- Why Was the ATF Seizing These Muzzle Brakes This Past Week? In this video, I discuss a recent warning notice from the ATF regarding three types of muzzle brakes manufactured by Lethal Eye (KBC Capital LLC). The ATF is classifying these devices as silencers and has given recipients 30 days to coordinate their abandonment. Mystery (partially) solved! TFBTV Discord user WidowKiss found one of the brakes on the list: the M-074. This appears like it might be an unshrouded baffle stack, which has already been deemed to be a silencer by BATFE and the Courts in the Sig Sauer case mentioned in this video. Pic in link.

So if the muzzle device (brake) makes the sound louder at the shooter's ear...it is a suppressor. If the muzzle device (blast cone) makes the noise not as loud at the shooter's ear....it is a suppressor. If the muzzle device has no effect whatsoever on the noise level BUT "looks" like it could be used in making a suppressor....it is a suppressor. Basically, the ATF, can classify or re-classify ANYTHING as a suppressor or POTENTIAL suppressor or "suppressor component". Sounds like a rigged game to me.

I use to be a LEO and spoke with a few BATF agents. This was a few years back, but they were not chasing individuals or individual owners. They originally were tracking down people setting up shops out of their garage. They didn’t even hook a guy for a FA AR. They were looking for big fish.
I know we aren’t talking “politics” here, but Biden changed everything. His agency is going after everyone. The irony that people are worried about Trump when in reality Biden abused the gov the worst

There was also a case where a Diesel Engine repair shop got targeted for buying thousands of, you guessed it, OIL FILTERS for the Diesel Engines they repaired and other vehicles.
It seems they really have nothing better to do.

Edit: I was speaking on the sig rifle with the muzzle brake that doubles as baffles when you pay your tax stamp.
Idk, if you take the tube off of a suppressor, its still part of a suppressor. Obviously I don't like the atf, but personally, I would have never purchased this product and expected it to fool the atf.

With the over-the-top efforts of several states to clearly disregard the 2A, there may be enough groundswell for that challenge to happen. Plus decisions from the current SCOTUS seems indicate that they could be sympathetic to that.

Using the ATF’s logic that some part by itself can be a silencer or a machine gun even though it’s impossible to make the part work as such. Then black high temp spray paint or a piece of TIG filler rod is also a silencer or a machine gun maybe even a nuclear weapon. They would rather harass legal gun owners than go after actual criminals killing and robbing people with weapons.
Indeed, adding length reduces muzzle pressure and sound intensity. By that abusive logic the gas tap on many rifles is a "suppressor".
Going down that rabbit hole, "suppressors" are in common use for lawful purpose, with attendant court precedent.
There is a Remington Arms video on youtube (it's a really good video too) from the 1960's showing them making their guns. Anyway, they show one of their designers at his home shooting range testing some rifles. He had about 10 large vehicle tires roped up and he would shoot through them to help reduce the sound so as to not disturb his neighbors. I wonder what the ATF would say about that today?

So I got one of these letters. I don't recall ever getting a "break" or anything or even remember a site called lethal eye and none of my bank or credit card records says as much either, but I did get a thread adapter for 5/8x24 to 3/4 npt threads off ebay a while back for adapting to pipe threads to make my own krinkov style brake, and explained that to them. I met with my local ATF agents to surrender the device. They said all I had to do was surrender it or sign an affidavit saying I don't have one. Well they looked it over and said it wasn't the material they were looking for. Mine appeared to be steel to them and a steel thread adapter was not illegal. Only the aluminum ones. Can't make this up. They gave it back to me and I signed a letter stating I didn't have any of the items described and they said the case was closed. Really bizzare. They said I'd know if I had the ones they are looking for because they are not safe and made of pot metal or aluminum and would blow up under regular rifle pressures. If that's the case, then all these devices would be destroyed and they would not have to search for them? Even my local law enforcement friends are confused by the logic and enforcement of this on the federal level right now.
ATF is nuts. They are out of control.

@@choccolocco there was a pretty good case with the Supreme Court about people found crossing the boarder with unlawful items. They pleaded ignorance and said we had no idea that was hidden under the car. SCOTUS said tough; you knew better and are responsible.

The Federal Government doesn't need a warrant. My home and FFL Business were raided and searched 5 times in the 2 years following January 6th and when I asked to see a warrant, the agents told me to stand back and shut up or go to jail. Sometimes they refused to even tell me what agency they were with but had "Federal Agent" vest on. No one ever found anything illegal but confinscated my phones and computers several times.

not anymore. anything resembling a baffle stack or wipes is good enough for an indictment+obligatory raid, confiscation of everything you own and pre-trial detention until you plead guilty so your family doesn't starve. they're basically enforcing the AWB in piecemeal fashion, slowly stacking case precedent after case precedent against every aspect of it. with each guilty plea precedent is set, warrants and indicments against the next target get easier, and greater erosion of the 2A is are all but assured. the SC will do NOTHING. like that judge in NY said - the 2A is dead. because nobody will do anything. they have won.

Just as an aside, these decisions aren't being made by ATF agents but by bureaucrats who might work for the BATF-E today, transfer to the DOD next week and the EPA next month to get a GS-12 to GS-13 salary bump. They don't need to have any particular expertise aside from knowing how to do office work.

Read "Ammunition" by Ian V Hogg. They have suppressed ammunition with no suppressors involved. Add a cast acrylic sabot that disintegrates upon exiting the barrel sending a pristine round down range with complete ballistic stability and increased terminal velocity and no internal ballistic data. They even re-shot rounds with other ballistic data. Firearms and ballistics are centuries old technology. Technology is a two edged sword. As the Ferrari Poster said "What can be Conceived can be Created!"

I am pro 2A, but Misquoting law doesn’t help the cause. If it did, you could take that quote to SCOTUS for all 50 states today. That case was in regard to religious liberty. You are better off quoting the founders opinions of 2A. That shows intent of the actual legislators.

@@BertShackleford My friend, I just searched that case thoroughly. That quote is not in there. I think you may have quoted another source. Something similar to that quote was found in an appeal for certiorari to the US Supreme Court this year, but the Supreme Court never said those words.
Almost every single time the word privilege appeared the word tax or taxation was in the same sentence.
