That's a good question to ask, but it's the question that is dealt with effectively last. DCS first has to prove on the balance of probabilities that the impugned comments were defamatory, which is no guarantee. Even if they clear that bar, truth is a complete defence to a defamation claim and it would appear this is Stefan's strongest argument (of many pretty strong arguments). Qualified privilege may be a good defence, as well as honest opinion. Honestly, I'm can't understand how DCS ever thought this suit would benefit them. Even if they win (which seems unlikely IMHO) their actions in bringing the suit at all have done more damage than an honest, unbiased review. Then there's the post-facto warranty change that Lois Rossman uncovered! What a mess.
In some ways I hope this continues, as a clear signal needs to be sent to companies about the whole youtube review process and that they cannot buy honest reviews or try to sway reviewers with threats of bad exposure. If a product is good or bad let the reviews show this. As a consumer I want to see both sides of a product so I can make the most informed purchasing decision. The report that was released a few weeks back showing how there is a high likelihood of false and misleading positive reviews on Google also. show that factual , concise and honest video reviews from real people is needed more than ever. Such an odd system. To us average Joes, we would expect the basic definition of deformation be checked against the claim long before the size of the company or claims of loss of profits were considered. As loss of profits could be directly tied to a poor quality product not due to unfounded slander.
In any justice system it is always best if you can get the case thrown out on a clear technicality. This is why lawyer prefer that approach. If it can be demonstrated that DCS is too large to sue people, case closed. When it comes to checking if the review was defamatory it usually gets less clear and if it is a jury trial (like in US, don't know about Australia) then anything can happen because the people in the jury have usually very little understanding of the subject mater.

Further you also suggest they are a small family business, therefore they can sue. I'd suggest words like corporation and business arm etc. Still, I dispute the suing of UA-camrs with honest reviews. I've donated and wish you well. Further, maybe we should all donate to another cause, hire a lawyer and get our silly Australian laws changed so this never happens again.

DCS doesn't co-own a factory in China. What a total crock of shit. To even get close to a joint venture with the Chinese, you need produce in massive volume. The Australian market for lithium batteries is so tiny that it wouldn't support a joint venture. It wouldn't even come close. DCS, like 99% of other importers, contract a Chinese manufacturer, or manufacturers, to produce branded goods on the importers behalf. And, like any other likewise manufacturer/exporter in China, they don't support warranty returns but instead will provide a percentage (usually 5-10% but open to negotiation) over and above a purchase order/production run as a buffer to cover any warranty issues. The importer is holding the risk above and beyond that 5-10% buffer. Once that buffer is exhausted, then the importer is left holding the bag and is forced to draw down on first line inventory, essentially stripping away profits. This why it is so difficult sometimes to get importers/vendors to acknowledge a warranty claim. Lithium batteries are certainly no exception.

Providing honest information with fact based testing of a product is not defamation. The irony is the lawsuit is going to do far more damage to their sales than the review.

That was a solar battery and not related to automotive use, it would not stand up in court as being relevant.

Depends on the state, SLAPP isn't universal and there are ways around it such as conducting the case in a federal court.

Providing honest information with fact based testing of a product is not defamation.
The irony is the lawsuit is going to do far more damage to their sales than the review.
They may have lost a little business as a result of the video, but they will have lost so much more as a result of their legal attack.

DCS because of their actions has put a huge spotlight on the company and its products reaching far and wide. And the continued pursuit of you only add fuel to the fire of the company reputation which took a huge hit already.
