What if the manager didn’t follow company’s investigation policy procedure after you complained but voiced their own “expectations” of a hostile work environment?

This is a great question. I was fired by my employer based on the words of a new manager I worked with less than two weeks. She was new and younger. She investigated in one day on my day off. I would love this answer.

    Question:
My employer investigated my complaint of FMLA retaliation. I believe there is very hard evidence to prove it as I was not the only employee to experience the same type of retaliation. The investigator came back and said no retaliation had occurred. They would not tell me any details of the investigation they did. Does this help or hurt my case? I am still 100% convinced they retaliated and have filed with EEOC.

Good morning Vince, I have retained an attorney and she is doing a pretty great job marshaling the facts of my claims and also has uncovered additional claims I had forgotten by interviewing my union representatives. It’s taking quite some time to get the valuation of the case could this be indicative of a higher demand amount considering it’s taking some time to get to the demand?

My employer is investigating , I have not yet filed a charge with the EEOC. I plan to file the charge in early October. I have also filed complaints with Office of civil Rights (OCR) and Office of Federal Contract Compliance Programs (OFCCP).

You need to file. If they fire you because you filed an EEOC complaint. It strengthens your claim. If there is a title VII case of discrimination, harrassment, this will give you retailation. But ask Vince. I am not an attorney. But, I have a case pending. I filed pro se after the EEOC gave me a right to sue letter. Vince is great and I have learned a lot from him.
