      A friend of mine had an account with Wells Fargo and discovered the bank opened an account in her name without her permission. I don't remember the details but there was fraud involved. My friend closed their account and then reported the bank to the police department. Last I heard there were criminal charges pending.

    I bought my house for cash several years ago. There was a note on the property. Wells Fargo gave us an amount and a date to pay by which was around 20 days. I paid within 7 days. The title company did their thing. I checked the county records about 2 months later and saw a bank listed on my property. Wells Fargo gave us a date, then sold the note to another bank a few days later, and they cashed my check. It's funny when you send a fax with the proper documentation and mention the words fraud and attorney how fast they become attentive and polite.

    4 years later he gets a notice from Banks that's right multiple banks. So he took legal action and showed proof there was no lean no loan nothing barrowed against his property ever sense he owned it out right.
    He ended up suing the previous land owners family cause they went behind his back and put loans on that property. His family frauded the bank. At this point it was pretty clear why they wanted the property so when he died they could sell it and make about 1mill split the profit between the three kids and no work.
    This was discovered by some investigating.
    Each one of his kids are spending 3-5 years for forgery, theift, property theft, unbegotten loans, and about 5 more things and they have to register as felons.

    I had a mortgage with Chemical bank when they were around. I always rounded up my mortgage check, having the overpayment applied to the principal. They got caught charging me a late fee on the mortgage when the additional principal was credited before the due date. The service team member argued with me that I must have sent 2 checks. I had to provide proof that it was one check before i got a refund of the fraudulant late charge... I suppose for an additional fee, I could have gotten an apology.

    In 1965 my mother and stepfather arranged to buy a house in Hermosa Beach, CA. We moved in and for the next ten months we had to spend a bundle on several calls to a company to have the cesspool drained (the house did not have a sewer connection). We were fed up and moved out. A law firm sent my parents a notice that they intended to open foreclosure proceedings. My parents contacted a lawyer, who spelled out my parents' grievances and said that if they tried to do so we would prepare a cross-complaint in court for damages and fraud. We never heard from the lawyers or the former owners again.

      @@tikesplace maybe my comment wasn't clear. Im not arguing the foreclosure, im arguing the processing fees.
      $45 each to serve papers on the husband and wife listed on the deed. Im asking why is it their responsibility to pay for processing fees to an "unknown spouse or tenant".
      If you wanted to sue me, you need documentation that I received the summons, that's why people use process servers. You could just mail the letter. That doesn't guarantee the letter arrived. Certified mail requires a signature. Unless you specify, anyone can sign for a letter/package. So again, you use a process server to ensure the letter gets to that specific person.
      You cannot serve an "unknown spouse or tenant". Just send a letter, its cheaper! So either the mortgage company or the processing company tried to fatten their checks. There's no way $500+ was needed to serve a couple for a foreclosure.

    • @iluvdissheet
      @iluvdissheet 3 роки тому

      @@tikesplace no we don't agree.
      If I buy a house, then 10 years later get married, that's not the lender's business.
      The loan, our agreement, is still in my name. If they have to sue my husband for half because its deemed martial property, fine. Thats understandable if the loan company does its homework and finds out im married. I could have a prenuptial agreement 😱.
      You cannot serve unknown spouse or unknown tenant. For example:
      If I lived with a friend for 3 months and they failed to pay the mortgage, you think the bank has a legal right to come after me as "unknown tenant"? You cannot be serious...
      Again, im not arguing the foreclosure, im arguing the excessive processing fees to unknown people. Thats ridiculous.
      And honestly, if lenders are still giving out loans to people who clearly can't afford it, we learned nothing from the 2007 housing/financial crisis and that's more concerning than your opinion.

    • @wandaring0
      @wandaring0 10 років тому +8

      Initially, you would think that they would suffer a loss. But, the banks are the ones that inflated the values of homes to begin with. The government and everyone is profiting and keeping people busy working with all of the paperwork and court crap. Many local governments had an influx of money during the housing bubble, then they got in debt. But, by transferring ownership of properties continually cities, counties, and states get tax revenue and fees and all of the systems connected get monies collected also. Real estate. moving companies, banks, mortgage brokers, etc. also get the profits from this mess. It is not in the best interest of any economy to have people stay put often times. Plus, you have to think, when people move from their homes, either by force or otherwise, they lose or throw away some possessions, redecorate, do home improvement, etc. They support other businesses in this continuous cycle as they move from location to location. It is not just the banks that benefit: but everyone except the homeowner. But, the homeowner can rebuild their credit again in time and just repeat the cycle all over again. I can't tell you how many times I've accumulated some decent money in savings to have a disaster/major life event that eats this money away, then I get through the issue, resave again and start over, to only have it repeat once more. It gets annoying after awhile. So tired of installing new car transmissions, brakes, and crap.. but shit is meant to break so we have to keep buying... It makes it hard to ever get ahead.

      Heather Gleason Home buyers share the blame too. Too many took what Joe Blow at the bank said as "this is what you can afford" as if they were looking out for them. Our bank was in awe when they said you can afford $450K and we said NO $300K was where we felt good at after WE ran the numbers. They actually asked "are you sure" a few times. Also being new to the market here we started to look at $150K home quickly upped that to $200K then to $250K and settled on $300K...why start at the top!!! it pissed the Realtor off but who cares they made money for 3 days of work. We never told the Realtor what the bank approved us for...none of their business. If we would have said $450K what would we be looking at $450K homes only...no thank you. So the home buyer needs to be smart too and not just blame the banks. You are an adult use the thing you have called a brain.

They gave us papers _twice._ It didn't even occur to them to _call and ask_ if anyone was going to try and take the house. Actually, you DID have claim. A Reverse Amortization mortgage has a Guaranteed payment and the net asset does diminish, however depending upon local market you might have had a net asset. Also you have the RIGHT in inheritance law to audit the balance and decide if you want to take a new mortgage. Generally speaking there is usually a LOT of money still on the table. Actuarials NEVER allow one to beat the bank or insurance.

These judges need to toss the entire foreclosure because these loans have been passed around so much, sold off at a discount to others, and manipulated so horrendously that even proving they own the mortgage might be difficult if not impossible. But hey they contribute to political campaigns so who cares if they are actually legal in the first place or they can even prove they own them.
