    We disbanded our HOA. Several years after the builder handed the HOA over to the residents, we got tired of the harassment and voted to disband it. Best idea we ever had. That’s what brought our community together.

      @@MegaMindyLou that makes a huge difference. A pool is mandatory in the summer. Pool maintenance and a life guard are provided with HOA's. In your case you did the right thing. Is your neighborhood still up to previous standards?

    A friend of mine bought a house that has a “Voluntary HOA Membership Option”. She refused to join the HOA prior to signing the Deed and other paperwork. She doesn’t have to pay dues and is not subject to the rules. Yes, she can’t use things like the boat launch (lake), the pool, tennis courts, club house, etc. But she is totally fine with that. The HOA tries to pressure her into joining all the time, but she refuses.

      This happen to me, too, plus the HOA pays for police security, they told me they patrol the community, but not my specific home, that I would have to call 911 for that which would be a much slower response. I told them I'm cool with that.

      I like how HOA tries to bribe you with amenities you can literally go and pay for anywhere else for better fees and less legal liability. Like if you decide to stop paying for a membership worst you'd have to worry about is a breach in a contract that was agreed on for a certain time period (like a year contract), potential late fees, or being banned from the place worst case scenario. At least you don't have to worry about those places foreclosing on your own house 🙃

    We had a newly retired neighbor who walked around with a notebook to list infractions to call in on daily. Once she was identified as the complainer. Neighbors reported her repeatedly for minor infractions. They wrote letters - you are not a neighbor - you are an enemy to this neighborhood.
    It backfired on her when people moved and rented their homes.

      Rainbow Dash in a sense, but they rented out their homes & the people renting the homes don't have to abide by the HOA rules & regulations. So little miss snitch bag can't do anything about all the little "infractions" the renters commit. Yes the HOA or DA (Developer Association) can send a letter to the home owner, but guess what, renters have rights & the homeowner cannot force them to do things homeowners do. So in the end, HAHA snitch with your little notepad. Those renters kids will scream all day long & there is ABSOLUTELY NOTHING snitchbag can do or have done about it.

      That’s a misstatement of fact. We sued the builder for non performance and made them add us as co-declarant.

    The original reason for an HOA is to look after common areas “ONLY” laws need to be drastically change so that homeowners have control not HOA/Developers. Private property should be solely in control of the owners.

      @@redgeneral5792 Creating rules that you HAVE to follow, with monetary consequences up to and including foreclosure on your home is the same as a law. You can't really go to jail for it, but you either follow it or lose your house. By purchasing a home in an HOA, you have VOLUNTARILY agreed to give up some of your rights and freedoms in order to have someone else be able to make some of your property decisions for you. Up to and including, in some cases, what type of vehicles you can have on your property. Some HOA's will not allow work vehicles (like plumber's trucks, etc.) to be visible, but since they don't usually fit well in your small garage, you just can't have it. Some also don't allow any vehicles that they consider an "eyesore" to be out and visible. That means that you can't have a classic car that you're restoring, unless you can fit it in your garage, or even have a beat up or damaged vehicle at all. And, if you're lucky enough, some of them won't even allow you to park your vehicles on the street, and don't have long enough driveways to park in them. So, you're stuck with only whatever vehicle you can fit in your garage.
      I know some of that about the cars, because my old boss bought a home in an HOA, and had to get rid of his truck, because it was about 6 inches too long to fit in the garage all the way.

      LOL I love them, too. Maybe because my husband and I bought a house last year and told our realtor it could _not_ be in a place with an HOA. As much as it would be nice to have someone cut the grass for us, we don’t need to stress out about the color of our front door or whether we can park in front of our own house!
      I still love watching videos of HOAs getting called out in the news.

    This sort of scam has been going on it Texas for decades. A co-worker of mine bought a unit in Dallas back in the '80s. The documents said that the homeowners would take over the HOA once the development was 80% sold. The catch was, the developer never sold the last 25%, they rented them out, and retained control. When the tennis courts were damaged by a storm, all the owners were charged an additional assessment to pay for the repairs. Turns out though, that there was insurance coverage that paid for the repairs. The special assessment when straight into the developers pocket. The homeowners found out, because one of them happened to work for the insurance carrier.

