filming a hyper lapse video of the sunset when I received a critical battery error (my own stupidity) and the drone made an emergency landing about 400 meters from home. I could see that it had landed on a neighbors property and waited until the next morning to go there and ask permission to search. When I did they told me that they had found it and called the police who came and took the drone. I was happy to hear that it was found and figured that all I needed to do was call, explain what happened, and go retrieve it from them. I made that call on September 4 and was told that the officer involved would have to call me back. I waited a few days without hearing a word then he finally contacted me. He informed me that I wouldn't be getting the drone back soon if at all because there had been other complaints, about drone flyers in my neighborhood. I explained that I could easily prove that there was no malicious intent on my part by showing him the flight logs. I also told him that everything I filmed would be on the memory card in the drone and, if he removed the battery, he would find a sticker with my name, address and phone number on it. He didn't want to hear that though and was very arrogant and downright rude when he told me that he was gathering everyone in the area who had complained and they were taking me to court. When I inquired about a timeline he said that he couldn't even start the 'investigation' until he gets off of 3rd shift. Its been a month and he still has not started the investigation. Since then I've done some research and found that civil forfeiture laws exist that allow them to keep property indefinitely even if there are never any charges or arrests made.

      UPDATE
      I received a call from Trooper Lewis of the PSP today (12/10/23) and he informed me that he would be filing 'unlawful use of an unmanned aircraft ' and also 'disorderly conduct ' charges against me. The disorderly conduct charge really blows my mind. When I asked him about it he said it was because 2 other officers had visited me with warnings. Those officers never issued any warning either written or verbal. Unfortunately with my wife battling breast cancer and heart problems and with both of us being retired on a fixed income the money won't be there to hire a lawyer and fight this and my income will keep me from getting legal assistance.

    Remember, this was 2 years ago and the laws change, not the FAA right to fly in Federal airspace, but like we have here in Florida, municipal laws regarding taking off and landing in certain areas. The following is an example:
    "Operating a UAS for commercial purposes within a City of Altamonte Springs park also requires a permit. Commercial UAS users must submit a copy of their FAA authorization to Events Management. Depending on the proposed use, the City may require a Special Event permit, Right of Entry permit, or other approval. Further, commercial photography or filming within Altamonte Springs also requires a permit from the Metro Orlando Film Commission." The FAA does allow municipalities to construe their own regulations regarding using municipal property, but they cannot ban flying over such properties.

    As a single-engine, auto-gyro, ultralight, and powered parachute pilot that entered into flying via model aircraft, I'm completely disgusted by the FAA and its growing aim to make it a rich man's hobby.

    Awesome video. 👍👍 I have been flying all 6 of the Genesee County Parks for 3 years now. I figured i was the only FPV pilot getting harassed here. Looks like i am not alone. I wish i had a few of my run in's still saved.
    I think i will head out today to say hi to the Rangers.... No more hiding to fly !!!

    As the saying goes A law into themselves. This is the main reason Sean I wear a body camera on me when out flying my drone to protect myself from he said she said situation and the same goes for my car I have a dash cam to record what’s going on around me just in case 👍 thanks as always for bringing us this story cheers

    Flying drones safely is not a crime! LEO's are not there to enforce feelings, they are there to enforce the LAW. If LEO's don't and they violate your rights, don't resist, let them violate your rights, say "I'm not going to resist but if you violate my rights then you do it without my consent." Record every interaction with police! Know your rights! Pro tip, pleading the 6th is a good way to not answer questions without the presents of an attorney and not look guilty! I'm glad people are standing up for their rights. Do it but do it smart.

    This sounds like a small case of a few or one officer butthurt about the lost case. The administration seems to have complied with the order. Even the other officer on the CB radio convo was advising nothing can be done. Keep up the fight everyone, it is never over.

      Hey Russ! Exactly! It was also good to hear the legal response to the Coalition's lawyer stating it shouldn't happen again. Although with the history this particular police department has with respecting the rules, everyone is remaining vigilant! Great to see you sir! Hope you are well!

    I am a retired commercial pilot, flight instructor and a air-frame and power plant mechanic and have held all of the licenses for well over 50 years. I have seen a lot things that would come and go but the DUMBEST thing is with the grounded so-called law enforcement clowns who write the rules as they see fit. The FAA (Federal Aviation Administration) has flight rules pertaining to drone flight which covers a myriad of rules. Drone pilots know what they are and abide by them. 99.9% of all of the FAR's (Federal Aviation Regulations) are safety orientated. This applies to mechanics (me) Pilots, flight instructors (me too) and drone pilots (later). My biggest FEAR is the common police departments having their employees wear costumes (clown suits) that have NO idea of what is going on and probably never will when it comes to drone flight or otherwise. Almost forgot to tell you all I used to fly radio controlled airplanes designed, built and flew my own designed airplanes. Kits were easy and all of the math was already taken out of the build process an TOO EXPENSIVE to buy, so my aviation knowledge is quite extensive. Just like the Constitution of the United States, State, county and or local rules DO NOT trump Federal Laws. In closing I would tell any cop (that approached me to say that I could not do what I am doing as long as I am within the law) to go kick rocks. IMPORTANT::::::: Unless you break the law DO NOT give your identification to ANY cop if they ask for it, then ask "What law do you suspect of braking , will be breaking or have broken. This in short is called RAS (Reasonable Articulable Suspicion). Most cops ask this and expect you give them your identification. Do not forget, they make the laws as they go ! ! !

