  • 3/13/2021 BREVARD COUNTY Florida FWC Officers heard a vessel with loud music and people returning to a local boat ramp. As the vessel approached the ramp, the officers watched as the operator moved over and allowed another man to take control of the vessel. Officers approached to conduct a vessel safety inspection and found multiple empty alcoholic beverage cans laying on the deck of the vessel. After conducting standardized field sobriety tasks, the man was placed under arrest for BUI and transported to jail.

    Never admit to drinking. Never agree to the BS field sobriety test. Never consume enough alcohol to be anywhere near a 0.08 and drive a boat.

      I don't think many people could pass those test sober. I've never seen some of those test they asked him to do. He seemed fine to me.. should have said no to the test, then make them get a blood drawl with a warrant

      Any sober person could easily pass this test. It's really not hard at all if you can follow directions. Have a nice day.

      @@user-peach408 The fact that calibrated breathalyzer tests are not admissible in court in some jurisdictions, but these purely subjective tests are, just highlights how ridiculous our criminal justice system can be. Ask for a COC blood and urine test.

    Wish folks would stop doing these tests.
    You are not required to take those tests.
    Only comply with the breathalyzer.
    Not an advocate for overindulging while boating.
    But even with ONE admitted drink..
    You will fail those tests.
    Even these officers had complications explaining the test.
    I understand the need for enforcement out on the waters.
    But we’ve all probably also seen boaters blow under the legal limit, fail these tests.

      @@vincegedeon6583 No need for a blood draw if you comply with the breathalyzer.
      But even then, if you don’t comply. They have to get a warrant for a blood draw.
      Best not to give them ammo to use against you.
      And no, I don’t agree with operating a boat while over intoxicated.

      @@aarontrenton1730 For some crazy reason FWC do not carry PBT's on them. If you refuse the FST's you go in cuffs to the station for breath tests.

      @@match360 Yup… It’s as if they know folks will fail those tests.
      I’m not big on digging yourself into a bigger hole.
      Folks not only need to monitor their intake better.
      But they also need to know what’s required of them by law while on the water.
      Verbal communication is not required.
      Anytime FWC approaches my vessel.
      I immediately comply with tying up and go for all the required equipment they will want to see.
      I have nothing against any of them.
      But I’m fully aware that they are fallible humans just like the rest of us.
      Sometimes they are good and sometimes they are shit.

    What is lacking in this video is the result of the breath test on the calibrated tester (or the result of the blood test). That value(s) would be interesting and confirm if the man was indeed over the limit or not. Perhaps next episode ?

    This is why we slowly but surely begin to disrespect law enforcement. This was total BS. This guy was sober until this AH totally confused him. We couldn’t follow sober from the living room couch REWINDING the video. These blanking FWC BULLIES need to be called out and shamed. Thanks for posting.

    The way these tests are ran, may as well just not drink at all on a boat. Dude seemed fine to me. Jet boats are hard to handle slow

    This was the most ridiculous arrest I have ever seen! The cops just kept testing him until he failed something and even then he really didn't fail it! I really hope this guy hired a good attorney to go to court with this video, I would hope that a jury would find him innocent! To me, these cops that did that to this poor guy shouldn't be cops ever!! Talk about cops giving other cops a bad name!!

    These tests are designed for failure through "officer" discretion. One: Don't drink on the water. Two: Don't consent to these these subjective games and don't admit to anything. You DO have to by law submit to a calibrated chemical breath and or chain of custody blood and urine or it is an automatic suspension in most jurisdictions. Hey, it's a hassle, but it's a bigger hassle to get convicted for intoxicated driving/boating because you couldn't play officer says.

      Yup Florida actually allows the capt of a vessel to drink while vessel is not underway.
      Some folks just don’t know how to properly moderate their drinking.
      Thats why I would never do these tests and only submit to a breathalyzer.
      Because it’s legal to drink in Florida, many capts admit to their drinking.
      But it’s rare to find an FWC with a portable breathalyzer on their vessel.
      So you end up arrested due to your admission and these tasks.