      That is called insurance fraud and carries jail time and fines. I hope the homeowners alerted the authorities and charges were filed. It has nothing to do with a functioning HOA.... The developer protects his investment until it is recovered, then passes control of the HOA over to the co-owners. If this developer retained ownership of 25% of the units I can see where that could certainly present a problem to the owners. I would suspect that if taken to court that a judge would rule that if the developer chose to "rent" out the remaining 25% of the units, that the developer in essence has "purchased" those 25% of the units at a discount and that all units are now considered "sole" for the purpose and intent of the clause that the law allows the developer to insert into the CC&Rs. I would check with a good Real Estate Attorney who WRITES CC&RS and ask them for their advice. Good luck.

      I don't think that it constitutes insurance fraud, because the insurance company has not been defrauded. That said, it does sound like embezzlement, because the proceeds from the assessment should remain the property of the HOA, not the developer.

      David Lamb you're correct, except the money should be given back to all the homeowners, NOT retained by the HOA. That's what "dues" are for. Homeowners shouldn't be forced to basically pay money "incase" shit happens. That's what insurance is for & what their monthly /yearly dues are for.

      David Lamb I read your comment wrong the 1st time. I thought it said, the money received from the homeowners should remain in the HOA. Nonetheless, you are correct & that would be embezzlement. I've seen over 500 news casts about crooked HOAs. I would NEVER EVER allow someone to tell what to do, how to live, what I can or can't have, on a property that I owned. I will NEVER buy into an HOA. I can cut my own grass, fix & repair my own home. Paint my house, re-cement my driveway, etc. all by myself. I can take my children to city parks & live under my OWN rules.

      V Star 1300 Adventures Not all HOAs are bad. The last two houses my parents owned had HOAs. One covered an entire subdivision and collected a small fee each year for upkeep of the bike trail system and playgrounds in the subdivision. The other one was smaller and did have a good sized monthly fee, but that was only to cover yard work, snow removal, and community building upkeep. Both pretty much stayed the f- out of the residents’ way otherwise.

    when I was looking to buy a house back in 1990 our realtor drove us around bunch of neighborhoods and said oh this one has an HOA and this one doesn't and so I asked her what an HOA meant and she told me so I started to ask let me see what the rules and regulations are for this particular neighborhood she's kind of beat around the bush getting us the information it was just kind of telling us what it was that's when I got a bad feeling. finally I saw the rules and regulations for this one subdivision we are going to move into and I couldn't believe what you could or could not do mostly could not do. they were so controlling if you had to have your roof fixed or reshingled you only had a choice of three types of shingles to choose from. long story short I did not move into one that had an HOA. the best thing I ever did.

    I absolutely abhor HOA's. When I sold my last home, I intentionally sought out a home to purchase that is NOT in an HOA. They take your money and treat you like your less than dirt. Fine you every time you turn around and you have to ask for permission for everything you want to do on your lot. I got out of there as quickly as I could. Never again! They're uncontrolled and go un-checked in this state and do nothing but harass a person. I refuse to live like that and worse, to pay extra to be treated like dirt! Buyer's beware! You have very little recourse when you want to stand up for yourself and your family. Unless of course you have plenty of money to throw around at attorney that will help you get nowhere really fast! Buyer's beware!

    This is why people need to READ THE HOA DISCLOSURE when they buy a house. I would never buy a house in a HOA that is still controlled by the developer.

    Imagine what would happen if every single resident in an HOA all got together at the same time, and voted amongst themselves to stop paying their HOA extortion ever again. One thing that bothers me about them is their ability to foreclose on any home for just about no reason. What if you bought your home when you were still very young, and you're now in your late 50s to early 60s, you've made all of your payments over the course of 30-40 years, and you now own your home. There is no more mortgage on your home and you tell the HOA that they can now go pound sand because you now own your home lock, stock and barrel. What are they going to do, foreclose on and evict you?

      I don't have to imagine what would happen. I've seen too many video's on UA-cam that shows exactly what would happen. If you stop paying dues after paying off your home, the hoa will foreclose on your home and sell it out from out from under you. If you get lucky, they may only put a lien on your home

      @@deanosborn3464 They're required to pay you the sale price of the home minus owed dues when they do this. State law may also offer a redemption period during which you are guaranteed the right to buy the house back even if it was sold, but guess what. When you do that, you gotta join the HOA again. People need to see the truth about mandatory HOAs. The grass may be greener in an HOA, but that's because the homeowners get fined if it isn't the exact shade of green that the CC&R requires.

