If not, the police usually tell parents they have to go to court and they refuse to intervene. I’m sorry this happened. May I ask which state you live in? Was there a court order in place indicating his mother is the primary guardian? If not, the police usually tell parents they have to go to court and they refuse to intervene. However, if you haven’t been legally identified as the child’s father or you’re not on the birth certificate, you will need to establish paternity to assert your rights.