    TEXTBOOK EXAMPLE OF A PROPER DRONE/POLICE ENCOUNTER- Always be nice and respectful with the cops, argue and get combative and you'll end up in handcuffs. Document everything, pick up your crap and leave. Follow the legal process later. I am a retired cop (32 years) with 8 years in business as a commercial drone operator.

    I am retired LE (federal). I see a lot of police, fire etc. have starting their own "drone airwing" for search and rescue, recovery operations, intelligence gathering etc. It is a lot cheaper than operating a helicopter, especially in the early stages of an operation. Maybe the park police guys don't have a unit. Ask them. Maybe put on a presentation on how drones could be used for those purposes. The way that one officer was chowing down on his McD hamburger, I don't think he gets out of his car much. What happens in the bigger parks where someone goes missing? I don't see those guys "hoofing it" through the woods. I know it sounds harsh. I would be embarrassed as hell if I got caught on camera stuffing my face while my partner was doing all the work. If I were his boss, I'd be talking to him! What if he had to react if his partner was in trouble, he's be shot before he ever got out of the SUV. I was getting a program going before I retired, still fly and I love it.

    I’m not sure why there was such adamancy for park law enforcement to prevent drone flights over local parks, but I don’t know the whole story. The few times I’ve been dispatched to drone related calls in Texas, I’ve always chatted it up with the pilot about his drone. The areas I’m dispatched to are in Class B airspace, but each time, the pilots had LAANC approval and were not violating any laws. One guy was a little nervous because of the interaction, so he wanted to end his flight, but I just encouraged him to continue flying. It’s a fun hobby! I’m also a Part 107 pilot, but I still mostly use my drone for scenic videos and landscape photography.

    Sean - I have a question. Is there a Drone Flyers organisation here in the UK that routinely challenge over zealous rulings like the ones depicted here? Litigation in the UK can be very expensive, yet it's vitally important that our rights are defended when operating legally. Great vids!

      Hey David! There are a few groups who certainly try to keep the authorities under observation such as the anti airprox group. There was also the instance where the couple falsely accused of flying a drone at Gatwick who received substantial compensation.
      However, there so far hasn't been the need for organised support. That could change with the drone bill going through Parliament which will see police granted greater powers over drone flyers...

    This kinda seems like the dystopian base of the hunger games. They closed the parks for the day so they could not fly. They had police (peace keepers) surrounding the park when they got to the other park.

    The most interesting thing is that this video preaches as long as you’re with an FAA regulations you’re fine. But the fact remains that the drones flying over houses and cars and populated areas are in there in direct violation of the FAA.

    Michigan is my home State. So proud of my brothers who are willing to push back against domestic police power controled by sick men. The comments by police give us all concern for the crisis the Republic is in. A Curse has been put upon many minds and they have lost all sence of community, respect, civil order, living by the laws and regulations that we agree to follow to keep the peace and have a safe place for families. Police power is required but we are in need of Reforms and new laws that govern officers conduct when in contact with police. Support for good policing is needed and the legal system needs to step up and apply justice when we have criminals on both sides of the law. Police need better monitoring and officers need to hold each other accountable. It is already too dangerous for officers we don't need bad evil officers endangering other officer's lives by their conduct.
    Men keep the high ground and hold it!

    Great video, kinda beginning to wonder if drone piloting is beginning to become more like the trucking industry was back in the seventies.
    Police who think that they’re doing their due diligence on ordnance’s they right up that flies in the face of governmental agencies in which it’s the police who are actually breaking the law.
    Looks like we’re all going to need to retain good attorneys that keep us from going to jail for basically doing nothing wrong, while junkies are needling up in the playground area.

    Same thing happened to me - the park ranger said I needed an FCC license.. YES A LICENSE FROM THE FCC! When I told her that she was wrong she told me to google it and drove off in her truck

    Any violation of order should be reported to court for consideration of contempt of court order. Do not allow them to just walk on violation of order. Make sure court knows of each time they violate order.

    typically states and local municipalities can't make laws for airspace. However, they still control the ground. If you are standing on their property controlling a drone, you are trespassing. So, just go to a private property nearby and fly over.

    Just now seeing this video. I am not a drone enthusiasts, but I am fascinated by the drone flying issue. I'm just completely confused that in a public park, where there is no expectation of privacy, that there is an issue with a drone. Someone can walk right up to me and take a picture of me head on if they so choose, but they can't fly a drone high above me, where you would do well to make out the top of my head? This makes no sense to me. Is this some sort of a safety issue? Are they afraid a drone will crash onto someone? I know nothing about drones. I know my grandsons had a very cheap drone one time with a battery life of about ten minutes. If that thing had hit me on the head, it might have smarted, but it wouldn't have killed me. But as I said, I know very little about drones. I'm wondering if anyone could enlighten me as to whether there has ever been any issues with injury to anyone. Can a drone simply fall out of the sky? It seems unlikely to me, but I don't know. What is the issue with this odd crackdown on drones? No, I don't want someone filming me in my backyard sunbathing, (not that anyone would want to if they got a look at me hahaha), but I still don't understand the public issue. It seems unreasonable to me. Can anyone explain this to me?

    Love the cop shoving burger in his face while idling his internal combustion engine while illegally waiting for the electric drone to stop flying. The broadcast on the radio only shows most cops are just another gang with guns.

    Talk about overreach of the Police. This does have an overarching theme of Police trying to enforce their authority on everything and restrict freedoms.
    It's bad enough that drone pilots have to deal with members of the public who don't know the law on a daily basis, but when the Police are worse, it's just intolerable!

    Every time I have flown a drone in public, in multiple states, I have had the police called on me. Now, if I want a video of a certain area, I launch and fly from a private area nearby and never fly directly back to where I am. Problem solved.
