  • The plaintiff rented two storage units at the defendant’s facility and says $5,000 worth of belongings were stolen. The plaintiff claims security footage shows the defendant going into the unit, so the plaintiff is suing for the cost of the missing items. The defendant argues she thought the belongings were abandoned junk, so she donated the items. The defendant is countersuing for stolen sneakers, as well as pain and suffering.

The defendant is definitely a thief. If she noticed a storage space is missing a lock, the normal response is to put on a temporary lock and then notify the owner. You don't load up your car and take stuff home. It's why she was fired.

    3. If property was abandoned why was she fired
    4. Why didn’t she sue her former employer for wrongful termination

    1. No police report listing the designer items
    2. Why didn’t she have renters or homeowners insurance for such expensive items
    3. No pictures of her wearing designer items. Who has items that flashy and doesn’t wear or show them off.

I worked at storage place for about 4 months. If someone broke in and stole stuff from a unlock storage, then it would be the customers fault. But as an employee, if we saw an unlock storage, we had to place a temporary lock on storage and notify the customer. We can't just simply walk in and take stuff. I am sure the place she worked at had a similar process, that's why they did lock check twice a day. Also, any property left outside the storage, we had to place it in a designated area and notify the customer and give them 2 weeks to reclaim it. If they failed, we would dispose of it ourself with the company that we contracted and charge the customer a fee. We could not take items home or "donate" them because it could lead to tons of legal issue. Also, all item disposed, we kept the paperwork on file for 5 years and also send the customer a copy of the item that was disposed including pictures.
