When my back was going through the C&P exam, the examiner asked about nerve pain and symptoms and added radicalopothy as a secondary that visit. Nice surprise
I got radiculopathy for my shoulders that was a nice surprise. I had an examiner who was a veteran and she looked at my MRI where I have 2 bulging disks in my neck.
It was also brought up during my back c and p exam. Radiculopathy has never been brought up during my VA health examine to my doctors. Could they still grant it for my increase?

I have so many issues that were secondary to what VA has me rated at. They don't like to tell you anything that is secondary to my main diagnosis. I recently applied for secondary conditions and wish I could have claimed more because I have a lot more verifiable secondary conditions but for a non-medical person I have to figure them out for myself.
There's nothing in the VA regulations that states VBA has to inform the vet of what they can claim secondary to a service-connected condition. Why not get a private doctor to do a DBQ and nexus. You will need both.
Thanks, Dewayne. I’m going to set up my first primary visit consultation at my local VA clinic right outside of Philadelphia. Our main VA hospital is down in southwest Philly right by the University of Pennsylvania and it’s affiliated major hospital, HUP.

Why won't the VA regional offices approve claims with solid and relevant medical evidence from medical doctors whose specialties are specific to a claim? They only consider the opinion of a nurse practioner from a c&p exam.
It's not the regional office, it's only a few RVSR's whom which complete the rating decisions. It's not all of them but some and why is a good question.
@@Jonathan_G12thank u for your feedback. I have researched evidence for my claim online and found four additional sources of medical evidence showing that hypothroidism can cause osteoarthritis. My original claim contained one research report. Two if these sources are from medical doctors, one specializing in rheumatology and the other in endocrinology. One is from the Mayo Clinic. If this isn't absolute and indisputable medical evidence then I don't know what the .... is. Label me extremely frustrated.

Great info Sir! If radiculopathy was not claimed but was shown evident in the DBQ but was NOT rated what is the proper fix: HLR appeal to the back rating citing duty to assist error , radiculopathy shown in DBQ but not rated. OR file a new secondary claim for radiculopathy and include the back DBQ as evidence?

In my initial decision (2009) I was granted 10% for chronic Low back pain, with a secondary claim for sciatica Neuritis. I went before a PEB while I was still in and they diagnosed me with low back strain, chronic low back pain and segmental dysfunction (all under one,) as well as sciatica neuritis. but denied my secondary claim even with a diagnosis. Technically I was still in and was medically separated with that diagnosis. and yet their decision to deny was that I didn't have a current diagnosis. I didn't learn about this until recently when i looked up my decision letter online. This makes zero sense to me.
I'm so sorry I didn't see this response. The examiner said I didn't have sciatica but instead SI joint dysfunction. And that's where my symptoms stemmed from. Even with a unfavorable finding since I had a bdd claim with a favorable finding. Wouldn't that presumptive with the year I got out? I literally just filed my claim yesterday and put in for a CUE claim for the sciatica neuritis. I have a current diagnosis but even my VSO said they may come back with I should've done this within a year of being denied.
@@tytitus1781 I'm sorry but I don't quite understand your response. Could you please rewrite it because I'm not sure about the questions that you're asking? However, one thing that does stands out is that you' stated that the examiner said that you had something different from scatica? What type of exam was it? C&P exam or something else?
Can a DBQ be updated? My brother had his C&P exam in April; I was with him. I know we talked about Diabetes and its various related impacts. The Diabetes DBQ could have been completed based his medical records. Whether or not they were I don't know. All I can tell is that there appears to have been 15 DBQs submitted to his claims file (from what I saw on his My VA portal.) Many of those secondary conditions are documented on his medical records. I recently requested a copy of the DBQs. If upon reviewing them I see that some conditions, which are clearly part of his medical record, are missing from the DBQ, what recourse does one have to correct the omission(s)?
I'm not understanding what you are trying to do. If he has had a C & P exam, the examiner will completed the DBQ, depending on what they decided, the VA will list the options in the notification letter. Does anyone have any insight as to how the VA will process some claims? In the end of May, I filed two secondary claims and one increase. All three were assigned for a C&P. One, was an ACE, no appearance needed, just a medical review. The examiner did call me with a few questions. The second was a virtual meeting. Both DBQ’s were completed and show on my VA profile as received. The increase was also assigned for C&P but it isn’t scheduled for over another month away. Will they hold all three claims until all DBQ’s are received, or will they process and determine each to their own claim? I did call the VA and they really wouldn’t say how they will process them.
No one can say what each VA employee at each location will do. They have the option of granting one condition and deferring others if more development is needed but that will depend on the VA employee. It's not standard across the board.

Because some veterans pay for nexus letters knowing they are committing fraud. It's a little more difficult to fake it in a comp & pen exam.

I only used a couple of examples in the video and every claim is different.
How to connect your migraines without a nexus ?
Ya I am about to claim RLE radiculopathy secondary to my back. I thought a nexus was needed
look at the DBQ.
Section VIII, Page 10 lists Radiculopathy. Does it still need to be added on “other” on page 2, Section 1B?
Yes, under the other section. The old DBQ had it listed as one of the diagnosis.
Appreciate your prompt response!
Great info Sir! If radiculopathy was not claimed but was shown evident in the DBQ but was NOT rated what is the proper fix: HLR appeal to the back rating citing duty to assist error , radiculopathy shown in DBQ but not rated.
Why did the examiner say no.
Did you ever get your answer? If not, let me know and I'll do my best to explain it to the best of my understanding.