    HOAs should be dissolved after the last house in the development is sold or ten years after the first property is sold. Then it should revert to a common area maintenance association.

      @@AdamSmith-gs2dv Exactly, the HOA board tells people they are there to protect and help homeowners. In reality they don't do shit and when you tell them something all they say is that they're going to get it done, but it never happens. Even if you get as much as half the community to agree with you, all they say is they're going to get it done but nothing happens. So basically you're just giving them money just for them to keep it and say they'll spend it on the community. In reality they're just in it for the money and fight to not have to spend it for the community. That's why it's actually quite common for things like unfinished community projects to exist in those communities. I live nearby HOA communities and neighbors and friends tell me how it's the worst. In one they promised to replace the water fountains in their park because they stopped working. For 5 years they've been telling them the same thing but they haven't been fixed. In another they were planning on building a community pool. A large hole was dug by construction workers that's it. For 2 years it's been just a large dug hole sorrounded by a tall metal fence. Homeowners asked when is it going to be built and all the HOA makes is excuses that the project is "slowed down" due to winter and in summer they say that work is getting done but there's no workers there. They must be so happy the virus came because now they don't have to come up with anymore bullshit excuses.

Arbitrary rules dictate everyone's behavior and violators face stiff fines. All under the false premise the HOA will protect property values when people should know only the real estate market determines that. ALL HOAs need to be banned!!

LOL of course everyone is grandfathered in now, but any buyer from here out cannot rent their property they just bought... Crazy and my HOA is $375/mth with them

    I work for a developer who has created HOAs where the developer has a seat on the board to protect the still developing property but once all property has been sold then that rule falls away. This is the right way to do it. Makes me mad that these sleazy developers give a bad name to all.

    In my area our HOA board is pretty good, it is the mangement company that does the day to day business that we have to keep an eye on. Many times we have had to contact a board member to get approval for repairs (like a new fence) and the request has not been forwarded to the board. Only after a homeowner contacts a board member directly does approvals get done. The mangement company is supposed to be sending those requests to members for approval as soon as they come in so repairs can be done in a timely manner.

    You’re a renter at an HOA. You can’t do anything to the home you’re paying for without permission, can’t park on the roads in front of your home.

    Subdivisions offer a lot of perks but they also cause a lot of misery. Buy a home away from the city or some land. Its hard to find urban and suburban areas without an HOA but living further fromtown will give you peace of mind

    Same with ours as long as our builder keeps building we cant switch out the majority that is the builders. we just bought and the community beside us has been waiting for 5 years since building plans count as "building" even though it takes years for permits to get approved for actual build.

    Take 'Lennar' to court. Tie them up on minor points. Go directly for the CEO and senior board members. Anything slightly off take them to court. You ask that the judge stops all new build work until sorted. Don't take pleas or holds. Demand to see finances as required. They will so get the message when the building stops and so does the income. Your settlement is that once a house is 1year old it is passed to an HOA in which they have no say

    The community that i rented previously had 2 HOAs that the owner had to pay. It was a nice neighborhood, however, too many rules. The whole community itself had a set of rules, and the sub-community had it’s own. Wow.

    i live in an apartment and people keep telling me to get a house. They talk about privacy and being able to do what I want. My arguments?
    - people never talk about the money for maintenance of the house, as if nothing ever breaks.
    - HOA bull
    - there are many different ways a house can be taken away from you, even if it's paid off. The easiest one being back taxes.
    The only way I'm owning a house is to flip it to make more money.

    can we take a moment to think about what that woman from the TX Association of Builders said @4:25? She's basically saying that residents should not be expecting to have a voice or a vote in matters pertaining to their community from an HOA. That you buy into a body who's job it is to maintain the community and preserve property value, but don't actually have a say in how they do it. I've never owned a home so I may not have experience with HOAs but even I know that if you call it an HOA, are paying dues for it's services, then there is a board comprised of residents who are voted in by residents and also votes for things as residents. She is saying that people aren't expecting that kind of system (which almost any HOA in the country does use) and if they are expecting it then they don't know what they're talking about because they've never lived in one? So is she saying that every one of the millions of HOAs established across the country and their equivalents abroad are all being run incorrectly and her one operation here in TX is a true HOA?

    If the home owners aren't represented, then why do they call it a "HOME OWNERS" association. They should rename it a DOA (Developer Owned Association) to avoid sounding like scammers. Also, raising the cost of dues is a clear sign of a scam. They could just never finish building the last home, and continue profiting by raising the HOA dues. It's a loophole gold mine. Since the residents paid for the park and the pool Do they own it or does the developer get to keep all the money?

