Have you been denied your disability benefits for degenerative disc disease by the Social Security Administration, your long-term disability insurance company, or the VA?
Degenerative disc disease is a condition that is the result of damaged discs. The intervertebral discs that cushion the spine's bony vertebrae become dehydrated and shrink.
The discs are worn down so severely that the vertebrae rub together as a person moves. They fragment and herniate, causing chronic pain, radiating pain, and loss of mobility.
Hi, I'm Marc Whitehead, founder of Marc Whitehead & Associates, a national disability law firm.
For many living with degenerative disc disease, working becomes unbearable. Yet winning Social Security disability benefits for this impairment can be difficult. The SSA wants to see medical evidence that supports the severity of your condition, your functional limitations, and how you have responded to treatment.
Specific medical tests can help you prove your disability and win your Social Security disability benefits. Tests like:
    • Imaging studies such as X-rays, MRI, or CT scan
    • Physical examination, where your doctor's direct observations support orthopedic, neurologic, or other findings
What if you don't meet the medical criteria in SSA's Listing? Don't be discouraged because SSA provides another step where you can prove disability by using vocational factors. SSA will review your residual functional capacity, along with your age, education, and work experience. It is by establishing these functional limitations that most degenerative disc disease claims are won.
If your insurance company denied your DDD claim, don't be surprised.
Our lawyers routinely work with the medical facts and functional limitations involved in Degenerative disc disease claims. We will analyze the insurer's denial letter and determine where mistakes were made, and help you develop an appeal that satisfies your burden of proof.
Finally, What about veterans with back problems that may not surface until long after their tour of duty? Our law firm is well aware that the VA often continues to deny these claims for service-connected disability compensation. An accredited VA attorney at our firm can review your claim and provide experienced representation to help you obtain the best ratings for Degenerative disc disease and other possibly related conditions.
It's also common to have multiple spinal impairments, such as Degenerative disc disease aggravated by underlying osteoarthritis, facet arthritis, or radiculopathy. A good disability lawyer will take the necessary steps to ensure all medical evidence is clearly presented to the SSA adjudicator, the insurance claims examiner, or the VA rater.

how do you prove all this after you lost your insurance and were fired from your job due to the injury? neurosurgeons basically laugh when i tell them i just want to pay with cash for a consultation. meanwhile my MRI and Xrays are aging and will soon be ignored by the specialist because most want imaging results at most 6 months old.