Can a person file Hiatal HerniaGERD & sleep apnea secondary to GERD at the same time?
GERD and GERD are the same. You can file sleep apnea secondary to GERD but a medical opinion and rational will be needed from the C & P exam. SH Video, Very good explanations as you always provide the details.. Hope your doing good DK. God Bless
Hope you are doing well. Thanks again for the positive feedback and glad you enjoyed the video.
@@DewayneKimble I appreciate the reply. I was just wondering if there is a guidance or protocol that would dictate procedures how VA Rater’s process claims. Being a government agency, they’re usually full of documented procedures so there isn’t a Rater’s personal feelings adjudicating claims. Like a Rater’s Manual so to speak. Thanks again.

My vso told me I don’t need to provide a nexus letter to claim ED as secondary to ptsd . Is it true?
They are wrong, but I'm sure you asked them which regulations states you don't need one. You can now get your signed copy of my new book "VA CLAIMS SUCCESS - Your Guide To Maximizing Your VA Compensation Benefits": store.kmd89.com/

I just received my service connection for my back (DDD, radiculopathy in both legs).
Do I need to wait 5 years to claim secondary conditions for my knees/neck so that my approved SC back condition is static?
Why do you need to wait, you can put a claim in now. Upcoming Webinar "Get Educated On The VA Compensation Claim Process Webinar" (COUPON CODE: WIN10). August 13th - 14th 6-8PM EST: va.kmd89.com/win-your-va-claim Tired of getting denied and ready to WIN your VA compensation claim.
I didn’t know if I needed to wait til my primary condition was “static” or not. Didn’t want to risk getting reduced since my primary condition was just awarded.
Thank you for the information.
You bet! and I will see you tomorrow on the live.
Great video Dewayne.
Thanks 👍
Thank you Dwayne!
Very welcome
Filed for increase on 4 disabilities in April had c&p exams first of May. Vso filed on others middle of May and haven't heard nothing since. IS this normal? it's been 120 days. Thxs
VSO should of probably waited until you received a decision on the first four claims since you had exams for them.
If you filed a Fully Developed Claim (FDC) initially and then submitted additional paperwork/claims after the fact, you put yourself in the back of the line again and removed your claim from the FDC program to a standard claim.

There are no specific time frame for VA claim completion. I've seen some take a week, year and in between. The VA has gotten faster from 10 to 15 years ago.
After the fact I do believe my vso should've waited.
I joined the army in 1981 and a month later I was diagnosed with perforated ear drum and was given a honorable medical discharge am I eligible for benefits? remember I had just started basic training only served less than 30 days.
All the evidence would have to be reviewed, DD 214, medical records from active duty etc. : www.kmd89.com/services

You can get service connected for more conditions but the payout is the same for 100 percent unless you have dependents and/or any SMC's. Don't forget to

Hey Dwayne, I had back surgery in December of 2020 and I’m still having severe pain as well swelling. They did a nerve test which concluded that the nerves are not responding as they should. How should I k proceed with this claim
Hello Mr. Clark, the sciatic and femoral nerve in the lower extremities are common complications as noted on the VA's back DBQ. In the video I show this on the back DBQ. Thanks for the support to the channel. Also, we will be posting our upcoming private Q & A session, be on the look out.

I have your book already…only read a few pages. Taking it with me on vacation.
Hi Dwayne! I had a question was hoping you could answer. If I had a DBQ filled out by a private physician. But they marked records were not reviewed. Is that bad? Or maybe unfavorable?
How could the examiner complete based on objective evidence. Please check out our DBQ service: www.kmd89.com/services

Can ED be secondary to PTSD if Doctor has noted in records Medication being taken for PTSD can cause ED?
I've seen veterans claim that secondary and get service connected for it, but a doctor would have to say it is.
@@DewayneKimble I've been diagnosed by primary care VA doctors but denied twice because they said I didn't have proof linking it to PTSD until recently my PTSD VA Doctor wrote a letter stating the medication I take for PTSD can cause ED so I resubmitted my claim.
It is if your PCP has proscribed duloxetine or equivalent to treat PTSD, ED is one of the listed side effects, this makes your case for you.
Wath abaut Apnea ?
Have you had a chance to review the sleep apnea DBQ.
Thank you...Great video

Quick question, are secondary claims to tinnitus, anxiety, depression and Migraines good claims and are they usually permanent? Thank you for you time and all the information you provide.
I'm not a medical doctor but I've seen veteran claim those secondary to tinnitus and get service connected for them. Your welcome and thanks for the support to the channel.
What about bruxism and tmj secondary to mental health? Are they common secondaries?

Do you know anyone that do nexus
Our clients have access to medical professional for some DBQs and nexus but they have to have their claims folder.
Can I please ask a question? Do the medical exams have to be probity by a VA doctor or can you just use your private primary care doctor?
Your private doctor can complete your own DBQ.
Hopefully, I can file for some of these because the ones that need an Nexxus or DBQ the VA and the civilian doctors in my area For used to do because the chickens..