    I made a negative comment about a resident to the treasurer, that I didn't want to go to anymore meeting because of the past experience of a resident arguing for well over 15 minutes at a meeting. She told me he was on the architectural board and I told her, that's great now I am going to be retaliated against but she said they don't do that. I am being retaliated against by them, by not acknowledging my request for yard work. I have done other request and received notice within 2 weeks, this time it is going on 3 weeks and nothing. The bylaws give a 30 reply or no reply means it has been approved. Is there anything I can do legally? Should I notify the board President of my concern or let it go?

    Never good to sue your HOA. You're basically suing yourself. Don't go that route unless you've already sold your house! Those court fees can be split up between all properties.

    The Builders get the HOA Dues and use them to finish building and developing the properties? Also it can continue that way for ever, or at least until the builder finally calls it completely done. So when do the owners really own the property?

    Yeah all of those raises in fees are because they go into the presidents pocket and in the council's pockets. I bet they follow none of the rules that they set forth. I bet they're so full of themselves in the position that they have they treat everybody like peasants and garbage beneath their feet. If you're thinking about buying a home please do not buy in an HOA it's not really your property in essence a rental even though you might be paying a mortgage but you're just renting there you have to ask permission for everything and your rights as citizens are also taken from you because you voluntarily gave them up when you bought the house.

      Our HOA's board has a fiduciary responsibility (EG: No board member can get paid for being on the board) and our HOA maintains the roads, lights and landscaping. Not all HOAs are evil... read the documents and make sure the board is elected before agreeing to buy a house. It's that simple.

    So wait. Lennar owns the HOA, but they say it's not HOA and shame on the home owners for not knowing?
    If Lennar wants to keep making money they need to send out letters to clarify or at least better state what the home owners can do to ease their concerns, therefore lower the chances of them being fed up and leaving.
    But what do I know. I've only been training/working in property management for a half way decent period of time. >.>

    I hate HOA communities. I would never buy another house in an HOA community. I sold my last house only because of the HOA and now I have another house with no HOA and what a piece of mind

    How long does the developer keep control? It used to be that the developer had to hand over full control to the residents once the neighborhood is fully constructed. How is this legal? Please pressure the State to fix the law.

      They just slow roll construction for as long as possible, mainly because they think if they slow roll it they will get more money for the house in the future

    Adding lights wouldn't solve the problem. Kids will still hang out there drinking. Giving them light will attract more, for longer. Might solve the condom issue, but not guaranteed.

      Plus there is the electric bill for the lights being used. What's the cut off, midnight. What about security. The HOA fees would get increased.

    I doubt she went to her HOA meetings. They only meet once a year, and if she didn't go to the meeting, she's not heard.
    I went to our HOA meeting once, and almost every request got approved, including installing mirrors for hard to see corners.

    HOAs should be outlawed in the USA. In Canada we only have possibly a couple in gated communities, which are rare themselves. Zoning is done strictly by the municipalities with property taxes that never relinquish control to HOAs. If zoning laws get weird, like what colour you can paint your garage, and this has happened, residents have a forum at meetings and can vote out their council in the next municipal election if unhappy.

      No.
      That being said, there are probably some blue-moon exceptions but in most cases the local government requires all homes in a neighborhood to be in the HOA and the CC&R's must be accepted before the owner can take possession of the home.

    Developers control the HOA until the last lot is sold. Then, and ONLY then, is the power give to the homeowners. The developers don't give a shit. I was in the land surveying business for 42 years and never worked with a developer who cared about anything but profit.

    HOA means run away.
    There was a story I saw once that a developer set the HOA up so vacant lots had 2 votes and developed lots only had 1. He never developed enough lots so he was always in control. To me that is not an HOA, it's another business the developer has, since he makes a profit off it.

    Laws governing HOAs are state laws. They are different in each state. In Florida once the development is 51% completed a percentage of the board must be residents. People need to change the laws in the state.

    If you are in a new development of 15 homes and the developer has plans for 500 m ore homes then plan 20 years or more before anything can be done.

    If a developer is moving through a development and building the homes this well intended developer HOA makes sense. But what if the developer stops building and has no intention of returning to complete the job, and even lets the development fall apart but continues to raise the HOA dues, then you've got a problem like I face.
